Abstract

Sustainable development or commonly called Sustainable Development Goals (SDGs) is a goal achieved by many countries, including Indonesia. One of the goals of the SDGs is to create jobs for all parties without exception. Then the principle used in the SDGs is "no one leaves". This is a challenge for the Indonesian state to create jobs for all, including people with disabilities. However, the data shows that the workforce for people with disabilities is still low. The purpose of this research is to analyze the implementation of the right to work for persons with disabilities in Indonesia.The research method used in this research is normative juridical. The type of data used is secondary data which consists of primary legal material, namely the 1945 Constitution and Law Number 8 of 2016 concerning Persons with Disabilities and uses the Law Effectiveness Theory from Soerjono Soekanto.The results of this study indicate that the implementation of the fulfillment of the right to work for persons with disabilities has increased quite well from 2016 to 2020, but it is still not optimal and effective due to several factors, including legal factors, law enforcement, society and culture.

Abstract

Kegiatan pengabdian masyarakat merupakan bentuk pelayanan yang bertujuan untuk membantu masyarakat tanpa mengharapkan imbalan melalui edukasi. sosialisasi, penyuluhan, dan lain-lain. Mahasiswa/i Universitas Internasional Batam dipercayakan dengan tugas untuk melakukan kunjungan ke Yayasan Bina Ummah Doktor Haji Adamri Al Husainy sebagai bentuk pelaksanaan kegiatan PkM dan pengabdian masyarakat. Kegiatan ini dilaksanakan dengan tujuan untuk membantu dan memberikan manfaat kepada anak-anak melalui program-program yang telah direncanakan dan dipersiapkan. Anak-anak Yayasan Bina Ummah diajak bermain permainan-permainan Word Chain dan Estafet Sarung untuk mengasah kemampuan kerjasama dan meningkatkan rasa solidaritas. Karena pesatnya perkembangan zaman, kemampuan anak-anak untuk bekerja sama sangat penting untuk dilatih sedari dini. Implementasi kegiatan pengabdian masyarakat dilaksanakan dengan metode Pendidikan Masyarakat dengan memberikan bimbingan kepada anak-anak akan pentingnya kemampuan bersosialisasi, bekerja sama, dan menghargai satu sama lain. Melalui serangkaian kegiatan ini, mahasiswa/i berkesempatan untuk berbagi dan mendapatkan pengalaman baru. Adapun implementasi kegiatan diharapkan dapat memberikan manfaat kepada Yayasan Bina Ummah, mempererat tali persaudaraan, dan membawakan hasil berupa meningkatnya wawasan serta kemampuan bekerja sama dan rasa solidaritas anak-anak dalam jangka panjang.

Abstract

Terrorism as a universal threat to peace has been a huge problem specifically for Indonesia, threatening the fabrics of Indonesian society in collaboration with radicalism, which can reach even minors. To fight this, efforts to eradicate radicalization as an important factor in the spread of terrorism’s influence should be supported with by adequate regulations. Using the normative legal research method, this research analyzes the reality of terrorism and its relation to the existing relevant legal framework in Indonesia. This research finds that terrorism has a wide grip on Indonesian society, especially the youth, due to the spread of radicalism and the weak normative structure surrounding the act of radicalization. Findings and analysis of this research argue that there are possibilities of using the restorative justice approach through the process of deradicalization, according to Indonesia’s ideology, Pancasila.

Abstract

A brand is something that is used to get to know a product or company in commerce. Brand rights are also one of the components of intellectual property that align with copyright, patents, and other intellectual property rights. Registering a brand can avoid unfair business competition. For people who live in small towns and do not understand the rules of the brand, it is rare to register a brand even though the resulting product is conventional in wide circles. Brand registration is considered quite difficult and can only be registered in certain places, namely at the Office of the Director General of IPR Jakarta or through the DepkumHAM Kanwil in the provincial capital, therefore being one of the factors in the least number of brand registrations in Indonesia. Riau Islands Province. Related to these problems, the place used to conduct research is to carry out practical work on the CV. Tribina Jasaindo is a business entity engaged in document management services in Batam City. This research uses normative legal methods based on literature studies, then delivered through design ideas in accordance with the working title of practice and data information processing to perform designs on a series of activities. The results of this study show that the procedures for brand registration and its protection are regulated in Law No. 15 of 2001 on Brands.

Abstract

Sexual violence on college campuses has become an urgency, initiated by various parties, especially students. In response to this, the Minister of Education of Indonesia issued Regulation of the Minister of Education, Culture, Research, and Technology Number 30 of 2021 concerning the Prevention and Handling of Sexual Violence in Higher Education . However, some people appear to have repudiation against the regulation, concerning the phrase "without consent", which seems to be allowing immoral actions and violating religious norms. This study is aiming to examine the meaning of the phrase "without consent" based on the regulatory context and analyze the legal protection provided. Normative legal research was used for this study. The results show that the phrase "without consent" in this case means when sexual violence occurs because of coercion and without the consent of the victim. And when it does happen, this regulation provides significant legal protection to the victims. The phrase “without consent” provides clear parameters for cases to go through a legal process, as well as the establishment of a task force as the party responsible for handling sexual violence mechanisms from receiving reports, resolving cases, and providing recovery facilities for victims.

Abstract

This research aims to analyze the legal aspects of electronic information dissemination that violates moral norms. The unethical dissemination of information, including hoaxes, hate speech, and other harmful behaviors, has become a significant concern in the digital environment today. The research method employed is normative legal research, utilizing three approaches: legislative, case-based, and conceptual. Research data were collected from secondary sources, including relevant laws and literature on legal issues related to electronic information dissemination. Additionally, tertiary data was derived from specific cases that exemplify the phenomenon of morally unethical information dissemination empirically, both within the digital space and outside the network. Data analysis involved stages of reading, note-taking, reduction, interpretation, and concluded with deduction. The research results outline the pertinent articles and sections within legal regulations concerning violations of moral norms in electronic information dissemination. Furthermore, the study discusses law enforcement measures that can be taken against the perpetrators of such violations. This research contributes to understanding the legal aspects related to morally unethical electronic information dissemination in the current digital era. It is essential to ensure that ethics and legal compliance are maintained in the increasingly complex online environment.

Abstract

The arbitrary economic exploitation of children by parents and other interested parties requires immediate attention. Batam City, located in the Riau Archipelago, is known for its innovation and low crime rates, primarily due to its focus on foreign relations. However, despite these positive aspects, the economic exploitation of children remains a significant issue, with economic factors playing a crucial role. This study aims to investigate the legal protection of children as victims of economic exploitation in Batam City using an empirical legal research method. This approach involves analyzing and examining the functioning of law within society, utilizing both primary and secondary data sources. The objective is to analyze legal protection for children as victims of economic exploitation from the perspectives of justice, utility, and legal certainty. The findings confirm that legal regulations concerning the protection of children from economic exploitation are clearly stipulated in the law. Various legal protection measures are available for children who fall victim to exploitation. However, enhancing parental awareness is essential to ensure consistent attention to the rights and obligations owed to their children.

Abstract

Despite importance of education in overcoming drug addiction, the connection between the education system and the juvenile justice system remains unclear. Juvenile drug addicts often experience socially-disadvantaged situation, thereby social rehabilitation is an important aspect of recovery aside from medical rehabilitation. This research was performed to identify the challenges in social reintegration among juvenile drug addicts, describe the legal interplay between the relevant framework, and propose a model of legal development for the integration of social rehabilitation for juvenile drug addicts into the education system. Using normative legal research method and statutory approach, this research revealed numerous potentials and challenges in integrating social rehabilitation into the education system. A model consisting of normative reforms and practical framework of works is proposed to be applied by educational institutions and relevant government agencies. This research offers a vital step toward creating inclusive educational environments that prevent relapse and foster societal integration.

Abstract

The issue of abortion is currently still an actual discussion, both done in accordance with applicable regulations and done illegally, for example, women who are victims of rape.  The purpose of this study is to explain the discussion of Abortus Provocatus as a result of acts of rape based on human rights. Based on Law Number 17 of 2003 concerning Health and Law Number 39 of 1999 concerning Human Rights and the writing of this research article using normative research methods, using library materials as data to analyse the problems discussed in the preparation of this research article. Exceptions to abortion Article 60 paragraph (2) point c which provides relief for abortion for women who are victims of rape. This is also in line with Law No. 39/1999 on Human Rights abortion is only done to protect the life of the mother and child. The existence of regulations that legalise abortion is solely to fulfil the rights and freedom of the mother from psychological and social burdens and freedom in her life as a living being that has human rights

Abstract

The Industrial Revolution 4.0, which was initially introduced in Germany, have brought significant implications for the industrial sector in various countries. One of them is Indonesia, as a country that felt the implications and experienced both positive and negative consequences from this change. To anticipate transformation in the industrial sector, the Ministry of Industry initiated the launch of the Making Indonesia 4.0 program. This program aims to accelerate the adaptation of the industrial ecosystem in Indonesia to the industrial era 4.0 which prioritizes the use of information technology in production and management processes. Apart from that, the Making Indonesia 4.0 program is also directed at intensifying the welfare of the Indonesian people through increasing the Gross Domestic Product (GDP) and creating new employment. The study method used is the normative juridical approach, this approach is a scientific study procedure that aims to find the truth based on legal scientific logic from a normative perspective. This study aims to investigate the implications of foreign investment and related regulations for example, Law No. 11 of 2020 concerning Job Creation and Law No. 25 of 2007 concerning Capital Investment, in increasing community welfare through the implementation of the Making Indonesia 4.0 program. The results of this research prove that there is a close relationship between the growth in the amount of foreign investment and the increase in social welfare, especially in terms of the increment in the number of employment opportunities.
