Abstract

Keberadaan Kebun Raya Lemor di Kabupaten Lombok Timur sebagai sumberdaya alam telah memberikan mafaat secara langsung maupun tidak langsung kepada masyarakat berupa jasa lingkungan. Tingkat kunjungan wisatawan menggambarkan tingginya manfaat kebun raya tersebut kepada manusia. Angka kunjungan wisatawan mengalami peningkatan antara tahun 2016 sampai tahun 2019, menurun drastis pada tahun 2020 dan belum ada peningkatan signifikan sampai saat ini. Ukuran besar atau kecilnya jasa limgkungan Kebun Raya Lemor dapat diketahui dari nilai ekonomi lingkungannya. Penentuan nilai ekonomi suatu objek wisata dapat dilakukan dengan metode biaya perjalanan, dimana biaya perjalanan yang dihitung meliputi total biaya yang dikeluarkan oleh pengujung yaitu mulai perjalanan dari rumah, sampai di kawasan wisata hingga kembali lagi ke rumah. Hasil penelitian ini menyimpulkan bahwa kebun raya lemor memiliki nilai rata-rata surplus konsumen sebesar Rp. 4.049.075 dan nilai ekonomi lingkungan sebesar Rp.195.905.822.

Abstract

Ambiguity in Indonesia's digital laws, particularly in the Electronic Information and Transactions Law (ITE’s Law), has raised concerns over the criminalization of free expression and the erosion of digital rights. Vague terms like "contents against propriety" and "inflicting hatred or dissension" in Articles 27 and Article 28 often lead to subjective interpretations, undermining legal certainty and exposing individuals to unfair prosecution. This study examines the role of the lex certa principle in addressing ambiguities within ITE’s Law and its application to safeguard digital rights. Employing a normative legal research method, that analyzes and systematizes legal norms, synthesizes doctrines, and provides prescriptive justifications aligned with existing laws to guide legal decision-making. This study examines relevant provisions, judicial precedents, and international best practices, including regulatory frameworks in Canada, the European Union, and the United States. The findings highlight that Indonesia's digital laws lack clarity, making them prone to misuse and inconsistent enforcement. Key cases, such as Prita Mulyasari and Baiq Nuril, illustrate the detrimental impact of ambiguous regulations on individuals' rights. The study proposes reforming ITE’s Law by redefining ambiguous terms, enhancing law enforcement training, and adopting proportionality tests to ensure restrictions on expression are justified and lawful. By incorporating lex certa into digital regulations, Indonesia can balance public order and freedom of expression while protecting digital rights. The study concludes with recommendations for multi-stakeholder collaboration in regulatory reforms to create a fair and inclusive digital legal framework.

Abstract

Penelitian ini bertujuan mengembangkan model komunikasi strategis untuk meningkatkan partisipasi Generasi Z Kabupaten Mempawah dalam perlindungan ekosistem mangrove. Penelitian ini merupakan penelitian deskriptif kuantitatif dengan menggunakan metode Analytical Hierarchy Process (AHP). Pengumpulan data melalui kuesioner kepada delapan (8) orang pakar yang berasal dari berbagai latar belakang. Hasil penelitian ini menemukan bahwa arah strategi komunikasi yang berorientasi pada dampak memiliki bobot prioritas tertinggi. Pada tingkat subkriteria, tiga elemen dengan bobot prioritas tertinggi adalah aksi konkret, akses ke platform media sosial, dan biaya langsung. Alternatif strategi terpilih adalah kegiatan aksi langsung. Dengan demikian, model komunikasi yang direkomendasikan untuk meningkatkan partisipasi Generasi Z Kabupaten Mempawah adalah berorientasi pada dampak dengan fokus terhadap kagiatan aksi langsung, optimalisasi penggunaan media sosial, dan pemanfaatan biaya langsung.

Abstract

This study aims to analyze in depth the legal aspects of the seizure of evidence by the state in the First Travel case and its implications for the recovery of victims' losses. This study will use normative legal methods, with a qualitative descriptive approach and case studies, to analyze the Supreme Court's decision on the confiscation of goods from criminal acts. The results of the study are expected to provide a significant contribution to the development of a fairer legal system that better supports the rights of victims of crime. The research data will include court decisions, laws and regulations, and relevant legal literature. The urgency of this study is based on the fact that the handling of TPPU must be carried out carefully and cautiously, by paying attention to the principles of justice and protection of victims' rights. The state has an obligation to eradicate crime, but it also has an obligation to protect the rights of its citizens, including the right to receive compensation for losses suffered as a result of criminal acts. This study is expected to provide constructive recommendations for improving the legal system and law enforcement practices in Indonesia, so that a fairer and more effective system can be created in eradicating crime and protecting victims' rights.

Abstract

This study examines the application of the fiduciary duty principle in realizing Good Corporate Governance (GCG) within Limited Liability Companies in Indonesia. Fiduciary duty serves as a fundamental principle requiring directors and commissioners to act in good faith, with loyalty and prudence, to safeguard the interests of the company and its stakeholders. This research employs a normative juridical approach by analyzing relevant legal frameworks, literature, and regulations, particularly Law Number 40 of 2007 concerning Limited Liability Companies. The findings indicate that effective implementation of fiduciary duty strengthens corporate accountability, transparency, and compliance with legal provisions, ultimately fostering a more ethical and sustainable business environment. However, challenges such as conflicts of interest, lack of transparency, and limited awareness among corporate executives hinder its full implementation. Therefore, continuous education and training for directors and management are essential to enhance their understanding of fiduciary responsibilities. Despite the study’s limitation in scope, which is primarily focused on the Indonesian legal framework, its findings provide valuable insights for improving corporate governance practices. Future research should explore fiduciary duty across various industries to develop more comprehensive recommendations. By consistently applying fiduciary duty principles, companies can achieve robust and accountable corporate governance, thereby supporting long-term corporate growth and sustainability.

Abstract

This study aims to analyze the enforcement of criminal law against illegal logging from the perspective of positive law, particularly Law Number 18 of 2013 on the Prevention and Eradication of Forest Destruction, and Islamic law, which emphasizes ethical principles such as maslahah (public welfare), hifz al-bi'ah (environmental preservation), and hifz al-mal (protection of property). This research employs a qualitative method with a normative and comparative approach, utilizing literature studies and legal analysis. The findings reveal that positive law enforces strict legal sanctions, including imprisonment of up to 10 years and fines of up to 5 billion rupiah, to create a deterrent effect. Meanwhile, Islamic law emphasizes moral responsibility and social awareness, viewing illegal logging as a breach of divine and social trust. Both legal frameworks recognize illegal logging as a criminal act and provide various penalties, including ta’zir in Islamic law. However, the effectiveness of law enforcement depends on government consistency and public participation. This study recommends integrating Islamic legal values with positive law to develop a more comprehensive, value-based, and sustainable legal framework for combating illegal logging.

Abstract

The death penalty has unique characteristics that are different from other forms of punishment. The aim of being studied is to know the existence and constitutionality of the death penalty concerning the objectives of Islamic law This research uses doctrinal research with a legislative approach and decisions regarding the death penalty. The results of this research explain that the application of the death penalty as a form of punishment known in Indonesian criminal law is in harmony with the 1945 Constitution of the Republic of Indonesia and its existence is by Islamic Law. The death penalty in Islamic law states that the concept of the objectives of Islamic law contained in the 1945 Constitution of the Republic of Indonesia is the concept of maqashid sharia which can be used as an alternative in resolving legal problems in society

Abstract

Kecamatan Parung Panjang, Kabupaten Bogor, Provinsi Jawa Barat, menghadapi tantangan serius terkait daya dukung lingkungan akibat pertumbuhan populasi dan perubahan penggunaan lahan. Penelitian ini bertujuan untuk menganalisis daya dukung lingkungan dengan pendekatan Ecological Footprint, yang mengukur konsumsi sumber daya hayati dan limbah yang dihasilkan oleh masyarakat. Metode penelitian yang digunakan meliputi analisis citra satelit untuk memantau perubahan penggunaan lahan, serta penghitungan Ecological Footprint untuk menilai dampak aktivitas manusia terhadap lingkungan. Hasil penelitian menunjukkan bahwa nilai daya dukung lingkungan di Kecamatan Parung Panjang berada dalam kategori surplus, dengan lahan pertanian sebagai penopang utama kehidupan masyarakat. Namun, terdapat perubahan signifikan dalam penggunaan lahan, di mana lahan pertanian berkurang dan beralih fungsi menjadi lahan pemukiman dan infrastruktur. Perubahan ini berpotensi mengancam keberlanjutan sumber daya alam dan kualitas lingkungan. Oleh karena itu, penting untuk mengelola sumber daya secara berkelanjutan untuk menjaga keseimbangan antara kebutuhan manusia dan kelestarian lingkungan

Abstract

This study  focus on the WACC method in determining the optimal cost of capital. The cost of capital must be calculated on an after-tax basis, because after-tax cash flow is the most relevant cash flow to fulfill an investment decision. This study aims to calculate the amount of WACC juxtaposed with the amount of ROA in liquors sub-sector companies listed on the IDX in the period 2018 - 2022 (DLTA and MLBI). The results showed the following calculation as follow: DLTA's highest ROA occurred in 2019 at 2,229%, but in the same year the WACC figure showed 4.44%, CAPM 4.46%, Equity/asset 85.10%, while in the period 2018 - 2022 the lowest WACC was in 2021 at 2.75%. And for MLBI, the highest ROA is 4.236% occurred in 2018, with WACC value 4.39%, CAPM 9.36%, and Equity/asset 40.41%. Meanwhile, the lowest WACC calculation occurred in 2020 at 3.23%. Thus it can be concluded that both of the companies have not achieved optimal result, because when the company achieved the highest ROA it was not matched by the lowest WACC in that period.

Abstract

Carbon Footprint Modeling of Al Kausar Boarding School in the Parungkuda area is the first step in realizing low-carbon educational activities based on boarding school life. This research aims to analyze carbon emissions from the direct and indirect activities of current Al Kausar Internat Middle School residents, as well as develop a model based on a dynamic systems approach to reduce carbon emissions in the future. The research method uses a quantitative approach by collecting data through literature study, observation, questionnaires, interviews, documentation, measuring waste generation, calculating secondary and primary data, calculating gas usage, and calculating the duration of social media access. The research results show that the total carbon emissions from several dominant activities of Al Kausar Boarding School are currently 839,721,408 KgCO 2 eq. Teak gardens and various trees in the school environment absorb carbon dioxide (CO2) as much as 592,675.64 KgCO2 per year. Using carbon uptake by trees cultivated in Al Kausar, total carbon emissions are corrected to 607,888.82 KgCO 2 eq, reducing total emissions to 231,832,588 KgCO 2 eq in scenario I. Scenarios II, III, and IV show further reductions in carbon sequestration from various plants, even reaching harmful total carbon emissions. Scenario V shows an increase in the absorption capacity of trees, which causes total carbon emissions to be corrected to -12,967,412 KgCO 2 eq. Scenario VI shows an increase in the carbon absorption capacity of trees, reducing total carbon emissions to 252,845,358 KgCO 2 eq. With this intervention, it is hoped that Al Kausar Boarding School can become a sustainable education with a lower carbon footprint."
