Abstract

Sampah kini telah memantapkan dirinya sebagai persoalan bersama yang kerap menimpa lingkungan sekitar kita, khususnya Desa Jatiluwih. Hingga saat ini, upaya pengelolaan sampah menjadi sumber permasalahan utama warga Desa Jatiluwih. Salah satu bidang yang sangat krusial untuk dikonsentrasikan oleh Desa Jatiluwih adalah pengelolaan sampah karena sampah merupakan salah satu isu yang membahayakan potensi desa dari segi pertanian dan pariwisata. Sampah-sampah yang ada di Desa Jatiluwih berpotensi merusak ekosistem dan berdampak buruk bagi pertanian desa tersebut. Pembuatan lubang biopori merupakan salah satu strategi yang dapat digunakan untuk mengatasi masalah ini. Tujuan menyeluruh proyek layanan masyarakat ini adalah untuk 3R.

Abstract

This research examines the regulations and law enforcement efforts concerning the use of cryptocurrency as a money laundering tool in both Indonesia and the United States. Using normative legal research methods and a comparative approach, the study compares the legal frameworks of the two countries. In the United States, agencies such as FinCEN, IRS, and SEC play a critical role in enforcing laws against the use of cryptocurrencies for money laundering, with comprehensive laws and sophisticated enforcement mechanisms. Meanwhile, Indonesia relies on BAPPEBTI to oversee and regulate cryptocurrency activities. Although Indonesia’s legal framework may not be as extensive as the United States', the country has taken significant steps, such as adopting the "Travel Rule" to monitor cryptocurrency transactions. However, both countries face a common challenge: the anonymity offered by cryptocurrencies, which complicates investigations into money laundering. To address this challenge, both countries require more detailed regulations and enhanced international cooperation to effectively combat the misuse of cryptocurrencies for money laundering. The research suggests that strengthening legal measures and improving global collaboration are essential to mitigate the risks associated with cryptocurrency-based financial crimes.

Abstract

This article discusses the role of the police in implementing restorative justice, including the function of mediation, solving cases at the initial level, crime prevention, as well as education and outreach to the community. This approach not only helps resolve conflicts peacefully, but also restores social relations and builds public trust in the legal system. However, the implementation of restorative justice faces a number of challenges, such as the need for a paradigm shift, increasing the capacity of police officers, and coordination between institutions. Through conceptual analysis, this paper concludes that restorative justice, if implemented effectively, can be the basis for creating a more sustainable, inclusive and just legal system. This approach is in line with the principle of distinguished justice which places humans as subjects, not objects, in the legal process. Thus, restorative justice not only offers more humane legal solutions, but also contributes to the creation of a harmonious and just society.

Abstract

The business activities carried out by BPR KITA are collecting and distributing funds to residents in the form of credit loans. Given COVID-19 pandemic, which implementation of lending carried out by BPRs did not run smoothly, as a result it resulted in congestion on credit or defaults, this factor was the cause of the inability of citizens to fulfill certain obligations from transactions and engagements that they had carried out. , resulting in the threat of default such as late payment of credit installments and other payments that have been previously agreed with the bank. This thesis research is empirical legal research which places more emphasis on field research. The research method used is descriptive qualitative method, using primary data and secondary data. The data collection technique used in the preparation of this thesis is an interview technique with the main director of BPR KITA. The results of this thesis research can be concluded that the cause of bad loans is due to a pandemic that has an impact on their business, resulting in a default by the debtor, so the settlement of bad credit disputes at BPR KITA uses a non-litigation method (outside the court), which takes a non-litigation approach. to the debtor and find a way out so that the debtor can carry out his obligations again.

Abstract

As a state governed by law, Indonesia has an obligation to provide protection and equal access to justice for all its citizens, including persons with disabilities. This report examines the efforts of the Bali High Prosecutor's Office in optimizing legal services for persons with disabilities, in accordance with Law Number 8 of 2016 concerning Persons with Disabilities. Through research using observation and interview methods, steps taken and challenges faced were identified. Although the Bali High Prosecutor's Office has made significant efforts based on Guideline Number 2 of 2023, challenges such as a lack of accessible infrastructure, limited legal understanding among persons with disabilities, and a shortage of trained human resources still exist. Therefore, further strategies are needed to ensure equal treatment for persons with disabilities before the law, including increasing training for law enforcement officials and improving more inclusive facilities. This journal is expected to serve as a guide for other institutions in developing more disability-friendly legal services.

Abstract

The ideal tax policy should balance social justice through income redistribution, as proposed by John Rawls, with economic freedom and individual property rights, as emphasized by Robert Nozick, to create a fair and sustainable system. This study analyzes the differences and similarities in the theories of distributive justice according to John Rawls and Robert Nozick in normative, philosophical, and sociological aspects, as well as examine their implications for tax policy to formulate an ideal taxation system. This article employs a normative legal method with conceptual, legislative, and comparative approaches to analyze the theories of distributive justice by Rawls and Nozick in tax policy, using a literature study technique and descriptive-comparative analysis of tax regulations in various countries. The findings reveal that differences in the theories of distributive justice between Rawls and Nozick have significant implications for tax policy, where Rawls advocates progressive taxation to reduce social inequality and improve the welfare of disadvantaged groups, whereas Nozick rejects tax redistribution as it violates individual property rights and supports a proportional tax system instead. An ideal tax policy could adopt a mixed approach, with moderate progressive taxation to support social welfare and lower corporate taxes to encourage investment and economic growth, thereby effectively balancing social justice and individual freedom.

Abstract

The biggest arak producer in Bali is precisely located in Tri Eka Buana Village, Sidemen District, Karangasem Regency, Bali Province. With the arak in the village of Tri Eka Buana which is one of the village head's references to advance the Tri Eka Buana Village by giving an idea in the form of a wine museum development which will later become a tourist attraction. The development of the wine museum aims to preserve cultural customs especially the process of making traditional wine and to examine the potential of the wine museum to become a new tourist destination that will affect the economy of the population in the village of Tri Eka Buana. Besides that, Tri Eka Buana Village also plans to make its village a tourist village. However, to get to the tourist village there are several problems, one of which is the lack of village funds that will be used as the construction of the arak museum. In order to achieve the construction of the wine museum in the village of Tri Eka Buana, we therefore help the village by making proposals for the submission of funds to be submitted to related parties which will later be used for the construction of the arak museum.Keywords: Arak Museum, Tourism Village

Abstract

Arak adalah minuman beralkohol suling jenis minuman keras yang biasanya diproduksi di Negara Negara Asia Tenggara dan Asia Selatan. Arak terbuat dari fermentasi kelapa, tebu dan biji-bijian. Bahan distilat arak dapat dicampur, disimpan lebih lama dalam tong kayu atau berulang kali, disuling dan disaring tergantung pada rasa dan warna keinginan pembuatnya. Di desa Tri Eka Buana mata pencaharian rata-rata masyarakatnya adalah pembuat arak, akan tetapi  masyarakat luas kurang mengetahui bahwa desa Tri Eka Buana merupakan salah satu desa penghasil arak terbesar di Bali, maka dari itu kami membantu desa dengan mengajukan design packaging arak yang akan digunakan sebagai souvernir museum arak yang akan diberikan kepada para wisatawan yang berkunjung ke museum arak di desa Tri Eka Buana. Diharapkan dengan adanya packaging arak tersebut wisatawan dapat lebih mengenal ciri khas dari cita rasa arak di desa Tri Eka Buana.Kata Kunci : Arak, Souvernir, Desa Wisata

Abstract

Penelitian ini menganalisis kebijakan yuridis dan implementasi perlindungan konsumen atas penggunaan Bitcoin di Indonesia pada tengah percepatan ekonomi digital dan meningkatnya modus penipuan daring. Tujuan riset adalah mengevaluasi efektivitas regulasi yang berlaku, memetakan peran lembaga pengawas, serta membandingkan praktik terbaik internasional untuk merumuskan penguatan tata kelola yang berorientasi konsumen. Metode yang digunakan ialah penelitian hukum normatif dengan pendekatan perundang-undangan dan komparatif, bersumber dari bahan hukum primer, sekunder, dan tersier, serta telaah literatur terkait aset kripto dan perlindungan konsumen. Hasil menunjukkan masih adanya disharmonisasi kebijakan, kebutuhan penguatan pengawasan seiring peralihan kewenangan ke otoritas sektor jasa keuangan, rendahnya literasi digital masyarakat, serta urgensi penerapan standar keamanan informasi dan mekanisme penyelesaian sengketa yang cepat dan transparan. Implikasi penelitian menegaskan pentingnya harmonisasi lintas-otoritas, edukasi publik yang berkelanjutan, peningkatan kapasitas kelembagaan dan teknologi, serta kolaborasi internasional untuk menekan penipuan lintas batas sehingga ekosistem kripto nasional menjadi lebih aman, akuntabel, dan kompetitif.

Abstract

Era digital telah membawa perubahan signifikan terhadap dinamika industri kreatif dengan menempatkan konten kreator sebagai aktor utama dalam produksi dan distribusi karya. Namun, kemudahan teknologi juga membuka ruang luas bagi pelanggaran hak kekayaan intelektual, khususnya hak moral yang melekat secara abadi pada pencipta. Penelitian ini bertujuan untuk mengidentifikasi, mengklasifikasikan, dan menganalisis bentuk-bentuk pelanggaran hak moral yang dialami konten kreator dalam media digital berdasarkan Undang-Undang Nomor 28 Tahun 2014 tentang Hak Cipta. Metode yang digunakan adalah penelitian hukum normatif dengan pendekatan perundang-undangan dan konseptual melalui telaah dokumen hukum, literatur ilmiah, serta analisis kasus relevan. Hasil penelitian menunjukkan bahwa pelanggaran hak moral terjadi dalam dua bentuk utama, yaitu pelanggaran hak atribusi berupa pengunggahan ulang tanpa penyebutan nama pencipta dan pelanggaran hak integritas melalui modifikasi, distorsi, atau penggunaan karya dalam konteks yang merendahkan. Temuan ini menegaskan perlunya penguatan penegakan hukum, peningkatan kesadaran digital, serta kolaborasi lintas sektor untuk menciptakan ekosistem hukum yang melindungi martabat kreator di ruang digital.
