Abstract

Postponement of Debt Payment Obligations (PKPU) is a legal mechanism that provides an opportunity for creditors and debtors to submit a debt reschedule plan to avoid bankruptcy. In the PKPU process, creditors have a role in determining the success of the agreement. In this case, concurrent creditors are more advantaged, because their position can be equal to that of separatist creditors who have collateral. This study examines how the existence of concurrent creditor sovereignty in the agreement process through PKPU, and to what extent the regulations regarding concurrent creditors and their rights are benefited in the cassation decision, especially in the Supreme Court Decision Number 751 K /Pdt.Sus-Pailit/2024. This research is a normative legal research, with prescriptive legal approach and conceptual approach. The types of data used include primary and secondary legal materials, which are collected through literature studies. The legal material analysis technique uses the syllogism and interpretation methods. The results of the analysis, this study identifies how the protection of concurrent creditor sovereignty in peace through PKPU. And how the Supreme Court Decision in Decision No. 751 K/Pdt.Sus-Pailit/2024 pays more attention to concurrent creditors. In this discussion, shows how the regulations and legal protection of concurrent creditors, while discussing the Supreme Court Decision No. 751 K/Pdt.Sus-Pailit/2024 which gave rise to polemics in the interpretation of the provisions of Article 281 paragraph 1. However, it is likely to reflect the judiciary in considering all creditors and debtors, to achieve equal justice for all parties.

Abstract

Kompleksitas permasalahan dalam penanganan perubahan iklim telah menuntut adanya inovasi dalam sistem penurunan emisi gas rumah kaca. Kesadaran untuk menyelesaikan permasalahan tersebut ditandai dengan Paris Agreement yang menjadi seruan bagi seluruh negara agar dapat berkontribusi dalam menjaga batas pencemaran lingkungan dan menunjukkan komitmennya untuk  memperbaiki kualitas lingkungan hidup. Implementasi Undang-Undang Nomor 4 Tahun 2023 tentang Pengembangan dan Penguatan Sektor Keuangan menjadi landasan bagi pemberlakuan bursa karbon sebagai salah satu sarana untuk mencapai Net Zero Emision di Indonesia. Permasalahan muncul ketika aktivitas ini belum sepenuhnya dapat berjalan dengan optimal karena minimnya jumlah korporasi yang terlibat langsung dalam perdagangan karbon di Bursa Efek Indonesia. Pengabdian ini dilaksanakan dengan menggunakan pendekatan preskriptif, pragmatis, persuasif dan evaluatif untuk memperkuat peran Galeri Investasi dalam mensosialisasikan bursa karbon kepada pelaku Industri yang ada di wilayah Solo Raya. Pengabdian ini dilakukan dengan memberikan sosialisasi kepada perwakilan PT. Konimex serta menganalisis potensi keuntungan dari aktivitas industri tersebut dalam bursa karbon. Hasil observasi dalam proses pengabdian menunjukkan bahwa PT. Konimex telah memiliki pedoman komitmen pencapaian PROPER Biru dalam proses produksi yang dilakukan dengan menggunakan teknologi ramah lingkungan. Kendati demikian, belum ada agenda untuk terjun dalam bursa karbon. Dari hasil sosialisasi yang dilakukan oleh IDX Carbon, telah terlihat peluang dan strategi yang perlu dipertimbangkan oleh PT. Konimex untuk dapat ikut serta dalam perdagangan karbon di Indonesia. Pendekatan dan agenda serupa perlu terus dilakukan terhadap industri-industri skala nasional yang ada di Solo Raya.

Abstract

Artikel ini mengkaji tentang independensi hakim serta disparitas putusan hakim pada perkara kasus korupsi di lingkup Mahkamah Agung. Faktor Undang-Undang sangat substansial, di mana Undang-Undang merupakan acuan penetapan jenis dakwaan dan tuntutan bagi pelaku. Fakta hukum dan independensi hakim juga turut mempengaruhi terjadinya disparitas putusan dan disparitas putusan juga dijadikan landasan untuk mengukur apakah hakim telah independen atau belum dalam menetapkan sebuah putusan. Adapun metode yang digunakan dalam penulisan ini adalah yuridis normatif atau library research (kepustakaan) dengan menggunakan Undang-Undang Kekuasaan Kahakiman, Undang-Undang Pemberantasan Tindak Pidana Korupsi, KUHP dan putusan perkara korupsi yang mengalami disparitas sebagai bahan hukum primer dan karya ilmiah yang berkaitan dengan topik penelitian sebagai bahan hukum sekunder. Artikel ini dianalisis menggunakan teori kepastian hukum Hans Kelsen dan teori sistem hukum Lawrence M. Friedman. Penulisan ini menemukan penyebab terjadinya disparitas putusan pada perkara tindak pidana korupsi, independensi hakim terhadap sejumlah putusan perkara korupsi, dan indikator independensi Hakim dalam Disparitas Putusan Korupsi. Kata Kunci: independensi hakim; disparitas; korupsi; mahkamah agung.

Abstract

Illegal fishing poses a critical threat to maritime sovereignty, undermining national security, ecological sustainability, and economic stability. This study conducts a comparative analysis of law enforcement against illegal fishing under Indonesian positive law and contemporary Islamic law. Employing a qualitative legal research method supported by statutory, case, and conceptual approaches, it examines the normative foundations, enforcement challenges, and philosophical principles underpinning both systems. The findings show that Indonesian positive law provides a comprehensive regulatory framework through instruments such as Law No. 45/2009 and the Fisheries Act. However, its enforcement faces significant obstacles, including jurisdictional overlaps, limited institutional resources, and weak interagency coordination. In contrast, contemporary Islamic law frames marine resource protection as part of ḥimāyah al-bi’ah (environmental protection) and maṣlaḥah (public welfare), advocating community-based accountability and ethical stewardship rooted in moral responsibility. The study highlights the potential for normative synergy between the two systems, suggesting that integrated legal pluralism could enhance maritime governance by balancing legal deterrence with ethical imperatives. Such an approach promotes not only compliance but also shared moral commitment to resource preservation. This research contributes to the discourse on environmental justice within Islamic jurisprudence and offers policy recommendations for strengthening enforcement mechanisms through a holistic, values-based legal framework.

Abstract

Agrarian disputes in Indonesia are highly complex, covering a range of issues such as customary and communal land rights, certificate disputes, conflicts between communities and corporations, and state land acquisition. These challenges are compounded by the inability of general courts to effectively address them due to overlapping jurisdictions, inadequate coordination, and a lack of technical expertise. Consequently, the resolution of land disputes is often delayed, leading to diminished public trust in the judicial system. Comparative studies from Brazil and New Zealand have shown that specialized land courts can enhance efficiency, consistency, and the protection of indigenous rights by focusing on specific mandates, employing expert knowledge, and utilizing mediation mechanisms. This research highlights the urgent need for the establishment of a Land Court in Indonesia, presenting it as a critical institutional reform that would ensure legal certainty, provide substantive justice, and improve access to justice. The novelty of this study lies in its integrative approach, which combines doctrinal, comparative, and empirical analyses. The proposed Land Court, staffed with specialized judges, land experts, and supported by strong mediation procedures, is designed to offer quicker, fairer, and more socially legitimate outcomes. This approach is expected to strengthen public confidence in Indonesia’s land governance system, ultimately improving the overall effectiveness of land dispute resolution.

Abstract

Tindak pidana pencucian uang merupakan salah satu kejahatan dimana pelaku menyembunyikan harta kekayaan yang didapatkan secara ilegal sehingga tidak diketahui oleh aparat penegak hukum dalam melakukan penegakan. Bentuk terhadap tindak pidana pencucian umumnya hanya melalui harta bergerak dan tidak bergerak, akan tetapi setelah era revolusi industri 4.0 tentunya dengan perkembangan terhadap ilmu pengetahuan dan teknologi pencucian uang dilakukan dengan melibatkan teknologi digitalisasi. Tujuan dalam penelitian ini tentunya digunakan untuk mengetahui beberapa faktor serta peran aparat penegak hukum dalam memberantas serta menanggulangi tindak pidana pencucian uang berbasis teknologi digital. Pembahasan masalah yang diangkat dan dibahas dalam Pendekatan metodologi normatif ini digunakan untuk menganalisa kerangka terhadap tindak pidana perdagangan orang yang meliputi beberapa faktor hingga penegakan hukum yang dilakukan oleh negara Indonesia. Pendekatan normatif ini melibatkan studi dokumen hukum seperti undang-undang, jurnal hukum hingga buku hukum. Sehingga hasil dalam penelitian ini meliputi faktor serta fungsi aparat penegak hukum dalam menanggulangi tindak pidana pencucian uang berbasis digital. Faktor terjadinya tindak pidana pencucian uang tentunya meliputi faktor perkembangan teknologi, e money, dan globalisasi. Serta terdapat beberapa upaya penegakan hukum yang dilakukan oleh aparat penegak hukum untuk melakukan pemberantasan terhadap tindak pidana pencucian uang berbasis digital

Abstract

Abstrak Merek dan Indikasi Geografis salah satu cabang Hak Kekayaan Intelektual diatur dalam Undang-Undang Nomor 20 Tahun 2016 tentang Merek dan Indikasi Geografis. Merek adalah tanda yang dapat ditampilkan secara grafis  berupa gambar, logo, nama, kata, huruf, angka, susunan warna dalam bentu 2 dimensi atau 3 dimensi untuk membedakan barang dan/ atau jasa yang diproduksi oleh orang atau badan hukum dalam kegiatan perdagangan. Merek dibedakan atas merek dagang dan merek jasa.Merek dagang adalah merek digunakan pada kegiatan perdagangan sedangkan merek jasa adalah merek yang digunakan pada jasa dalam kegiatan perdagangan. Syarat merek dagang mendapat perlindungan apabila telah diterbitkan sertifikat merek. Merek dagang ditolak pendaftarannya karena tidak memilik daya pembeda. Permasalahan, apa problematika yang muncul pada merek dagang  dan mengapa pentingnya dilakukan  pendaftaran merek dagang? Metode penelitian yang digunakan, penelitian kepustakaan. Jenis penelitiannya normatif. Pendekatan penelitian, adalah pendekatan konseptual, pendekatan kasus dan pendekatan perundangan. Data hasil penelitian kepustakaan dianalisa secara kualitatif. Hasil penelitian, problematika yang muncul dalam merek dagang adalah terdapat merek yang tidak memiliki daya pembeda, merek terdaftar lebih dahulu menggugat merek yang kemudian, pentingnya pendaftaran merek memiliki daya pembeda agar pendaftaran merek diterima, diterbitkan sertifikat merek, mendapat perlindungan hukum dari pemerintah. Kata kunci: Pendaftaran, Merek Dagang , Daya Pembeda AbstractMarks and Geographical Indications are one of the branches of Intellectual Property Rights regulated in Law Number 20 of 2016 concerning Marks and Geographical Indications. A brand is a sign that can be displayed graphically in the form of images, logos, names, words, letters, numbers, color arrangements in 2-dimensional or 3-dimensional form to differentiate goods and/or services produced by individuals or legal entities in trading activities. Brands are differentiated into trademarks and service marks. Trademarks are brands used in trading activities, while service marks are brands used for services in trading activities. Trademark requirements receive protection if a trademark certificate has been issued. Trademark registration is rejected because it does not have distinguishing power. Problems, what problems arise with trademarks and why is it important to register a trademark? The research method used is library research. The type of research is normative. Research approaches are the context approach, problem approach and regulatory approach. Data from library research were analyzed qualitatively. The results of the research show that the problem that arises in trademarks is that there are brands that do not have distinguishing power, the registered mark first challenges the brand and then the importance of registering a mark has distinctive power so that the mark registration is accepted, a brand certificate is issued, and it receives legal protection from the government. Keywords: Registration, Trademark, Differentiating Powe

Abstract

The legal protection given to trademark certificate holders is that the trademark is valid for a period of 10 years and the only registered trademark owner has the rights to the trademark and cannot be changed without the trademark owner's permission. Law enforcement provided by the Trademark and Geographical Indications Law is criminal and civil. There are other alternatives, namely through arbitration and alternative dispute resolution with the concept of a win - win solution.

Abstract

This article aims to explore the urgency of applying the principle of proportionality in online loan agreements. The research results are expected to be utilized by all parties involved, especially prospective recipients of online loans, in crafting a standardized online loan agreement. The research methodology employs normative legal research, utilizing both primary and secondary legal materials through a literature review data collection technique. The approaches used in this research are the legislative approach (statute approach) and the conceptual approach. The data analysis technique employed is deductive analysis using the syllogism method. The application of the proportionality principle is examined through a guiding theory to identify the proportionality principles in contracts, including the principles of equality of rights, freedom, proportional distribution, and an elegant resolution with a win-win solution. Applying the proportionality principle in online loan electronic contracts is expected to minimize the risk of disputes during the execution of online loan agreements.

Abstract

ABSTRACT Purpose: This study aims to analyze the impact of the Constitutional Court's Decision Number 23/PUU-XIX/2021 regarding the permissibility of cassation in the Suspension of Debt Payment Obligations (PKPU). Methodology: The research method used by the researcher was a normative research method by reviewing statutory regulations and related legal materials. Results: The judge's consideration in the Constitutional Court's Decision Number 23/PUU-XIX/2021 is the permit of a cassation legal action against the decision on PKPU submitted by the creditor and the rejection of the offer of reconciliation from the debtor so that the court's decision on the PKPU application submitted by the creditor can be corrected as part of the control mechanism over court decisions at lower levels. However, with this decision, it is necessary to immediately issue implementing regulations regarding the mechanism for submitting PKPU and to control the good faith of creditors, so they do not actually injure. This is because the existence of debtors becomes a part of business actors playing a role in maintaining economic stability, so business continuity is sustained and is not misused. That being said, the legal certainty of the PKPU instrument can definitely be realized in accordance with the spirit of Law 37/2004, which is to provide legal protection for business actors. Applications of the study: It is expected that the legal certainty of the PKPU instrument can definitely be realized in accordance with the spirit of Law Number 37 of 2004, which is to provide balanced legal protection between debtors and creditors. Novelty/Orginalty of this study: This research is conducted due to the decision of the Constitutional Court Number 23/PUU-XIX/2021 that has recently been issued, the author analyzed the impact of the issuance of the decision on creditors and debtors.
