Abstract

ETLE (Electronic Traffic Law Enforcement) is basically the result of technological developments that keep moving forward, which are then used in the framework of less traffic control. This is the same as digitizing law enforcement against traffic violations. With the existence of ETLE, of course the hope is that it can run effectively in order to create order in traffic for motorized vehicles. Based on this, it is worth exploring the implementation of ETLE implementation as well as the obstacles, to be linked to the effectiveness of the law. This research is an empirical juridical research, with a qualitative approach. The field study was conducted at Polretabes Surabaya. Sources of data are primary and secondary data, in which there are primary, secondary and tertiary legal materials. Collecting data using the method of observation, interviews, and literature study. Data analysis used descriptive analytical method. The results of the study show that the implementation of ETLE as mandated by the Law of the Republic of Indonesia Number 22 of 2009 concerning Road Traffic and Transportation begins with planning and ending with implementation. However, ETLE with CCTV cannot be implemented in the Surabaya area. In its implementation, discrepancies are still found that are contrary to the objectives and benefits of implementing ETLE. In addition, there are still obstacles in its implementation, which shows that the implementation of ETLE is still not effective.

Abstract

The aim of this research is to explore the concept of repressive protection for customary disputes in Indonesia and explore the manifestation of repressive protection for Awig-Awig in Bali in resolving customary disputes. This research method is normative juridical, with a statutory, conceptual legal and legal case approach. Data comes from secondary sources, including primary legal materials, secondary legal materials and tertiary legal materials. Data analysis is descriptive analytical. The results of the research found that the concept of repressive protection for customary disputes in Indonesia is in the form of protecting indigenous peoples by enforcing the law as well as imposing sanctions on law violators. The legal certainty is as stated in the Constitution of the Republic of Indonesia of 1945 and Law of the Republic of Indonesia Number 6 of 2014 concerning Villages. The embodiment of this protection in Awig-Awig is as an example in Bali, where there are regulations regarding the rights of indigenous peoples as well as their application when disputes occur. Those who violate will be subject to sanctions.

Abstract

This research discusses the validity of a land sale and purchase agreement allegedly made on the basis of deception (niet zoude aangegaan), using a case study of Decision Number 113/Pdt.G/2019/PN.Mjk. This research uses a normative legal method with a statutory approach, case approach, and conceptual approach. The data used in this research is secondary data obtained from literature studies and interviews. The results show that there are complex legal relationships between the parties, including debt and credit relationships, land certificate lending, and buying and selling of land. Although this legal relationship is regulated in accordance with the applicable provisions, there are indications of the use of false identity by the buyer in the Deed of Sale and Purchase No. 85/2017. This deed, which was made by a notary, allegedly violates the subjective requirement for the validity of an agreement, namely an agreement arising from fraud. As a result of this fraud, the deed can be canceled through a court process because it does not meet the validity requirements of the agreement as stipulated in Article 1320 of the Civil Code. This research highlights the importance of honesty in making agreements, especially in land sale and purchase transactions, to avoid legal disputes that harm the parties involved.

Abstract

Village is the smallest part of the state structure. A number of villages in Indonesia have distinctive features which contain traditional elements. One of the elements of this custom is customary law. In the community of Pakraman Bali Village, there are indigenous people in which customary law applies. This customary law is stated in awig-awig. If we look at the discussion then it is related to the legal structure, of course there is a connection related to that part of the legal system. The legal system in a state can be referred to as a national legal system in which the national legal system has parts or elements that each function and have a relationship, namely between one part and another. Likewise, there are laws that are part of the customary law community where the customary law community is part of the village which is an institution in the state structure. This then becomes an issue of how the position of awig-awig is in the national legal system. This research was conducted through an analysis of legal facts and legal doctrine, namely the theoretical and statutory approaches. This article is the result of research funded by the university, so it is the outcome product of this research. The discussion in this analysis shows that awig awig is written customary law, while what is generally understood so far is the unwritten law. In addition, the position in national law is recognized because it is the right of the customary law communities in Bali (adat in Pakraman Village, Bali). In addition, of course, awig-awig can be used as a source of material law, which is a social conception that exists in society, some of which are still applicable and some need conformity.

Abstract

This Research aim to find the connection between legal awareness UPN “Veteran” Jawa Timur College student with state defense attitude. Legal awareness is awareness or values contained in man about the existing law or about laws that are expected to exist. Actually, what is emphasized is the values regarding the function of the law and not a legal assessment of it concrete events in the community concerned. Legal awareness is very important in measuring the level of state defense attitudes. There are several indicators of the problem of legal awareness, namely Knowledge of legal regulations (law awareness); Knowledge of the contents of legal regulations (law acquaintance); Attitude towards legal regulations (legal attitude); Legal behavior patterns (legal behaviour). All indicators are related to campus regulations. Legal awareness, especially regarding student compliance in obeying the rules set by the campus. the higher the level of violation of campus discipline, the greater the reduction of student defending attitudes. The method used in this study begins with identification from various literatures related to the legal awareness culture of students towards university regulations and policies in terms of the problems that occur and the challenges that must be faced by the university. Then arranged in such a way as to bring up the right problem formulation which later can be comprehensively reviewed through field studies and direct observation, especially related to the problems taken in this study, namely the application of campus regulations to realize the attitude of defending the State in students. The research results in this study are expected to be able to contribute to the university and the development of students who are expected to have a spirit and attitude to defend the country.

Abstract

Participatory leadership is gaining increasing attention in the educational context, as this leadership style involves the active participation of team members in decision-making and planning, which is essential for creating a productive school climate. This study aims to examine the role and impact of participatory leadership by principals in improving teacher professionalism. Using a qualitative approach through a literature review method, this study collected and analyzed various relevant sources on participatory leadership in education. The results indicate that principals who implement participatory leadership can create an environment that supports teacher professional development. Involving teachers in decision-making, encouraging open communication, and facilitating close collaboration between principals and staff have been shown to improve teacher professionalism. Furthermore, this leadership style provides teachers with space to develop independently, increasing their motivation and engagement in the learning process, and ultimately enhancing the quality of teaching in schools. This study also found that implementing participatory leadership requires a strong commitment from principals in building a collaborative and inclusive school culture. These findings contribute to the development of more effective and relevant education policies, particularly in improving the quality of education through teacher empowerment. Therefore, this study can provide important insights for education policies and the implementation of more adaptive and collaboration-based leadership.

Abstract

Corporations are legal entities that play a role in the economy and also have the potential to commit criminal offense, including corruption. Bribery commited by corporation constitutes corporate crime, which can harm the state, undermine integrity, and violate applicable law. One case of corporate crime that occurred was the corporate crime committed by PT Merial Esa. Decision No. 23/PID.SUS-TPK/2022/PT.DKI, PT Merial Esa was proven to have satisfied the subjective and objective elements of the crime of bribery. In this case, PT Merial Esa may be subject to legal consequences for the actions it takes. The research is grounded normative legal research. This research uses an legislative approach, which involves analyzing various relevant data sources, combined with a conceptual approach.

Abstract

Kesenian Sandur merupakan bagian dari tradisi budaya masyarakat Bojonegoro, yang menghadapi tantangan dalam pelestariannya, terutama di kalangan generasi muda. Penelitian ini bertujuan untuk melestarikan Sandur melalui diversifikasi produk yang dapat diterapkan pada dolanan anak, sebagai sarana edukasi dan hiburan yang mengenalkan budaya Sandur kepada generasi muda. Metode yang digunakan dalam pengabdian ini meliputi pelatihan dan pendampingan kepada seniman Sandur dalam menciptakan produk turunan yang berbasis pada nilai-nilai budaya lokal, seperti permainan tradisional yang mendidik. Hasil dari pengabdian ini menunjukkan bahwa produk diversifikasi, seperti mainan kartu, boneka wayang, dan buku berwarna, berhasil meningkatkan keterampilan seniman dalam mengembangkan produk yang edukatif. Selain itu, pelatihan kewirausahaan yang diberikan memungkinkan para seniman untuk mengelola dan memasarkan produk mereka secara mandiri. Program ini diharapkan dapat memperkenalkan kesenian Sandur kepada generasi muda, melestarikan budaya, dan meningkatkan kesejahteraan seniman Sandur di Bojonegoro.
