Abstract

Panti asuhan merupakan suatu organisasi sosial yang bertanggung jawab dalam meningkatkan kesejahteraan kaum dhuafa, anak terlantar, dan yatim piatu. Salah satu topik yang perlu diedukasikan ke anak-anak panti asuhan ialah cara pengolahan sampah dengan metode 3R. Metode yang digunakan dalam kegiatan sosialisasi ini ialah metode pendidikan masyarakat, yang mana mahasiswa/i UIB melakukan penyuluhan yang bertujuan untuk meningkatkan kesadaran anak-anak panti mengenai pentingnya menjaga lingkungan sekitar dan cara mengolah sampah yang baik dan benar. Setelah melakukan sosialisasi ini, didapatkan hasil yang memuaskan, dikarenakan anak-anak panti menjadi lebih teredukasi mengenai cara pengolahan sampah dengan metode 3R. Walaupun begitu, masih banyak hal yang dapat dikembangkan dalam sosialisasi ini, seperti pemaparan sampah secara langsung agar anak-anak panti dapat lebih mudah memvisualisasikannya.

Abstract

This paper explores the various practices surrounding the legal framework for protecting personal data in the context of private electronic systems used by commercial companies. The research's main focus is the ambiguity of the goals of Indonesia's Electronic System providers and how they may adopt better practices to enhance data protection within Electronic System Providers, so this extensive examination also includes a thorough comparison of the personal data protection laws in South Korea and Indonesia. This investigation aims to carefully define, evaluate, and harmonize the two countries' unique legal systems. This study uses a normative legal research framework with a Teleological and Legal Protection approach as its research technique. Additionally, it uses the comparative law method to clarify, outline, and examine the specifics of the personal data protection laws that are now in force in Indonesia and South Korea. The results of this research go beyond identifying problems; they are expected to produce a thorough understanding of the complexities surrounding personal data security in the context of electronic commerce. These discoveries are well-positioned to be the foundation for upcoming regulatory improvements, eventually encouraging more potent and reliable data protection procedures in both nations.

Abstract

The right to access clean water is a fundamental human right and an important part of SDGs. Indonesia as a country committed to developing SDGs-compliant policies to respond to climate challenges need to make sure that it has enough normative support from its legal framework. Using normative legal research method, this study analyzes the emerging legal problems regarding the Indonesian government’s responsibility to provide clean water to its citizens. To support the analysis, this study employs the statutory approach to find the normative problems contributing to a number of possible legal problems that might hinder Indonesia’s commitment to SDGs, particularly the one to make sure that every person has the right to access clean water. Analysis of this research finds that there are normative confusions within the Indonesian legal framework that are related to the government’s responsibility in providing access to clean water, along with the urgency to tackle to these normative issues to better deal with the emerging legal problems, in the face of climate change.

Abstract

Indonesia possesses significant potential to enhance and expand its halal industry, leveraging its unique cultural assets from many of its indigenous communities. One of the ways to ensure the growth of the halal industry is the facilitation of IPR protection through the legal framework. Using a normative method supported by a statutory approach, this research analyzed the challenges and potentials of integrating halal certification into the communal IPR system in Indonesia. The analysis found many restrictions within the existing positive laws which can prevent the integration of halal certification into the communal IPR system. This research proposed a model of communal IPR according to the challenges identified, along with the normative construction needed to establish it. This model mainly focused on providing normative spaces for the integration of sharia compliance while also making sure that the purposes of IPR protection are fulfilled.

Abstract

Perdagangan secara daring berkembang pesat sejak saat internet dihadirkan. Perkembangan secara signifikan dalam platfrom marketplace tersebut harus terus diawasi dengan tegas, barang yang dijual harus sesuai dengan peraturan perundang undangan, terutama terkait beredarnya obat-obatan yang mengandung psikotropika. Pada Peraturan Menteri Kesehatan Pasal 44  Nomor 73 Tahun 2016 menjelaskan bahwa Psikotropika hanya dapat diserahkan oleh fasilitas pelayanan Kesehatan dan hanya dapat menyerahkan berdasarkan resep dokter. Namun sering dijumpai pada marketplace pelaku usaha yang tidak memiliki izin edar masih menjual obat psikotropika. Tujuan dari penulisan ini adalah untuk menganalisis akibat hukum serta pertanggungjawaban hukum bagi para penjual obat golongan psikotropika di marketplace didasarkan kepada perbandingan hukum dengan negara Singapura.  Berdasarkan hasil perbandingan hukum dengan negara singapura terkait jual beli obat psikotropika secara bebas pada marketplace , ialah bahwa penjualan obat psikotropika sangat dibatasi, hal tersebut juga didukung dengan penerapan hukum yang tegas sehingga tidak dapat ditemukan di marketplace. Dalam hal ini dapat menjadi pembelajaran bagi pemerintah indonesia untuk melakukan pengawasan yang lebih ketat guna mengurangi penyalahgunaan yang terjadi akibat pengedaran obat tersebut.

Abstract

International law has an aim to help international community to ensure the peace and security between states. Whenever a dispute between states arisen in any field of law, there are some choices of dispute settlement, which could be chosen by state entities to solve it, which are diplomatic methods and the adjudicative methods. As mentioned in article 3 point 1(a) of Vienna Convention 1961, the function of diplomatic mission is represent the sending state in the receiving state. The functions are not only in ceremonial attempt. Diplomatic mission also could protest and do inquiries to the receiving states if there are any dispute arisen. Same rule do applied in maritime disputes between Indonesia and Vietnam recently. Indonesian Navy patrol ship under name KRI Tjiptadi 381 was hit by two surveillance vessels owned by the Vietnam Coastguards while pursuing illegal fishing boats on the North Natuna Sea, which is defined as “undelimited” maritime boundaries between Indonesia and Vietnam on Saturday, April 27th 2019. The Indonesian Foreign Ministry then called on the Vietnamese Ambassador as the diplomacy mission of Vietnam in Jakarta to deliver a protest note against a dangerous incident in the North Natuna Sea. This article will discuss about the limitations of diplomatic mission authority in dispute settlement between states, also does the diplomacy settlement could give a better result settling the maritime boundaries dispute.

Abstract

Batam is recognized as one of the regions within the Riau Islands Province designated as a Free Trade Zone (FTZ) in Indonesia due to its strategic positioning along international shipping routes. As a border region of Indonesia, it encounters challenges typical of other border areas, closely linked to issues of order, security, and national integrity. Moreover, within Batam, which serves as both a border area and an FTZ, a persistent issue revolves around the prevalence of illicit activities and the smuggling of foreign-origin products. The smuggling of electronic goods in Batam is driven by market demands beyond the city, seeking electronic items at comparatively lower prices than those in other regions. The lack of public awareness regarding the implications of purchasing illegal or smuggled goods constitutes a significant impediment to the eradication of illicit smuggling in Indonesia. This research employs the doctrinal or normative legal research method, utilizing secondary data obtained through a comprehensive review of literature such as books, journals, articles, and other relevant sources, including online resources. The choice of normative legal research method is justified by the research's objective, which aims to analyze the law from the perspectives of three fundamental legal values: justice, utility, and certainty. The findings of this research affirm that despite the legal regulations governing the criminal offense of smuggling and associated sanctions outlined in the legislation, the oversight implementation by BP Batam has not been entirely effective. This is evidenced by the continued occurrence of smuggling activities in Batam, attributed to various challenges encountered by BP Batam in their enforcement endeavors.

Abstract

Child marriage is a significant human rights issue as it deprives children around the world of their childhood, education, and safety. Its unfortunately a practice that still has prevalence in Indonesian society. This research is done for the purpose of analyzing the threat of child marriage and the urgency for a dedicated effort to tackle this issue normatively. Through the normative legal research method and supported by comparative analysis, this research analyzes how the Indonesian legal framework fare up to international human rights standards and best practices around the world, in tackling the practice of child marriage. Findings of this research suggest that child marriage can still be considered a neglected human rights abuse, due the minimum number of legal developments throughout the years. The findings expose the legal loophole and the lack of criminalization which can contribute to the prevalence of this dangerous phenomenon. This research serves the purpose of the betterment of human rights protection in Indonesia, specifically on vulnerable underage girls, by providing insights and recommendations that the government may consider for future legal development.

Abstract

Technology continues to advance as time evolves. Conventional transportation methods have long been the preferred choice for individuals heading to specific destinations. However, the emergence of online-based transportation services like Grab has made it easier for people to move around by simply using the GrabAppon their smartphones. While the GrabApphas brought numerous benefits to society it also comes with certain drawbacks, such as instances where drivers do not align their identities with the information provided on the Grab platform. This mismatch can lead to potential inconveniences and safety concerns for consumers, including the possibility of account takeovers. The objective of this research is to understand and analyze the consumer protection regulations concerning legal issues and forms of protection, and to undertake a comparative analysis of the legal frameworks in Indonesia and Singapore regarding online drivers and the penalties imposed when they encounter legal complications. In conducting this research, the author adopted a normative doctrinal research approach, encompassing legislative and comparative legal perspectives. The data gathered during this investigation were subjected to qualitative analysis techniques. The research findings reveal that the legal regulations in Indonesia and Singapore are relatively similar. Both countries have regulations covering traffic and transportation, consumer protection, and sanctions for drivers whose identities do not match the application. The result of the research is to improve the regulation concerning the implementation of sovereign rights and jurisdiction that is related regulatory provisions regarding consumer’s right in Indonesia and Singapore.

Abstract

With the rapid advancement of technology, the emergence of Non-Fungible Token (NFT) platforms has revolutionized digital buying and selling. However, this innovative platform has also given rise to a concerning issue: the unintentional trade of personal data instead of artwork. This problem poses a significant challenge in protecting individuals' personal information, especially when items like National Identity Card (KTP) photos are sold as NFT assets. This research aims to explore the critical importance of legal education in safeguarding personal data, thus preventing such transactions that may lead to self-harm. Employing a normative juridical method and a conceptual approach, this study extensively analyzes legal aspects and regulations related to personal data protection. The findings underscore the urgent need for legal education to effectively address personal data transactions on NFT sites within marketplace platforms. Despite the implementation of the Personal Data Protection Act (Law Number 27 of 2022), it is clear that the legislation alone is insufficient. Given the gravity of the issue, comprehensive public education initiatives involving various segments of society are crucial. Protecting personal data has become a matter of utmost concern for the government, the state, NFT platform users, and internet users at large. Individuals must adopt a vigilant and proactive approach in safeguarding their personal data. Legal education programs, including outreach activities conducted by governmental and non-governmental entities, along with the involvement of students and academics in community counseling, can effectively support this objective.
