Abstract

The right to access clean water is a fundamental human right and an important part of SDGs. Indonesia as a country committed to developing SDGs-compliant policies to respond to climate challenges need to make sure that it has enough normative support from its legal framework. Using normative legal research method, this study analyzes the emerging legal problems regarding the Indonesian government’s responsibility to provide clean water to its citizens. To support the analysis, this study employs the statutory approach to find the normative problems contributing to a number of possible legal problems that might hinder Indonesia’s commitment to SDGs, particularly the one to make sure that every person has the right to access clean water. Analysis of this research finds that there are normative confusions within the Indonesian legal framework that are related to the government’s responsibility in providing access to clean water, along with the urgency to tackle to these normative issues to better deal with the emerging legal problems, in the face of climate change.

Abstract

The development of artificial intelligence has posed significant challenges to the concept of moral rights within Indonesia's intellectual property law framework. This study aims to analyze the construction of moral rights for works generated by AI through the lens of legal constructivism. Employing a normative legal research methodology with legislative and philosophical approaches, the study examines the existing legal framework and its implications for the protection of moral rights in the artificial intelligence era. The findings reveal that the construction of moral rights in Indonesia is anchored in an anthropocentric concept, prioritizing human consciousness and creative intent. Artificial intelligence, as an entity lacking consciousness or moral interests, cannot be deemed a subject of moral rights in the traditional sense. The study concludes that a reformulation of the legal framework is necessary to accommodate the complexities of artificial intelligence-driven creative ecosystems while preserving the essence of moral rights protection, which remains human-centered. Perkembangan artificial intelligence telah menciptakan tantangan signifikan terhadap konsep hak moral dalam hukum kekayaan intelektual di Indonesia. Penelitian ini bertujuan menganalisis konstruksi hak moral atas karya yang dihasilkan artificial intelligence melalui perspektif konstruktivisme hukum. Menggunakan metode penelitian hukum normatif dengan pendekatan perundang-undangan dan pendekatan filosofis, penelitian ini mengkaji kerangka hukum yang ada serta implikasinya terhadap perlindungan hak moral di era artificial intelligence. Hasil penelitian menunjukkan bahwa konstruksi hak moral di Indonesia bertumpu pada konsep antroposentris yang mengutamakan kesadaran dan kehendak kreatif manusia. Artificial intelligence sebagai entitas yang tidak memiliki kesadaran atau kepentingan moral, tidak dapat menjadi subjek hak moral dalam pengertian tradisional. Penelitian menyimpulkan bahwa diperlukan reformulasi kerangka hukum yang dapat mengakomodasi kompleksitas ekosistem kreatif berbasis artificial intelligence, namun tetap mempertahankan esensi perlindungan hak moral yang berorientasi pada kepentingan manusia.
