Abstract

The aim of this research is to find out the process and implementation of land registration in Hutuo Village, as well as to find out the factors that cause problems in land registration in Hutuo Village. The type of research used is Empirical Legal research. Data collection techniques were carried out using interview techniques and literature. Then the writer will analyze the data obtained in the research process descriptively, in this case the researcher will describe the description of the research subjects and objects as the results of the research he conducted. The results of this research indicate that land registration in Hutuo Village in view of Government Regulation Number 24 of 1997 is still not optimal. This is proven by the data in Hutuo Village where there are still a large number of unregistered land cases. However, the cases of land that have not been registered have not been resolved, due to the background obstacles that influence the achievement of legal certainty in the Hutuo Village. The suggestion in this research is that the Government, especially the Regional Office of the National Land Agency in Gorontalo Regency, continues to strive to carry out more outreach to the people of Hutuo Subdistrict to carry out land registration so that they can have a certificate to obtain legal certainty.

Abstract

The execution of fiduciary security at the Tunas Muda Savings and Loan Cooperative frequently encounters legal and factual obstacles despite being regulated under Law No. 42 of 1999, and has become increasingly complex following Constitutional Court Decision No. 18/PUU-XVII/2019, which restricts creditors’ unilateral authority to execute collateral. This study aims to analyze the legal effectiveness of creditor rights protection and to identify obstacles in the execution process of fiduciary security at the Tunas Muda Savings and Loan Cooperative. The research employs a socio-legal approach with an empirical legal research design, using primary data obtained through interviews and observations, and secondary data collected through document study, all of which are analyzed using qualitative descriptive techniques. The findings show that the legal effectiveness of fiduciary security execution is not yet optimal; the main obstacles include the non-registration of collateral objects, low legal awareness among debtors, limited litigation costs, and collateral objects that have been transferred or have depreciated in value. These results indicate that Constitutional Court Decision No. 18/PUU-XVII/2019 provides greater protection for debtors but simultaneously reduces efficiency and legal certainty for creditors by requiring court proceedings when default is disputed. The study concludes that enhanced compliance with fiduciary security registration by cooperatives and regulatory improvements are needed to balance protection between creditors and debtors so that fiduciary security execution can proceed more efficiently and fairly.

Abstract

Spot market transactions in crypto assets in Indonesia have shown significant growth; however, this development has not been fully matched by adequate legal certainty and protection, particularly regarding the legal status of spot contracts as the basis of the legal relationship between business actors and consumers. This study aimed to analyze the legal status of spot contracts in crypto-asset transactions in Indonesia and to identify factors influencing their implementation under spot market supervisory provisions, an urgency heightened by the rapid growth of crypto-asset trading and the shift in the supervisory regime from the Commodity Futures Trading Regulatory Agency (Bappebti) to the Financial Services Authority (OJK). The study employed normative legal research using a statutory approach and a comparative approach. The findings show that spot contracts have a valid and binding legal status because they satisfy the legal requirements for agreements under Article 1320 of the Indonesian Civil Code (KUHPerdata) and are executed through organizers registered with and supervised by the competent authority. The transfer of authority from Bappebti to OJK marks a paradigm shift from viewing crypto assets as commodities toward treating them as digital financial assets under financial services sector supervision. The study also finds that the effectiveness of spot contract implementation is determined by three main factors: regulatory consistency, supervisory effectiveness, and institutional readiness, including the governance of exchanges, physical traders, and clearing institutions, which are essential prerequisites for ensuring legal certainty, market stability, and consumer protection within Indonesia’s crypto-asset trading ecosystem. Accordingly, this study has implications for strengthening understanding of electronic contracts in the context of digital financial assets and enriching scholarship on the legal status of spot contracts within the Indonesian legal system.

Abstract

This study examines the implementation of Article 4(1) of Law Number 8 of 1999 on Consumer Protection in the regulation and control of parking as an effort to fulfill consumer rights, particularly the right to safety and comfort in using parking infrastructure. Problems arise when breaches of obligation by parking attendants occur and they refuse to assume responsibility for their negligence, raising questions about the form of dispute resolution when no accountability is taken by the attendant. This study employed a socio-legal approach with an empirical legal research design to analyze the implementation of Article 4(1) of Law Number 8 of 1999 on Consumer Protection in parking regulation and to investigate monitoring and law enforcement activities related to on-street parking on Panjaitan Street in Gorontalo City. Field data and relevant regulations were analyzed to describe patterns in the fulfillment of legal obligations by parking attendants and the realization of consumer rights. The findings show that parking activities have been routinely monitored by the Transportation Agency; however, implementation remains constrained by limited monitoring facilities and the absence of a clear mechanism for allocating responsibility for damage to or loss of consumers’ vehicles. In conclusion, the implementation of consumer protection provisions in parking practices on Panjaitan Street has not yet fully ensured legal certainty of protection for consumers, thereby necessitating stronger monitoring mechanisms and more explicit formulations of parking attendants’ liability within the framework of consumer protection law enforcement.

Abstract

Alternative dispute resolution mechanisms in developing nations frequently experience structural dysfunctions within complex agrarian governance. This study examines the optimization of land dispute resolution through mediation in Biau District, Buol Regency. Employing a qualitative socio-legal approach, primary empirical data were gathered via purposive sampling across twenty-three key informants and analyzed rigorously using an interactive qualitative model. Grounded in Lawrence Friedman’s legal system theory, the findings reveal that mediation failures do not stem from statutory deficits, but rather from deep-seated structural pathologies, specifically uncertified local mediators, and cultural patron-client dynamics that systematically distort neutrality. Consequently, grassroots consensus frequently suffers from severe executive impotence. To resolve this procedural impasse, this article conceptualizes the Tripartite Alliance for Site Agrarian Resolution. This framework integrates local government, agrarian offices, and judicial courts via e-Court networks to transform informal settlements into legally binding settlement deeds (Acta van Dading), thereby guaranteeing absolute enforcement and sustainable agrarian justice.

Abstract

Sungai Citarum mengalami pencemaran berat akibat limbah industri tekstil, namun penegakan hukum pidana belum memberikan efek jera yang memadai. Penelitian ini menganalisis efektivitas penegakan hukum pidana terhadap pencemaran Sungai Citarum oleh industri tekstil di kawasan Majalaya, Kabupaten Bandung, dengan mengidentifikasi kendala struktural dan merumuskan model penegakan hukum yang lebih efektif. Menggunakan pendekatan yuridis-empiris dengan metode studi literatur, yaitu analisis dokumen hukum, dan anlisis jurnal penelitian yang berhubungan dan menjadi basis studi literatur. Hasil penelitian menunjukkan bahwa dari 64 kasus pelanggaran, hanya 9,4% diproses secara pidana, sementara 90,6% diselesaikan melalui sanksi administratif yang tidak efektif mencegah pelanggaran berulang. Kendala utama meliputi lemahnya pengawasan pasca program nasional, kesulitan pembuktian teknis pencemaran, tumpang tindih kewenangan antar lembaga, dan rendahnya penerapan prinsip strict liability. Penelitian ini merekomendasikan reformulasi mekanisme penegakan berbasis pidana dengan penerapan strict liability, standar verifikasi IPAL berbasis monitoring online real-time, dan model koordinasi kelembagaan terpadu untuk meningkatkan deterrence effect dan keberlanjutan perlindungan lingkungan.

Abstract

The development of e-commerce has driven the use of the Cash on Delivery (COD) method as a payment alternative that enhances consumer trust, yet it also raises legal issues regarding the liability of shipping companies. This study aims to analyze the form of legal liability of shipping companies in COD transactions regarding violations of consumer rights and to identify weaknesses in existing regulations. The research method employed is a normative legal approach using legislative and conceptual frameworks, through a literature review of primary and secondary legal sources. The results indicate that regulations regarding the liability of shipping companies in COD transactions remain unclear and fall within a normative gray area. Shipping companies can no longer be positioned merely as carriers but also as parties involved in the transaction process. Therefore, a proportional liability framework is required using an intermediary liability and joint liability approach. This study emphasizes the importance of legal reform through regulatory harmonization to strengthen consumer protection in digital transactions.

Abstract

This community service program aims to enhance the legal understanding and awareness of Micro, Small, and Medium Enterprises (MSMEs) in Dumbo Raya Subdistrict, Gorontalo City, regarding the importance of trademark protection and intellectual property rights (IPR) under Law No. 20 of 2016 on Trademarks and Geographical Indications. The method employed was a participatory educational approach through legal outreach sessions, seminars, interactive discussions, and evaluations based on pre-test and post-test questionnaires. The results of the activity showed that prior to the outreach, the majority of participants had very low levels of legal literacy, both in terms of conceptual understanding of trademarks and technical understanding of the trademark registration process at the Directorate General of Intellectual Property. After the outreach activities were conducted, there was a significant improvement in all aspects of the participants’ legal understanding and awareness. These findings demonstrate that structured and practical legal outreach is an effective tool for promoting IPR literacy and fostering sustained legal compliance among MSME operators.

Abstract

Rapid advancements in Artificial Intelligence (AI) have significantly impacted the music industry by enabling AI systems to autonomously create song compositions. This development presents critical legal challenges, particularly concerning the protection of economic and moral rights associated with AI-generated songs. The study examines whether current Copyright Law effectively addresses these issues, employing normative research methods and focusing on relevant legislation and concepts. Findings indicate considerable limitations within existing legal frameworks since the definition of a creator typically pertains to human authors. Consequently, works produced by AI are subjected to a legal gap, resulting in ambiguity regarding the safeguarding of moral and economic rights. The study advocates for regulatory reforms that would clearly define the legal status of AI-generated works, ensuring both legal certainty and fair intellectual property rights protection in the evolving digital landscape.

Abstract

This article examines judicial reasoning in determining whether a debtor’s failure to perform obligations under a banking credit agreement following a natural disaster constitutes force majeure or breach of contract. It applies normative legal research using statutory, conceptual, and case approaches, with a comparative analysis of Decision Number 9/Pdt.G/2019/PTA.Gtlo of the Gorontalo Religious High Court and Decision Number 97/Pdt.G/2020/PA.Pal of the Palu Religious Court. The study finds that the Gorontalo decision recognized relative overmacht and restricted collateral execution, whereas the Palu decision rejected force majeure because the contractual object remained usable and the debtor lacked sufficient good faith. These differing approaches create uncertainty for creditors in debt recovery, restructuring, and collateral execution. The article proposes assessment indicators based on causation, the condition of the collateral, the temporary or permanent nature of the impediment, debtor good faith, restructuring efforts, and proportional creditor action.
