Abstract

The implementation of juvenile justice with a progressive legal approach deserves to be used in child law enforcement because it prioritizes the interests of child protection. The relevance of progressive law enforcement to the juvenile justice system in Indonesia rests on the objectives of the juvenile justice system and the existence of rules for arrest, detention, and sentencing of crimes as an effort and form of sanctions against children, which can be in the form of treatment placed in the juvenile justice constitution. This research uses the juridical-normative method, namely legal analysis conducted by reviewing library materials or secondary data, and the data will be analysed through qualitative methods. This study aims to make law enforcers apply progressive law maximally in law enforcement of juvenile justice. The results of this study indicate that law enforcement for juvenile criminal justice in Indonesia is generally still far from the will of law enforcement with a progressive legal approach, and diversion is the right way to decide child criminal cases.

Abstract

The development of artificial intelligence has posed significant challenges to the concept of moral rights within Indonesia's intellectual property law framework. This study aims to analyze the construction of moral rights for works generated by AI through the lens of legal constructivism. Employing a normative legal research methodology with legislative and philosophical approaches, the study examines the existing legal framework and its implications for the protection of moral rights in the artificial intelligence era. The findings reveal that the construction of moral rights in Indonesia is anchored in an anthropocentric concept, prioritizing human consciousness and creative intent. Artificial intelligence, as an entity lacking consciousness or moral interests, cannot be deemed a subject of moral rights in the traditional sense. The study concludes that a reformulation of the legal framework is necessary to accommodate the complexities of artificial intelligence-driven creative ecosystems while preserving the essence of moral rights protection, which remains human-centered. Perkembangan artificial intelligence telah menciptakan tantangan signifikan terhadap konsep hak moral dalam hukum kekayaan intelektual di Indonesia. Penelitian ini bertujuan menganalisis konstruksi hak moral atas karya yang dihasilkan artificial intelligence melalui perspektif konstruktivisme hukum. Menggunakan metode penelitian hukum normatif dengan pendekatan perundang-undangan dan pendekatan filosofis, penelitian ini mengkaji kerangka hukum yang ada serta implikasinya terhadap perlindungan hak moral di era artificial intelligence. Hasil penelitian menunjukkan bahwa konstruksi hak moral di Indonesia bertumpu pada konsep antroposentris yang mengutamakan kesadaran dan kehendak kreatif manusia. Artificial intelligence sebagai entitas yang tidak memiliki kesadaran atau kepentingan moral, tidak dapat menjadi subjek hak moral dalam pengertian tradisional. Penelitian menyimpulkan bahwa diperlukan reformulasi kerangka hukum yang dapat mengakomodasi kompleksitas ekosistem kreatif berbasis artificial intelligence, namun tetap mempertahankan esensi perlindungan hak moral yang berorientasi pada kepentingan manusia.

Abstract

Currently there are no indicators that can measure the effectiveness of the role of ASEAN in Southeast Asia, especially those related to human security issues in the safety of labor and migrants' mobilization. However, ASEAN still working through any possibilities of cooperation to prevent any threats that would endanger the personal securities of ASEAN community. This paper will further analyze the human security issues in Southeast Asia starting with conceptualizing, identifying, and engaging to find how is the effectivity of ASEAN in charge of prevent human security issues from sociology of law perspective with normative-juridical methodology combined with perspective of international relation approach. Based on the findings in conceptual and data, this research will show the problems that have been handled and have not been done by ASEAN institutionally. In addition to showing the relevance of the establishment of ASEAN Political-Security Community (APSC) 2015 as an affirmation for all ASEAN member countries to respond to institutional human security issues especially in the mobilization of labor and migrants.

Abstract

The aim of this research was to analyze legal problems that are hindering the process of intellectual property rights (IPR) transfer within the Indonesian legal system. This objective was achieved by employing the normative legal research method with a statutory approach while, utilizing secondary data. Accordingly, the secondary data used consisted of primary legal sources, including Law No. 30 of 2000 on Trade Secrets, Law No. 20 of 2016 on Trademarks and Geographical Indications, Law No. 28 of 2014 on Copyrights, Law No. 13 of 2016 on Patents, as well as relevant judicial decisions made within the Indonesian legal system, which enhanced the analysis. This research showed the problems that exist within the Indonesian legal system regarding the transfer of IPR and identified the contributing factors. Furthermore, from the analysis conducted, it was found that the Indonesian IPR legal framework is too complex and lacks harmony, specifically when it comes to the mechanisms involved in IPR transfer and the bureaucratic efficiency associated with these processes. This research serves the purpose of providing comprehensive literature for the development of better intellectual property laws, which are continuously being refined by the Indonesian government to protect and foster creativity in the economy of the country, thereby making it a more attractive prospect for capital. Unlike previous studies, this research placed significant emphasis on legal problems specifically hindering the process of IPR transfer and examined their impacts on actual IPR cases within the Indonesian legal system.

Abstract

This paper explores the various practices surrounding the legal framework for protecting personal data in the context of private electronic systems used by commercial companies. The research's main focus is the ambiguity of the goals of Indonesia's Electronic System providers and how they may adopt better practices to enhance data protection within Electronic System Providers, so this extensive examination also includes a thorough comparison of the personal data protection laws in South Korea and Indonesia. This investigation aims to carefully define, evaluate, and harmonize the two countries' unique legal systems. This study uses a normative legal research framework with a Teleological and Legal Protection approach as its research technique. Additionally, it uses the comparative law method to clarify, outline, and examine the specifics of the personal data protection laws that are now in force in Indonesia and South Korea. The results of this research go beyond identifying problems; they are expected to produce a thorough understanding of the complexities surrounding personal data security in the context of electronic commerce. These discoveries are well-positioned to be the foundation for upcoming regulatory improvements, eventually encouraging more potent and reliable data protection procedures in both nations.

Abstract

Indonesia, a developed nation, is currently emphasizing its developmental efforts, particularly in the economic sphere. Given that financial resources are not evenly distributed among the Indonesian population across all levels and regions, financial institutions play a crucial role in bolstering the country's economic resilience. Banks, in particular, provide loans to individuals in need of quick funds, addressing society's economic requirements more equitably. With the advancement of technology, the financial sector has undergone a transformation towards digitalization. In this study, a normative method is employed to examine the vertical and horizontal aspects encompassing laws and regulations. The focus is on the legal protection extended to users of online loan services, aiming to identify the safeguards available for consumers utilizing such services. The government, in its commitment to safeguard the Indonesian population residing in the digital realm, particularly in the financial sector where information technology is utilized, has implemented several regulations. Notable among these are the Financial Services Authority Regulation Number 77/POJK.01/2016, the Information and Electronic Transactions (ITE) Law, the Personal Data Protection Law, and the Consumer Protection Law. Given the inherent significance of personal data in the digital world, it becomes crucial to protect it as it forms an integral part of an individual's legal identity. Any misuse of personal data by irresponsible parties infringes upon an individual's rights as a legal subject.

Abstract

Potensi militerisasi di Laut Cina Selatan memiliki pengaruh terhadap kelestarian cagar budaya di Kepulauan Riau. Dampak terjadinya militerisasi dapat menyebabkan punahnya cagar budaya bangsa yang senantiasa dijaga dan dilestarikan. Fokus kajian penulis yaitu pengimplementasian peraturan nasional dan internasional terkait perlindungan cagar budaya. Pada penulisan ini penulis menggunakan metode pendekatan penelitian yuridis normatif, yaitu pemerolehan suatu sumber data utama dengan cara menelaah teori-teori, konsep-konsep, asas-asas hukum serta peraturan perundang-undangan yang berhubungan dengan penelitian ini. Pada penelitian ini penulis menggunakan pendekatan kualitatif pendekatan Perundang-undangan (Statute Approach) pendekatan kepustakaan (Library Research). Bahan hukum yang digunakan dalam penelitian ini merupakan bahan hukum primer dan bahan hukum sekunder. Bahan hukum primer diperoleh dari perundang-undangan. Sedangkan bahan hukum sekunder diperoleh dari pengkajian kepustakaan (Library Research), seperti: buku, jurnal-jurnal hukum, internet dan pendapat para ahli. Hasil penelitian ini menunjukan bahwasanya Peraturan Daerah Kota Tanjungpinang Nomor 8 Tahun 2018 Tentang Pengelolaan Wisata Budaya Pulau Penyengat merawat cagar budaya Makam Engku Puteri Raja Hamidah yang diperoleh berdasarkan Keputusan Menteri Pendidikan dan Kebudayaan Republik Indonesia Nomor 112/M/2018 tentang Kawasan Cagar Budaya Pulau Penyengat Sebagai Kawasan Cagar Budaya Peringkat Nasional. Convention concerning the Protection of World Cultural and Natural Heritage merupakan konvensi UNESCO yang berperan dalam melindungi cagar budaya diseluruh dunia.

Abstract

Batam is recognized as one of the regions within the Riau Islands Province designated as a Free Trade Zone (FTZ) in Indonesia due to its strategic positioning along international shipping routes. As a border region of Indonesia, it encounters challenges typical of other border areas, closely linked to issues of order, security, and national integrity. Moreover, within Batam, which serves as both a border area and an FTZ, a persistent issue revolves around the prevalence of illicit activities and the smuggling of foreign-origin products. The smuggling of electronic goods in Batam is driven by market demands beyond the city, seeking electronic items at comparatively lower prices than those in other regions. The lack of public awareness regarding the implications of purchasing illegal or smuggled goods constitutes a significant impediment to the eradication of illicit smuggling in Indonesia. This research employs the doctrinal or normative legal research method, utilizing secondary data obtained through a comprehensive review of literature such as books, journals, articles, and other relevant sources, including online resources. The choice of normative legal research method is justified by the research's objective, which aims to analyze the law from the perspectives of three fundamental legal values: justice, utility, and certainty. The findings of this research affirm that despite the legal regulations governing the criminal offense of smuggling and associated sanctions outlined in the legislation, the oversight implementation by BP Batam has not been entirely effective. This is evidenced by the continued occurrence of smuggling activities in Batam, attributed to various challenges encountered by BP Batam in their enforcement endeavors.
