Abstract

Technology cannot be separated from the maritime sector with the discovery of unmanned vessels or AMVs as a use option for various purposes. AMV technology is considered capable of providing various benefits commercially and for the security of a region. However, its development has not been followed by specific regulations, including in Indonesia. In line with this, Indonesia still has overlapping issues related to maritime security law. So a solution is needed to handle this. The method for writing this research uses a normative legal method with a conceptual and regulatory approach. The research results show that the maritime security omibus law is the government's solution in synchronizing overlapping regulations between applicable agencies with the formation of PP Number 13 of 2022 concerning maritime security. The maritime security omnibus law is still being developed until it will eventually touch on statutory regulations. In line with this, AMV technology is expected to be part of this arrangement.

Abstract

Data protection is one of the most important aspects of the digital economy, with its legal implications extending across digital landscapes. The failure to protect data in data breaches can threaten the interests of owners and expose them to various risks. Legal compliance regarding how owners are notified of data breaches is important to prevent this, necessitating deep legal discourse and analysis. Using a comparative legal research method with a statutory approach, this study dissects norms within Indonesia and South Korea’s legal systems to analyze their differences in legal compliance regarding this issue. The findings of this study highlight the discrepancies in legal frameworks between Indonesia and South Korea. It particularly notes Indonesia's lack of a governing body for data breach notifications and the absence of comprehensive privacy impact assessments or cybersecurity compliance. Ultimately, the study underscores the need for Indonesia to develop a normative model for data protection to address its significant regulatory gaps—contrasting with South Korea's more robust legal mechanisms and the GDPR's systematic oversight.KEYWORDS: Data Breach, Data Breach Notification, Data Protection.

Abstract

This study compares efforts to prevent human trafficking (TPPO) via maritime routes between Indonesia and the Philippines. TPPO is a transnational crime involving sexual exploitation, forced labor, and online fraud. This study employs a normative juridical approach, examining the implementation of the United Nations Convention against Transnational Organized Crime (UNTOC) and the ASEAN Plan of Action in both countries. This study is based on a qualitative literature study, utilizing secondary data from both primary and secondary legal sources. The findings indicate that Indonesia has implemented Law No. 21 of 2007 on the Eradication of Human Trafficking, while the Philippines uses the Anti-Trafficking in Persons Act of 2003 and Expanded Anti-Trafficking in Persons Act of 2012. Both nations have strengthened maritime patrols and inter-agency coordination, but the effectiveness of law enforcement still faces challenges, such as limited resources and insufficient training. Another issue is the need for enhanced cross-border cooperation. This study recommends strengthening regional collaboration, raising public awareness, and improving victim protection measures. These findings aim to contribute to better TPPO policies in Southeast Asia, especially in Indonesia and the Philippines.

Abstract

The integration of Artificial Intelligence (AI) into scientific advancements has become a crucial part of daily life for many people. In the creative industry, AI has the potential to not only enhance the level of creativity, but also productivity. The legal implications of this development must be carefully analyzed for the development of the creative industry, to establish a legal position on where AI stands in the increasingly competitive market, especially when Intellectual Property Right (IPR) as a key factor is taken into account. This research examines the need for a legal framework for AI. It was conducted through the lens of intellectual property law, to determine its place within existing IPR regimes using the comparative legal method. The results conceptually justify the urgency to regulate AI, and highlights the taxonomy dilemma of AI-generated works within the current dynamics of the creative industry, indicating a taxonomy dilemma. Further analysis also indicates that while there’s a decent urgency to address all of the normative issues that exist within Indonesia’s IPR legal framework, it’s imperative that Indonesia prioritizes the development of the copyright and patent regimes, which are closely related to the nature of AI-generated works.

Abstract

Background: This study discusses the regulation and mechanism for the return of assets resulting from corruption crimes through international cooperation in the form of Mutual Legal Assistance (MLA) by comparing the practice in Indonesia and Singapore.Methodology: This study uses normative research methods and data collection techniques through literature review with secondary data sources and using statute and comparative approaches. Objectives: The study aims to compare the asset recovery practices through MLA in Indonesia and Singapore. Findings: The findings of this study reveal that Indonesia is still standing on a relatively suboptimal rate of return on assets resulting from corruption compared to Singapore. And, although Indonesia is a party of the ASEAN MLA, Indonesia also implements the bilateral agreements with countries inside and outside ASEAN. Originality/Novelty:The results of this study show that Indonesia needs to strengthen its diplomacy ties with the other countries, pass the Asset Forfeiture Bill, and make the ASEAN MLA as its main agreement to implement an efficient asset returns in the ASEAN region.

Abstract

Introduction to the Problem: Indonesia has been continuously developing its legal framework regarding many aspects of digital spaces, including cybersecurity, in the quest of maximizing the potentials of Industry 4.0. However, this rapid development of legal framework must be analyzed thoroughly to make sure that it’s in line with the principles of human rights. Purpose/Study Objectives: Drawing from international standards of human rights, this research focuses on analyzing the cybersecurity legal framework in Indonesia, and how the laws and regulations related to it fare against international standards of human rights. Design/Methodology/Approach: Using the normative legal research method, this research analyzes secondary data in the form of primary Indonesian and international law sources to evaluate the protection of human rights in the midst of this legal development. Findings: Findings of this research show that the legal framework in Indonesia does leave many rooms for potential human rights abuse, with normative loopholes and underestimation of potential issues regarding the denial of human rights, within digital spaces. Abstract

Public service is a way to realize a prosperous country. Notaries are officials who provide public services in the field of legal services for the community. The role of notaries is very important in providing legal certainty. The purpose of this study is to analyze notary services in the Riau Islands Province and the role of the supervisory board in supervising the performance of notaries. The method in this study is empirical juridical. In answering the problem in this study, the legal basis namely Law Number 2 of 2014 Concerning the Position of Notary and theoretical basis is used, namely the theory of legal certainty by Hans Kelsen and legal protection theory by Philipus M. Hadjon. The results of the study show that notary services still face various problems, especially in the Batam City area. However, there still needs to be synergy between regional and central supervisors in taking firm action against notaries who do not provide good public services. The role of regional supervisors in providing guidance to notaries is expected to provide preventive and repressive protection. The preventive role can be carried out through guidance and repressive can be carried out with the active role of supervisors at the central level in providing sanctions for permanent dismissal based on recommendations from the supervisory board at the regional level.

Abstract

Keselamatan kapal perikanan menjadi aspek krusial dalam menjaga keberlanjutan sektor perikanan, khususnya di Kepulauan Riau yang kaya akan sumber daya kelautan. Kapal perikanan kecil, sebagai tulang punggung industri perikanan, menghadapi tantangan serius terkait registrasi dan penertiban. Penelitian ini bertujuan untuk menyelidiki tantangan dan prospek registrasi kapal kecil di Kepulauan Riau serta memberikan gambaran komprehensif mengenai keselamatan kapal perikanan di wilayah tersebut. Penelitian ini bertujuan untuk menganalisis peraturan dan implementasi registrasi kapal perikanan di Kepulauan Riau, mengevaluasi peran Pemerintah Daerah dalam penertiban kapal perikanan, dan merumuskan rekomendasi untuk meningkatkan keselamatan kapal perikanan di wilayah ini. Metode penelitian yang digunakan adalah metode yuridis normatif dengan menggunakan pendekatan konseptual dan pendekatan perundang-undangan. Pendekatan konseptual akan digunakan untuk mengidentifikasi konsep-konsep dasar terkait keselamatan kapal perikanan dan registrasi kapal kecil di wilayah Kepulauan Riau. Analisis menunjukkan bahwa registrasi kapal kecil di Kepulauan Riau menghadapi berbagai tantangan, termasuk kendala administratif, kurangnya pemahaman masyarakat nelayan, dan kurangnya infrastruktur pendukung. Pemerintah Daerah Kepulauan Riau telah mengambil langkah-langkah strategis, namun implementasi masih dihadapkan pada tantangan sumber daya manusia dan teknologi. Rekomendasi diberikan untuk meningkatkan efektivitas registrasi kapal, penertiban, dan keselamatan kapal perikanan secara keseluruhan. Title: Fishing Vessel Safety: Challenges and Prospects for Small Vessel Registration in the Riau Islands Fishing vessel safety is a crucial aspect in maintaining the sustainability of the fisheries sector, especially in the Riau Islands which are rich in marine resources. Small fishing vessels, as the backbone of the fishing industry, face serious challenges regarding registration and regulation. This research aims to investigate the challenges and prospects of small vessel registration in the Riau Islands and provide a comprehensive picture of fishing vessel safety in the region. This research aims to analyze the regulations and implementation of fishing vessel registration in the Riau Islands, evaluate the role of the Regional Government in controlling fishing vessels, and formulate recommendations to improve the safety of fishing vessels in this region. The research method used is a normative juridical method using a conceptual approach and a statute approach. A conceptual approach will be used to identify basic concepts related to fishing vessel safety and small vessel registration in the Riau Islands region. Analysis shows that small vessel registration in the Riau Islands faces various challenges, including administrative obstacles, lack of understanding of fishing communities, and lack of supporting infrastructure. The Regional Government of the Riau Islands has taken strategic steps, but implementation is still faced with human resource and technological challenges. Recommendations are provided to improve the effectiveness of vessel registration, control and overall safety of fishing vessels.

Abstract

Fraudulent investment is an investment activity that offers to give a promise of maximum profit in a short time without the need to do a job that is physically, mentally and mentally exhausting and find information about the origin of the platform. Asset forfeiture by law enforcement aims to make the perpetrator fall into poverty to provide a deterrent effect and uphold a sense of justice for perpetrators of criminal acts such as money laundering. Poverty is a frightening thing in their lives. The purpose of the research is the general objective in conducting this research to find out how the recovery of asset forfeiture in handling cases of money laundering crimes. The specific objective is to analyze how the effectiveness of asset forfeiture implementation against fraudulent investment through legal comparison (Indonesia & South Korea). The research method that the author uses is in accordance with the title and relevant, so the author uses normative legal research methods. In this case, normative research is used because the characteristics of this normative legal research method are to examine legal comparisons regarding the Asset Forfeiture Law in Indonesia and South Korea. Asset forfeiture in South Korea shows effective enforcement of justice. The Indonesian people hope that this measure will be implemented to realize the 5th principle of Pancasila “Social justice for all Indonesian people” by impoverishing criminals through asset forfeiture.

Abstract

Human trafficking remains a major humanitarian crime problem worldwide. Indonesia has made efforts to combat human trafficking by establishing various regulations that serve as the main foundation in this fight, one of which is Law No. 21 of 2007. The framers of the law used the Palermo Protocol as the foundation for its creation. As a transnational crime, human trafficking has also prompted ASEAN, as a regional organization, to take a stand. Since the 1990s, ASEAN has included human trafficking in its agenda to be collectively eradicated. However, human trafficking practices in Indonesia and ASEAN continue to increase, with various methods of operation. Unfortunately, the majority of the victims of this crime are women and children. This article aims to examine the formalization of national law and ASEAN's role at the regional level in combating human trafficking within the framework of international law. This research employs a normative legal approach. The findings indicate a disconnection between national regulations and the fundamental norms upon which they were based, as well as disharmony with other national regulations. Meanwhile, in the ASEAN context, the formation of hard law has not yet been fully implemented, a situation further compounded by the rigid principle of non-intervention in ASEAN.
