Wali amanat berperan sebagai pihak yang mewakili kepentingan pemegang obligasi Emiten setelah dinyatakan efektif pernyataan pendaftarannya mempunyai kewajiban untuk selalu menyampaikan informasi penting yang berbentuk laporan berkala dan laporan kejadian penting. Selain perjanjian perwaliamanatan, salah satu hal yang sangat penting bagi perlindungan kepada pemegang obligasi dari aspek hukum adalah keterbukaan informasi. Keterbukaan informasi ini merupakan jiwa dari keterbukaan pasar modal. Adapun permasalahan diajukan dalam penelitian ini adalah konsep perlindungan hukum terhadap wali amanat di Pasar Modal. Metode penelitian bersifat penelitian deskriptif dan Analisis data digunakan adalah pendekatan kualitatif. Berdasarkan hasil penelitian bahwa bentuk Perlindungan hukum bagi wali amanat menurut Undang-Undang Nomor 8 Tahun 1995 Tentang Pasar Modal dan Undang Undang Nomor 21 Tahun 2011 Tentang Otoritas Jasa Keuangan bersifat preventif dan represif. Perlindungan hukum bersifat preventif ditunjukkan dari ketentuan-ketentuan yang mengaruskan pembinaan, edukasi serta pengawasan dari otoritas bursa dan pengawas, sedangkan perlindungan hukum bersifat represif adanya penerapan sanksi berupa sanksi administratif sebagai ultimum remedium bagi para pihak yang melanggar aturan hukum dalam regulasi pasar modal. This study aims to examine the legal arrangements for the role and authority of the capital market supporting profession in the face of globalization, namely the notary public. Notary public is a public official who has the authority to make a contract deed or decision required by law to be made in confirmed documents. The position of a notary is regulated in Law No. 30 of 2004 which states that a notary public is the authorized official to make an authentic deed and other authorities. This study uses a normative juridical method that is analytical descriptive. The notary is authorized to make authentic deeds about all agreements, deeds, and stipulations that are required by legislation and / or that are desired by the parties concerned to be stated in the authentic deed. In addition, the notary must also ensure the certainty of the date of making the deed, keep the deed, give the grosse, copy and quote the deed, all of it as long as the making of the deeds are not also assigned or excluded to other officials.

Keadaan memaksa atau lebih dikenal force majeure atau dengan overmacht merupakan kondisi ketika debitur tidak sanggup melaksanakan prestasinya kepada kreditur disebabkan kejadian diluar kendali. Penelitian ini bertujuan mengetahui tinjauan hukum terhadap force majeure pada perjanjian kredit perbankan ditengah pandemi covid-19 ditinjau KUHPerdata dan PJOK No. 11.03/2020. Penelitian ini menggunakan metode yuridis-normatif dan menganalisis data secara kualitatif. Data sekunder yang diperoleh dari jurnal, buku merupakan sumber data penelitian ini. Kondisi memaksa atau force majeure tertuang pada Pasal 1244-1245 KUHPerdata. Akibat dampak covid-19 pada sektor perbankan Otoritas Jasa Keuangan menerbitkan Peraturan OJK Nomor 11/PJOK.03/2020 dan adanya Keputusan Presiden Nomor 12 Tahun 2020 tentang Penetapan Bencana Non-Alam Penyebaran Corona Virus Disease 2019 sebagai bencana Nasional. Munculnya kebijakan ini atas dasar berbagai keluhan terkait kesulitan akses keringanan kredit. Kebijakan stimulus tersebut diantaranya: penilaian kualitas kredit pembiayaan dan penyediaan dana lainnya hanya berdasarkan ketetapan pembayaran pokok dan/atau bunga untuk kredit pembiayaan dan penyediaan dana lain, peningkatan kualitas kredit pembiayaan menjadi lancar setelah direstrukturisasi selama masa berlakunya PJOK.

The number of cases of law violations committed by producers who ignore the rights of consumers for their own benefit, Consumer Protection is one of the legal developments in Indonesia. However, because customers have limited legal knowledge, business actors always make customers prey. Especially in the event of a surge in clean water bills carried out by the clean water supply agency PT. PDAM in Medan City which just happened in 2021. The surge in water bills was due to a system shift that occurred because PDAM officers did not record meter readings correctly. The purpose of this study is to identify and understand consumer protection in this event and the role of the Ombudsman as a public service institution in Indonesia. The method used is an empirical juridical approach, namely conducting interviews and distributing google form questionnaires. The Consumer Protection Act does not regulate water payment provisions but has guaranteed the position of power and obligation between the two parties. The community as consumers/customers of PDAM is a party that can be protected by the Ombudsman in terms of the treatment of the public administration unit, namely PDAM, for services that are detrimental to the customer community. The role of the Ombudsman is that the implementation of public services fulfills its obligations so that consumer rights are fulfilled.

The word "security" is the most popular word that is often asked back when someone is introduced for stock investment for the first time.The large number of crimes that have occurred in capital market activities since 2009 until now has certainly led to much speculation about the authority of the OJK body responsible for overseeing capital markets so this is a problem in this study. The problem is the role and authority of the government in mitigating Indonesian capital market crime and transaction security in the capital market. Keywords :security, OJK's role and authority.

The large number of crimes that have occurred in capital market activities from 2009 to 2017 will caused a lot of speculation about the authority of the OJK agency responsible for modest market supervision so that this becomes a problem in this research. The problem is how the government plays a role in mitigating Indonesia's capital market crime. This study was conducted on the policies and performance of the Financial Services Authority. The research method used in this study is a litelature study, with a source of secondary legal material. Sanctions for capital market crimes are stated in the Capital Market Law that crime in the capital market can be prosecuted in the form of sanctions for acts against the law, and can also be prosecuted criminal. However, by the capital market regulator, the OJK tends towards compensation or fines/administrative sanctions.With capital market events, it is desirable for OJK to be able to make regulators that follow developments and conditions needed in capital market law enforcement, can minimize crime in the capital market and also doesn’t make investors both national & foreign afraid to take part in the capital market in Indonesia.

The land issue is an issue that affects the most basic rights of the people. Because it has a social function other than economic value, so that individual interests on land are sacrificed for common purposes. The purpose of this study is to analyze the payment of compensation for land acquisition in cash and in kind, to identify and analyze the land acquisition process based on Law no. 2 of 2012, as well as explaining the concept and its provisions. To investigate and analyze. This is done by searching for relevant regulations and literature through the search for library materials as a starting material for investigation, using normative legal procedures for problem analysis. Depending on the issue being investigated, the matter will be carried out to analyze the legal regulations in the area of implementing the release of property rights. The results of the examination show that the payment of compensation for the purchase of land can be in the form of cash or non-cash. Change of money, land, resettlement. The land acquisition process that is being developed based on Law no. 2 of 2012 through three stages: The process of planning, compiling and implementing remuneration, concepts and regulations in land acquisition must be carried out in accordance with laws and regulations so that it is fair and does not harm the government or land owners.

Drugs (narcotics, psychotropics, and dangerous drugs) have basically been used by mankind for a long time. Many types of narcotics and psychotropics provide great benefits when used properly and correctly. In the field of medicine, narcotics and psychotropic substances can cure various diseases and end suffering. This indicates, drugs do not always have a bad impact. The problem arises when drugs are abused and used excessively. The problem of drug use disorders (narcotics, psychotropics and other addictive substances) is a complex problem whose management involves many scientific fields, both medical and non-medical. Drug use disorders are very complex bio-psycho-socio-cultural problems that need to be addressed in a multidisciplinary and cross-sectoral manner in a comprehensive and consistent program. This is in accordance with the provisions of Law Number 35 of 2009 concerning narcotics in article 54. Djasamen Saragih Regional General Hospital Pematang Siantar City is one of the hospitals that participate in carrying out medical rehabilitation and social rehabilitation through the Methadon Maintenance Therapy Program (PTRM).In this case, from the applicable law, the MMT program is adequate although it needs improvements both in the ability of health workers, both patient non-compliance in undergoing the program and the participation of local governments in supporting the improvement of the ability of health workers in the MMT program and the need for implementing this program with spiritual therapy.

In a credit agreement, the position of the bank as a creditor and the customer as a debtor is never balanced. The position of the bank is stronger than that of potential customers. Whereas freedom of contract can only achieve justice if the parties have a balanced bargaining power. Unbalanced bargaining power occurs when a strong party can impose his will on a weak party, until the weak party only follows the terms of the contract proposed to him. Given that in the credit agreement there has been a contractual relationship and the clauses tend to favor the bank as the creditor, in a credit agreement, mostly for debtors its only a take it of leave it option, so that the opportunity to negotiate as an initial process of obtaining an agreement is small and even neglected. The research is used a empiric juridical legal research method. Data sources from the research were derived from secondary data consisting of legal materials and legal documents that became the basic foundation for answering problems in this study. The results of this study revealed that the completion of defaults in the mortgage loan agreement can be made before it is executable. Settlement of the default can be done by reschedulling, re-requirements and rearrangegement.

The government established a Draft Law cipta Kerja has the aim of making it easier for businesses in Indonesia to set up their businesses.This draft law is one of the urgency that is expected to be a barometer increase in the business world where Indonesia is still fifth in ASEAN.This is what makes the government always make regulations so that the community is easier in setting up its business, especially for Micro and Small Businesses.The Work Copyright Bill contains many additional rules, especially those related to the founder of a business entity.One of the things that is considered by the government to facilitate the community in setting up a business is by forming a new type of business entity, namely Individual Limited Liability Company (Micro and Small Business) that can be established only by 1 (one) person.With the hope that it can make it easier for businesses, especially micro and small businesses in setting up their businesses by facilitating the terms and minimizing capital.
