Abstract

Salah satu aspek penting dalam perlindungan konsumen adalah pemberdayaan konsumen melalui edukasi dan sosialisasi. Konsumen yang cerdas, kritis dan berani akan mampu melindungi dirinya sendiri dari berbagai praktik bisnis yang merugikan atau berbahaya. Oleh karena itu kegiatan sosialisasi pemberdayaan konsumen tentang garansi kepada siswa Madrasah Aliyah (MA) Hidayatullah Martapura dilaksanakan untuk memberikan pemahaman dan kesadaran untuk mewujudkan konsumen cerdas. Materi sosialisasi meliputi pengertian konsumen, hak dan kewajiban konsumen, alasan mengapa konsumen perlu dilindungi, pengertian garansi, jenis-jenis garansi, kewajiban pelaku usaha untuk memberikan garansi, cara mengajukan klaim garansi, dan Badan Penyelesaian Sengketa Konsumen (BPSK). Metode yang dipilih untuk menyampaikan materi adalah melalui pemaparan, dialog dan interaksi. Kegiatan sosialisasi berhasil meningkatkan pemahaman dan kesadaran siswa tentang garansi sehingga mewujudkan konsumen yang cerdas.

Abstract

Mediation dominates the dispute resolution process in BPSK Banjarmasin, including insurance disputes between consumers (TMC) and insurance business actors, resulting in a Peace Agreement. However, in reality, the business actors do not implement the Peace Agreement. The aim of this research is to identify the actions and factors causing consumer actions regarding the non-implementation of the Peace Agreement by the business actors in the dispute. This study adopts an empirical legal research method and utilizes a case study approach. The collected data is then processed and analyzed descriptively and qualitatively. The result of the research indicate that the action taken by the consumer is to negotiate with the business actors by contacting them through WhatsApp and Telegram. Several actions that should have been taken by the consumer but were not: 1) The consumer did not register the Peace Agreement resulting from the mediation by filing a lawsuit in court; 2) The consumer did not resolve the dispute through arbitration; 3) The consumer did not file a breach of contract lawsuit regarding the Peace Agreement resulting from the mediation that the business actors did not fulfill. There are three factors causing consumer actions, namely: 1) Knowledge; 2) Economic; 3) Cultural.

Abstract

This research is motivated by the many violationscommitted by electricity service users or electricity customerswhich are often referred to as unlawful use of electric current.Consumers who object if their rights are not fulfilled submit alawsuit to BPSK (Consumer Dispute Resolution Agency).Consumers always have their complaints rejected regardingviolations of P2TL (Issuance of Electrical Inspections) because PLNalways makes excuses and takes refuge in PT Directors'Regulations. PLN and as long as the resolution method chosen ismediation, which is essentially an agreement between the parties,the BPSK panel cannot impose sanctions on PLN or grant consumercomplaints. Consumer protection is any effort that ensures legalcertainty to provide protection to consumers. There are 8 (Eight)cases related to consumer and PT problems. PLN (Persero) BPSKBanjarmasin City, one of the authors took a case regardingconsumer problems and PT. BPSK PLN (Persero) Case Number:18/PN BPSK.BJM/VIII/2022. This research aims to find out howthe dispute resolution process works and how legal protection is forconsumers in resolving disputes between consumers and PT. PLN(Persero) at BPSK Banjarmasin City. This type of research usesempirical law and uses a case study approach. The data obtainedwas collected using interview and documentation techniques. Thecollected data was then processed and analyzed using qualitativedescriptive methods. Based on the results of this research, in theprocess of resolving BPSK case Number: 18/PNBPSK.BJM/VIII/2022, the parties agreed to choose disputeresolution through mediation. According to the author's analysis,the resolution of mediation according to BPSK and according toIslam based on explanations is in harmony in its resolution. bothuse a peace agreement between the parties without forcing orpressuring the parties. According to the author's analysis, theprotection carried out by BPSK has implemented the theory of legalprotection as appropriate for consumers, starting from their rightsin receiving complaints to determining the results of disputeresolution.

Abstract

This study explores the resilience of female workers in Banjar society in South Kalimantan, particularly in three key regions: Banjarmasin, Martapura, and Bati-bati. In Banjar society, working women play a crucial role in supporting both family and community economies. This study highlights the various challenges and opportunities faced by female workers, including online motorcycle taxi drivers (ojol), traditional food vendors, and agricultural laborers. Using a qualitative approach, the study finds that the primary motivation for Banjar women to work is to support their families economically, avoid financial dependency, and maintain social dignity. Despite facing numerous challenges such as harsh working conditions and social stigma, Banjar women persist with resilience and family support. The findings indicate that women’s work in Banjar society is not merely an economic activity but also a vital aspect of social and cultural resilience.

Abstract

Advokat merupakan profesi yang memberikan jasa hukum, saat menjalankan tugas dan fungsinya dapat berperan sebagai pemberi penasehat (advice) hukum, pendamping atau pun menjadi kuasa hukum untuk dan atas nama kliennya. Dalam penerapannya, seorang Advokat memberikan pembelaannya terhadap kasus dalam perkara pidana yaitu KDRT dimana seorang isteri melakukan kekerasan terhadap suaminya. Dalam kasus ini seorang Advokat memberikan pembelaan terhadap kasus perkara pidana tersebut agar mendapatkan keringanan serta kebebasan atas hukumannya dan Advokat tersebut berhasil membebaskan memberikan pembelaannya atas beberapa pertimbangan. Penelitian ini bertujuan untuk mengetahui bagaimana persepsi ulama terhadap upah (Ujrah) yang diterima oleh seorang Advokat atas pembelaan terhadap kasus dalam perkara pidana, dan mengetahui apa dasar hukum yang digunakan para Ulama dalam memberikan persepsinya. Jenis penelitian ini merupakan penelitian hukum empiris dengan pendekatan kualitatif, menggunakan metode wawancara, dengan para informan berjumlah 7 orang Ulama MUI Kota Banjarmasin. Berdasarkan hasil penelitian yang dilakukan oleh penulis, ditemukan 7 orang Ulama MUI Kota Banjarmasin yang menyampaikan persepsinya, para Ulama memiliki perbedaan pendapat yaitu ada 1 orang Ulama yang mengharamkan upah tersebut karena terdapat kezaliman dalam kasus yang ditangani oleh Advokat. Ada pula 6 Ulama yang menghalalkan upah tersebut karena para Ulama sepakat bahwa upah (Ujrah) yang di terima adalah termasuk dalam Ijarah dan upah tersebut sudah sesuai dengan kriteria upah yang di halalkan.

Abstract

Abstrak Penelitian ini bertujuan untuk menganalisis peran Badan Perlindungan Konsumen Nasional (BPKN) dalam penyelesaian sengketa konsumen di kota-kota besar di Indonesia. Fokus studi diarahkan pada efektivitas, mekanisme, dan kendala yang dihadapi oleh BPKN dalam menjalankan fungsinya. Penelitian ini menggunakan pendekatan kualitatif dengan metode studi kasus yang dilakukan di Jakarta dan Surabaya. Data diperoleh melalui wawancara mendalam dengan pihak BPKN, pelaku usaha, dan konsumen. Hasil penelitian menunjukkan bahwa peran BPKN cukup signifikan sebagai lembaga advokasi dan rekomendasi kebijakan, namun keterbatasan kewenangan eksekutorial dan minimnya pemahaman masyarakat terhadap fungsi BPKN menjadi hambatan utama dalam penyelesaian sengketa konsumen secara efektif. Kata Kunci: BPKN, sengketa konsumen, perlindungan hukum, kota besar, penyelesaian sengketa   Abstract This study aims to analyze the role of the National Consumer Protection Agency (BPKN) in resolving consumer disputes in major cities in Indonesia. The research focuses on the effectiveness, mechanisms, and challenges faced by BPKN in carrying out its functions. A qualitative approach was employed using a case study method conducted in Jakarta and Surabaya. Data were collected through in-depth interviews with BPKN representatives, business actors, and consumers. The findings indicate that BPKN plays a significant role as an advocacy and policy advisory institution. However, the lack of executive authority and the limited public understanding of BPKN's functions are key obstacles to effective consumer dispute resolution. Abstract

The trade in mystical oil is a phenomenon that exists in society, one example being in Central Kalimantan, particularly in the city of Kuala Kapuas. This practice has raised doubts among the community regarding its legitimacy. Therefore, this study aims to explore the opinions of religious scholars in Kuala Kapuas and the arguments they use. This is an empirical legal study involving interviews with five religious scholars from the Indonesian Ulema Council (MUI) and the Majelis Ta’lim. The results of the study indicate that the religious scholars are divided into two groups: the first group permits the buying and selling of mystical oil provided it meets the legal requirements of Islam, while the second group prohibits it, as it is considered to involve elements of fraud and the potential for idol worship.

Abstract

This paper discusses the standardisation of Islamic financial products at the national and international levels to reveal what needs to be done to achieve standardisation of Islamic financial products at the national and international levels and how to ensure that Islamic financial products meet the established standards. This type of research is library research with a qualitative approach. Islamic financial products are products based on Islamic economic principles. Standardisation can be defined as the process of developing and implementing standards to ensure consistency, quality, and suitability of products. In the context of Islamic finance, the purpose of standardisation is to create a clear and transparent framework that can be followed by all Islamic industry players so that Islamic financial products and services are in line with Islamic principles, banking regulations, and market needs. According to the author, the way to achieve standardisation of Islamic financial products at the national and international levels is by establishing binding rules for all Islamic financial institutions that comply with Islamic principles, banking regulations, and market needs. To ensure that Islamic financial products meet Sharia standards and compliance, the Sharia Supervisory Board (SSB) must perform effectively. Abstract

Abstrak: Pentingnya kesadaran konsumen dalam memilih kemasan harus diperhatikan, karena Undang-undang Nomor 8 Tahun 1999 tentang Perlindungan Konsumen memberikan amanat terhadap pelaku usaha bahwa di dalam setiap kemasan produk baik wajib mencantumkan informasi yang jelas baik berupa tanggal kedaluwarsa, komposisi produk, serta informasi gizi yang tercantum di dalamnya. Sebagai upaya meningkatkan literasi hukum dan pengabdian kepada masyarakat, Dekan Fakultas Syariah dan Mahasiswa Hukum Ekonomi Syariah UIN Antasari Banjarmasin melaksanakan pengabdian kepada masyarakat dengan tema “Konsumen Cerdas: Pilih Makanan Kemasan Aman dan Sehat” yang diadakan di Aula Bhayangkari Mathilda Batlayeri pada Minggu, 3 Desember 2023 dan diikuti sebanyak 70 peserta dari Mahasiswa UIN Antasari Banjarmasin. Materi yang disampaikan terkait dengan bagaimana memperhatikan kemasan makanan yang aman sesuai dengan peraturan Dinas Kesehatan dan BPOM. Dengan menggunakan metode sosialisasi serta tanya jawab, hasil dari kegiatan ini diharapkan para mahasiswa lebih selektif lagi dalam memilih makanan serta literasi hukum terkait harapan dari lahirnya Undang-undang Perlindungan Konsumen bisa tercapai. Abstract: The importance of consumer awareness in choosing packaging must be considered, because Law Number 8 of 1999 concerning Consumer Protection mandates business actors that in every good product packaging must include clear information in the form of expiration dates, product composition, and nutritional information contained therein. As an effort to improve legal literacy and community service, the Dean of the Faculty of Sharia and Sharia Economic Law Students of UIN Antasari Banjarmasin carried out community service with the theme "Smart Consumers: Choose Safe and Healthy Packaged Foods" held at the Bhayangkari Mathilda Batlayeri Hall on Sunday, December 3, 2023 and attended by 70 participants from UIN Antasari Banjarmasin Students. The material presented was related to how to pay attention to safe food packaging in accordance with the regulations of the Health Office and BPOM. By using socialization and question and answer methods, the results of this activity are expected that students will be more selective in choosing food and legal literacy related to the expectations of the birth of the Consumer Protection Law can be achieved.
