Abstract

This research is motivated by the large population in the world which can cause an imbalance because a rapidly growing population can result in a population with poor quality and result in the Earth or the State not providing maximum facilities. However, this program has attracted a lot of controversy in Indonesia because the majority are Muslim and consider this program a refusal of the sustenance given by Allah SWT. The purpose of this study is to find out this program from the perspective of Hadith, where Hadith is used as a source of law in Islam but the purpose of Family Planning is to plan for a sufficient number of children and ensure their survival in a family. This research uses descriptive analytical method and applies a qualitative approach, as well as various relevant references as data sources. Data were collected using literature study techniques and then analyzed using content analysis techniques. The results of this study indicate that family planning in the perspective of hadith is allowed but with clear and strong reasons, some hadith scholars also allow it, some do not allow it for various reasons. Further discussion will be presented in this journal.

Abstract

Interfaith marriage is a widely debated issue in Indonesia, particularly within the context of Islamic law. The prohibition of interfaith marriages has frequently been the subject of substantial criticism from an Islamic legal perspective. This article aims to critically examine the enforcement of this prohibition within Indonesia's marriage legal system. Employing a normative legal approach and literature analysis, the research explores various Islamic law perspectives on the prohibition of interfaith marriages. Additionally, this study analyzes the social, cultural, and legal impacts of this prohibition on Indonesian society. The findings indicate that the prohibition of interfaith marriages often conflicts with principles of justice, religious freedom, and human rights. In the context of Islamic law, several scholars and legal experts advocate for a more inclusive interpretation, emphasizing the importance of considering social context and justice in marital regulations. It is essential to formalize Islamic law by incorporating sociological and cultural aspects and aligning it with the national constitution. Therefore, the development of Indonesia's marriage legal system must consider universal values that evolve sociologically and culturally. In conclusion, this research underscores the need for reform in Indonesia's marriage legal system to accommodate individual needs and rights while respecting religious and cultural values. These changes are expected to provide legal recognition for interfaith marriages and promote a more inclusive and harmonious society.

Abstract

Al-Jarh wat Ta’dil is an important field in hadith studies that provides information about the conditions of hadith narrators based on critiques by critical scholars. These critiques follow a hierarchical structure, with shaduq being a level two endorsement after tsiqat. Despite being an endorsement, a narration from a shaduq narrator is not accepted outright and requires further scrutiny. This research analyzes the acceptance status of narrations from shaduq narrators according to critical scholars. It critically examines the case of the shaduq narrator named ar-Rabi bin Anas and investigates the reception status of his narrations. The methodology employed is qualitative with a descriptive-analytical approach, using references such as al-Jarh wat-Ta’dil literature, mustalah hadith, hadith collections, relevant books, and journals. The study demonstrates that among shaduq narrators, some receive negative critiques leading to partial rejection of their narrations. Furthermore, it shows that narrations from shaduq like ar-Rabi bin Anas are rejected if: First, they have negative critiques from scholars supported by indications after comparison with parallel narrations. Second, their hadiths are transmitted by problematic disciples; in ar-Rabi's case, his problematic disciple is Abu Ja’far ar-Razi, and the narration by this disciple occurs in isolation.

Abstract

This research will discuss the legal analysis of article 338 of the Criminal Code relating to murder, as well as the legal perspective provided by the hadith from Samurah Radhiyallahu'anhu. Article 338 of the Criminal Code is a criminal law provision in Indonesia which regulates murder. In this context, an analysis will be carried out on the legal implications of the article, both in its application and interpretation. Apart from that, this abstract will also discuss the perspective of Islamic law regarding murder based on hadith from Samurah Radhiyallahu'anhu. Hadith is the second source of law in Islam after the Koran and is often a guide in interpreting various legal issues. By analyzing this hadith, we will consider how Islamic law views the act of murder and the factors that influence it. Through this approach, this abstract will present a comprehensive understanding of murder in the context of Indonesian positive law and Islamic law. By considering legal perspectives from these two different sources, it is hoped that we can provide a broader and deeper view of the issue of murder in the legal realm..

Abstract

Extramarital affairs are becoming an increasingly prevalent social phenomenon in the modern era. This research aims to examine the understanding and definition of extramarital affairs in Islam, the concept of extramarital affairs based on Hadith Abu Dawood No. 1692, the sanctions and punishments for the perpetrators, preventive measures for extramarital affairs from an Islamic legal perspective, and its correlation with the provisions of adultery in the Criminal Code of Indonesia (KUHP) Article 284. A qualitative method with a text and content analysis approach is used to conduct this research, as well as a literature study. The research results show that extramarital affairs in Islam are categorized as a major sin that has the potential to damage the harmony of families and society. Hadith Abu Dawood No. 1692 emphasizes the prohibition of extramarital affairs and provides an overview of the sanctions for the perpetrators. Preventive measures for extramarital affairs in Islam include fostering faith and morality, strengthening families, and providing sexual education. The Criminal Code of Indonesia (KUHP) Article 284 regulates adultery with criminal sanctions, but its relevance as a sanction for perpetrators of extramarital affairs still needs to be studied further. This research concludes that Islamic law plays an important role in preventing and addressing extramarital affairs, and its integration with positive law needs to be considered to realize justice and the common good.

Abstract

The BLT Program is a government effort to reduce poverty levels and improve social welfare by providing financial assistance to economically disadvantaged and vulnerable families. This study aims to assess the effectiveness of implementing the BLT Program in achieving these objectives, as well as to explore the correlation between this policy and Indonesia's legal framework in the context of achieving Sustainable Development Goal (SDG) No. 16, which pertains to peace, justice, and institutional strengthening. The method used is a literature review with a descriptive analytical approach, examining secondary data from various reliable sources. Findings from this research indicate that while BLT helps alleviate the burden on impoverished communities, there are challenges in its implementation, including delays in distribution and inaccuracies in target determination. To optimize the benefits of BLT, improvements in distribution mechanisms, inter-agency coordination, and stricter monitoring are necessary.

Abstract

Islamic financing has become an increasingly popular option for individuals and businesses looking to meet their financial needs in accordance with Islamic principles. One of the prominent innovations in Islamic financing is the concept of Hybrid Contracts, which allows combining several types of Islamic contracts in one financing product. This article explores the role and benefits of the concept of Hybrid Contracts in financing rahn at Pegadaian Syariah. We also explain the detailed implementation steps, which include customer identification, risk evaluation, determination of sharia contract type, application submission, feasibility review, contract signing, transaction execution, and financing monitoring. The concept of Hybrid Contracts helps increase flexibility, inclusivity, and compliance with sharia principles in rahn financing, opening the door to broader sharia-based economic development.

Abstract

This study is motivated by the fact that the restriction of property ownership rights for individuals often serves as an essential instrument in achieving social justice and societal welfare. This research aims to analyze the restriction of property ownership rights in the context of social interests based on the perspectives of the Qur'an, Hadith, and Article 17 Paragraph 1 of The Universal Declaration of Human Rights (UDHR). The study employs a normative juridical approach and descriptive analytical methods. Data were collected through literature studies and analyzed using qualitative data analysis techniques. The findings of this study indicate that the Qur'an emphasizes property as a trust that must be utilized for the benefit of the community through obligations such as zakat and other forms of wealth distribution, while the Hadith highlights the importance of social solidarity. Article 17 Paragraph 1 of the UDHR provides an international legal basis for restricting individual rights for the common good, aligning with various regulations in Indonesia such as the 1945 Constitution and the Basic Agrarian Law. The findings of this research imply the necessity of strengthening redistribution regulations, improving the efficiency of zakat and tax systems, and enforcing equitable laws to create more equitable social welfare

Abstract

A. Hassan encouraged efforts to perform ijtihad by referring to the Qur'an and Sunnah. Hassan's call to directly base one's views on the Qur'an and Sunnah motivated people to study the sciences related to these two sources, particularly hadith and the science of hadith. The purpose of this written work is to understand A. Hassan's approach to the study of hadith, including his research methodology as well as his critique of sanad (chain of transmission) and matan (content). The methodology used is specifically descriptive analysis, which involves studying specific objects, conditions, or phenomena and aims to provide a systematic, factual, and accurate general description. As a scholar of hadith, it is essential to study A. Hassan's thoughts, as the motto ar-ruju’ ila Qur’an wa Sunnah (returning to the Qur'an and Sunnah) cansnot be separated from his significant contributions.

Abstract

This article dissects the ‘ashabiyyah (fanaticism) hadith. Analysis of the ‘ashabiyyah hadith aims to understand the messages and values contained therein and their implementation in modern society. The ‘ashabiyyah hadiths chosen as the basis for this research are those which explicitly mention the word ‘ashabiyyah, along with their derivations. The ‘ashabiyyah hadith is analyzed using the syarh approach used by hadith experts and then reviewed using a socio-anthropological science approach. The theory used is Anthony Giddens’ social constitution which is supported by anthropological facts about the Arab people revealed in the Sirah Nabawiyah books and Ibn Khaldun’s theory of ‘ashabiyyah. From the results, it was found that the Prophet was a social agent who changed the tribalistic order of life of the Arab nation into a civil society, without eliminating it as a whole. He still maintained the positive values of jahiliyyah, but changed his motives or intentions. This was seen when he discussed with his friends regarding ‘ashabiyyah which has become the DNA of Arab people anthropologically. The concept of `ashabiyyah, whose basis can be religion, kinship, clanism, tribalism, ethnicity, ideology, economic and political interests, regionalism, and so on, is not only a characteristic of tribal (Arab) societies of the past, but also of modern societies and countries of post-colonial nations, including Indonesia. [Artikel ini membedah hadis ‘ashabiyyah (fanatisme). Analisa hadis ‘ashabiyyah bertujuan memahami pesan dan nilai yang terkandung di dalamnya serta implementasinya terhadap masyarakat modern. Hadis-hadis ‘ashabiyyah yang dipilih sebagai basis penelitian ini ialah yang secara eksplisit menyebut kata ‘ashabiyyah, berikut derivasinya. Hadis ‘ashabiyyah dianalisa menggunakan pendekatan syarh yang digunakan oleh ahli hadis kemudian ditinjau ulang menggunakan pendekatan ilmu sosio-antropologi. Teori yang digunakan ialah konstitusi sosial Anthony Giddens yang didukung dengan fakta antropologis bangsa Arab yang diungkapkan dalam kitab-kitab sirah nabawiyah dan teori Ibn Khaldun tentang ‘ashabiyyah. Dari hasil penelitian ditemukan bahwa Nabi adalah agen sosial yang mengubah tatanan kehidupan bangsa Arab yang bersifat kesukuan menjadi masyarakat madani, tanpa menghilangkannya secara menyeluruh. Beliau tetap mempertahankan nilai-nilai positif jahiliyah, tetapi mengubah motif atau niatnya. Hal itu terlihat ketika beliau berdiskusi dengan para sahabat berkenaan dengan ‘ashabiyyah yang secara antropologis telah menjadi DNA masyarakat Arab. Konsep ‘ashabiyyah yang basisnya dapat berupa agama, kekerabatan, klanisme, kesukuan, etnisitas, ideologi, kepentingan ekonomi dan politik, kedaerahan, dan sebagainya, tidak saja menjadi ciri masyarakat kesukuan (Arab) masa lalu, tetapi juga masyarakat modern dan negara-negara bangsa pascakolonial, termasuk Indonesia.]
