Abstract

The phenomenon of informal marriages in various regions of Indonesia, including Mananggu District in Boalemo Regency, continues to persist despite legal regulations that mandate marriage registration, as stipulated in Law No. 1 of 1974 in conjunction with Law No. 16 of 2019 concerning Marriage. This study aims to analyze the factors influencing the prevalence of unregistered marriages and examine the social and legal impacts from the perspective of legal sociology. The research method employed is an empirical legal approach with field studies, including in-depth interviews with community leaders, religious affairs office staff, couples involved in informal marriages, and secondary data analysis from regulations, legal literature, and previous research findings. The study finds that several key factors contribute to the high rate of informal marriages, including social factors (out-of-wedlock pregnancies, customary pressures, and religious legitimacy), cultural factors (the belief that a marriage is legitimate based on Islamic law without state registration), economic factors (administrative costs and access to transportation to the religious affairs office), and administrative factors (complexity of document processing). The impacts are significant, both legally and socially. Legally, the wife and children lose legal protection for basic rights such as maintenance, inheritance, and civil status. Socially, negative stigma, vulnerability to discrimination, and barriers to accessing education and public services arise. In conclusion, informal marriages present a multidimensional problem that requires legal, administrative, and social solutions to ensure the protection of citizens' rights.

Abstract

This study was motivated by the high number of cases of breach of contract by cooperative members in loan agreements, which has disrupted legal certainty and the financial stability of the cooperative. This study aims to analyze the forms of breach of contract by cooperative members and to assess the effectiveness of dispute resolution regarding such breaches at the Berkat Jaya Mandiri Cooperative in Tilongkabila Subdistrict, Bone Bolango Regency. The method used is empirical legal research employing both a statutory approach and a sociological-legal approach. Data were collected through interviews, observations, and documentation, and analyzed qualitatively. The results indicate that the forms of default include complete failure to fulfill obligations, fulfillment of obligations that do not conform to the agreement, and fulfillment of obligations that is delayed. Of the 77 members who received loans in 2025, 35 members defaulted. Dispute resolution is generally conducted through non-litigation channels using a family-oriented approach, negotiation, and informal warnings. Although this method is considered more cost-effective and helps maintain good relations between the cooperative and its members, its effectiveness has not been optimal because it does not fully provide legal certainty and has not been able to prevent repeated defaults. Thus, there is a need to strengthen the enforcement of rules, increase members’ legal awareness, and establish more rigorous dispute resolution mechanisms to ensure the proper implementation of agreements. ABSTRAKPenelitian ini dilatarbelakangi oleh tingginya kasus wanprestasi anggota koperasi dalam perjanjian pinjam meminjam yang berdampak pada terganggunya kepastian hukum dan stabilitas keuangan koperasi. Penelitian ini bertujuan untuk menganalisis bentuk wanprestasi anggota koperasi serta menilai efektivitas penyelesaian sengketa wanprestasi pada Koperasi Berkat Jaya Mandiri Kecamatan Tilongkabila Kabupaten Bone Bolango. Metode yang digunakan adalah penelitian hukum empiris dengan pendekatan perundang-undangan dan pendekatan sosiologis hukum. Data diperoleh melalui wawancara, observasi, dan dokumentasi, serta dianalisis secara kualitatif. Hasil penelitian menunjukkan bahwa bentuk wanprestasi yang terjadi meliputi tidak memenuhi prestasi sama sekali, memenuhi prestasi tetapi tidak sesuai dengan perjanjian, dan memenuhi prestasi tetapi terlambat. Dari 77 anggota yang menerima pinjaman pada tahun 2025, sebanyak 35 anggota mengalami wanprestasi. Penyelesaian sengketa pada umumnya dilakukan melalui jalur non-litigasi dengan pendekatan kekeluargaan, negosiasi, dan peringatan nonformal. Meskipun cara ini dinilai lebih hemat biaya dan menjaga hubungan baik antara koperasi dan anggota, efektivitasnya belum optimal karena belum sepenuhnya memberikan kepastian hukum dan belum mampu mencegah terjadinya wanprestasi berulang. Dengan demikian, diperlukan penguatan penegakan aturan, peningkatan kesadaran hukum anggota, dan mekanisme penyelesaian sengketa yang lebih tegas agar pelaksanaan perjanjian pinjam meminjam di koperasi dapat berjalan lebih efektif.

Abstract

The construction of Bulango Ulu Dam in Gorontalo province is a national strategic project aimed at raw water supply, irrigation, and flood control. However, in the process of construction, land rights disputes arose between the government and local communities. This dispute is triggered by differences in perceptions about the value of compensation, as well as the limited information received by the community regarding the status and boundaries of land affected by development, so that a comprehensive study of the appropriate dispute resolution mechanism is needed. This study aims to examine the concept of land dispute resolution in general and analyze the process of land dispute resolution that occurs around the construction of the Bulango Ulu Dam. This study uses the method of Empirical Legal Research (socio-legal research), which is a method that combines normative study of legislation with factual data obtained in the field. Data collection was carried out through direct observation at affected dam construction sites, in-depth interviews with land owners or tenants, as well as agencies related to the land acquisition process, then analyzed in a descriptive qualitative manner. The results showed that the concept of land dispute resolution emphasizes a multidimensional approach that integrates legal certainty, community participation, and social justice principles. Settlement is carried out through comprehensive legal mechanisms, both non-litigation such as mediation and deliberation, as well as litigation through courts or arbitration, with the strategic role of the National Land Agency (BPN) in the prevention and handling of cases. In this Bulango Ulu Dam conflict, the settlement steps include inventory and identification of land by BPN to determine the legal status and basis for compensation, socialization to explain the rights, obligations, and procedures for land acquisition, as well as deliberation to reach a fair agreement and accepted by all parties. This deliberative approach reflects the values of local wisdom such as togetherness, consensus, and respect for the rights of indigenous peoples, so as to provide a more participatory solution, and accepted by the community.

Abstract

The circulation of toxic cosmetics in transnational marketplaces threatens public health law sovereignty within Gorontalo. This research analyzes supervisory effectiveness based on Law Number 17 of 2023 and formulates enforcement strategies integrating Maqashid asy-Syari'ah. Through empirical socio-legal methods, data collection was executed using cyber document tracking alongside interviews with local administrative authorities, subsequently analyzed deductively. The findings demonstrate that post-market instruments experience structural paralysis due to algorithmic exploitation legitimized by the safe harbor doctrine. This electronic regulatory disparity diametrically defeats the protection of life and universal welfare. As a conclusion, this article recommends an absolute transformation from intermediary immunity toward corporate criminal liability. The state is obligated to overhaul digital architecture by compelling commercial platforms to integrate automated pre-market content filtering mechanisms, which manifest the preventive principle of Sadd adz-Dzari'ah. Such preventive algorithmic standardization constitutes an imperative prerequisite to restoring consumer rights, safeguarding health, and achieving sustainable development targets globally.

Abstract

This research aims to find out how supervision is carried out by the Regional Representative Council of Gorontalo Province regarding the implementation of regional regulations promulgated in 2020. This type of research is Empirical Research. The research results show that the forms of supervision over regional regulations are divided into two, namely preventive supervision and repressive supervision. Preventive supervision is carried out before a regional regulation is passed. Repressive supervision is carried out after the regional regulation is passed, where what is supervised is the implementation of the regional regulation and is carried out by the Provincial Regional People's Representative Council. Repressive supervision in the implementation of regional regulations in Gorontalo Province is carried out by the Regional People's Representative Council in two ways: first, going directly to the field to directly observe the implementation of regional regulations; and secondly, hold an evaluation meeting on the implementation of the regional regulations by inviting agencies related to the regional regulations being supervised.
