Abstract

Article 20 of Law Number 10 of 2009 concerning Tourism states that everytourist has the right to obtain accurate information about tourist attractions,tourism services that meet standards, legal and security protection, health services,protection of personal rights, and insurance protection against risks. . tourismactivities. tall. The purpose of writing this thesis are: First, to determine theresponsibility of tourism entrepreneurs Bukit Selancang to the safety of touristsbased on Law Number 10 of 2009 concerning Tourism. Second, to find out theobstacles of tourism entrepreneurs in carrying out their responsibilities towardstourists in Bukit Selancang. The type of research used is empirical or sociologicallegal research, because in this paper the author conducts research at the locationor place under study in order to provide a complete and clear picture of the problemunder study. The data sources used are primary data and secondary dataThis research was conducted in Bukit Selancang, Aur Cina Village,Indragiri Hulu Regency. The population and sample in this study were SelancangHill tourists and selancang hill tourism entrepreneurs, and the sources used weresecondary data and primary data. Data collection techniques by means ofinterviews and the data obtained were then analyzed qualitatively. The conclusionthat can be drawn from the results of the First Research, because it refers to severalcases that occurred such as tourists being injured due to inadequate facilities, lossof goods in the form of helmets, in this case the tourism entrepreneur is notresponsible for the losses suffered. by tourists. All these losses must be borne by thetourism entrepreneur Bukit Selancang. Second, the constraining factors that affectthe legal responsibility of Bukit Selancang tourism entrepreneurs in Aur CinaVillage for accidents or losses experienced by tourists are the lack of publicawareness, inadequate facilities or infrastructure and weak supervision from thegovernment.Keywords : Responsibility, Tourism Entrepreneurs, Tourist safety

Abstract

This study aims to find out how the procedure for implementingmortgage auctions is carried out and to find out the obstacles in the process ofimplementing mortgage auctions at the Pekanbaru State Property and AuctionService Of ice. The type of research used is Sociological Law research, Sociologicalresearch with primary and secondary data types using qualitative data analysistechniques. The results of this study are first to find out the auction procedure formaterial guarantees that have been tied with mortgages as part of the executionof debt guarantees by a creditor who has been guaranteed by the debtor andinstalled Mortgage by the creditor. Second, to find out and analyze the Obstaclesin the Implementation of the Auction of Mortgage Objects Based on PMK Number213/PMK.06/2020 concerning Instructions for the Implementation of Auctions. Suggestions that the author can give in this research: Firstly, PekanbaruKPKNL and Auction Of icials in carrying out auctions can verify more carefullythe object to be executed. Comprehensive initial verification in terms of theprocess that has carried out the imposition of mortgage rights by creditors canminimize pre-auction and post-auction problems. Abstract

Learning Media is everything that can be used to convey messages or information in the teaching and learning process so that it can stimulate students' attention and interest in learning. The problem found at SDN 012 is the limited learning media in supporting the teaching and learning process so that it causes children's development and understanding to be less than optimal, such as children having difficulty in recognizing the alphabet and understanding mathematics lessons. This Kukerta activity aims to help students at SDN 012 Pasir Utama Village in recognizing the letters of the alphabet and understanding the divisional material taught in schools. Smart Board and Reading Board Learning Media are strategies used to make it easier for students and students to understand and improve their knowledge. Smart Board media is used in division materials that aim to make it easier for grade 4 students of SDN 012 Rambah Hilir to understand mathematical sciences, especially in division, while reading boards aim to help students, especially grade 1, in alphabet letter recognition and word-to-word spelling.

Abstract

Implementation of legal protection for wages of workers/laborers in employmentrelations is urgently needed, bearing in mind that the socio-economic position ofworkers/laborers is very weak, especially during the Covid 19 pandemic. Manycompanies have ignored workers' rights, including the fulfillment of wages whileundergoing self-isolation which means workers are in the process of healing whose rightsare protected under the provisions of Article 40 of Government Regulation Number 36 of2021 concerning Wages which mandates that every worker/laborer who does not workdue to illness, his wages are still paid in full.This research is classified as a sociological research type, because it directlyconducts research on the locations or points examined to provide a complete and clearpicture of the problems examined. This research was conducted in Pekanbaru City withsources from the Riau Province Manpower and Transmigration Office, while the samplepopulation was Covid-19 survivors who experienced wage deductions while undergoingindependent isolation. Sources of data used, primary data and secondary data, datacollection techniques in this study by interviews, literature review, and data analysis.The results of this study are as follows: First, that the implementation of legalprotection against wage deductions experienced by workers who are survivors of Covid19byemployersinseveralcasesinPekanbaruhasnotbeenfulfilledinaccordancewiththeprovisions of Article 40 of Government Regulation Number 36 of 2021 concerningWages. In practice, 8 out of 21 employers have deducted survivor workers' wages fromthe basic wages, because workers undergo independent isolation for 15 days. Second,efforts to resolve disputes between workers and employers can be carried out throughbipartite negotiations. If viewed from the concept of dispute resolution theory,negotiations must proceed equally, must not proceed as normal internal negotiations bynot considering the condition of workers who experience illness. It is necessary to beaware that employers/employers and workers in implementing work agreements must bein accordance with legal protection based on Article 40 of the Government Regulation onWages which mandates that every worker/laborer who is not working due to illness, hiswages must still be paid in full and understand the concept of dispute resolution and thebipartite negotiation mechanism in accordance with the provisions of Article 6 of LawNumber 2 of 2004 concerning the Settlement of Industrial Relations Disputes also inorder to produce mutually beneficial agreements for both parties, in particular workersmust join a trade union.

Abstract

The majority of Keranji Guguh Village's residents work in the agricultural sector, which looks after a land area of 805.42 Ha. The product produced is palm oil, while the production of vegetable crops is very low. In addition, the majority of the land near residents' homes is underutilized. This is due to the lack of public interest and knowledge about vegetable cultivation. The purpose of this program is to provide skills for the residents of the village of Keranji Guguh to use the hydroponic system. Hydroponics is a plant cultivation technique that uses water as a growing medium. The activity method is carried out by counseling and practicing how to plant with a hydroponic system. The events held in the village of Keranji Guguh were successful, and the participants could clearly grasp the idea of hydroponic vegetable cultivation using a wick system. As a result, empty yards can be used to grow vegetables.

Abstract

This study aims to determine the implementation of the Lend-UseAgreement between the first party and the second party, and efforts to resolvedisputes in the Lend-Use Agreement between the first party and the second partybased on civil law. This research is useful theoretically and practically. The typeof research is sociological juridical law research. Based on the results of the study,it was shown that the implementation of the Lend-Use Agreement between theFirst Party and the Second Party was carried out verbally with the object of theagreement being foodcrop land. In the agreement, it was agreed that the mainprovisions were that the Second Party was only allowed to plant foodcrops. Theagreement that has been made above has explained the existence of the partiesrelated to the rights and obligations of each party, on that basis the agreement thathas been made between the two parties has fulfilled the legal requirements of theagreement as stipulated in Article 1320 of the Indonesian Civil Code. However, inits implementation, the Second Party does not follow the agreement that has beenmade, resulting in a default. The settlement of disputes between the first party andthe second party in the Lend-Use Agreement in Berumbung Baru Village, DayunDistrict, Siak Regency has been carried out through non-litigation and litigation.However, these efforts could not solve the problem. The inhibiting factors forresolving land-borrowing disputes through mediation and litigation are notresolved because there is no goodwill from the Second Party, and this causes theproblems that have occurred to date have not been resolved.Keywords: Dispute - Agreement - Lend Use Agreement - Private Law

Abstract

This research is related to the Fulfillment of Women's Inheritance Rights in the Patriarchal Culture of the Toba Batak Tribe in Untemungkur Village. Fulfillment of women's inheritance rights in fact has not been appropriately fulfilled. This happens because of the patriarchal culture that is still ingrained in people's lives, especially the Toba Batak whose heirs are men and not women. The research method used is a type of sociological legal research. The research location was carried out in Unte Mungkur Village, Muara District, North Tapanuli Regency. The data sources used are primary data and secondary data. Data collection techniques in this study were questionnaires, interviews, literature review, and ended with a deductive thinking method. The first result of this study is that the fulfillment of women's inheritance rights in the patriarchal culture of the Batak Toba tribe in Unte Mungkur Village, North Tapanuli Regency, has not fulfilled the values of justice for women. Second, obstacles to fulfilling women's inheritance rights in the patriarchal culture of the Toba Batak tribe in Unte Mungkur Village are caused by patriarchal culture and the presence of habataon (for example Batak) burdens on women. Family law and inheritance can be developed towards a parental/bilateral legal system so that men and women are given equal status and several matters in customary regulations must be corrected to fulfill human rights and elements of justice for all regardless of gender.

Abstract

The Riau Provincial Government through the Head of Village (Lurah) has issued a Land Certificate (SKT) and a Certificate of Compensation (SKGR) as documents used by land owners to apply for land ownership registration in reference to the provisions of Articles 23 and 24 of Government Regulation Number 24/1997 on Land Registration. However, referring to Government Regulation Number 24/1997 on Land Registration, it is not explicitly stated that there is an obligation for Lurah to issue those types of land ownership certificate mentioned above. In previous years, the public's interest to process land ownership certificates in the Regency/City Land Agency in Riau is still lacking. The people are under the impression that land ownership certificate in the form of SKGR is enough to justify the legality of the land ownership. Referring to that condition, there was a case in Riau Province in which an Indonesian citizen who had land ownership status only in the form of SKGR happened to renoune his citizenship. Based on the problems stated above, the author would examine the legal analysis of land ownership in the form of SKGR for Indonesian citizens who renounced citizenship. Abstract

Good faith is fundamentals in every contract, without which a contract will find it difficult to achieve its goals. In 2019, through a contract made before a notary in the hall of Kampar Regent Office, Kooperasi Nenek Eno Senamanenek and PT. Perkebunan Nusantara IV start a new beginning after a long period of dispute over Senamanenek community’s customary land. The good faith in fulfillment of contract between KNES and PTPN V would affect the legal relationship between these two parties. For KNES, the realization of the clauses within the contract will affect senamanenek community who become the member of the cooperative. The contract object was a palm oil plantation owned by the cooperative member. This empirical legal study scrutinized the implementation of good faith in the contract between KNES and PTPN V By identifying the law and the effectiveness of legal principles in the community. It took place in Kampar Regency. Primary, secondary, and tertiary data were collected through interviews and literature review. This study concludes that the good faith has not been fully implemented in the contract between PTPN V and KNES due to legal and non-legal factors. Therefore, both parties are suggested to possess a good faith in all stages of the contract-making process, from the pre-contract, contract, and post-contract stages. They are also suggested to minimize factors inhibiting good faith in the contract.

Abstract

Many foreigners come to Indonesia to settle in the country, but are limited in their needfor housing and land. According to Indonesian law, foreigners cannot own property rights toland in Indonesia. Thus, foreigners choose a shortcut using a nominee agreement which isindicated as legal smuggling. Seeing the existence of foreign elements in the civil relations thatoccur, and the act of legal smuggling (wetsontduiking) which falls into the realm of PrivatInternational law (PIL). The purpose of this research is to find out the aspects of PIL in thepractice of nominee agreements on land by foreigners and to find out the legal consequencesof controlling land ownership rights carried out by foreigners through nominee agreements inIndonesia from an PIL perspective by first examining the legal force of nominee agreements.The results of this normative legal research are, nominee agreement is an agreementcontaining international aspects made between Indonesian citizens and someone whoaccording to the law cannot be the subject of property rights, namely in order to control landwith property rights. Nominee agreement is a form of legal smuggling to avoid the provisionsof Article 21 paragraph (1) in conjunction with Article 26 paragraph 2 of the UUPA. Based onArticle 1320 of the Civil Code, the nominee agreement does not fulfill the halal causa, so thatthe legal consequences are null and void.
