Abstract

The legal protection given to trademark certificate holders is that the trademark is valid for a period of 10 years and the only registered trademark owner has the rights to the trademark and cannot be changed without the trademark owner's permission. Law enforcement provided by the Trademark and Geographical Indications Law is criminal and civil. There are other alternatives, namely through arbitration and alternative dispute resolution with the concept of a win - win solution.

Abstract

This article aims to explore the urgency of applying the principle of proportionality in online loan agreements. The research results are expected to be utilized by all parties involved, especially prospective recipients of online loans, in crafting a standardized online loan agreement. The research methodology employs normative legal research, utilizing both primary and secondary legal materials through a literature review data collection technique. The approaches used in this research are the legislative approach (statute approach) and the conceptual approach. The data analysis technique employed is deductive analysis using the syllogism method. The application of the proportionality principle is examined through a guiding theory to identify the proportionality principles in contracts, including the principles of equality of rights, freedom, proportional distribution, and an elegant resolution with a win-win solution. Applying the proportionality principle in online loan electronic contracts is expected to minimize the risk of disputes during the execution of online loan agreements.

Abstract

ABSTRACT Purpose: This study aims to analyze the impact of the Constitutional Court's Decision Number 23/PUU-XIX/2021 regarding the permissibility of cassation in the Suspension of Debt Payment Obligations (PKPU). Methodology: The research method used by the researcher was a normative research method by reviewing statutory regulations and related legal materials. Results: The judge's consideration in the Constitutional Court's Decision Number 23/PUU-XIX/2021 is the permit of a cassation legal action against the decision on PKPU submitted by the creditor and the rejection of the offer of reconciliation from the debtor so that the court's decision on the PKPU application submitted by the creditor can be corrected as part of the control mechanism over court decisions at lower levels. However, with this decision, it is necessary to immediately issue implementing regulations regarding the mechanism for submitting PKPU and to control the good faith of creditors, so they do not actually injure. This is because the existence of debtors becomes a part of business actors playing a role in maintaining economic stability, so business continuity is sustained and is not misused. That being said, the legal certainty of the PKPU instrument can definitely be realized in accordance with the spirit of Law 37/2004, which is to provide legal protection for business actors. Applications of the study: It is expected that the legal certainty of the PKPU instrument can definitely be realized in accordance with the spirit of Law Number 37 of 2004, which is to provide balanced legal protection between debtors and creditors. Novelty/Orginalty of this study: This research is conducted due to the decision of the Constitutional Court Number 23/PUU-XIX/2021 that has recently been issued, the author analyzed the impact of the issuance of the decision on creditors and debtors. Abstract

The creative economy (CE) is a vital driver of national economic growth, yet awareness of Intellectual Property Rights (IPR) among Creative Economy Actors (CE Actors) remains low, with many failing to protect, register, or own IPR. This weak legal culture poses a major barrier to effective IPR protection. This research analyzes the factors behind the government’s failure to foster an IPR legal culture and formulates strategies to strengthen awareness and ownership among CE Actors. Using a socio-legal approach that combines doctrinal legal analysis with empirical investigation, the research identifies systemic obstacles, including inconsistent presidential commitment, the absence of operational frameworks at subnational levels, weak professionalism within the legal bureaucracy, and the lack of IPR and creative economy education. To address these challenges, the government must establish firm and sustained presidential commitment, enact comprehensive implementing regulations, set professionalism standards for relevant bureaucracies, reinforce both internal and external legal culture, and integrate IPR and creative economy content into educational curricula. Coordinated action on these fronts is essential to increase IPR ownership, strengthen legal protection, and support the sustainable growth of Indonesia’s creative economy.

Abstract

Online loan-based financing services are increasingly attracting public interest because of the simplicity and rapidity of the procedure. However, in practice there are often violations of consumer rights, especially in the collection process by debt collectors who use violence and misuse personal information. This research seeks to assess the legal safeguards provided to consumers who use the Rupiah Plus application against such practices. By using a juridical-normative approach by examining applicable laws, regulations, and relevant case studies, this research reveals that although legal protection exists in a normative sense, its enforcement remains inadequate. Protective measures may be taken both preventively and repressively, while conflict resolution can be approached through judicial proceedings or alternative non-litigation methods.

Abstract

Indonesia is a country that has a lot of natural resources; one of the natural resources in Indonesia is lime. In Palembang, there is a large-scale dolomite lime-producing company that covers the territory of Indonesia. The content in the dolomite lime is Magnesium Oxide (MgO) ≥ 18% and Calcium Oxide (CaO) ± 30%. The purpose of this study is to utilize dolomite lime as a mixture of asphalt concrete layers and to find out changes in the characteristics of the HRS-WC mixture due to the use of dolomite lime as a filler. The experiment refers to Bina Marga 2018 revision II. The method used in this study is the experimental method, which is carried out by conducting experimental activities to obtain data. The aggregate specific gravity test obtained more than 2.5 gr/cm3 results, which qualify the 2018 Bina Marga revision II specifications. Examination of the wear of the coarse aggregate yielded results that fulfil the 2018 Bina Marga revision II specifications. The filler used in this mixture is applied on combination with a percentage of 0% rock ash and 100% dolomite lime, then 25% rock ash and 75% dolomite lime, then 50% rock ash and 50% dolomite lime, then 75% rock ash and 25% dolomite lime, and 100% rock ash and 0% dolomite lime. %. The Marshall results from the percentage of 100% rock ash filler content and the percentage of 0% OAC dolomite lime filler content of 6.5% obtaine a stability value of 914.821 Kg, a flow value of 3.45 mm, and a Marshall Quotient value of 265.286 Kg/mm. The volumetric value of the percentage of 100% rock ash filler content and the percentage of dolomite lime filler content of 0 % OAC 6.5% deliver a VIM value of 4.153%, a VMA value of 18.391%, a VFB value of 79.671%.

Abstract

Cryptoization in Indonesia can be seen in the number of investors and crypto asset transactions. As of January 2024, the total number of crypto asset investors reached 18.83 million investors. Meanwhile, the total accumulated value of crypto asset transactions throughout 2024 was recorded at IDR 48.82 trillion. Various types and developments in crypto assets trigger shadow currency risks. Shadow currency is a currency function that can be replaced by another form. In this regard, research is needed regarding the relationship between crypto assets as shadow currency in financial stability and the importance of regulating digital rupiah in Indonesia. The approach used is the statute approach. This research will examine various laws and regulations relating to crypto assets, fintech, financial systems and currencies. The research results show that the crypto asset transaction process occurs outside the official monetary system and can develop into a digital currency area outside certain jurisdictions. The materialization of this risk can threaten a country's monetary sovereignty, thus triggering the risk of shadow currency. Therefore, it is recommended that the Digital Rupiah be a Central Bank Digital Currency (CDBC) which is officially implemented in Indonesia. However, there needs to be regulatory and policy support needed so that CBDC can be implemented in Indonesia, one of which is through a revision of the Indonesian Act on Currency.

Abstract

Abstrak               Pembangunan ekonomi nasional memerlukan iklim investasi yang kondusif, namun minat investor seringkali terhambat oleh lemahnya penegakan hukum yang menimbulkan ketidakpastian dan risiko usaha tinggi. Di Indonesia, tantangan ini diperburuk oleh tumpang tindih regulasi dan korupsi. Penelitian ini bertujuan untuk menganalisis peran penegakan hukum dalam menciptakan iklim investasi yang kondusif di Indonesia serta mengidentifikasi faktor-faktor yang menghambat efektivitasnya. Metode penelitian yang digunakan adalah yuridis normatif bersifat preskriptif, dengan pendekatan konseptual dan analitik. Hasil penelitian menunjukkan bahwa penegakan hukum adalah faktor sentral dan prasyarat mutlak untuk menciptakan kepastian investasi. Penegakan hukum yang baik, mencakup aspek publik (pemberantasan korupsi) dan privat (jaminan eksekusi sengketa), berfungsi mengurangi risiko dan biaya operasional bisnis. Efektivitas penegakan hukum ini terhambat oleh beberapa faktor, yaitu: tumpang tindih regulasi, korupsi dan lemahnya integritas aparat, rendahnya kompetensi aparat terhadap hukum ekonomi modern, serta lemahnya koordinasi antar lembaga. Disimpulkan bahwa penegakan hukum yang adil, transparan, dan konsisten bukan hanya instrumen keadilan, tetapi juga motor penggerak ekonomi yang menentukan kepercayaan investor dan daya saing nasional.Kata Kunci: Penegakan Hukum, Iklim Investasi, Pertumbuhan Ekonomi
