Abstract

Customary dispute resolution institutions in Indonesia and the Philippines serve to provide indigenous peoples with access to justice beyond state courts. This research, employing a normative juridical approach with a descriptive-analytical specification, highlights key differences between the two systems. In Indonesia, customary courts derive recognition from the 1945 Constitution, while in the Philippines, they are explicitly regulated under the Indigenous Peoples’ Rights Act (IPRA) of 1997, leading to greater integration with the national legal system. Indonesian customary courts handle a broader range of disputes, whereas Philippine customary courts primarily focus on land rights and natural resource management. Additionally, Indonesian customary court decisions often face dualism in the application of customary and national law when reviewed by state courts, while Philippine customary court decisions are more systematically recognized and enforced within the formal legal framework.

Abstract

Philippe Nonet and Philip Selznick stated that responsive law is a law that is oriented to the fulfillment of social needs and is able to adapt according to the dynamics of society. This study aims to compare the application of responsive legal theory in responding to social changes in the field of criminal and civil law. The research method used is normative or doctrinal legal research with a conceptual and comparative approach. The conceptual approach is used to understand the basic principles of responsive legal theory that emphasize legal flexibility in dealing with social dynamics. A comparative approach is applied to analyze the similarities and differences in the application of this theory in criminal and civil law. The results show that the application of responsive law theory in criminal law tends to focus on the rehabilitation of perpetrators and the restoration of social relations through a restorative justice approach. On the other hand, in civil law, this theory is implemented through flexible alternative dispute resolution, such as mediation and arbitration, which considers substantive justice for the parties to the dispute. Although the goals and processes in these two areas of law are different, they emphasize the need for legal adaptation to social changes and societal needs. Thus, responsive legal theory is expected to be able to create a legal system that is more inclusive, fair, and relevant to the development of Indonesian society. Abstract

This article analyses the implementation of the Supreme Court Regulation Number 3 of 2017 concerning Guidelines for Trial of Cases Involving Women Facing Legal Challenges (which is then written as SC Reg. 3/2017) in Religious Affairs Courts. This regulation provides a guideline and serves as a reference point for judges which helps them to better understand and implement the principles of gender equality and non-discrimination in hearing and trying a case involving women. This study employs juridical-empirical approach method and purposive sampling as the data collection technique in interviewing several judges at multiple religious affairs courts in Java Island, as well as in literature review. The result of this study shows that judges at religious affairs courts have adopted Supreme Court Regulation Number 3 of 2017 (hereinafter, SC Reg. 3/2017), although in their practices, even after four years since the enactment, there still isn’t any consensus or shared views amongst judges in implementing matters such as post-divorce women’s rights, especially regarding verstek (in absentia) judgment. However, several religious affairs court judges have shown a good understanding of equality between men and women, indicated by judgments that favours women. Religious court judges in their ex officio capacity may grant rights to divorced wives, even if they are not requested.

Abstract

Introduction:  The marriage law was carried out through a long process, due to, religions, or national interests. Marriages in Indonesia are not only based on the beliefs of official religions in Indonesia, but there are also marriages carried out by the Faith in God Almighty. One of the faith streams in Indonesia is the Sunda Wiwitan school. Purposes of the Research:  In this study, researchers were interested in examining magical religious practices in the marriages of the Sunda Wiwitan indigenous people of West Java.Methods of the Research: The approach method used in this study is normative juridical research through legal principles, legal systematics, legal synchronization, and legal comparison. Results of the Research: The results showed that the marriage practice of indigenous peoples who live the Sunda Wiwitan faith is still thick with its customary rituals, this is done as a process in fulfilling the practice of marriage as one of the important life phases for the Sunda Wiwitan community. The characteristics of marriage of indigenous peoples who live in Sunda Wiwitan in West Java, having the concept of marriage containing the meaning of the beginning of the single end so sawaji (initially one, finally so unified), Marriage must be monogamous which is approved by the parents of both parties and the prohibition of marriage for Sunda Wiwitan believers is to marry between nations (marrying people outside Indonesia).

Abstract

This library research focuses on books and literature as primary sources. It provides an overview of Indonesia's economic development from the perspective of sharia economic law philosophy and its application in DSN-MUI fatwas. Islamic economic philosophy is rooted in the Qur'an and Sunnah, which also guide DSN-MUI in formulating fatwas addressing economic issues. DSN-MUI plays a strategic role in developing sharia economic law to meet society's need for legal fatwas on economic activities, particularly in response to evolving product innovations.

Abstract

This study examines the contested legal status of traditional sharecropping contracts among Islamic scholars and religious leaders in rural West Java, Indonesia. The primary objective is to analyze how Islamic law governs these contracts both normatively and in practice and how relevant regulations function within the local context. Employing an empirical legal approach, the research relies on direct observation and analysis of legal behavior in society. Findings indicate that the rising value of land and labor has turned traditional sharecropping arrangements into symbols of economic inequality. Ideologically, the legitimacy of such contracts is debated among village groups with varying socio-religious orientations. This contestation reflects an ongoing process of rural Islamization and highlights emerging pragmatism. The increasing accessibility of global information via the internet enables rural communities to reinterpret Islamic legal norms and agricultural practices, illustrating their adaptive responses to socioeconomic change and technological advancement.

Abstract

Abstract: This research aims to explore the urgency and strategy of structuring the legal and human rights awareness curriculum through an anti-bullying dissemination study at the junior high school level. The formulation of the problem raised is how the urgency of developing a legal and human rights awareness curriculum and structuring efforts to increase students' understanding and awareness of legal and human rights issues, especially in the context of bullying prevention. The research method used an extension approach through stages that included needs assessment, interactive seminars, discussions, case simulations, and interpersonal skills training. The results showed that the implementation of a law and human rights-based curriculum had a significant impact in reducing cases of bullying, increasing empathy, and building a culture of respect for human rights in the educational environment. These findings emphasize the importance of integrating the values of law and human rights in the formal education system to create a young generation that is aware of the law, has character, and has a culture of peace.

Abstract

Perlindungan terhadap korban kekerasan dalam sistem peradilan pidana di Indonesia masih menghadapi berbagai tantangan. KUHAP yang saat ini berlaku lebih berorientasi pada perlindungan hak tersangka dan terdakwa, sementara hak-hak korban belum diakomodasi secara memadai. Berdasarkan data dari Lembaga Perlindungan Saksi dan Korban (LPSK), hanya sekitar 30% korban kekerasan yang mengajukan permohonan perlindungan mendapatkan bantuan hukum dan restitusi. Selain itu, laporan dari Komnas Perempuan tahun 2023 mencatat sebanyak 339.782 kasus kekerasan terhadap perempuan, di mana mayoritas korban menghadapi hambatan dalam mengakses keadilan dan pemulihan. Penelitian ini bertujuan untuk mengevaluasi ketentuan KUHAP terkait perlindungan korban kekerasan dan membandingkannya dengan standar Hak Asasi Manusia (HAM) internasional. Metode penelitian yang digunakan adalah metode normatif dengan pendekatan perbandingan hukum, yang menganalisis peraturan nasional dan instrumen internasional, seperti Deklarasi PBB tentang Prinsip-Prinsip Keadilan bagi Korban Kejahatan dan Penyalahgunaan Kekuasaan. Rumusan masalah yang dikaji meliputi sejauh mana perlindungan korban diatur dalam KUHAP, bagaimana standar perlindungan korban dalam sistem peradilan berdasarkan HAM internasional, serta rekomendasi reformasi KUHAP untuk memperkuat perlindungan bagi korban kekerasan. Hasil penelitian menunjukkan bahwa reformasi KUHAP diperlukan untuk mengakomodasi hak korban melalui pendekatan keadilan restoratif, penyediaan mekanisme perlindungan khusus, serta peningkatan akses terhadap kompensasi dan pemulihan.

Abstract

AbstractLegal assistance is a constitutional right of every citizen that is non-derogable rights as an effort to fulfil access to justice and equality before the law, especially for the poor and who doesn’t understand law. The implementation of legal assistance in the Cimahi Religious Court are not optimum due to lack of information, the presence of individuals who seeks personal benefits, and a common sense of high cost advocate services. This study is aimed to determine the implementation of legal assistance for the poor in the Cimahi Religious Court along with its supporting factors. This research is a qualitative research with descriptive analytical method and an empirical juridical approach. The utilized data are primary and secondary data. Data collection is done by interview techniques and literature studies. The implementation of legal assistance in the Cimahi Religious Court is still not effective due to legal factors, law enforcement factors, facilities, community factors and cultural factors. The inhibiting factor in legal assistance is a lack of socialization, difficult access for the community, and a culture in apparatus seeking personal gain. Supporting factors in legal assistance include good relations between legal aid agencies, increased awareness of the Village apparatus and KUA, and the existence of Cimahi Religious Court Website.Keywords:legal assistance, equality before the law, poor society. AbstrakBantuan hukum merupakan hak konstitusional setiap warga negara yang bersifat non derogable rights sebagai upaya mewujudkan Acces to Justice dan Equality Before The Law terutama untuk masyarakat miskin dan buta hukum. Fenomena yang terjadi di Pengadilan Agama Cimahi masih kurangnya informasi bantuan hukum, adanya oknum yang mencari keuntungan pribadi, dan anggapan mahalnya jasa advokat membuat pelaksanaan bantuan hukum belum maksimal. Penelitian ini bertujuan untuk mengetahui pelaksanaan bantuan hukum bagi masyarakat miskin di Pengadilan Agama Cimahi beserta faktor penghambat dan penunjangnya. Penelitian menggunkn penelitian kualitatif dengan metode Deskriptif Analitis dn pendekatan Yuridis Empiris. Data yang digunakan adalah data Primer dan Sekunder. Pengumpulan data dilakukan dengan teknik wawancara dan studi pustaka. Pelaksanaan bantuan hukum di Pengadilan Agama Cimahi masih belum efektif karena faktor hukum, faktor penegak hukum, faktor sarana, faktor masyarakat dan faktor budaya. Faktor penghambat dalam bantuan hukum adalah kurangnya sosialisasi, akses masyarakat yang masih sulit, dan ada budaya di aparat yang mencari keuntungan pribadi. Faktor penunjang dalam bantuan hukum diantaranya adanya hubungan baik antar lembaga pemberi bantuan hukum, meningkatnya kesadaran perangkat Desa, KUA dan ada Website Pengadilan Agama Cimahi.Kata Kunci :Bantuan Hukum, Equality Before The Law, Masyarakat Miskin

Abstract

Abstract: The practice of marital rape or known as marital rape is a discussion that is often considered a contradictio in terminis which is interpreted as a combination of contradictory words, because currently rape is limited outside marriage. Rape in marriage is a form of inequality in gender justice, the assumption is that men/husbands have an autonomous right to force their wives to have sex, while women/wives are legitimized by construction to devote themselves to accepting whatever is done in marriage. This should not be in line with what has been regulated in the Marriage Law, which basically states that the purpose of marriage is to form a happy and eternal family (household) based on the One Godhead. Marital rape can be defined as coercion of sexual activity by one party without regard to the other party. The purpose of this study is to explain the basis for regulating marital rape in positive law in Indonesia and Islamic law. The research method used is juridical-normative, namely research by analyzing the provisions of laws and regulations relating to marital rape by connecting the basic arrangements in Islamic law. The results of this study indicate that domestic rape or known as marital rape is part of sexual violence in the household as regulated in the PKDRT Law. Meanwhile, in Islam the essence of marriage is interpreted as mistaqan ghalidzan or a sacred and strong bond, then the practice of forced sexual intercourse is considered an inequality of rights and obligations of sexual relations in marriage. Islam teaches the principle of mu'asyarah bil ma'ruf, namely a good and voluntary relationship. in having sexual relations by not monopolizing sexuality in the name of religion because it is clearly against the Shari'a.Absktrak: Marital rape menjadi pembahasan yang sering dianggap sebagai suatu contradictio in terminis, karena pengaturan hukum tentang pemerkosaan masih terbatas di luar perkawinan. Pemerkosaan dalam perkawinan merupakan bentuk ketimpangan keadilan gender, anggapan bahwa laki-laki/suami memiliki hak otonom untuk memaksa istri berhubungan seksual, sedangkan perempuan/istri dilegitimasi konstruksi untuk mengabdikan diri menerima apapun yang dilakukan dalam perkawinan. Hal ini seyogyanya tidak selaras dengan UU Perkawinan yang pada pokoknya menyebutkan bahwa tujuan perkawinan ialah membentuk suatu keluarga (rumah tangga) yang bahagia juga kekal berdasarkan Ketuhanan Yang Maha Esa. Tujuan penelitian ini adalah untuk menjelaskan dasar pengaturan marital rape dalam hukum positif di Indonesia dan hukum Islam. Metode penelitian yang digunakan ialah yuridis-normatif yakni penelitian dengan menganalisa ketentuan peraturan perundang-undangan berkaitan dengan marital rape dengan menghubung­kan dasar pengaturan dalam hukum Islam. Hasil penelitian ini menunjukan bahwa pemerkosaan dalam rumah tangga atau dikenal sebagai marital rape merupakan bagian dari kekerasan seksual dalam rumah tangga sebagaimana yang telah diatur dalam UU PKDRT. Dalam perkembangannya, RUU KUHP juga mengatur tentang marital rape. Sedangkan, dalam Islam hakikatnya perkawinan di­mak­nai sebagai mistaqan ghalidzan atau ikatan yang sakral dan juga kuat, maka praktik pe­maksaan hubungan seksual dianggap sebagai ketimpangan hak dan kewajiban relasi seksual dalam per­kawi­nan Islam mengajarkan prinsip mu’asyarah bil ma’ruf yaitu hubungan yang baik dan juga sukarela dalam melakukan relasi seksual dengan tidak memonopoli seksualitas dengan mengatas­namakan agama karena jelas bertentangan dengan syariat.
