Abstract

Marriage is one of the Sunnah of the Messenger and the religious advice.Marriage in the Qur’an referred to as mitsaqan ghalizhan (grandagreement). However, today in most families, the marriage was impressedmerely as a means of getting descent and distribution of sexual libidoor impingement sheer lust. So the role of the family is considered notfunctioning as it should. Therefore, building a maslahah family is acentral element in Islam, because the family unit is the major joints ofsociety. According to the views of young Nyai from Boarding of KrapyakYogyakarta, in building maslahah family is not only a form of support inan effort to mature age of marriage, birth control or guidance of familysupport, but also efforts to improve the lives of the family concerned.There are two things to look for in this article, namely, first, about theconcept of maslahah family by young Nyai from Boarding of KrapyakYogyakarta. Secondly, the Islamic legal review of the concept of maslahahfamily in view of young Nyai from Boarding of Krapyak Yogyakarta.This paper is a research field with normative juridical approach. Whereis the primary source was obtained through interviews with three younghousekeeper at boarding school Krapyak Yogyakarta in 2013.

Abstract

This article explains the concept of establishment of the sakinah family according to the perspective of Hamka and Quraish Shihab. This is a qualitative research which utilizes data sourced from literature. This article shows that according to Hamka, modern Sufism can be used as a solution to achieve a happy family in this world and the hereafter, regardless of the stigma that marriage is only to have children. Sufism does not only mean zuhud which is lonely, away from the world normally, but must actively work. As for the meaning of zuhud according to Hamka, is ready to be poor, rich, and to not have any penny, and on the other hand, being willing to become a millionaire, but wealth does not the cause of forgetting God, and neglecting the obligations. This is in line with the concept that taught by Islam, that Islam advocates the spirit to fight, the spirit of sacrifice and work not to be lazy. According to Quraish Shihab, The presence of sakinah does not just come, but there is a condition for its presence, the heart must be prepared with patience and piety.

Abstract

Mediasi merupakan proses penyelesaian suatu sengketa yang dibantu pihak ketiga melalui suatu perundingan atau pendekatan mufakat antara kedua belah pihak, dimana orang yang menjadi penengah suatu sengketa menurut Peraturan Mahkamah Agung PERMA disebut mediator. Dengan meningkatnya perceraian di Pengadilan Agama Wonosobo peran mediasi sangat dibutuhkan untuk mengurangi penumpukkan perkara. Penelitian ini bertujuan untuk menjelaskan bagaimana peran/efektifitas praktik mediasi dalam mengatasi jumlah perkara yang semakin meningkat, dan apakah praktik tersebut sudah sesuai dengan konsep hakam dan Hukum Islam. Hasil penelitian ini menunjukan bahwa peran / efektifitas pelaksanaan mediasi di PA Wonosobo pada tahun 2012 masih kurang berhasil atau kurang maksimal. Hal tersebut disebabkan dua hal, baik dari aspek PA (hakim) maupun dari aspek para pihak yang berperkara. Dari aspek hakim dari sebelas hakim yang bertugas di PA Wonosobo hanya satu orang yang sudah mengikuti pelatihan mediasi (bersertifikat). Sedangkan dari para pihak yang berperkara yaitu banyaknya perkara verstek, serta para pihak yang belum memahami pentingnya mediasi disamping hal tersebut diperkuat oleh motifasi dari para pihak yang berperkara hanya untuk bercerai saja, disamping bila rumah tangganya diteruskan hanya mendatangkan kemadhorotan, sehingga perkara gugatan perceraian dikabulkan. Praktik mediasi di PA Wonosobo tahun 2012 tersebut sudah sesuai dengan konsep hakam dalam Hukum Islam.

Abstract

Imported goods sent to a country do not necessarily have a permit or official to be traded in that country. In this study, the question that will be answered is what are the implications for the import of unofficial cellular phones by business actors who are sold to consumers and how law enforcement and the difference between unofficial cellular phones by business actors are sold to consumers in Indonesia, Malaysia, and Japan. This research method uses normative juridical type. The results of the study show different legal products from each country and their enforcement. In Indonesia, the impact of this forgery can be detrimental to state tax revenues as well as economic instability. Thus, it is regulated by law from Article 45 and Article 46 of the Consumer Protection Law to sanction a prisoner of a maximum of 2 years with a fine of Rp. 500,000,000.00. Malaysia is also affected by this black market, namely the decline in the state deficit due to the non-disbursement of goods taxes. Law enforcement in Malaysia refers to the counterfeiting rules based on the CopyRight Act 1987 with a prison sentence of not more than 5 years and a fine of money. In addition, in Japan itself has the Consumer Protection Law of 2000 and its enforcement for people who carry counterfeit and counterfeit goods based on article 167 with a prison fine of not more than 3 years. The conclusion that can be drawn is that each country, such as Indonesia, Malaysia, and Japan, has its own way of enforcing the law against the sale of unauthorized cell phones, but the impact can be the same.

Abstract

Abstrak: Penguatan kepala sekolah merupakan program untuk meningkatkan kemampuan kepala sekolah dalam manajemen sekolah.Tujuan penelitian ini secara umum adalah untuk mendapatkan implikasi bimbingan teknis petugas supervisi moda darng dan luring terhadap peningkatan petugas supervisi penguatan kepala sekolah di Indonesia. Penelitian ini termasuk eksperimental dengan rancangan two group pretest dan posttest design. Penelitian ini menggunakan populasi berjumlah 34 petugas, dengan jumlah sampel kelompok perlakuan I adalah 17 petugas diberikan bimbingan teknis superbisi moda daring, kelompok perlakuan II adalah 17 petugas diberikan bimbingan teknis moda luring. Metode tes digunakan untuk pengumpulan data. Hasil Penelitian bahwa data diperoleh dengan nilai Sig 0.015 < 0.05 sehingga bimbingan teknis petugas supervisi moda daring dan luring memiliki pengaruh yang signifikan terhadap peningkatan kapasitas petugas supervisi dalam ramgka penguatan kepala sekolah. Hasil data Petugas supervisi moda daring dan luring tidak ada perbedaan dalam meningkatkan kapasitas petugas supervisi.Abstract: Principal strengthening is a program to improve the principal's ability in school management. The general purpose of this study is to obtain the implications of technical guidance for online and offline supervisory officers on improving principal strengthening supervisory officers in Indonesia. This study is an experimental study with a two-group pretest and posttest design. This study used a population of 34 officers, with the number of samples of treatment group I being 17 officers given technical guidance for online mode supervision, treatment group II being 17 officers given technical guidance for offline mode. The test method was used for data collection. The results of the study showed that the data was obtained with a Sig value of 0.015 <0.05 so that technical guidance for online and offline supervisory officers had a significant influence on increasing the capacity of supervisory officers in the framework of strengthening principals. The results of the data for online and offline supervisory officers showed no difference in increasing the capacity of supervisory officers..

Abstract

This study aims to analyze the phenomenon of learning loss experienced by Information Systems students in the Linear Algebra course, particularly in understanding the concept of Gauss-Jordan elimination during online lectures. A qualitative research method was employed with a sample of 59 third-semester students. A questionnaire was utilized as the research instrument for data collection. The findings revealed that 33% of the total respondents encountered significant difficulties in understanding the Gauss-Jordan elimination concept during online learning. These results indicate a significant impact of learning loss in the context of online education, which may affect students' understanding and academic performance. The implications of this research highlight the importance of efforts to enhance the effectiveness of online learning, including the development of more interactive and supportive teaching strategies, as well as improving the quality of interaction between instructors and students in the virtual environment. Further research is needed to gain a deeper understanding of the factors influencing learning loss and to develop more effective solutions for addressing the challenges of online learning in the future

Abstract

The "Jo Kawin Bocah" program aims to prevent early marriages in Central Java, particularly in Temanggung Regency, where 414 cases were recorded in 2022. Implemented by the PKK Movement Team, the program focuses on educating communities to reduce early marriage rates. This research analyzes its implementation in Temanggung Regency in 2023 using a sociological approach to Islamic law and descriptive analysis. The findings reveal two main points. First, the PKK Movement Team enhances the program through collaboration with the government, communities, institutions like GenRe (Planned Generation), and mass media for effective dissemination. Second, based on Atho' Mudzhar's sociological theory of Islamic law, factors such as religious practices, social structures, interactions, and support from community organizations significantly influence the program's outcomes. By fostering awareness and community involvement, the program has successfully shifted perceptions and reduced early marriage practices in Temanggung, demonstrating its potential as a model for other regions.

Abstract

This article discusses the competence of religious courts in adjudicating disputes over interfaith inheritance between Muslims and non-Muslims. This can happen inseparably from the social and cultural conditions of people in Indonesia who are pluralism with various backgrounds such as ethnicity, customs, different languages, and belief or religious factors. But on the other hand, there are differences in views between the fuqaha regarding the heritage of different religions. If the heir and heir, both the heir as the plaintiff and the defendant, have differences in religion, then the practice of law enforcement in the court against the inheritance case creates a dispute over competence between the religious court and the district court. This study examines through legislation, legal literature in accordance with the research being discussed and uses Islamic law to answer the author's problem formulation by analyzing decision number 1854 / Pdt.G / 2013 / PA.Plg. The results of the research that can be concluded are that when viewed from a juridical point of view, religious courts are authorized to adjudicate cases of disputes over inheritance between religions. This can happen because it is based on jurisprudence 51K/AG/1999. The function of jurisprudence can be used as the best way given by judges to communities that have family pluralism as a solution in resolving cases of inheritance disputes between religions. However, when viewed from the normative side of Islamic law, religious courts are authorized to adjudicate inheritance disputes with parties of different religions. This can happen because it is based on the interpretation of Yusuf Al-Qardawi and the ijtihad of the supreme court for a sense of justice for families whose pluralism of beliefs. The inheritance is not counted as heirs but is counted as a mandatory will of no more than 1/3 part.

Abstract

Kajian ini membahas mengenai tinjauan normatif dan yuridis terhadap pelaksanaan wakaf uang secara online pada lembaga Wakaf Salman ITB. Dewasa ini semakin banyak lembaga yang menyediakan layanan wakaf uang secara online. Wakaf uang secara online semakin dilirik oleh masyarakat karena kemudahan dan efesiansi waktu. Dasar hukum pelaksanaan wakaf secara online terdapat pada Peraturan Badan Wakaf Indonesia Nomor 1 Tahun 2009 tentang Pedoman Pengelolaan dan Pengembangan Wakaf Bergerak Berupa Uang. Berdasarkan penelitian ini pelaksanaan wakaf uang secara online di Wakaf Salman belum sesuai dengan anjuran dari Undang-Undang Wakaf. Undang-Undang menganjurkan bahwa wakaf uang dikelola secara produktif, sementara dalam Wakaf Salman sendiri pemanfaatan harta wakaf dipergunakan untuk pengadaan wakaf fisik. Meskipun belum memenuhi anjuran dari undang-undang, wakaf uang secara online di Wakaf Salman sendiri membeli banyak dampak positif untuk membantu kesejahteraan masyarakat. Kata Kunci : Wakaf Uang; Online; Lembaga Wakaf.

Abstract

Latar Belakang : Era digital telah membawa perubahan signifikan dalam berbagai aspek kehidupan, termasuk dalam pembelajaran Pendidikan Agama Islam (PAI). Teknologi menawarkan peluang dan tantangan dalam proses pembelajaran yang memengaruhi pemahaman serta perilaku keagamaan siswa. Tujuan : Penelitian ini bertujuan untuk menganalisis pengaruh pembelajaran PAI terhadap perilaku keagamaan siswa di era digital Metode : Metode penelitian yang digunakan adalah pendekatan kualitatif dengan teknik pengumpulan data melalui wawancara, observasi, dan studi literatur. Hasil dan Pembahasan : Hasil penelitian menunjukkan bahwa pemanfaatan teknologi dalam pembelajaran PAI dapat meningkatkan pemahaman agama siswa melalui akses ke berbagai sumber belajar digital. Namun, tantangan juga muncul, seperti kurangnya literasi digital dan pengaruh media sosial terhadap persepsi keagamaan siswa. Oleh karena itu, strategi pembelajaran inovatif yang mengombinasikan teknologi dengan pendekatan pedagogis yang efektif diperlukan agar siswa tidak hanya memahami ajaran Islam tetapi juga mampu mengamalkannya dalam kehidupan sehari-hari. Kesimpulan : Penelitian ini diharapkan dapat memberikan kontribusi dalam pengembangan model pembelajaran PAI yang adaptif terhadap perkembangan teknologi.
