Abstract

This case involves a land sale and purchase agreement dispute between the buyer and seller. The buyer (Plaintiff) claims that the seller did not deliver the land certificate as promised in the agreement, then the seller (Defendant) submits an argument that the delivery of the certificate was delayed due to administrative problems which were not his responsibility. The Supreme Court considered that in a sale and purchase agreement, both parties have an obligation to fulfill the agreed provisions. Default occurs if one party does not fulfill its obligations without a valid reason. Therefore, the Supreme Court decided that the seller had committed a breach of contract because he did not hand over the land certificate in accordance with the agreement. As a result, the Supreme Court upheld the decision of the court of first instance which ordered the seller to immediately hand over the land certificate to the buyer and pay the fine as stipulated in the agreement. This decision emphasizes the importance of fulfilling obligations in the land sale and purchase agreement and providing legal protection to parties who suffer losses due to default.

Abstract

The urgency of the issue of environmental pollution caused by the mining industry in Indonesia is increasing, especially with the rise of mining activities that do not pay attention to sustainability aspects. The case of PT Gema Kreasi Perdana (GKP) on Wawonii Island, Southeast Sulawesi, is a concrete example of how mining activities can have significant ecological, social and legal impacts. This research aims to analyze the form of corporate legal liability for environmental pollution based on Law Number 32 of 2009 concerning Environmental Protection and Management (UU PPLH). This research uses descriptive qualitative method with normative juridical approach and case study. The results show that PT GKP can be subject to legal liability based on the principle of strict liability without the need to prove the element of fault. The company was also proven to have violated licensing regulations and community rights, which had a direct impact on the environment and community welfare. The conclusion of this study indicates that enforcement of environmental legal liability must be supported by a strong regulatory system and strict supervision. This study recommends periodic evaluation of mining licenses and ecological restoration as absolute requirements for the sustainability of the mining industry in Indonesia.

Abstract

Penelitian ini bertujuan untuk menganalisis kedudukan hukum, bentuk dan batasan pertanggungjawaban Notaris, serta penerapan prinsip etika jabatan terhadap akta yang dibuat melalui platform daring dalam perspektif hukum positif di Indonesia. Metode penelitian yang digunakan adalah penelitian hukum normatif dengan pendekatan perundang-undangan, konseptual, dan kasus. Data penelitian bersumber dari bahan hukum primer seperti Kitab Undang-Undang Hukum Perdata (KUHPerdata) dan Undang-Undang Nomor 2 Tahun 2014 tentang Jabatan Notaris (UUJN), serta bahan hukum sekunder berupa literatur dan pendapat para ahli hukum. Hasil penelitian menunjukkan bahwa akta yang dibuat secara daring belum memiliki kedudukan sebagai akta otentik karena tidak memenuhi unsur formil kehadiran para pihak di hadapan Notaris sebagaimana disyaratkan oleh hukum positif. Tanggung jawab Notaris atas akta daring dibatasi pada kewenangan dan kehati-hatian dalam pelaksanaan jabatan, termasuk perlindungan terhadap data elektronik. Sementara itu, penerapan prinsip etika jabatan menjadi aspek penting dalam menjaga integritas profesi di era digital. Abstract

The implementation of the Legal Aid Post (Posbakum) by the District Court includes 3(three) scopes of legal services by the provisions contained in Perma No. 1 of 2014. The three scopes are fee waiver services, and holding hearings outside the court building, and providing Court Posbakum. In connection with the implementation of this Posbakum, the District Court only provides room facilities to Posbakum for three accredited legal aid institutions or advocate organizations. The handling of legal aid funds for each case will be submitted by the Court through the Local Office of the Ministry of Law and Human Rights. However, this does not mean that the function of the facilitator can be ignored, considering that this Posbakum is located in the Constitutional Court, it is necessary to pay attention to the special mandate from the State Administrators to the Constitutional Court to ensure the success of free legal services for the poor. . Therefore, it is also hoped that the presence of Posbakum in the Constitutional Court can erode the negative and frightening stigma of the Court for the wider community. Abstract

The land issue is an issue that affects the most basic rights of the people. Because it has a social function other than economic value, so that individual interests on land are sacrificed for common purposes. The purpose of this study is to analyze the payment of compensation for land acquisition in cash and in kind, to identify and analyze the land acquisition process based on Law no. 2 of 2012, as well as explaining the concept and its provisions. To investigate and analyze. This is done by searching for relevant regulations and literature through the search for library materials as a starting material for investigation, using normative legal procedures for problem analysis. Depending on the issue being investigated, the matter will be carried out to analyze the legal regulations in the area of ​​implementing the release of property rights. The results of the examination show that the payment of compensation for the purchase of land can be in the form of cash or non-cash. Change of money, land, resettlement. The land acquisition process that is being developed based on Law no. 2 of 2012 through three stages: The process of planning, compiling and implementing remuneration, concepts and regulations in land acquisition must be carried out in accordance with laws and regulations so that it is fair and does not harm the government or land owners.

Abstract

Perkembangan teknologi informasi telah memberikan dampak yang signifikan terhadap berbagai aspek kehidupan, termasuk dalam pengaturan hukum terkait perseroan terbatas (PT). Penelitian ini bertujuan untuk mengkaji regulasi terkait e-RUPS,Peran notaris dalam proses e-RUPS, dan keabsahan akta e-RUPS di Indonesia. Penelitian ini menggunakan metode penelitian normatif dengan pendekatan studi dokomen. Data yang dikumpulkan kemudian dianalisis secara kualitatif. Hasil penelitian menunjukkan bahwa regulasi terkait e-RUPS telah memberikan kepastian hukum, namun masih terdapat perdebatan terkait peran notaris dan keabsahan akta e-RUPS. Kesimpulan penelitian ini menyatakan bahwa e-RUPS dapat diakui sebagai metode yang sah, dengan catatan pesyaratan keamanan, akses, partisipasi, dan dokumentasi yang telah terpenuhi. Saran dari penelitian ini termasuk perlunya penambahan Pasal dalam UUJNP yang secara khusus mengatur pelaksanaan e-RUPS dan perlunya perluasan makna dari berhadapan secara fisik. Penelitian ini diharapkan memberikan kontribusi pada pengembangan ilmu hukum terkait e-RUPS dan memberikan pemahaman yang lebih mendalam tentang fenomena ini dalam konteks hukum Indonesia. Perkembangan teknologi yang semakin maju saat ini di era 5.0 maka sangat diharapkan kepada pemerintah untuk dapat menciptakan aturan hukum yang secara khusus mengenai e-notary, tidak hanya dalam perusahaan terbuka, tetapi juga secara lebih meluas, sehingga produk hukum yang dihasilkan secara elektronik dapat memberikan kepastian hukum yang kuat.

Abstract

Land, due to its high economic and social value, often becomes a source of legal disputes, particularly in transactions involving unregistered land. In practice, the public frequently engages a Notary to draft a deed as evidence of a legal act, even though the actual authority to transfer land rights lies with the Land Deed Official (PPAT). This study aims to examine the Notary’s authority in drafting deeds of sale and purchase of unregistered land and analyze the legal consequences of such deeds. Using a normative legal research method with statutory, conceptual, and case approaches, the study finds that a Notary’s authority in these transactions is limited: the Notary may prepare a deed as evidence of an agreement or obligation but cannot directly effect the transfer of land rights. The Notary’s responsibility primarily concerns the formal correctness of the deed, yet civil, administrative, ethical, or even criminal liability may arise if negligence or professional misconduct occurs. The study emphasizes the importance of prudence, thorough verification, and legal counseling by Notaries to protect parties’ interests and uphold the integrity of the Notarial profession in unregistered land transactions.

Abstract

The three objectives of this study are to: (1) ascertain the parentage of children in unregistered marriages; (2) ascertain the legal ramifications if children in a marriage are not registered under Indonesian law; and (3) ascertain the judge's legal considerations in decision Number 483/Pdt.P/2023/PA.Krs. Empirical and normative legal research are the types of research used in this study. The source and secondary legal materials employed in the data analysis were literary techniques, which were then examined using qualitative approaches. The study's findings indicate that the legal framework dictating how the parentage of children born to unregistered marriages is determined is routinely reviewed. This study makes reference to the laws governing marriage, No. 1 of 1974, and population management, No. 23 of 2006. Marriages that are both registered and unregistered are still regarded as legitimate but are subject to legal repercussions because the unregistered marriage. Marriages that aren't formally recorded with the Civil Registry office. Marriages that are not officially recognized by the Civil Registry Office have an effect on the children as well as the husband and wife legally.
