Abstract

The Kain Tunun Gringsing Bali is a cultural heritage of the people of Tenganan Pegringsingan Village and has a philosophical value and sacred meaning behind every motif of the Balinese Tunun Gringsing cloth. In October 2016 the government has issued a Geographical Indication Protection certification for the Bali Gringsing Tunun Fabric. The purpose of writing this paper is to examine the granting of Geographical Indication Certificates to Bali Gringsing Tunun Fabrics both in terms of production and sales. The research in this article uses empirical legal research methods. The results of the study found that the evaluation after obtaining a protection certificate showed that there was no significant impact on the productivity of the Balinese Tunun Gringsing fabric craftsmen. This is due to the lack of socialization after and data collection so that it cannot be done in a concrete way the perceived impact of getting the exclusive right to protect the geographical indications of the Kain Tunun Gringsing Bali

Abstract

Traditional Knowledge and Traditional Cultural Expression including traditional dance are constituted as cultural heritage of the ancestor which derived from generation to generation, high value and useful, therefore very important to protect. The purpose of this paper is to elaborate the implementation of Article 38 of Law No. 28 of 2014 on Copyright (Indonesia Copyright Law) related to traditional Balinese dance. This writing uses empirical legal research method. Traditional dance art as part of the traditional cultural expression is protected under Article 38 of Indonesia Copyright Law. In its implementation in Bangli regency, this provision has not been implemented effectively. One of the factors is because the community does not have a deep understanding on the substance specifically the importance of conducting inventory and documentation in the framework of legal protection through government cooperation with the community and related parties. Pengetahuan Tradisional dan Ekspresi Budaya Tradisional termasuk seni tari tradisional merupakan warisan budaya dari leluhur yang diturunkan dari generasi ke generasi berikutnya, bernilai dan memiliki daya guna yang tinggi, oleh karenanya sangat penting untuk dilindungi. Tujuan tulisan ini untuk mengelaborasi implementasi Pasal 38 Undang-Undang No. 28 Tahun 2014 tentang Hak Cipta (UUHC 2014) berkaitan tari tradisional Bali. Penulisan ini menggunakan metoda penelitian hukum empiris. Seni tari tradisional sebagai ekspresi budaya tradisional dilindungi berdasarkan Pasal 38 UUHC 2014. Dalam implementasinya di Kabupaten Bangli, ketentuan ini belum terlaksana secara efektif. Salah satu faktor penyebabnya adalah masyarakat baru sebatas mengetahui, namun belum memahami substansinya, termasuk pemahaman tentang pentingnya melakukan inventarisasi dan dokumentasi dalam rangka perlindungan hukum melalui kerjasama pemerintah dengan masyarakat serta pihak terkait.

Abstract

The purpose of this article is to examine the child protection that is integral/simultaneous and prioritizing the non-penal policy by forming and realizing the Jagaddhita family. This research is normative juridical research. The results show that in terms of penal-policy the State has provided a legal umbrella through the Law of the Republic of Indonesia No. 23 of 2002 on Child Protection as amended by the Law of the Republic of Indonesia No. 35 of 2014. However, as time goes by such Law is deemed unable to run effectively and the crime against children is increased. Establishing the Jagaddhita family as a non-penal policy is a strategic effort in eliminating any crime related to children. Such establishment is the goal of a marriage in which the marriage itself has four (4) main objectives namely Dharma, Artha, Kama, and Praja that will lead to the birth of good children.

Abstract

This study specifically focusing on uncertainty and inconsistencies that faced on blood transfusion services caused by the existence of Blood Donor Unit and Blood Transfusion Unit led by existing norms on the statutory laws. The Act on Health, the Blood Service Government Regulation, and the Minister of Health Regulation No. 83/2014 assign blood services to the Blood Transfusion Unit. However, the existence of the Red Cross Law along with the Red Cross Government Regulation normalizes the task of providing blood services to the Blood Donor Unit, without confirming legal certainty for the Blood Transfusion Unit. This has triggered the issue of legal inconsistency towards those who carry out blood services, so a solution is needed through this study. This study is based on normative juridical legal research supported by a statutory approach as well as a legal conceptual approach. The results of this study are there are two options that can be formulated in the future, namely by basing the principle of legal preference lex posteriori derogate legi priori or based on the technique of formulating statutory norms according to the principle of clarity of formulation, certainty of the formulation of explanations, transitional provisions, closing provisions and phrases that selected in determining the executor of blood service duties.

Abstract

TRIPs requires members to arrange to any intellectual property rights in accordance with the conditions of each country, so that each state set the Geographical Indication (GI) varies. The different settings are potential conflicts between TRIPs member countries. So the research problem of this thesis is: How IG arrangements relating to cessation of the use of the registered mark is associated with a state's territory IG TRIPs Agreement? and legal actions for users How IG to a dispute between members of the TRIPs? Research using normative legal research methods approach: Statue Approach, Conceptual Approach, Comparative Approach, and Analytical Approach. Analysis of legal materials is done by descriptive analysis. The results showed that each WTO member countries set different. For example, the United States set up through the Trademark Law, Regulation & Legal ATF habits, countries under the European Union set up the European Community Regulation (EEC No.2081/92), Vietnam: Intellectual Property Law (Law No.50-2005-QH11), and others. In general, countries that determine protection through a first to file system. The use of registered GIs in the same marks or identical, Singapore set specifically in the Geographical Indications Act 44 of 1998, the Indonesian Though not set in isolation, but more specifically set in Trademark Law Article 56 (8) PP. 51 of 2007, Article 27 (1) and (2) termination of the use of signs to be discontinued within 2 years after the IG registered. The results also showed a lot of disputes going on in the field of IG Efforts settlement can be reached through WTO mechanisms if the parties to a dispute between the State by State with DSU procedures, WIPO mechanism is used if the dispute between the individual and the individual (state) with WAC procedures. National mechanisms such as in Indonesia through a lawsuit at the Commercial Court (Pengadilan Niaga).

Abstract

This paper aims to examine the relevance of regulating the Intellectual Property Guarantee Institution as credit to banks in Indonesia in the future. The research method in this paper uses normative legal research, with a statutory approach and developing doctrines, as well as a comparative approach. The result found from this paper is that there is a need for synergy in the guarantee legal system in Indonesia, particularly in regulating intellectual property valuation, including the urgency to form an institution that handles the valuation of movable objects of intangible intellectual property. This is very much needed in encouraging the creative economy which in turn improves the welfare of the Indonesian people. Tulisan ini bertujuan untuk mengkaji relevansinya pengaturan Lembaga Penilai Jaminan Kekayaan Intelektual sebagai kredit pada perbankan di Indonesia di masa mendatang. Metode penelitian dalam tulisan ini menggunakan penelitian hukum normatif dengan pendekatan undang-undang dan pendekatan doktrin-doktrin yang berkembang, serta pendekatan perbandingan. Hasil yang ditemukan dari tulisan ini adalah perlu adanya sinergitas dalam sistem hukum jaminan di Indonesia, khususnya pengaturan valuasi kekayaan intelektual termasuk urgensinya dibentuk sebuah Lembaga yang menangani valuasi benda bergerak tak berwujud kekayaan intelektual. Hal ini sangat dibutuhkan dalam mendorong ekonomi kreatif yang pada akhirnya meningkatkan kesejahteraan masyarakat Indonesia.

Abstract

The agreement is made to undertake a treatment for an illness, which resulted in the conclusion of a therapeutic contract under Laws as regulated under Article 1233 of the Civil Code of Indonesia (Kitab Undang-Undang Hukum Perdata). Every legal relationship will result in rights and obligations. Medical malpractice is usually caused by an unfulfillment of a patient’s basic rights because of the lack of communication or information, which are the basic rights of a patient. The dispute settlement through court system is unsatisfactory for either patient or doctor. Therefore, a dispute settlement that is considered ideal is through non-litigation process, which is mediation, to achieve win-win solution. Procedures for mediators to mediate such malpractice dispute are in accordance to seven principles, which are also regarded as the seven bbaasic philosophies of mediation for medical dispute, which are known as the principle of Iknemook. The contents of the Iknemook principle for mediator in medical malpractice dispute settlement through mediation are the problems in this research. This research aims to assess and study the seven principles of Iknemook for mediator in medical malpractice dispute settlement through mediation. This research is categorised as a library research with a specification of descriptive research, which is presented to explain Iknemook principles for mediator in medical malpractice dispute settlement through mediation. This research finds that the principles comprised of the principles of good faith of both parties, trust, neutrality, exclusivity of a mediator (med-power), open-mind, autonomy, and confidentiality.

Abstract

The development of the 5.0 era, namely the era of the internet of things, made Land Deed Maker Officials required to follow the development of digitalization, one of which was by making an electronic Land Deed Making Official deed. The purpose of this research is to examine and analyze the arrangement and strength of the proof of the deed which is made electronically. This study uses a normative legal research method with statute approach and an analytical approach. The study indicates that the arrangement for the deed of granting mortgage rights is made by the Land Deed Making Officer submitted in electronic form as stipulated in Article 9 paragraph (4) of the Minister of ATR/KBPN No. 5 of 2020 which is related to Article 86 of PP 18/2021, but is still experiencing a blurring of norms because it is not clear what PPAT deeds are made electronically so that they do not provide legal certainty, and the power of proof of deeds made electronically does not have the power of proof which is perfect as an authentic deed and cannot be used as legal evidence in court so that it cannot be enforced because it is not in accordance with the provisions of Article 5 paragraph (4) letter b of the ITE Law. Therefore, it is urgent to harmonize policies related to electronic deeds Perkembangan zaman era 5.0 yaitu era internet of things membuat Pejabat Pembuat Akta Tanah dituntut harus mengikuti perkembangan digitalisasi salah satunya dengan membuat akta Pejabat Pembuat Akta Tanah secara elektronik. Tujuan penelitian ini untuk mengkaji dan menganalisa pengaturan dan kekuatan pembuktian akta tersebut yang dibuat secara elektronik. Studi ini menggunakan metode penelitian hukum normatif dengan pendekatan Perundang-Undangan dan pendekatan Analisis. Hasil penelitian menunjukkan bahwa pengaturan akta pemberian hak tanggungan dibuat oleh Pejabat Pembuat Akta Tanah disampaikan dalam bentuk elektronik sebagaimana ketentuan Pasal 9 ayat (4) Permen ATR/KBPN No. 5 Tahun 2020 yang memiliki keterkaitan dengan Pasal 86 PP 18/2021, namun masih mengalami kekaburan norma karena belum jelasnya akta-akta PPAT apa saja yang dibuat secara elektronik sehingga tidak memberikan kepastian hukum, serta kekuatan pembuktian akta yang dibuat secara elektronik tidak memiliki kekuatan pembuktian yang sempurna selayaknya akta otentik serta tidak dapat dijadikan alat bukti yang sah di pengadilan sehingga tidak dapat diberlakukan karena tidak sesuai dengan ketentuan Pasal 5 ayat (4) huruf b UU ITE. Oleh karenanya, urgen harmonisasi kebijakan yang terkait dengan akta elektronik.

Abstract

This study aimed at defining the forms of disputes resolution conducted by the parties involved in peer to peer lending fintech business. article aims to analyze the forms of dispute resolution that can be taken by the parties in the peer to peer lending fintech business. This article uses normative legal research with statutue approach. The results show that the parties in the dispute on bad loans in the Peer to Peer Lending Fintech business can take two forms of dispute resolution, namely litigation and non-litigation. The litigation route is to file a simple lawsuit or by Parate Executie, while through the non-litigation route, it could yo use the Alternative Dispute Resolution Institution for the Financial Service Sector.

Abstract

The objective of this scholarly publication is to investigate and assess the Consumer Dispute Settlement Body's (BPSK) authority and the conclusive and legally binding nature of its decisions. This investigation employs normative legal research. The authority and responsibilities of the Consumer Dispute Resolution Agency (BPSK) are specified in Article 52 UUPK. The consumer dispute resolution body is obligated to render a final and binding decision within twenty-one (21) business days from the date of receipt of the lawsuit. This adheres to the provisions outlined in Article 54 paragraph 3 UUPK and Article 55. The ultimate and enforceable interpretation of a Consumer Dispute Settlement Agency decision is fundamentally distinct from that of a court institution's decision bearing the same meaning. This shows that the status and position of the Consumer Dispute Resolution Agency (BPSK) is assessed from an administrative perspective, it only has administrative authority. Therefore, it was deemed that the decision could not have judicial attributes. Consequently, BPSK may be categorized as a quasi-judicial institution, deviating in character from the principal court institutions in terms of the substance of its rulings. Therefore, in light of the BPSK decision's "final and binding" nature, it is possible to interpret it only as an agreement or agreement.
