Abstract

The implementation of the customary land management agreement between PT DutaPalma and Indigenous Peoples in Kuantan Singingi Regency is regulated in an agreementagreement in 1998 which states that PT Duta Palma will build oil palm plantations with theKKPA pattern and further regulated in Law number 39 of 2014 concerning Plantations. Articles58, 59, and 60 state that palm oil companies are required to provide 20 percent of the total landarea of business use rights for facilitating the development of community gardens. However,in fact PT Duta Palma did not fulfill either an agreement with indigenous peoples or did notimplement Law Number 39 of 2014 concerning Plantations. This is due to several things,including the unavailability of land for the development of the community land in question sothat this obstacle is the strongest reason for PT Duta Palma Nusantara not to obey the servicesmade. Therefore, it is necessary to study the first stimulant, the implementation of thecustomary land management agreement between PT Duta Palma Nusantara and the IndigenousPeoples of Kuantan Singingi Regency, Second, efforts that can be made so that the customaryland management agreement between PT Duta Palma Nusantara and the Indigenous Peoplesof Kuantan Singingi Regency can be implemented.This research is a sociological legal research, because it is based on field research,namely by collecting data from interviews, questionnaires, and literature studies that have arelationship with the problem to be studied assisted by primary, secondary and tertiary data.This research uses qualitative data analysis and produces descriptive dataFrom the results of the study, it was concluded that, First, the implementation of theagreement between PT Duta Palma Nusantara and indigenous peoples in Kuantan SingingiRegency was not fully implemented. Second, the lack of communication between indigenouspeoples and pt Duta Palma Nusantara and the local government or related agencies. Third, thefuture effort is to take the non-litigation or litigation stage so that this problem finds a solutionand does not drag on. The author's suggestion is, first, to ask PT Duta Palma Nusantara withhumility to remain obedient to the agreement that has been made secondly, local indigenouspeoples continue to maintain conduciveness by taking litigation and non-litigation steps, third,if PT Duta Palma still does not fulfill the agreement then the HGU should be reviewed whereit is handed back to indigenous peoples if the land Ulayat is included in the HGU of PT DutaPalma Nusantara.Keywords: Accord – Customary Lands – Indigenous Peoples

Abstract

Customary law is a living law because it embodies the real legal feelings of the people.According to Islamic law, adultery is any act or sexual intercourse (male genitals have enteredthe female genitalia) that are carried out outside of marriage. The application of customary lawagainst adulterers, especially in Tanah Bekali Village, Pangean District, Kuantan SingingiRegency. The main problems in this study are: first, what are the rules of adultery based on thecustomary law of the Tanah Bekali community, Pangean District, Kuantan Singingi Regency?Second, how is the settlement of adultery cases before carrying out a marriage in the village ofTanah Bekali, Pangean District, Kuantan Singingi Regency?This research is sociological legal research, namely research that is carried out directlyon the location or in the field to obtain data to provide a complete and clear picture of theproblem being studied, this research was conducted in Tanah Bekali Village, Pangean District,Kuantan Singingi Regency. The sample population is all parties related to the problems studiedin this study. The data sources used are primary data sources and secondary data. Datacollection techniques used, interviews and literature review.From the results of the study there are two main problems that can be concludedFirst, the Adat of Tanah Bekali Village, Pangean District, Kuantan Singingi Regency is anunwritten rule of life, customary sanctions or fines given to perpetrators of adultery accordingto customary law in Tanah Bekali village, namely Didoro or at 100 o'clock. sticks, married,ostracized from society, expelled from the village. Second, the problem of adultery in TanahBekali village is resolved with several levels of settlement that have been determined accordingto customary law in force in Tanah Bekali village, namely: family settlement or mamak soko,settlement by deliberation with Ninik Mamak and community leaders. To prevent the occurrenceof adultery, the ninik-mamak in Tanah Bekali village should be more active in guiding andteaching the applicable customary rules/stipulations, so that awareness and communitycompliance with customary rules will be created. It is better for the people of Tanah Bekalivillage to make village rules that prohibit teenagers or young people from carrying out activitiesuntil after 10 pm except for activities that are indeed held by the village or school, so that thingsdo not happen that are beyond our control and prevent damage to the younger generation..Keywords : Customary Law – Adultery – Customary Sanctions

mengenai masalah yang timbul, hal ini disebabkan agen masih kurang memahami perjanjian asuransi, sehingga masyarakat masih kurang paham dengan asuransi yang diikuti. Oleh karena agen itu harus membaca dan memahami isi perjanjian sehingga dalam menerangkan kepada tertanggung agen tidak salah dan tertanggung juga dapat memahami isi perjanjian tersebut.

Abstract

The existence of Law Number 42 of 1999 concerning Fiduciary Guarantees is expected to be able to meet legal needs that can further spur national development and guarantee legal certainty as well as provide legal protection for interested parties in guarantee law. In practice, there are differences in interpreting the executorial meaning in fiduciary guarantee certificates which often lead to vigilante actions (eingerichting) or coercion in the execution of goods that are fiduciary objects. The Constitutional Court through Decision Number 19/PUU-XVII/2019 conducted a review of Article 15 paragraph (2) and paragraph (3) of Law Number 42 of 1999 concerning Fiduciary Guarantees against the articles in the 1945 Constitution of the Republic of Indonesia. With this decision the Constitutional Court provide reconstruction of the meaning and significance of the executorial title as referred to in Article 15 paragraph (2) and paragraph (3). So that it has harmonized a fairer legal relationship between creditors (fiduciary recipients) and debtors (fiduciary givers).

Abstract

The basis for implementing land use in Indonesia is regulated in Article 33 Paragraph (3) of the 1945 Law, the article explains that everything regarding natural resources including land. Therefore, no one can interfere with someone's land ownership rights, where land tenure rights are a concrete legal relationship. Based on the author's observations, the problem regarding land disputes between PT RAPP and oil palm farmers in Dayun Village is that long-standing mutual claims to land rights have led to even greater conflicts. The purpose of this study was to obtain an overview of the factors causing the dispute between PT RAPP and the oil palm farmers of Dayun Village. And how to resolve land disputes between PT RAPP and oil palm farmers in Dayun Village. It is hoped that the disputing parties should pay attention to and also consider mediation efforts and also other solutions that can reconcile the two parties.

Abstract

Asuransi atau pertanggungan timbul karena kebutuhan manusia. Dalam Kehidupan manusia, sadar atau tidak pasti menghadapi risiko. Dengan perkembangan produk asuransi khususnya produk asuransi jiwa Unit link yang menggabungkan fungsi proteksi dengan investasi. Salah satu perusahaan asuransi yang menawarkan produk asuransi Unit Link ini adalah PT. Asuransi Jiwa Kresna dengan nama produk assuransi Jiwa Kresna Link Investa (K-LITA) Namun dalam perjalanannya perusahaan asuransi jiwa Kresna telah menyatakan gagal bayar akibat masalah likuiditas yang membelit perusahaan. Kasus gagal bayar yang dialami oleh PT. Asuransi Jiwa Kresna atau kresna Life berakhir dengan putusan pailit Mahkamah Agung (MA). Putusan ini tercantum dalam amar putusan MA Nomor 647 K/Pdt.Sus-Pailit/2021 pada tanggal 8 Juni 2021. Dalam penulisan ini penulis berfokus kepada analisis kedudukan Nasabah Asuransi dalam mengajukan Permohonan PKPU dan Kepailitan terhadap Perusahaan Asuransi pada putusan MA Nomor 647 K/Pdt.Sus-Pailit/2021. Adapun tujuan penulisan skripsi ini pertama untuk mengetahui Kedudukan Nasabah Asuransi dalam Mengajukan Permohonan PKPU dan Kepailitan terhadap Perusahaan Asuransi, Kedua untuk mengetahui upaya hukum Nasabah Asuransi setelah adanya putusan kepailitan Nomor MA 647 K/Pdt.Sus-Pailit/2021memperhatikan dan juga mempertimbangkan upaya mediasi dan juga solusi-solusi lainnya dapat yang mendamaikan kedua belah pihak.

Abstract

One of the financial institutions experiencing credit problems in the Pasir Pangaraian area is PD BPR Rohul. The number of customers in 2021 is 1170 customers with a loan amount of Rp. 37,091,711,617, where bad loans amounted to Rp. 2,388,181,879 of which agribusiness credit is the type of credit with the most bad loans, which is Rp. 1,600,782,615. The problems in this study are the factors that cause the occurrence of bad loans in the Agribusiness Sector at the Rokan Hulu Rural Bank Regional Company, how to resolve the Agribusiness Sector bad loans and the obstacles faced by the Rokan Hulu Rural Bank Regional Company in credit settlement. Agribusiness sector traffic jam. This research is a sociological research located at the Regional Company of BPR Rokan Hulu. The data sources used in this research are Primary Data, Secondary Data and Tertiary Data with Data Collection Techniques using Interviews and Library Studies. Based on the discussion, the authors conclude that the rights and obligations of each party based on the credit agreement include the ceiling and intended use of credit, term and schedule, interest rates, fees and administrative costs, insurance, power of attorney, guarantees, fines, interest in arrears, defaults, execution of collateral, change of domicile, notification, change, validity period, legal domicile and closing articles. Settlement of bad loans in the Agribusiness Sector at the Rokan Hulu Rural Bank Regional Company is carried out by rescheduling, reconditioning and liquidation. Obstacles faced by the Rokan Hulu People's Bank Regional Company in resolving bad loans in the Agribusiness Sector in the form of agribusiness businesses that are not managed properly, collateral sold privately, customers experience ongoing internal problems, customers are in debt, customers are difficult to communicate with, change addresses, influence PD BPR Rohul staff and customers avoid deliberations.

Abstract

Economically, most of the residents of RW O6 Tanjung Rhu Village, Lima Puluh District, are middle and lower class residents with irregular income because they do not have a fixed source of income as an economic support. Some residents work as freelance laborers with incomes below Rp. 3,000,000/month. Based on this, the Chairman of the RW and several residents are trying to find alternative businesses or activities that can be used as a source of income and family income. InSeptember 2020, the Mina Sari Jaya Fish Farmers Group (POKDAKAN) was formed, with a catfish farming business plan. Some of the problems experienced are the lack of knowledge and understanding of the Fish Farmers group related to legal aspects in the form of group legality, product legality and product innovation resulting from catfish farming, as well as the lack of optimal group understanding related to fishery aspects in the form of traditional aquaculture patterns so that they have not been able to provide additional income for the family economy. The activities that have been carried out are in the form of Legality Management of Catfish Farming Farmer Groups, increasing group understanding of legal and fisheries aspects through modernization of catfish farming, innovation of processed products made from catfish, namely Catfish nuggets, Halal Label Management and PIRT by-products. Abstract

Basically, ulayat land is a ulayat right for customary law communities,which according to customary law ulayat rights can only be owned together, usedtogether and used together. ulayat land may not be owned individually, becausebasically ulayat land cannot be sold, given, or pawned to anyone. However, inreality there are cases of selling ulayat land of the Malay Datuk Mudo by thenephew of the Malay tribe of Datuk Mudo. The purpose of writing: first : to findout the regulation regarding the transfer of ulayat rights of the Malay DatukMudo indigenous peoples according to customary law. Second : knowing how toresolve disputes over customary land of the Malay Datuk Mudo tribe according tocustomary law. This type of research can be classified in the type of sociologicalresearch. This research was conducted in Sei Jernih Hamlet, Pasir SialangVillage, Bangkinang District, Kampar Regency. The population and sample arethe parties related to the problems studied by the authors in this study. Collectingdata by interview method and library study.From the results of the research problem there are two main things thatcan be concluded. First: The ownership of customary land rights for the MalayDatuk Mudo indigenous peoples basically cannot be transferred or traded, ormortgaged, which has been explained by ninik mamak based on existingcustomary law regulations or based on national regulations that have been set. bythe Kampar Regency Government. Except based on the conditions and coercion ofthe customary leader through consultation with traditional officials, religiousscholars, and ninik mamak. Second: The dispute resolution carried out in thisstudy has reached the point of deliberation and consensus. In which thisdeliberation was carried out with traditional officials, ninik mamak, religiousscholars, government and the indigenous Malay tribal community, Datuk Mudo.However, the dispute over the customary land of the Datuk Mudo Malay tribe inKampar Regency has not been resolved.Key words: Transfer of ulayat rights- ulayat land

Abstract

Inheritance law is a body of regulations that governs the wealth left by the heir andthe effects of this transfer on those who inherit it, both in terms of their relationships with oneanother and with other people. All rights and duties are instantly transmitted to the heirsupon death. According to teachings, the Chinese ethnic community frequently appliescustomary law. The position of a tall boy is more assured. It has long been accepted amongthe indigenous Chinese population that only sons are entitled to the whole inheritance, whilefemales can only inherit jewels. In according to Article 131 IS, which applies to the CivilCode, the Chinese community is considered a population group for the purposes ofinheritance distribution. The goal of this thesis is to investigate the status of sons in thesystem of son inheritance in ethnic Chinese marriages and to learn about the system of soninheritance in ethnic Chinese marriages based of justice.This type of research is empirical research. Basically, it is a comparative studybetween legal ideals and legal reality in the form of actions (law in action). The data sourcesused consist of primary legal materials, secondary legal materials and tertiary legalmaterials. Data collection techniques in this study were carried out by interviews andliterature studies by taking quotations from the literature that had links with the problems ofthis research.The results of the research conducted, there are several conclusions obtained,namely: First, Chinese customs do not regulate in writing regarding the position of children,in practice the position of sons in ethnic Chinese is higher than that of women which iscarried out from generation to generation. Second, justice can be guaranteed from thebinding nature of codified civil regulations in the process of resolving cases of inheritancedistribution in ethnic Chinese communities.Keywords: Inheritance System – Chinese – Boy Position.
