Abstract

Islamic inheritance law highlights diverse approaches to its interpretation and implementation in Muslim-majority countries such as Indonesia and Oman. These differences arise from a legal gap between the universal principles outlined in the Qur'an and their application within national legal frameworks. In Indonesia, Islamic inheritance law functions within a pluralistic legal system, whereas in Oman, Sharia principles serve as the primary and integral foundation of the judiciary. This article examines how the foundational philosophy of Islamic inheritance law is understood and applied in Indonesia and Oman, two countries with contrasting legal systems, to identify both normative and practical challenges, as well as the implications of these differences for future legal development. Employing a normative and comparative legal approach, the study reviews relevant legislation, fatwas, and court decisions in both countries, alongside an analysis of classical and contemporary Islamic jurisprudence. The findings indicate that Indonesia adopts a conciliatory approach, balancing religious norms with modern social needs, while Oman tends to adhere to a more literal and textual interpretation of inheritance law. These differences reflect the dynamic nature of Islamic inheritance law philosophy in responding to each country's unique social, cultural, and political contexts. This contributes to the ongoing discourse on developing an adaptive and context-sensitive understanding of Islamic inheritance law within various national legal systems.

Abstract

Article 263 paragraph (2) of Law Number 8 of 1981 concerning the Criminal Procedure Code limits the grounds on which a Judicial Review of a court decision may be filed. This limitation stems from the extraordinary nature of the Judicial Review, as it provides a mechanism to reopen a case that has obtained permanent legal force (inkracht van gewijsde). Errors in assessing the grounds for a Judicial Review can undermine the principles of legal certainty and justice, which are fundamental to the rule of law. This paper analyzes the use of sentencing disparity in corruption cases as a basis for Judicial Review, as recognized by the Supreme Court of Indonesia. The study employs a normative-descriptive research method. The findings indicate that sentencing disparity in corruption cases is multi-causal, suggesting that it does not always constitute a factual matter but may also involve legal considerations. The study concludes that determining sentencing disparity as an instance of judicial error in a Judicial Review must be conducted with due regard to the principle of judicial independence. Furthermore, with the issuance of Supreme Court Regulation No. 1 of 2020 concerning Sentencing Guidelines under Articles 2 and 3 of the Corruption Eradication Law, issues of sentencing disparity should ideally be resolved through ordinary legal remedies such as appeals or cassation.

Abstract

Community service activity partners are a group of productive partners, namely batik MSMEs in Pekalongan City, namely those who are members of the Kauman batik kampoeng association and the Pesindon batik tourism village. The main problem is marketing, especially digital product marketing in improving the brand image of batik MSMEs towards global competitiveness. This is in line with the aim of community service to optimize digital marketing for batik MSMEs to be able to increase global competitiveness through digital marketing training and mentoring activities by utilizing social media and e-commerce platforms and brand rights registration as part of MSME branding and functions so that consumers can characterizes a product owned by batik MSMEs so that it can differentiate it from other batik products. This activity is divided into three stages, namely the preparation stage including identifying each partner's problem and preparing a problem solving plan, the implementation stage in the form of introducing digital marketing strategies as well as training on marketing utilization and optimization as well as introduction and assistance in creating brand rights, the conclusion evaluation stage of the entire activity, suggestions and conclusions from the results of community service activities. The results obtained from this activity are that batik MSMEs are still minimal in optimizing digitalization for marketing their products, as well as brand rights, only 20% of batik MSMEs have trademarks, the rest have no awareness of trademarks and don't even want to officially register their danang brands.

Abstract

Batik is a product that has become Indonesia's cultural identity. As a batik city, Pekalongan continues to strive to improve the quality of batik products so that Indonesian batik does not become extinct. One of the things that makes batik attractive is its motifs and colors. Through its appeal, batik will increasingly exist and become global. In line with the problems that exist in the batik industry, namely the problem of production time efficiency, this community service aims to provide solutions to problems in the batik industry in order to save or reduce production time, especially in the batik industry. color dyeing stage, while maintaining the quality of the batik. The dyeing process carried out by the batik industry which is the activity partner, namely Perkumpulan Kampoeng Batik Kauman and Kampung Wisata Batik Pesindon, still uses traditional dyeing techniques, so that through a batik dyeing machine solution called a feeder machine, the batik production process at the dyeing stage can be made easier. The results of this service activity were achieved with evidence of a success rate based on evaluation results reaching 87.4% as a dyeing tool innovation that had an impact on efficiency and with a color dyeing printing time of around 20-30 minutes on one 2x1m sheet of paper. cloth. Furthermore, the results of using the feeder machine are visible in the even coloring results and the batik wax does not break. This means that apart from being an efficiency solution, the feeder machine also improves the quality of batik.

Abstract

Tourism village management plays a pivotal role in advancing sustainable development, particularly in rural areas endowed with rich biodiversity and natural resource potential. Ecological justice, which underscores equitable access to natural resources and shared responsibility in maintaining ecosystem balance, is a critical concept for ensuring sustainability in tourism village management. This study investigates the integration of ecological justice into tourism village management and examines the challenges and opportunities associated with its implementation. Utilizing a qualitative approach, the research explores strategies and policies that promote environmental sustainability while enhancing the welfare of local communities. The findings reveal that participatory approaches, environmental education, and policies rooted in local wisdom are essential for achieving ecological justice. The novelty of this study lies in its focus on ecological justice as a comprehensive framework that transcends economic considerations to incorporate ecological and social equilibrium. By proposing a model for sustainable tourism village management, this research contributes to the discourse on sustainable development, providing practical insights for policymakers and stakeholders in achieving long-term environmental and community welfare objectives.

Abstract

This community service activity is important to carry out because there is an urgency to introduce batik products more widely, especially Pekalongan batik which has its own distinctive and unique motifs and philosophies, and has differentiation which will be packaged through batik innovation with Quick Response Code labeling which can be accessed by consumers with a display that contains information about the profile of the SME maker along with the batik motifs complete with meanings and symbols and philosophies. Through this strategy, SMEs can market batik products more exclusively but still maintain the local wisdom and philosophy of Indonesian batik culture. In addition, SMEs are also able to boost the independence of SMEs in readiness for competition in the global market. The activity was carried out with partners, namely the Kauman Batik Kampoeng Association, East Pekalongan District, Pekalongan City. Activity partners have problems in the commercialization of branding and digital marketing. The method is carried out through several stages. Before the service team carries out activities, it begins with observations, adjusting the needs of service activity partners and creating a website for information needs that can be accessed via QRcode-based labels. The service team provides solutions to problems through training and assistance, including regarding the importance of QRCode-based batik labels, preparing UKM profiles for the QRCode database which refers to the website, assistance in using QRCode-based batik labels, as well as assistance and management of brand rights and copyrights.

Abstract

This study aims to analyze the problem of legal uncertainty for MHA related to the establishment of a Land Bank as mandated by the Job Creation Perppu. This research is a normative legal research with a conceptual and statutory approach. The results of the study concluded that the obligation to involve the Customary Law Community in land use through the Land Bank agency is said to be urgent, especially in an effort to maintain the mandate of the 1945 Constitution of the Republic of Indonesia and the UUPA to provide guarantees for recognition, protection as well as empowerment of the Indigenous Peoples. Efforts to realize legal certainty for Indigenous Peoples (MHA) in land use through the Land Bank agency with reference to grammatical, authentic, and teleological (sociological) interpretations, it is necessary to expand the meaning of the word "community" in Article 8 paragraph (2) PP Agency Land Bank which does not only cover society in general (individuals as legal subjects) but includes the Customary Law Community.

Abstract

Program Pengabdian kepada Masyarakat bermitra dengan Kelompok PKK Perumahan Wirabaru 1, Kelurahan Pekuncen Kecamatan Wiradesa . Mitra merupakan komunitas yang memiliki anggota Ibu –ibu sebagai konsumen jual beli online. Dalam melakukan kegiatan juala beli online anggotanya terdiri dari ibu –ibu belum memahami hak dan kewajiban mereka sebagai konsumen dan upaya hukum yang harus mereka lakukan apabila ada kasus hukum dalam jual beli online tersebut.. Berdasarkan analisa situasi tersebut diatas, permasalahan yang dihadapi oleh mitra yaitu pertama, belum tahu hak dan kewajiban konsumen dan upaya hukum apabila dirugikan. Dengan demikian, solusi yang ditawarkan untuk menyelesaikan permasalahan mitra yaitu dilakukan sosialisasi & diskusi e-commerce beserta aspek hukumnya. Adapun metode kegiatan diawali dengan tahap persiapan, kemudian tahap pelaksanaan dan terakhir tahap pelaporan yang direncanakan selesai dalam jangka waktu 3 bulan. Hasil dan luaran kegiatan setelah dilaksanakan program telah tercapai yaitu, konsumen dalam hal ini mitra yaitu kelompok PKK mengalami peningkatan pemahaman mengenai pentingnya e-commerce khususnya pemasaran online beserta aspek hukumnya.

Abstract

Program Pengabdian kepada Masyarakat bermitra dengan Pokdarwis Desa Kasimpar Kecamatan Petungkriyono. Mitra merupakan komunitas di bidang pariwisata yang mempromosikan petungkriyono menjadi ikon Kabupaten Pekalongan. Komunitas ini dibentuk oleh warga Kecamatan Petungkriyono Desa Kasimpar sebgai bentuk tanggung jawab untuk mengembangkan pariwisata di Petungkriyono. Sebelum ada Pokdarwis pariwisata Petungkriyono tidak ada yang mengurus dan kurang promosi. Berdasarkan analisa situasi tersebut diatas, permasalahan yang dihadapi adalah pemberdayaan Pokdarwis untuk lebih diberikan pelatihan untuk mengembangkan pariwisata. Hasil dan luaran kegiatan setelah dilaksanakan program telah tercapai yaitu, anggota Pokdarwis lebih paham akan tugasnya untuk mengembangkan pariwisata di Kecamatan Petungkriyono.

Abstract

Tourist villages in Batang Regency, Central Java, have great potential for development through pentahelix collaboration. Although collaborative efforts have been made, challenges such as inter-party coordination and marketing strategies still need improvement. The purpose of this research is to analyze the form of pentahelix collaboration in the management of tourist villages in Batang Regency and to identify supporting and hindering factors that affect this collaboration. This study uses empirical legal methods to analyze pentahelix collaboration in the management of tourist villages in Batang Regency through in-depth interviews, direct observation, and qualitative analysis. The results show that pentahelix collaboration in the management of tourist villages in Batang Regency involves the integration of five main components: government as facilitator and regulator, local communities as the main drivers, academics contributing through research, the business sector providing capital and expertise, and media playing a role in promotion. The implementation of this collaboration is evident in various tourist village development programs. The main supporting factors include local government commitment, active community participation, academic contributions, business sector investment, and the media's role in promotion. However, there are several obstacles such as lack of coordination between elements, limited human resource capacity, limited access to funding, overlapping regulations, environmental sustainability challenges, and resistance to change.
