Abstract

Abstract: The practice of marital rape or known as marital rape is a discussion that is often considered a contradictio in terminis which is interpreted as a combination of contradictory words, because currently rape is limited outside marriage. Rape in marriage is a form of inequality in gender justice, the assumption is that men/husbands have an autonomous right to force their wives to have sex, while women/wives are legitimized by construction to devote themselves to accepting whatever is done in marriage. This should not be in line with what has been regulated in the Marriage Law, which basically states that the purpose of marriage is to form a happy and eternal family (household) based on the One Godhead. Marital rape can be defined as coercion of sexual activity by one party without regard to the other party. The purpose of this study is to explain the basis for regulating marital rape in positive law in Indonesia and Islamic law. The research method used is juridical-normative, namely research by analyzing the provisions of laws and regulations relating to marital rape by connecting the basic arrangements in Islamic law. The results of this study indicate that domestic rape or known as marital rape is part of sexual violence in the household as regulated in the PKDRT Law. Meanwhile, in Islam the essence of marriage is interpreted as mistaqan ghalidzan or a sacred and strong bond, then the practice of forced sexual intercourse is considered an inequality of rights and obligations of sexual relations in marriage. Islam teaches the principle of mu'asyarah bil ma'ruf, namely a good and voluntary relationship. in having sexual relations by not monopolizing sexuality in the name of religion because it is clearly against the Shari'a.Absktrak: Marital rape menjadi pembahasan yang sering dianggap sebagai suatu contradictio in terminis, karena pengaturan hukum tentang pemerkosaan masih terbatas di luar perkawinan. Pemerkosaan dalam perkawinan merupakan bentuk ketimpangan keadilan gender, anggapan bahwa laki-laki/suami memiliki hak otonom untuk memaksa istri berhubungan seksual, sedangkan perempuan/istri dilegitimasi konstruksi untuk mengabdikan diri menerima apapun yang dilakukan dalam perkawinan. Hal ini seyogyanya tidak selaras dengan UU Perkawinan yang pada pokoknya menyebutkan bahwa tujuan perkawinan ialah membentuk suatu keluarga (rumah tangga) yang bahagia juga kekal berdasarkan Ketuhanan Yang Maha Esa. Tujuan penelitian ini adalah untuk menjelaskan dasar pengaturan marital rape dalam hukum positif di Indonesia dan hukum Islam. Metode penelitian yang digunakan ialah yuridis-normatif yakni penelitian dengan menganalisa ketentuan peraturan perundang-undangan berkaitan dengan marital rape dengan menghubung­kan dasar pengaturan dalam hukum Islam. Hasil penelitian ini menunjukan bahwa pemerkosaan dalam rumah tangga atau dikenal sebagai marital rape merupakan bagian dari kekerasan seksual dalam rumah tangga sebagaimana yang telah diatur dalam UU PKDRT. Dalam perkembangannya, RUU KUHP juga mengatur tentang marital rape. Sedangkan, dalam Islam hakikatnya perkawinan di­mak­nai sebagai mistaqan ghalidzan atau ikatan yang sakral dan juga kuat, maka praktik pe­maksaan hubungan seksual dianggap sebagai ketimpangan hak dan kewajiban relasi seksual dalam per­kawi­nan Islam mengajarkan prinsip mu’asyarah bil ma’ruf yaitu hubungan yang baik dan juga sukarela dalam melakukan relasi seksual dengan tidak memonopoli seksualitas dengan mengatas­namakan agama karena jelas bertentangan dengan syariat.

Abstract

AbstractHistorically, domestic workers has been around a long time. Their domestically roles made them often underestimated. However, the legal protection they are still very concerned, even until now Indonesia has no law regarding the protection of domestic workers, because domestic workers act of Indonesia has not been enacted. Whereas legal protection to domestic workers is urgent considering the number of cases of abuse and violence against domestic workers, particularly female domestic workers, without any handling or legal process well. Therefore, the authors are interested in examining how the application of the theory of gender equality and inquity for domestic workers act.This research results: Firstly, the bill is needed to protect of domestic workers. Secondly, A worker of either sex is the same as other workers must be paid a fair wage and good treatment as a dignified human being. Thirdly, The aim of this act should be the process of formalizing the PRT even though the workings area of domestic workers are in domestic area. AbstrakSecara historis, pekerja rumah tangga telah ada sejak lama. Peran mereka di dalam ranah domestik membuat mereka sering diremehkan. Namun, perlindungan hukum mereka masih sangat kurang, bahkan sampai sekarang Indonesia tidak memiliki Undang-undang perlindungan pekerja rumah tangga. Perlindungan hukum bagi pekerja rumah tangga sangat mendesak keberadaannya mengingat jumlah kasus pelecehan dan kekerasan terhadap pekerja rumah tangga, terutama PRT perempuan, semakin bertambah. Oleh karena itu, penulis tertarik untuk meneliti bagaimana penerapan teori kesetaraan dan keadilan gender bagi pekerja rumah tangga.Hasil penelitian menunjukkan bahwa: Pertama, Indonesia sangat memerlukan UU untuk melindungi atau pekerja rumah tangga, sehingga RUU PRT mendesak untuk segera diundangkan. Kedua, Seorang pekerja baik perempuan maupun laki-laki mempunyai kedudukan yang sama, sehingga harus mendapatkanhak- haknya dengan baik sebagai manusia yang bermartabat. Ketiga, harus ada Formalisasi PRT walaupun kerja bidang pekerja rumah tangga berada di wilayah domestik tetapi hak-haknya sebagai pekerja harus diakui dan disamakan dengan pekerja di wilayah publik.

Abstract

Indonesia merupakan negara demokrasi, dimana seharusnya Rancangan Undang-Undang KUHP dibuat sesuai dengan konteks pada masa kini. Hal tersebut dimaksudkan agar perbuatan- perbuatan yang dilarang dan tidak dilarang sesuai dengan zaman yang berkembang pada masa sekarang. Pengaturan atas asas legalitas yang dikecualikan atau lebih tepatnya dipanggil dalam RKUHP, secara tidak langsung melahirkan permasalahan-permasalahan dalam penegakan hukum pidana (Pasal-Pasal Kontroversional). Lalu yang menjadi pokok permasalahan bagaimana jika ada multitafsir terhadap penerapan pasal-pasal kontroversial tersebut serta kemudian disalahgunakan oleh oknum aparat penegak hukum. Padahal jika kita tinjau ciri produk hukum yang tepat adalah produk hukum yang maknanya disepakati tunggal (monotafsir) dan tidak membuka ruang adanya tafsir lain. Tetapi, kenyataannya produk hukum atau undang- undang saat ini berawal dari potensi dan kinerja DPR yang patut dipertanyakan sebagai perwakilan yang menyuarakan aspirasi rakyat.

Abstract

Zakat is giving some of the property owned by individuals and then must be issued and given to Muslims, one of which is given to underprivileged people. The government in this case helps increase the potential of zakat by forming an amil zakat agency. The tempting of zakat funds managed by many causes managers to become complacent. There are so many cases related to zakat management. This is what we must understand that as a profession amil zakat must have a strong determination to help others, not to enrich oneself. This type of research uses literature research that takes data through information by obtaining library materials, data techniques that have been obtained by reviewing and analyzing, both in the form of books, journals, research results. As well as by using descriptive analysis techniques. Yusuf Qardhawi said that amilin is a person who works as a zakat collector, both including those who collect, inform, calculate and distribute zakat. Professional ethics that should be applied from amil zakat are, Openness and Transparency, Integrity and Credibility, Professionalism, Fairness and distribution, Efficient operations, Empathetic approach

Abstract

Rehabilitation is one form of restorative justice in Indonesia's criminal justice system. The rehabilitation practice is also able to reach drug abusers. The condition of correctional institutions that are overcapacity is the reason for the importance of alternative punishment for narcotics cases. On the other hand, narcotics are the category of victimless crimes, so the victims and perpetrators must be protected to reduce other impacts. This research uses the juridical-normative method by studying legislation and principles of criminal law. The results represent that the prosecutor's office has an important role in realising restorative justice in drug cases based on the dominus Litis principle. The use of rehabilitation is limited to drug abusers who commit criminal acts against themselves. It is still necessary to reorient the policy of terminating cases of narcotics abuse by the prosecutor's office so that the implementation of rehabilitation is truly compatible with the principle of victim protection in punishment.

Abstract

This research is motivated by the phenomenon of the polemic faced by the press against the Police, which is related to the lack of certainty in resolving cases in the press even though there is an MoU made between the Press Council and the Police. This research aims to find a problem that has existed between the Police and the Press Council such as the MoU (Police and Press Council) which then questioned its significance such as its legal strength in resolving press cases. Then provide the best advice in resolving press cases by the police of the Republic of Indonesia. The research method used is normative juridical, with a statute approach. The results obtained from this research show that the MoU between the Press Council and the Police has the same legal force as agreements in general. Then the settlement of cases in the Police can be resolved one of them using the restorative justice method by using police discretion as an effort to keep press people from feeling criminalized and maintaining the image of the police.

Abstract

This research aimed to analyze the punishment of Sapayuang marriage according to Mashlahah perspective, ‘urf, and Human Rights correlated with the custom philosophy, Adat Basandi Syarak, Syarak Basandi kitabullah (Custom based on Islam, Islam based on Al-Qur’an) which is life foundation of Minangkabau people, the offender of sapayuang marriage accepts severe punishment. This research utilized the empirical juridical method wherein qualitative research was used as the research approach. Primary data was derived from the interview and field findings. Then, these data were analyzed using the relevant theories correlated with this issue such as classic books, books, journals, articles, law dictionaries, encyclopedia, and the previous correlated research to obtain a conclusion. There are several findings of this research, 1) the witness of sapayuang marriage is classified into mashlahah dharuriyah because maintaining the self-respect and prestige is included in mashlahah dharuriyah. If it is viewed from the perspective whether mashalahah changed or not, the prohibition of sapayuang marriage is categorized into mashlahah mutaqaiyyirah. If it is reviewed from the mashlahah side, it is characterized into mashlahah mursalah, because there is no nash which bann it. However, there is no nash which supports it. As a result, it cannot be classified into mashlahah mulghah, 2) If it is reviewed from the ‘urf object perspectives, the prohibition and punishment of sapayuang marriage are included in ‘urf amali, which means the society habits related to actions. Then, if it is seen from the scope, this prohibition is included in ‘urf  khashah which means the habit which is particularly obeyed by the people in certain region. If it is reviewed from the validity of ‘urf related to the punishment of sapayuang marriage, it is ‘urf shahih, and 3) according to the Western human rights perspective, the punishment dibuang dari nagari (expelled) and excommunicated is included in Human Right violation. It is different from the concept of Eastern human rights which emphasizes human rights as part of Islamic teaching implementation.

Abstract

This article aims to understand how the police, especially the West Java Regional Police, provide protection and handle domestic cases that come to the West Java Regional Police. The research method that the author carried out was an empirical juridical method by looking for data on cases of domestic violence in the West Java Regional Police and assisted by literature studies. The research results show that although many cases have been resolved at the West Java Regional Police, there are also obstacles, one of which is that victims are often reluctant to report domestic violence cases because they are considered a disgrace and only occur within the household. that the victim failed to report and resolve this case to the legal realm. Based on an agreement between the victim and the perpetrator, the resolution of cases that often occurs is with a restorative justice approach, where this justice provides attention to victims who are often ignored even though the justice used is a retributive justice approach which more often has a deterrent effect. the perpetrator and pays little attention to the victim.Keywords:Protection, Police, Household

Abstract

The position of children out of marriage in everyday life by some people is seen as low, on the other hand in terms of welfare and civil rights still get limitations. This research focuses on the implementation of Constitutional Court Decision No. 46/ PUU-VIII /2010 on illegitimate children of Indonesian Women Workers. The research confirmed that the addition of Article 43 paragraph (1) made by the Constitutional Court through Decision No. 46/PUU-VIII/2010 is not only limited to the right to protection but has a very broad meaning that also includes illegitimate children born to Indonesian Women Workers. In accordance with the principle of equality before the law, the law must provide fair protection and legal certainty. The findings of this study revealed that illegitimate children of migrant workers can obtain constitutional rights as Indonesian citizens adhering to the principles of the rule of law. Therefore, the Constitutional Court’s decision does not only affect children’s inheritance rights, but also has implications for guaranteeing and protecting illegitimate children born to migrant workers, such as the right to earn a living, guardianship rights, and the right to get child support from a biological father.

Abstract

The obligatory will regulated in Article 209 of the Compilation of Islamic Law is only for adoptive parents and adopted children, there is no obligatory will for heirs of different religions. On the other hand, there is a need for legal provisions that present a solution to provide part of the inheritance to heirs who do not receive inheritance due to religious differences. The purpose of this research is to analyze the important obligatory will in terms of its necessity, as well as a study of the obligatory will in terms of the procedure or implementation of the obligatory will itself in resolving disputes in court with legal considerations that are certain, fair and beneficial. The research method uses a qualitative method with a normative juridical approach. Primary data was obtained from regulations, laws, verdict numbers: 368 K/AG/1995, 51 K/AG/1999, 16 K/AG/2010, 721 K/AG/2015, 218 K/AG/2016 and 331 K/AG/2018. Supreme Court Decision No. 331 K/AG/2018 as well as the Compilation of Islamic Law (KHI) article 209 and regulations governing mandatory wills, secondary, tertiary data obtained from library studies, books, documents, journals and so on that have the same relevance to this research. The analysis process uses a legal logic approach, which analyzes the norms and laws or regulations that apply in depth, radically, systematically, and logically. The results of this study concluded that the dynamics of religious court decisions regarding compulsory bequests for heirs of different religions vary greatly, some are granted and some are rejected, the consideration depends on the sitting of the case that is disputed in the religious court, while the granting of compulsory bequests for heirs of different religions refers to the opinion who allows it as long as it is a will and the different religion in question is not kafir dzimmi. The effect of this decision becomes jurisprudence as part of the source of law for judges at levels below the Supreme Court. The contribution of the religious court's decision on this matter is that it can become a permanent jurisprudence so that it is proposed as a new article in KHI to fill in the missing article regarding mandatory wills for heirs of different religions.
