Abstract

Introduction: This article examines the normative tension between state law and customary law in regulating child marriage practices within indigenous communities. In the Indonesian legal system, marriage is regulated through a formal legal framework emphasizing legal certainty and protection, while customary practices are rooted in communal values, traditions, and unwritten norms. Within the perspective of legal pluralism, the coexistence of these legal systems often creates challenges in terms of effectiveness, compliance, and social legitimacy. Purposes of the Research: The purpose of this research is to analyze the application of legal positivism and natural law theory in social engineering toward child marriage practices in indigenous communities, as well as to formulate an appropriate approach for addressing such practices within the framework of Indonesian law. Methods of the Research: This research employs a normative juridical method using statute and conceptual approaches. Legal materials consist of primary sources such as legislation and secondary sources including legal doctrines and scholarly writings related to customary law, marriage law, and legal theory. Results of the Research: The findings reveal that the persistence of child marriage in indigenous communities reflects a normative tension between the formal validity of state law and the moral legitimacy of customary law. Neither legal positivism nor natural law independently provides an adequate solution. Instead, an integrative approach based on Roscoe Pound's concept of law as social engineering, supported by legal positivism and natural law, offers a more effective framework for promoting legal reform while respecting indigenous cultural values. This study contributes to the literature by proposing an integrated analytical framework that bridges legal certainty, moral legitimacy, and participatory social transformation in legally pluralistic societies.

Abstract

Indonesia is a country that has the objective of ensuring the welfare of its citizens. One effective way to achieve prosperity for its citizens is by implementing excellent public services, especially when it comes to the fulfillment of rights concerning the legalization of public documents. Therefore, this study is aimed to analyze the application of the Apostille convention in the legalization of public documents, and to investigate the changes in the law of public services related to the legalization of documents after the Apostille enactment. This legal study is categorized as a type of doctrinal analysis. Specifically, it is descriptive and analytical. Juridical and theoretical foundations were used for data analysis and the theoretical basis employed was the Theory of Legal Reform. The finding is consistent with the principles of the Legal Reform Theory. Legalization of public documents has undergone legal reform because legalization of public documents can be done online and in a short time. This shows that law, as a means of reform, has been realized because it has met the needs of society for the public. Despite the enhancement of public services, several aspects require careful consideration and improvement. This includes establishing effective cooperation with the Regional Office of Law and Human Rights, which acted as a liaison for Apostille services at the regional level. Additionally, the Regional Office of Law and Human Rights assume a pivotal role in overseeing the printing of certificates to ensure accessibility for the public.

Abstract

This study analyzes the role of the state in fulfilling gender-equal educational rights in Indonesia within the framework of the Sustainable Development Goals (SDGs), particularly the goals of quality education and gender equality. This research employs a normative juridical approach by examining statutory regulations, education policies and supporting empirical data related to educational access and protection. The novelty of this study lies in its analysis of the gap between formal legal guarantees and the achievement of substantive gender justice in education. The findings show that Indonesia has established an adequate legal foundation to guarantee the right to education without discrimination; however, its implementation remains ineffective in several aspects. Disparities are still evident in access to higher education, women’s participation in STEM fields, protection from gender-based violence in educational settings and educational accessibility for women in remote areas and vulnerable groups. The main barriers are not limited to regulatory issues but also include patriarchal culture, geographical inequality, economic constraints, limited gender-responsive curricula and weak institutional capacity. This study emphasizes that fulfilling gender-equal educational rights requires stronger legal enforcement, affirmative policies, preventive and repressive protection mechanisms and sustained social transformation to achieve the SDGs in a more inclusive and substantive manner

Abstract

Negara Indonesia merupakan negara yang menjunjung tinggi hak asasi manusia. Perlindungan terhadap hak asasi manusia merupakan sebuah kewajiban bagi Pemerintah Indonesia. Perlindungan tersebut diberikan juga kepada penyandang disabilitas fisik. Indonesia telah memiliki seperangkat hukum yang memberikan perlindungan mengenai hak bekerja bagi penyandang disabilitas namun pada kenyataannya, Indonesia masih menghadapi problematika dalam pemenuhan hak tersebut termasuk pemerintah Kota Batam menghadapi problematika dalam memenuhi hak bekerja bagi penyandang disabilitas.  Tujuan dari penelitian ini adalah untuk mengetahui pemenuhan hak bekerja bagi penyandang disabilitas dan tantangan yang mereka hadapi. Metode penelitian yang digunakan adalah pendekatan sosiologis yuridis. Teknik penelitian yang dilakukan adalah wawancara. Teori hukum yang digunakan dalam menganalisis penelitian ini adalah Teori Efektivitas Hukum oleh Soejono Soekanto dan Teori Keadilan Hukum oleh Jhon Rawls. Hasil penelitian menyatakan bahwa pemenuhan hak bekerja bagi penyandang disabilitas fisik di Kota Batam belum efektif dengan beberapa tantangan yaitu lemahnya peraturan di daerah Kota Batam dan lemahnya kemampuan yang mereka miliki.

Abstract

Countries must interact with other nations or international organizations in order to meet their diverse needs. Countries and countries, countries and international organizations, or one international organization and another international organization can all engage in international relations. One of the forms of international agreements carried out by a country is bilateral cooperation. Among the many countries that have cooperated with Indonesia, one of them is UK, a country that has had a long-standing partnership with Indonesia for approximately 70 years. The research method applied in this study is the normative legal research method. This method is used to describe how the law, particularly international agreements, perceives the bilateral partnership between Indonesia and UK. The ‘conceptual approach’ is chosen to provide insights into the analysis of the strategic partnership between Indonesia and UK. Additionally, various aspects and legal concepts underlying this partnership are analyzed in this research, including the Law Number 37 of 1999 regarding Foreign Relations and the Law Number 24 of 2000 regarding International Agreements. The results of the study show that the implementation of the cooperation agreement between Indonesia and the United Kingdom is in accordance with the two fundamental principles of international agreements according to Kartasasmita, the implementation of the agreement between Indonesia and England also fulfills several theories of the factors in the occurrence of international cooperation, including advances in technology; Economic progress and development; and There is awareness and willingness to negotiate.Keywords: International Agreement, Bilateral, Indonesia-UK

Abstract

Penelitian ini bertujuan mengevaluasi efektivitas Undang-Undang No. 23 Tahun 2004 tentang Penghapusan Kekerasan Dalam Rumah Tangga (KDRT) dalam melindungi perempuan di Kota Batam. Fokus kajian mencakup aspek penegakan hukum dan hambatan sosial-budaya yang memengaruhi perlindungan korban KDRT. Metode penelitian menggunakan pendekatan yuridis empiris dengan analisis kualitatif atas data dari wawancara, observasi, dan dokumen. Hasil penelitian menunjukkan bahwa meskipun undang-undang memberikan kerangka hukum yang jelas, implementasinya masih menghadapi berbagai kendala, seperti rendahnya tingkat pelaporan, respons aparat hukum yang belum maksimal, dan pengaruh budaya patriarki. Selain itu, keterbatasan fasilitas dukungan seperti shelter dan pendampingan psikologis turut menjadi tantangan. Oleh karena itu, diperlukan upaya kolaboratif dari berbagai pihak untuk meningkatkan kesadaran publik, pelatihan bagi aparat hukum, serta pemberdayaan ekonomi korban guna memperkuat perlindungan hukum.

Abstract

The Anti-Money Laundering (AML) program is designed to detect and prevent the flow of illicit funds, particularly those linked to terrorism financing. However, law enforcement efforts face significant challenges, including inadequate coordination in tracking digital transactions, technical limitations, and the complexity of proving criminal acts. These issues are especially pronounced in the Riau Islands Province, Indonesia, which has the highest potential for money laundering due to its strategic border location. Batam City, a key economic hub, ranks second after Jakarta regarding suspicious financial transactions. This study examines the effectiveness of the AML program in addressing money laundering in Batam City. Using an empirical approach, the research analyzes the coordination and implementation of AML initiatives at regional and provincial levels. Findings reveal critical gaps in enforcement strategies and highlight the need for improved interagency collaboration, advanced technical capabilities, and streamlined legal processes to combat money laundering effectively. The study concludes by proposing actionable solutions to reduce the prevalence of suspicious financial activities in Batam City. Key recommendations include strengthening regulatory frameworks, enhancing digital transaction monitoring, and fostering regional cooperation. This research contributes to the broader effort of fortifying Indonesia’s financial security and integrity
