Abstract

This research discusses the validity of a land sale and purchase agreement allegedly made on the basis of deception (niet zoude aangegaan), using a case study of Decision Number 113/Pdt.G/2019/PN.Mjk. This research uses a normative legal method with a statutory approach, case approach, and conceptual approach. The data used in this research is secondary data obtained from literature studies and interviews. The results show that there are complex legal relationships between the parties, including debt and credit relationships, land certificate lending, and buying and selling of land. Although this legal relationship is regulated in accordance with the applicable provisions, there are indications of the use of false identity by the buyer in the Deed of Sale and Purchase No. 85/2017. This deed, which was made by a notary, allegedly violates the subjective requirement for the validity of an agreement, namely an agreement arising from fraud. As a result of this fraud, the deed can be canceled through a court process because it does not meet the validity requirements of the agreement as stipulated in Article 1320 of the Civil Code. This research highlights the importance of honesty in making agreements, especially in land sale and purchase transactions, to avoid legal disputes that harm the parties involved.

Abstract

Village is the smallest part of the state structure. A number of villages in Indonesia have distinctive features which contain traditional elements. One of the elements of this custom is customary law. In the community of Pakraman Bali Village, there are indigenous people in which customary law applies. This customary law is stated in awig-awig. If we look at the discussion then it is related to the legal structure, of course there is a connection related to that part of the legal system. The legal system in a state can be referred to as a national legal system in which the national legal system has parts or elements that each function and have a relationship, namely between one part and another. Likewise, there are laws that are part of the customary law community where the customary law community is part of the village which is an institution in the state structure. This then becomes an issue of how the position of awig-awig is in the national legal system. This research was conducted through an analysis of legal facts and legal doctrine, namely the theoretical and statutory approaches. This article is the result of research funded by the university, so it is the outcome product of this research. The discussion in this analysis shows that awig awig is written customary law, while what is generally understood so far is the unwritten law. In addition, the position in national law is recognized because it is the right of the customary law communities in Bali (adat in Pakraman Village, Bali). In addition, of course, awig-awig can be used as a source of material law, which is a social conception that exists in society, some of which are still applicable and some need conformity.

Abstract

This Research aim to find the connection between legal awareness UPN “Veteran” Jawa Timur College student with state defense attitude. Legal awareness is awareness or values contained in man about the existing law or about laws that are expected to exist. Actually, what is emphasized is the values regarding the function of the law and not a legal assessment of it concrete events in the community concerned. Legal awareness is very important in measuring the level of state defense attitudes. There are several indicators of the problem of legal awareness, namely Knowledge of legal regulations (law awareness); Knowledge of the contents of legal regulations (law acquaintance); Attitude towards legal regulations (legal attitude); Legal behavior patterns (legal behaviour). All indicators are related to campus regulations. Legal awareness, especially regarding student compliance in obeying the rules set by the campus. the higher the level of violation of campus discipline, the greater the reduction of student defending attitudes. The method used in this study begins with identification from various literatures related to the legal awareness culture of students towards university regulations and policies in terms of the problems that occur and the challenges that must be faced by the university. Then arranged in such a way as to bring up the right problem formulation which later can be comprehensively reviewed through field studies and direct observation, especially related to the problems taken in this study, namely the application of campus regulations to realize the attitude of defending the State in students. The research results in this study are expected to be able to contribute to the university and the development of students who are expected to have a spirit and attitude to defend the country.

Abstract

Corporations are legal entities that play a role in the economy and also have the potential to commit criminal offense, including corruption. Bribery commited by corporation constitutes corporate crime, which can harm the state, undermine integrity, and violate applicable law. One case of corporate crime that occurred was the corporate crime committed by PT Merial Esa. Decision No. 23/PID.SUS-TPK/2022/PT.DKI, PT Merial Esa was proven to have satisfied the subjective and objective elements of the crime of bribery. In this case, PT Merial Esa may be subject to legal consequences for the actions it takes. The research is grounded normative legal research. This research uses an legislative approach, which involves analyzing various relevant data sources, combined with a conceptual approach.

Abstract

Kesenian Sandur merupakan bagian dari tradisi budaya masyarakat Bojonegoro, yang menghadapi tantangan dalam pelestariannya, terutama di kalangan generasi muda. Penelitian ini bertujuan untuk melestarikan Sandur melalui diversifikasi produk yang dapat diterapkan pada dolanan anak, sebagai sarana edukasi dan hiburan yang mengenalkan budaya Sandur kepada generasi muda. Metode yang digunakan dalam pengabdian ini meliputi pelatihan dan pendampingan kepada seniman Sandur dalam menciptakan produk turunan yang berbasis pada nilai-nilai budaya lokal, seperti permainan tradisional yang mendidik. Hasil dari pengabdian ini menunjukkan bahwa produk diversifikasi, seperti mainan kartu, boneka wayang, dan buku berwarna, berhasil meningkatkan keterampilan seniman dalam mengembangkan produk yang edukatif. Selain itu, pelatihan kewirausahaan yang diberikan memungkinkan para seniman untuk mengelola dan memasarkan produk mereka secara mandiri. Program ini diharapkan dapat memperkenalkan kesenian Sandur kepada generasi muda, melestarikan budaya, dan meningkatkan kesejahteraan seniman Sandur di Bojonegoro.

Abstract

Despite offering conveniences, digital bank services also pose a risk to customers, one of which is loss of balance. This research aims to analyze the forms of losses experienced by customers as well as the legal protection available to customers in cases of balance loss. The method used is normative juridical research with uses normative juridical research through a statutory regulation approach, case approach and conceptual approach. Data is collected through literature study and analyzed descriptively. The research results show that the forms of loss resulting from the loss of customer balances are material losses and immaterial losses, but the bank only provides responsibility in the form of compensation for material losses after a court decision states that the bank must be responsible for its actions. On the other hand, forms of legal protection for customers are provided through preventive and repressive efforts. Preventive protection is provided through statutory regulations and the Bank Agreement. On the other hand, repressive protection is provided through the imposition of sanctions to restore the situation, such as providing compensation to administrative sanctions. This research is expected to contribute to enhancing knowledge of customer rights and encourage a comprehensive regulation and protection mechanism to ensure customer protection.  Keywords: Legal Protection, Customers, and Digital Bank Services

Abstract

Keterampilan komunikasi merupakan salah satu kecakapan hidup abad ke-21 yang penting, terutama dalam konteks madrasah yang menekankan nilai-nilai etika komunikasi Islami. Penelitian ini bertujuan mengembangkan dan mengevaluasi Wahana Kreasi Siswa (WKS) sebagai media edukasi untuk penguatan keterampilan komunikasi berbasis nilai Islami di MTsN 2 Mojokerto. Penelitian menggunakan pendekatan Research and Development (R&D) dengan model ADDIE yang melibatkan 896 siswa dari 28 rombongan belajar. Pengumpulan data dilakukan melalui observasi, angket, wawancara, dan dokumentasi, sedangkan analisis data menggunakan teknik deskriptif kuantitatif dan kualitatif. Hasil penelitian menunjukkan bahwa implementasi WKS mampu meningkatkan keterampilan komunikasi siswa, ditandai dengan meningkatnya kepercayaan diri berbicara, kemampuan menyampaikan ide secara terstruktur, kerja sama tim, serta penerapan komunikasi santun berbasis nilai Islami (qaulan ma’rufa). Selain itu, program WKS juga berdampak pada penurunan perilaku negatif siswa selama waktu istirahat. Aspek inovasi dan difusi terlihat dari adanya studi tiru dan replikasi program di madrasah lain. Secara umum dapat disimpulkan bahwa WKS merupakan inovasi media edukasi yang efektif, kontekstual, dan berkelanjutan dalam mengubah waktu istirahat menjadi ruang aman dan kreatif untuk praktik komunikasi berbasis nilai Islami di madrasah.

Abstract

Deradicalization is guided by counterterrorism preventive measures as a strategic effort in neutralizing ideas that are considered radical and can be dangerous through a non-violent approach. This research was conducted with the aim of knowing radicalism in the younger generation, especially in higher education through questionnaires and interviews with related parties. Terrorism is currently a serious problem and endangers national security, so prevention efforts are needed. The target of the spread of radical terrorism that has infiltrated the university environment needs to be prevented and become a common concern, especially university leaders. The development of the radical flow of terrorism in the university environment can endanger the unity of the state because universities are a place for educational candidates for intellectuals, entrepreneurs, bureaucrats, technocrats and professionals. The aim of radicals is to bring about changes to the roots and for this they always use violent methods and oppose the existing structure of society. So that joint efforts are needed in preventing and overcoming the spread of radicalism, transformation of terrorism in universities. Efforts to prevent the various factors that cause radicalism are carried out with policies contained in universities and local governments through strengthening state minded in action among youth.

Abstract

Women's empowerment plays a crucial role in increasing the profitability of Micro, Small, and Medium Enterprises (UMKM) in the Society 5.0 era, characterized by the integration of digital technology and artificial intelligence. UMKM, as the backbone of the economy, face challenges in remaining competitive in this digital era. Profitability in the context of UMKM refers to a business's ability to generate optimal profits through increased operational efficiency, product innovation, and expanded market share. Women's empowerment in the UMKM sector can make significant contributions through skill enhancement, expanded market access, and product and service innovation that impact business profits. This study aims to analyze the role of women's empowerment in increasing UMKM profitability in the Society 5.0 era. The research method used is a qualitative literature review, with the aim of exploring and interpreting the results of previous studies related to the role of women's empowerment in increasing UMKM profitability in the Society 5.0 era. Data were obtained from books, journals, and articles relevant to the research topic. Based on a review of 10 related journal articles, it was found that women's empowerment not only encourages increased technical and managerial skills but also opens opportunities for access to global resources and markets. However, challenges such as unequal access to technology and funding continue to hamper the potential for women's empowerment. Therefore, policies that support women's empowerment, such as technology-based training and increased access to financing and business networks, are essential to boost UMKM profitability.

Abstract

This bibliometric study analyzes changes in corpus linguistics research from 2004 to 2024, emphasizing discourse analysis, digital literacy, and educational technology. Despite being the crucial tool for language analysis, corpus linguistics is frequently not taught in teacher preparation programs. Literacy has evolved digitally as a result of the growing prevalence of computers and the internet. Research indicates that educators must improve their technological proficiency. Using an analysis of 128 papers from the Scopus database, this study looks at the gaps in the extensive body of scientific literature on corpus linguistics. Studies indicate that scientific output has increased significantly in recent years, particularly since 2018. Papers are currently the most widely used publication format. The United States excels at assisting and cooperating with other nations. According to the investigation, Robert C. Meurant and Rodney H. Jones were the primary authors and had the highest number of citations and contributions, respectively. Traditional language methods are no longer the main focus of research; instead, an interdisciplinary framework that combines digital technology and education has taken its place. As a result, there is now a close connection between instruction and online and data resources. According to the research, literacy in corpus linguistics is now seen as a skill influenced by contemporary teaching strategies, the accessibility of data, and student engagement in the classroom.
