Abstract

Justice collaborators, or "crown witnesses," have become essential in modern criminal justice systems, particularly in dismantling organized crime and uncovering complex murder cases. This study explores the legal protections afforded to justice collaborators in Indonesia through a doctrinal analysis of the Supreme Court Decision No. 1704 K/PID.SUS/2022, commonly known as the Richard Eliezer verdict. The objective is to critically examine the adequacy and application of legal safeguards provided to individuals who cooperate with law enforcement while implicated in serious crimes. Employing normative legal research methods and a statutory and case approach, the paper reveals discrepancies in the implementation of protections for justice collaborators. While the Indonesian Witness and Victim Protection Agency (LPSK) offers procedural protections, this analysis identifies significant gaps in enforcement, judicial interpretation, and institutional coordination. The findings underscore a need for stronger legislative frameworks and consistent judicial standards to uphold the rights and safety of justice collaborators. The implications extend to criminal law reform and the balancing of retributive justice with restorative mechanisms. This study contributes to the legal discourse on human rights protections in criminal procedure, particularly concerning vulnerable individuals assisting the justice system under duress or threat.

Abstract

This study critically examines the constitutionality of Indonesia’s presidential candidacy threshold under Article 222 of Law No. 7 of 2017 in relation to the principle of popular sovereignty in Article 1(2) of the 1945 Constitution. The threshold requiring a party or coalition to hold 20% of DPR seats or 25% of the popular vote has been controversial for limiting voter choice and reinforcing oligarchic dominance. Using a normative legal research method, the study applies doctrinal interpretation through grammatical, systematic, historical, and teleological approaches to evaluate whether the threshold is consistent with constitutional democracy. The analysis identifies a disconnect between the legislative rule and the constitutional concept of sovereignty residing with the people, informed by theories of democracy, sovereignty, and progressive legal thought. While procedurally legitimate, the threshold lacks substantive constitutional validity because of its exclusionary impact on political participation. The study proposes four reform options: repeal, proportional adjustment, judicial reinterpretation, and constitutional amendment. These reforms would realign electoral rules with democratic principles and restore voters’ political agency. A doctrinal reinterpretation model is offered, framing the threshold as a regulatory instrument rather than a rigid barrier, advocating a legal structure that promotes inclusivity and reflects the people’s general will.

Abstract

Abstract This study analyzes the implementation of strategic management in transforming and enhancing competitiveness at Al Amin Islamic Elementary School, Tabanan. A qualitative descriptive case study was conducted using interviews, observations, and document analysis, following Miles and Huberman’s model. Strategic management involves three key stages: Islamic value-based planning, transformational leadership in implementation, and participatory continuous evaluation. The application strengthened institutional performance and Islamic identity, supporting Bryson’s and Porter’s theories that strategic management integrated with spiritual values enhances competitiveness. Keywords: strategic management, Islamic education, competitiveness, transformational leadership, elementary madrasah Abstrak Penelitian ini bertujuan menganalisis penerapan manajemen strategis dalam mentransformasi dan meningkatkan daya saing di Madrasah Ibtidaiyah Al Amin Tabanan. Penelitian menggunakan pendekatan kualitatif deskriptif dengan rancangan studi kasus. Data dikumpulkan melalui wawancara mendalam, observasi, dan dokumentasi, serta dianalisis menggunakan model Miles dan Huberman.Hasil penelitian menunjukkan bahwa penerapan manajemen strategis mencakup tiga tahapan utama: perencanaan strategis berbasis visi keislaman, implementasi melalui kepemimpinan transformasional dan inovasi pembelajaran, serta evaluasi berkelanjutan dengan partisipasi seluruh warga madrasah. Penerapan ini tidak hanya meningkatkan kinerja lembaga, tetapi juga memperkuat identitas Islam dan kepercayaan masyarakat. Hasil ini memperkuat teori Strategic Planning Model (Bryson) dan Competitive Advantage Theory (Porter), serta menegaskan bahwa manajemen strategis efektif bila disinergikan dengan nilai spiritual dan budaya lokal. Abstract

This article examines the doctrine of piercing the corporate veil in criminal law through a comparative study of Indonesia and the United Kingdom. The study employs a doctrinal methodology, analyzing statutes, case law, and regulatory frameworks to evaluate how each jurisdiction balances corporate governance with legal accountability. The comparative analysis highlights key differences in legal enforcement and procedural thresholds, revealing the evolving nature of corporate criminal liability and corporate responsibility in both jurisdictions. Key findings suggest that recent legislative initiatives and judicial developments have strengthened mechanisms for holding corporate actors accountable, though significant variations in enforcement persist. The study proposes targeted corporate governance and legal reforms to improve accountability and deter misconduct, underscoring the value of comparative insights for policy Development. These findings offer practical recommendations to strengthen corporate governance and prevent wrongdoing in both jurisdictions. By bridging the gap between Indonesian and UK legal perspectives, this research serves as a strategic roadmap for policymakers seeking to refine legal sanctions and promote a culture of corporate integrity.

Abstract

This study aims to analyse the role of the Department of Manpower in providing protection to former Indonesian Migrant Workers (PMI) returning from abroad and to identify the challenges encountered in performing this function. This research employs a normative juridical approach using secondary data sources, including statutory regulations, scientific journals, and institutional reports from 2020 to 2025. The findings reveal that the Department of Manpower plays several key roles, including providing information and education, coordinating with related agencies, offering legal assistance, supporting social and economic reintegration, and monitoring non-procedural placements. These roles are firmly grounded in Law Number 18 of 2017 concerning the Protection of Indonesian Migrant Workers and Government Regulation Number 59 of 2021. However, implementation remains constrained by inaccurate data, limited human resources and budget, weak institutional coordination, and suboptimal legal complaint services. Despite these challenges, efforts have been made through strengthening integrated services, staff training, public education, and the use of information technology. This study concludes that the protection of former migrant workers requires a holistic, participatory, and sustainable approach to ensure the fulfilment of their rights as mandated by law.

Abstract

This research examines the effectiveness of narcotics crime investigation by the Narcotics Investigation Unit (Satuan Reserse Narkoba) from the perspective of Indonesia's Criminal Procedure Code (KUHAP) and related legislation. The study also analyzes the juridical-normative obstacles encountered during investigation processes, along with potential solutions under Indonesian positive law. As an extraordinary crime, narcotics offenses require precise and legally sound investigation methods. However, investigative practices often face challenges due to inconsistencies between legal norms and field implementation, limited resources, and the absence of clear regulations on special investigative techniques such as wiretapping and controlled delivery. This normative legal research employs statutory and conceptual approaches, analyzing primary legal materials including Law Number 8 of 1981 (KUHAP), Law Number 35 of 2009 on Narcotics, and various implementing regulations. The findings indicate that narcotics investigations are not yet optimal due to weak technical regulations, disharmonized laws between KUHAP and the Narcotics Law, overlapping authority between the Police and the National Narcotics Agency (BNN), and a lack of protection for whistleblowers and witnesses. The legal gap in regulating special investigation methods creates uncertainty in evidence admissibility. Proposed solutions include regulatory reform through KUHAP revision, improving investigator competence through specialized training, utilizing modern technology, strengthening inter-agency coordination, and enhancing internal and external oversight mechanisms. Legal reform and institutional synergy are essential to enhancing the overall effectiveness of narcotics investigations in Indonesia.

Abstract

Stunting merupakan permasalahan gizi kronis yang berdampak pada kualitas sumber daya manusia dan menjadi tanggung jawab konstitusional pemerintah dalam menjamin hak anak atas kesehatan. Pemerintah Kota Surabaya menerbitkan Peraturan Wali Kota Nomor 79 Tahun 2022 sebagai dasar hukum percepatan penurunan stunting di daerah. Penelitian ini bertujuan untuk menganalisis pengaturan percepatan penurunan stunting di Kota Surabaya serta mengkaji bentuk pertanggungjawaban administratif pemerintah daerah dalam pelaksanaannya. Metode penelitian yang digunakan adalah penelitian hukum normatif dengan pendekatan peraturan perundang-undangan dan pendekatan konseptual. Hasil penelitian menunjukkan bahwa Peraturan Wali Kota Nomor 79 Tahun 2022 mengatur pembentukan Tim Percepatan Penurunan Stunting (TPPS), pembagian kewenangan antar perangkat daerah, serta mekanisme koordinasi, pengawasan, dan evaluasi kebijakan. Kewenangan pemerintah daerah dalam pelaksanaan kebijakan bersumber dari atribusi, delegasi, dan mandat yang berimplikasi pada perbedaan pertanggungjawaban administratif. Apabila terjadi kelalaian dalam pelaksanaan program, maka pertanggungjawaban administratif dapat dikenakan sesuai Undang-Undang Administrasi Pemerintahan dan prinsip Asas-Asas Umum Pemerintahan yang Baik (AUPB). Dengan demikian, efektivitas kebijakan sangat ditentukan oleh konsistensi pelaksanaan dan akuntabilitas pemerintah daerah dalam menjamin pemenuhan hak anak atas gizi dan kesehatan.
