Abstract

Group corporation as one of the effects of the fast growing economy, in the activities can also play a role in terms of pollution and/or environmental damage done by one or several subsidiaries. In this regard, the parent corporation may be subject to liability in certain cases where there is contamination and/or damage to the environment done by the subsidiary. Based on the results of research, it can be seen that the legal relationship between the parent corporation to the subsidiaries is the employment relationship or other relationship within the scope of work of the enterprise. The parent corporation may be subject to civil liability for pollution and/or environmental damage done by the subsidiary if the parent corporation controls the subsidiaries proven to perform actions within the scope of application of piercing the corporate veil. In addition, the parent corporation may also incur criminal liability if it is proved the parent corporation were also committing a crime of pollution and/or environmental damage done by the subsidiary. Based on this research, it is advisable to make a special provision of group companies in Limited Company Act. In addition, it should be prioritizing the use of criminal law in a law enforcement environment that affects the survival of human beings, as well as the need to increase the moral of businessmen for committing violations of environmental laws.

Abstract

ABSTRACTEnvironmental licence based on the Law on Living Environmental Management and Protection (UUPPLH) is a condition to obtain a business licence and/or activity. Functioning as an instrument of damage prevention and/or living environmental pollution in the framework of protecting and managing living environment. Environmental pollution belongs to living creature, substance, energy and/or other components polluted by human activities which is greater than the set standard quality of living environment. A control is needed to monitor the incident of living environmental pollution. Living environmental control or control for short is a sequence of activities which is directly or indirectly by the Living Environmental Controlling Official (PPLH) to find out, to ensure, and to determine the level of compliance of guarantor of business and/or activity set in the evironmental licence and the legislations in the field of living environmental management and protection. The control activity is intended to develop law reinforcement. The reinforcement of administrative environmental law is the control and application of the administrative sanction which are preventive (control) and repressive (administrative sanction) in nature. According to the UUPPLH criminal act is a violation done by an individual on the regulation of legislation and/or the provision of environmental licence. The criminal provision according to the UUPPLH to apply the criminal sanction related to environmental licence as regulated in Article 109, Article 111, and Article 112 of UUPPLH.Keywords: Environmental Licence, Reinforcement of Administrative, Sanction, Environmental Criminal Provision.

Abstract

ABSTRACTIndonesia as an archipelago has an abundant of fish resources. Geographically, Indonesia is located strategically, for which this condition becomes a challenge, and it is our responsibility to maintain, guard, and conserve these resources. This strategic condition will automatically attract foreign ships to do illegal fishing, particularly in ZEEI (Indonesian Exclusive Economy Zone) in the Area of Fishery Management of the Republic of Indonesia. The result of the research showed that the consequence of the illegal fishing in the area of fishery management of the Republic of Indonesia by foreign fishermen is very big; it amounts to 30 quintillion rupihs each year. It is recommended that, in order to cope with the criminal act of illegal fishing in the Area of Fishery Management of the Republic of Indonesia, particularly in the Indonesia Exclusive Economi Zone, the government should be serious in enlarging the budget for the supervision and furnish equipment and infrastructure which are related to supervision.Keywords: Criminal Act of Illegal Fishing

Abstract

Abstract. Medan City Big Police Resort (Polrestabes) part of the Republic of Indonesia National Police located in the city of Medan, North Sumatra province is one of the regional units under the control of the North Sumatra Regional Police (North Sumatra Regional Police). Medan Polrestabes in combating Narcotics-related crime cases must be well supported even though the numbers of these cases continue to increase. The disclosure of cases on the one hand can indeed be an indicator of increasing police work in hunting down drug trafficking syndicates, but on the other hand can provide clues to how the current government policies are weak in dealing with the circulation. Police efforts as law enforcement agencies in preventing and eradicating Narcotics crime in the jurisdiction of Medan Polrestabes can be seen from the performance of its ranks who are actively both open and closed, cooperating with other agencies and communities in breaking the chain of Narcotics circulation. Medan Polrestabes in this case has two steps to prevent and eradicate this Narcotics and Psychotropic crime, namely the efforts of Non-Penal and Penal's efforts. The police maximize the Non-Penal efforts, namely pre-eminent and preventive measures (prevention), because these efforts are considered more effective in suppressing the increase in the number of criminal acts Narcotics compared to the efforts of Penal (prosecution).
