Abstract

Program Keluarga Harapan merupakan program pembangunan kesejahteraan masyarakat. Dalam pelaksanaannya, PKH masih terdapat masalah. Temuan penulis di Desa Samborejo Kecamatan Tirto Kabupaten Pekalongan menambah persoalan dari PKH. Hal ini menyangkut tentang pelaksanaan PKH sesuai dengan Permensos Nomor 1 Tahun 2018 Tentang Program Keluarga Harapan. Paper ini mencari tahu bagaimana pelaksanaan Permensos Nomor 1 Tahun 2018 tentang PKH di Desa Samborejo Kecamatan Tirto Kabupaten Pekalongan, serta tinjauan Permensos Nomor 1 Tahun 2018 Tentang Program Harapan Keluarga di Desa Samborejo Kecamatan Tirto Kabupaten Pekalongan menurut perspektif fikih siyasah dusturiyah. Paper ini termasuk dalam jenis penelitian yuridis empiris dengan pendekatan top and down. Penelitian ini bersifat deskriptif analisis atau analisis kualitatif yakni menggambarkan data dan informasi lapangan berdasarkan sebagaimana adanya pada waktu penelitian kemudian dianalisa secara mendalam. Hasil penelitian yang diperoleh adalah bahwa ada beberapa masyarakat yang memenuhi kriteria untuk mendapatkan bantuan sosial PKH ini tetapi belum mendapatkannya. Hal ini masih kurang sesuai apa yang telah diatur dalam Permensos Nomor 1 Tahun 2018 tentang PKH. Namun saat peneliti melakukan wawancara dengan keluarga penerima manfaat merasakan dampak yang baik dalam kehidupan mereka, karena merasa terbantu dengan adanya bantuan sosial ini. Kebijakan ini juga sesuai dengan kaidah fikih siyasah dusturiyah karena peraturan yang dibuat memiliki kemaslahatan untuk kehidupan bermasyarakat.

Abstract

This paper analyzes the fulfillment of workers' rights in Termination of Employment Relationship during the Covid 19 Pandemic at PT Sukorintek and legal remedies that can be taken to fulfill workers' rights.This empirical juridical research uses a qualitative approach. Data collection techniques using interviews and documentation studies. The analysis technique uses an interactive model. The results showed that, Fulfilling workers' rights in Termination of Employment Relationship during the Covid 19 Pandemic at PT. Sukorintex Indah Textile is not in accordance with the provisions of the labor laws and regulations. PT. Sukorintex only provides severance pay to workers as much as 0.40 (40%) of the amount that should be received by workers. Whereas according to the labor laws and regulations, workers who are laid off due to force majeure which do not cause the company to close as in the case of PT Sukorintek are entitled to severance pay of 0.75 (zero point seventy five) times of service; 1 (one) time service award in accordance with the period of service and compensation for other entitlements in accordance with the period of service. Legal remedies that can be taken in the case of PT. Sukorintex, among others: using non-litigation, namely bipartite negotiations, mediation, and conciliation or using litigation, namely through the Industrial Relations Court at the District Court in the legal area where the worker/laborer works.

Abstract

This study aims to analyze how the regulation on Digital Work Copyright in Positive Law in Indonesia and how the legal protection of copyright in digital artwork from the perspective of Islamic Law and Law No. 28 of 2014 concerning Copyright. With qualitative and normative legal methods through a legislative and conceptual approach, which is taken by considering all laws and regulations related to the problem at hand, and a conceptual approach. The results of this study can be concluded that the Regulation on Digital Work Copyright in Positive Law in Indonesia according to Law Number 28 of 2014 can be done in two ways, namely first, preventive protection efforts by protecting copyright starting with warnings and reprimands for perpetrators who commit violations. Abstract

Introduction. Diabetes mellitus (DM) has become a health problem in the world, and if not treated, many of the body's systems can be damaged, especially the nerves and blood vessels. This research aims to explain the influence of walking and drinking water hydrotherapy to decrease random blood sugar levels in patients with type 2 diabetes. Method. This research designed in this study was Quasi-Experimental, with the Control Group Pre-Post Test Design. The sampling method used purposive sampling. The sample of this research were 32 respondents in Sumbergede Village. The independent variable was walking therapy and drinking water hydrotherapy, while the dependent variable was random blood sugar levels in patients with type 2 diabetes mellitus. The instruments used walking SOP, hydrotherapy SOP and glucose meter. The data analysis technique used Wilcoxon Sign Rank Test. Result and Analysis. This study random blood sugar level in the treatment and control groups before intervention was hyperglycemia category and after intervention in the treatment group was mostly euglycemia while in the control group the majority hyperglycemia. The results of the Wilcoxon Sign Rank Test were ρ = 0.001 (ρ <0.05), meaning that there is a significant influence of a combination of walking therapy and hydrotherapy against random blood sugar reduction in patients with type 2 diabetes. The results of the Mann Whitney statistical test showed that the value of ρ = 0.001 (ρ <0.05), so that there was a significant difference in decreasing random blood sugar levels between the treatment group and the control group. Discussion. Walking therapy can increase blood glucose usage in active muscles. While drinking water hydrotherapy causes the breakdown of blood glucose, the combination of walking therapy and drinking water hydrotherapy can cause random blood sugar level to decrease. This study was expected to make one of the anti-diabetes medication companion therapies in reducing random blood sugar level in patients with type 2 DM.

Abstract

Masyarakat Kasepuhan merupakan masyarakat adat Sunda yang hidup di sekitar Taman Nasional Gunung Halimun - Salak (TNGHS). Masyarakat adat ini mempunyai kekhasan dalam mengatur kehidupan warganya dalam berelasi dengan alam. Melalui konsep pancer pangawinan masyarakat mensandarkan kehidupannya pada keterikatan atas tanah. Permasalahannya sekarang adalah sejak diterbitkannya kebijakan perluasan Taman Nasional melalui SK Menteri Kehutanan Nomor 175/Kpts-II/2003, tanah yang dulu dikuasai oleh masyarakat berubah status menjadi tanah Taman Nasional. Perubahan status tanah tersebut menyebabkan hilangnya akses masyarakat terhadap tanah. Kondisi ini menempatkan masyarakat pada kondisi konflik dengan Pengelola TNGHS. Metode penelitian ini adalah kualitatif dengan paradigma konstruktivisme (Denzin, 2000). Teknik pengumpulan data melalui indepth interview, observasi partisipan, dan Focus Group Discussion (FGD). Hasil dan temuan penelitian menunjukkan adanya pengetahuan lokal masyarakat Kasepuhan dalam hal mengatur kelestarian lingkungan dan bagaimana lingkungan tersebut dapat memberi manfaat untuk kehidupan masyarakat. Misalkan dengan adanya konsep Ibu Bumi, Bapak Langit dan Guru Mangsa, Leuit dan Wewengkon Hutan. Pengetahuan ini telah dikembangkan secara turun temurun dan mengatur relasi masyarakat dengan alam (hutan). Namun pertarungan pengetahuan masyarakat lokal dan pengelola TNGHS telah menyebabkan teralienasinya pengetahuan lokal tersebut. Dengan mengacu pada konsep Escobar (1999), maka dapat disimpulkan bahwa pengetahuan lokal dalam mengelola sumber daya alam dapat dipandang sebagai rezim alam organik, dimana sejak diberlakukannya SK Menteri Kehutanan tentang perluasan TNGHS, masyarakat lokal dengan alam organiknya sedang berhadapan dengan pengelola TNGHS selaku rezim alam negara yang dalam prakteknya bertumpu pada pengetahuan kapitalis dan tekno, dalam memperjuangkan hak akses atas tanah.

Abstract

This qualitative descriptive research aimed to describe in detail the meaning of the values of religion and expression of women's resignation batik workers in the struggle of the production process, and the factors that influence it. Research was taken place in Pekalongan city and data obtained through observation, interviews, and literary studies. The results showed that deep belief in God is the foundation of understanding of the value of religion in the world of work as well when they interact with the skipper and other workers. The expression of resignation is seen almost in all stages from raw material procurement, production to marketing. Surrender women sanggan also evident in labor relations and outside the employment relationship, which is due to the fact that the religious elite is skipper and social conditions of patriarchal religious culture.

Abstract

This study aims to analyze the views of gender activists on the MUI Fatwa Number 02/MUNAS-IX/MUI/2015 on the rejection of criminal sanctions for perpetrators of domestic rape and to find out the legal arguments of the informants related to this fatwa . Domestic sexual violence is an important issue and is often ignored in society. This study uses a field research method with an interactive qualitative approach using primary data sources obtained by interview techniques with informants, namely activists of the UIN KH Abdurrahman Wahid Pekalongan gerder, and secondary data in the form of literature from research books obtained by documentation techniques. The data was analyzed using interactive model qualitative data analysis techniques.The results of the study concluded that gender activists' views vary regarding the fatwa. Several activists have different views on this fatwa. However, all of them reject the fatwa on sexual coercion in the household as not sexual violence because it is considered not to support protection for victims and strengthens patriarchal norms. Arguments from gender activists refer to the Domestic Violence Law which categorizes domestic rape as sexual violence . This study suggests that the fatwa be reviewed and accompanied by case studies to increase public understanding and acceptance and provide appropriate legal solutions for perpetrators of domestic rape.

Abstract

In doing business, Islam recommends complying with existing rules, including in terms of debt and credit (al-qardh), which aims as a form of mutual assistance. This study aims to analyze the practice of mosque cash fund accounts payable from the perspective of sharia economic law. This research uses a qualitative descriptive method, where data is obtained directly from the field and processed through qualitative analysis. The results showed that in the case of cash fund payables at the Roudlatul Jannah Mosque in Rama Oetama Village, Seputih Raman Sub-district, Central Lampung Regency, there is an agreement between the mosque cash management and the borrower regarding voluntary additions when returning funds. The amount of this addition is not specifically determined and is submitted according to the sincerity of the borrower. Based on the perspective of sharia economic law, the practice of cash fund payables is considered appropriate because it fulfills the principles of sharia, namely the principles of justice, ihsan, responsibility (al-mas'uliyah), sufficiency (al-kifayah), moderation (wasathiyah/i'tidal), as well as honesty and truthfulness that can be seen in the trustworthy management of mosque cash funds.

Abstract

This research aims to analyze the legal practice of the employment agreement of women domestic workers when they enter into a work contract with their employers in Surakarta City, then to identify patterns of power relations between women domestic workers and their employers when they make their work agreements, and finally to explain the identity politics that attached to women domestic workers when they work in their employer's family. To analyze this phenomenon, a socio-legal study with a qualitative research approach is used. The results of the study show that the practice of working agreements between women domestic workers and their employers even though the work agreements are made in unwriiten, but in fact the values are in accordance with the essence of contract law as regulated in the provisions of the Civil Code (KUHPerdata).  The work agreement shows a contractual and contextual dimension. The working relationship between them is based on a sense of interdependence and high trust between one another. This pattern of giving and receiving can ultimately able to reflect the existence of an equal power relationship between the two when making a work agreement. Even though women domestic workers have been labeled as helpless, they have a confident character and are autonomous in completing their work agreements. This equal relationship can make the relationship between the two very close and intense. This condition has implications for the political transformation of the identity of women domestic workers from outsiders who become part of the insider of the temporary employer's family

Abstract

This research investigates the implementation of Kampus Mengajar policies from the perspective of Islamic religious values. The study aims to analyze how these policies align with Islamic teachings, particularly in fostering social responsibility and educational development. Using descriptive analysis methods, the research involved 17 students participating in the Kampus Mengajar program, with data collected through questionnaires, in-depth interviews, participatory observation, and literature review. The findings reveal that the overall implementation of Kampus Mengajar policies is rated at 3.84, categorized as Good, with the highest score in the Disposition dimension (4.08) and the lowest in the Resources dimension (3.55). Notably, the facility indicator in the Resources dimension received a lower score (2.65) due to limited infrastructure. Despite these challenges, the program positively impacts schools with insufficient teaching staff, fostering creativity and innovation in the learning process. The study concludes that Kampus Mengajar is significantly aligned with Islamic principles, particularly in terms of social justice and responsibility, and enhances students' knowledge and contributions to educational quality, reflecting devotion to God and service to humanity. This research highlights the importance of integrating Islamic values in policy implementation to improve education.
