Abstract

The implementation of the cooperation agreement is the process and method of carrying outthe agreement or agreement of the parties to do something that gives rise to a relationship of rights andobligations of the parties in achieving common goals. Channeling comes from the word channel, whichmeans flowing, forwarding. Liquefied Petroleum Gas, hereinafter referred to as LPG, is a liquefiedhydrocarbon gas under pressure to facilitate storage, transportation and handling, which basicallyconsists of propane, butane or a mixture of both. The purpose of this thesis writer, first is to find out theimplementation of the cooperation agreement for the distribution of 3 kg LPG between agents of PT. SariBumi Raya with D'Hutawest base. Second, to find out the settlement of disputes in the cooperationagreement for the distribution of 3 kg LPG between agents of PT. Sari Bumi Raya with D'Hutawest base.This type of research is sociological legal research or is called empirical legal research.Sociological legal research is legal research that is intended to study and analyze the operation of law insociety, which is manifested in the legal behavior of society. This research was conducted at theD'Hutawest base which is located in the Sukamulia Village, Sail District, Pekanbaru City, Riau. Thesample and population in this study are representatives of PT. Sari Bumi Raya employees andD’Hutawest base owners. Sources of data obtained based on primary and secondary data, data collectiontechniques in research using interviews and literature review.The result of this research, there are two things that can be concluded, the first is theimplementation of the cooperation agreement for the distribution of 3 kg LPG between the agents of PT.Sari Bumi Raya with the D'Hutawest base was not fulfilled. The D'Hutawest Base is said to be included ina default where the debtor fulfills the performance, but not as it should. Second, the settlement of disputesin the cooperation agreement for the distribution of 3 kg LPG between agents of PT. Sari Bumi Raya withthe D'Hutawest base, namely by using an out-of-court settlement is negotiation. The author's suggestion,to the agents of PT. Sari Bumi Raya is expected to be more able to provide direction or socialize aboutthe distribution of 3 Kg LPG like what is good and right to the D'Hutawest base even though there arerules that are not listed in the cooperation agreement.Keywords: Implementation, cooperation agreements, agent, base

Abstract

Infrastructure development in this case the highway itself is still very much needed asa means of supporting land transportation to help the economy in the community. Theincreasing volume of commercial land transportation vehicles (motorbikes, cars), publictransportation (buses, minibuses) and freight transportation (trucks) certainly requires alot of land / land so that there is no overcrowding of vehicles, especially during peak hoursthat occur sustainably. In carrying out this infrastructure development, parties who needland can use the other party's land rights by seeking approval from the land rights holder.Parties who need land can be pursued through the transfer of rights in the form of buyingand selling, or the release of land rights by the holder by providing compensation by theparties who need the land to the holder of the land rights. To anticipate land disputes andconflicts that will occur, legal tools and a neat and orderly land administration system areneeded, so as to guarantee and be able to provide legal protection to land rights ownersand can regulate the ownership, transfer and allotment of land in a fair andcomprehensive manner.Research using a type of Empirical Juridical research or Legal Sociology research isan approach used to see something legal reality in society. The Sociology of Law approachis an approach used to look at legal aspects in social interaction in society and serves as asupport for identifying and clarifying findings of non-legal materials for the purposes oflegal research or writing.From the results of the first study, the implementation of the provision ofcompensation to land rights holders based on convoluted Consignment Decisions cannotbe proven due to misunderstandings starting from the preparation stage, implementation,to submission of results and the implementation of the compensation process has beencarried out in accordance with laws and regulations. The lack of public understanding andthe laws governing the reference point of land assessment make this compensation processtime-consuming and do not show transparency of justice in question. Secondly, Theimplementation of compensation is hampered because there are parties who refuse theamount of compensation offered by the land acquisition implementation team with theresults of calculations from an independent. Abstract

Ninik mamak bertanggung jawab terhadap permasalahan yang terjadi dalam masyarakat. Termasuk juga harta pusaka yang dimiliki oleh kaumnya (tanah) Dalam hal ini dikatakan sebagai kewajiban penghulu, seperti kata pepatah: “kusuik manyalasaikan, karuah mampajaniah. Dalam adat Minangkabau dengan menempatkan pemangku adat sebagai pelaksana dari kebenaran yang memposisikan musyawarah mufakat. Keadaan sekarang peran dan tanggung jawab ninik mamak dan peradilan adat sudah mulai di abaikan dan mengandalkan hukum nasional, hal ini dilakukan beberapa pihak untuk mendapat kekuatan hukum. Adapun tujuan pertama Untuk mengetahui peran ninik mamak dalam menyelesaikan sengketa tanah ulayat menurut hukum adat, kedua Untuk mengetahui faktor penyebab terjadinya pergeseran peran ninik mamak dalam menyelesaikan sengketa tanah ulayat di Nagari Koto Tangah Kecamatan Tilatang Kamang Kabupaten Agam, ketiga Untuk mengetahui upaya agar peran ninik mamak hidup kembali dalam menyelesaikan sengketa tanah ulayat berdasarkan hukum adat yang berlaku di Nagari Koto Tangah Kecamatan Tilatang Kamang Kabupaten Agam. Metode   yang   digunakan   pada penelitian   ini   adalah   metode   kualitatif   dengan   pendekatan deskriptif. Hasil  dari  penelitian  yaitu Peran Ninik Mamak dalam Menyelesaikan Sengketa Tanah Ulayat berdasarkan Hukum Adat telah bergeser karena salah satu pihak tidak mengikuti adat Minangkabau sesuai dengan azas bajanjang naiak batanggo turun dan menggugat ke pengadilan untuk mendapatkan ketetapan hukum sehingga peran ninik mamak di sini diabaikan.

Abstract

Land has an important role for human life because human life cannot be separated from land.In the regulations that have been set forth in Article 10 paragraph 1 of Law number 5 of 1960concerning Basic Agrarian Regulations it stipulates that: "Every person and legal entity that has aright to agricultural land is in principle obliged to work or actively cultivate it himself by preventextortion. According to the Basic Agrarian Law, it expressly prohibits land aggregation. The aim is tofind out the factors of the occurrence of guntai land (absentee) in Gunung Toar District and to find outthe Prevention Efforts Against Guntai Land Ownership (absentee) in Gunung Toar District.The research method is an important factor for scientific writing. A scientific work must containtruth that can be accounted for scientifically so that the results of the scientific work can approach areal truth. Legal research is carried out in the context of efforts to develop law and respond to newlegal issues that are developing in society. Without legal research, legal development will not beoptimal. The author uses a type of sociological or empirical legal research. Sociological research isresearch on law observing what are the characteristics of a community's behavior in an area in anaspect of social life. The location of the research conducted by the author is in Gunung Toar District,Kuantan Singingi Regency because in Gunung Toar District there is still absentee land ownership.Laws and regulations as guidelines for the implementation of clear and firm regulationsregarding restrictions on land ownership which are increasing on the control of agricultural land. Inarticles 12 and 13 of the UUPA the government in the agrarian field which is monopoly can only becarried out by law. Kuantan Singingi Regency, especially in Gunung Toar Subdistrict, there are stillmany absentee/guntai lands. So far, the Defense Office has indeed not done anything concrete tosupport the effectiveness of the ban on absentee/guntai land ownership. The results of the interview withMr. Riko Syahrudin S.H explained that there were several steps that had been taken by the ATR/BPN ofthe Kuantan Singingi Regency in carrying out prevention and control of agricultural land by people orfamilies who lived outside the area where the land was located or also called absentee/guntai land. Inline with the objectives to be achieved through the Defense Orderly Chess program, especially defenseand orderly use of land, the Agrarian Spatial Office/National Land Agency of Kuantan SingingiRegency has made efforts, namely: law enforcement by holding directed and widely continuous legalcounseling.Keywords: Land, Guntai (Absentee), Ownership.

Abstract

In managing the administration of marriage, in addition to the conditionsstipulated in the Marriage Law in Nagari Simpang Lama Inderapura, theprospective bride and groom who are about to marry must be granted the writtenapproval for marry from the Ninik Mamak. This requirement is based on theadditional rules of Nagari Simpang Lama Inderapura which require writtenapproval from the Ninik Mamak for the marriage of his nephew's child that tookplace before they register their marriage to the authorized Office of ReligiousAffairs. Without the written approval from the ninik mamak, the Walinagari officeas the party to create the marriage recommendation letter for the KUA will notfurther process the administration of the marriage file before the marriage permitis completed from the ninik mamak.The purpose of this study was to find out the implementation of marriagein Nagari Simpang Lama Inderapura and to find out the role of ninik mamak inmarriages in Nagari Simpang Lama Inderapura. The type of research for thisthesis is sociological legal research, namely research conducted directly onlocation or in the field to obtain data to provide an overview completely andclearly about the problem under study. The location of this research wasconducted in Nagari Simpang Lama Inderapura. Data collection techniques inthis study were interviews and literature review. The collected data is thenanalyzed qualitatively using the deductive method, namely drawing conclusionsfrom things that are general in nature to be specific.From the results of the research conducted, it can be concluded thatfirst.in the marriage administration needs, aside of the conditions stipulated in theMarriage Law, every niece's who is about to marry in Nagari Simpang LamaInderapura need to seeking for a written marriage approval from the ninikmamak. In practice, without a marriage license from the ninik mamak, the KUAwill refuse to carry out the marriage because this marriage license is as importantas other marriage conditions. Second,the role of the ninik mamak in marriage aasa tribal or clan leader cannot be ignoret. Abstract

Non-perfomance of contract is a condition where one or both parties bound in an agreementnot carrying out obligations or achievements according to what is written in the agreementthat has been agreed upon. In this case, the seller or the housing developer named PT.Cahaya Meranti Internasional (CMI), committed a Non-perfomance of contract against thebuyer (member of the Meranti Islands community). In this case, the seller does not return thefunds deposited to them, while based on the agreement the funds deposited by the buyershould be returned up to 100% excluding administrative fees if the mortgage applicationsubmitted is rejected by the bank. This study aims to determine the Implementation of theHousing Purchase Agreement between the Seller and the Buyer and to find out the legalremedies for the Housing Buyer in Requesting a Refund Against the Seller who Admitted Non-perfomance of contract.The type of research used by the writer is sociological research where the writerdirectly conducts research at the location or place under study to provide a complete andclear picture of case. The population and sample in this study are Marketing Supervisors atPT. CMI and Housing Buyers in the Meranti Islands.The results of the analysis in this study show that the implementation of the housingbuy and purchase agreement between the seller and the buyer is not carried out properly inaccordance with the agreement. The failure in following the agreement was caused by Non-perfomance of contract comitted by the seller, in which case the seller should return the fundsthat have been deposited in full if the buyer submits a cancellation, if the reason for thecancellation is due to a refusal of credit from the Bank. Until now, the seller has not fulfilledits obligation in returning the initial deposit from the buyer, which has resulted significantlosses experienced by the buyer. As a solution, the buyer have used legal efforts in form ofthe dispute resolution method outside the court for requesting a refund from the seller, PT.CMI, who admitted the Non-perfomance of contract. Moreover, the buyer has made efforts tonegotiate with the assistance and mediation from the Meranti Resort Police. Abstract

PT. Mitra Dinamis Sejahtera is one of the largest private companies in Batam City and isa specialist fire safety company providing fire faucets, fire alarms, emergency lifeboats and fireextinguishers. Regarding the labor quota that must be met by PT. Mitra Dinamis has employed 2people with disabilities, but there are several rights that have not been fulfilled. In Law Number13 of 2003 concerning Manpower Article 67 Paragraph (1) stipulates that employers who haveworkers with disabilities are required to provide protection according to the type and degree oftheir disability. This form of protection includes providing accessibility, providing work toolsand personal protective equipment. In an effort to protect, respect, promote and fulfill the rightsof persons with disabilities. In fact, the company has not provided protection such as theprovision of accessibility, hearing aids, special ladders for disabilities, and personal protectiveequipment.This research is a type of empirical research or sociological legal research. Sociologicallegal research is research that is carried out directly on location or in the field to obtain data toprovide a complete and clear picture of the problem under study. Data collection was carriedout using interviews, questionnaires and conducting literature studies using both books and datafrom the internet in the form of articles related to this writing.The author concludes that companies have not fully provided protection for workers withdisabilities. the company only provides protection in general and there are inhibiting factorssuch as internal companies, indecisiveness of Batam City Government, Lack of Knowledge, andBudget. Furthermore, the authors provide suggestions that the Government, companies andsociety must change the anti-discrimination stigma against persons with disabilities, byproviding motivation to do work like other workers. There needs to be cooperation between thegovernment and companies to carry out the fulfillment of special rights for workers withdisabilities. As well as the need for quality improvement in fulfilling the rights of workers withdisabilities, in addition to education and training, it can be carried out by giving directions fromcompany leaders or from the government. Abstract

Intellectual Property Rights have a fairly broad scope, including brands. Brands have animportant role in identifying the goods or services of a particular seller or group of sellers anddistinguishing them from the goods or services produced. Thus, it is very important to registerthe trademark of the Ministry of Law and Human Rights Cq. Directorate General ofIntellectual Property in order to obtain legal protection. Mark provisions are regulated in theLaw of the Republic of Indonesia Number 20 of 2016 concerning Marks and GeographicalIndications. Article 72 to Article 79 regulates the abolition and cancellation of registeredmarks on the initiative of the minister. However, if this action is not carried out based on theapplicable laws and regulations, it can lead to unlawful acts.This research is a normative legal research with a normative juridical approach bycritically analyzing the cancellation and abolition of the I AM GEPREK BENSU SEDEPBENER brand by the Ministry of Law and Human Rights Cq. Jakarta Directorate General ofIntellectual Property which does not implement decision Number 56/Pdt.Sus-HKI/Merek/2019/PN Niaga Jkt.Pst Central Jakarta Commercial Court which has permanentpower (incraht).The results of this study show the first: the act of canceling and deleting the I AMGEPREK BENSU SEDEP BENER brand belonging to Yangchent from the general list ofbrands by the Ministry of Law and Human Rights Cq. Jakarta's Directorate General ofIntellectual Property has administrative defects and has resulted in unlawful acts. In DecisionNumber 56/Pdt.Sus-HKI/Merek/2019/PN Niaga Jkt.Pst the Central Jakarta Commercial Courthas decided that Yangchent is proven to be the first owner of the I AM GEPREK BENSUSEDEP BENER brand which is officially registered in the general register of marks andordered to carry out cancellation and deletion of the GEPREK BENSU mark, the owner ofRuben, from the general register of marks. In principle, the court's decision is a reflection ofthe values of justice and the essential truth with sufficient evidence and facts. Second: the act ofdeleting and canceling the I AM GEPREK BENSU SEDEP BENER brand by the Ministry ofLaw and Human Rights Cq. The Directorate General of Intellectual Property of Jakartaresulted in the mark being removed from the general register of trademarks, the end of legalprotection for the mark, the end of cooperation with the licensee of the mark, the occurrence ofmaterial and immaterial losses of the brand holder. Thus the business development of PT. Abstract

Same-ethnic marriage is a ban on marriage in the indigenous people of Tambak Village,Langgam District. This is because the customary law system views same-ethnic marriages asmarriages that occur within one family or one breastfeeding. The indigenous people of Tambak,Langgam District, are still guided by the fatwas from their ancestors. So in this case the indigenouspeople in Tambak Village, Langgam District, still prohibit same-tribe marriage. The purpose of thisthesis research is first, the factors that cause same-tribal marriage in indigenous peoples in TambakVillage, Langgam District, Pelalawan Regency. Second, settlement of violations of the prohibitionon same-tribal marriages committed by traditional leaders in the indigenous people of TambakVillage, Langgam District, Pelalawan Regency.This type of research can be classified into the type of sociological juridical research. Withthe research location in Tambak Village, Langgam District, Pelalawan Regency. While thepopulation and sample are parties related to the problem under study. This study used primary datasources and secondary data and data collection techniques were carried out by means of interviewsand literature review.The results of the research conducted by the author are, First, the causes of one-tribemarriage in indigenous peoples in Tambak Village, Langgam District, Pelalawan Regency arecaused by a lack of understanding of customs and tribes in Tambak Village, Langgam District,Pelalawan Regency; decreased public compliance; Affection and mutual love; law is defeated bytime; Because in Islamic law there are no rules governing the prohibition of same-ethnic marriages.Second, the settlement of violations of the prohibition on same-tribal marriages perpetrated bytraditional leaders in the indigenous people of Tambak Village, Langgam District, PelalawanRegency can be carried out by means of the customary leader (datuk shoot inner/penghulu) carryingout clarification of couples who violate customary same-tribal marriages; listen to explanations orclarifications by perpetrators of ethnic marriage offenders; customary leaders will deliberate toreach a consensus/decision; after finding a consensus, the traditional leader conveys the customarysayings and inner shoots conveys their attitudes and decisions; sanctions for violators of sameethnic marriages, namely expulsion from the village; if the violator asks for forgiveness, he must pay1 (one) buffalo along with other equipment; paying customary fines by feeding 1 (one) Nagari; ifthe customary fine has been paid, the offender of the same ethnic marriage has been reinstated. This Geographical Indication Protection Objectincludes Natural Resources, handicraft products, industrial products owned by an area but notowned by other regions in the Territory of the Unitary State of the Republic of Indonesia. Thistype of protection for Geographical Indications has the peculiarity of other IntellectualProperty Rights Protection, which is characterized by communal ownership and usuallyidentifies the area as its trademark. In writing this thesis, the author tries to examine the Socio-Economic Influence on the Protection of the Rights of Geographical Indications of SumatraLintong Arabica Coffee.The objectives of writing this thesis are: first, to find out the Socio-Economic Effects inProtecting the Rights of Geographical Indications of Sumatra Lintong Arabica Coffee inHumbang Hasundutan Regency. Second, to find out the Efforts That Can Be Taken in Obtainingthe Protection of the Rights of Geographical Indications. The research method in this thesisuses a type of sociological legal research, namely research on the effectiveness of laws that livein society. The nature of this thesis research is research descriptive which describessystematically, the facts and characteristics of the object studied appropriately. The data sourceused is the data source first, seconds and tertiary, the data collection technique in this studywas by interview method, and literature review, then after the data was collected, it was thenanalysed to draw conclusions.Based on the results of the research, the first conclusion can be drawn. The socio-economic impact that occurred on the coffee farmers of the Sumatran Lintong Arabica CoffeeObserver Community (maspekal) as the owner of the right to the geographical indication ofSumatera Lintong arabica coffee is a change in people's lives from previously woodendwellings to semi-permanent and permanent, changes to agricultural management frompreviously only simple tools and using machine tools to help improve farming care and yields,especially coffee. Second, violations committed intentionally and unintentionally must bepursued by legal remedies to prevent further losses to the Sumatra Lintong Arabica CoffeeObserver Community in accordance with Law Number 20 of 2016 concerning Marks andGeographical Indications.Keywords: Geographical Indication-Legal Protection-Legal Remedies.
