Abstract

Religious and spiritual knowledge are among the areas of education that must be given full attention by families for their children. Religious knowledge is very meaningful in awakening the instinctive spiritual strength and willingness that exists in children through religious guidance and the practice of religious teachings which are of course adapted to their level and age, so that it can help to gain basic religious knowledge which has implications for the child's awareness of running. religious teachings properly and correctly. The Koran explains about orphans in various ways, including religion, faith, property, inheritance, spoils of war, marriage, and so on. This shows that the problem of orphans in the Koran is not only a sosial and humanitarian problem, but is also related to religious and faith issues which will have an impact in the afterlife. Therefore, the problem of orphans in Islam is a very important matter, so it requires serious attention and handling from people who are caring and adequate. Allah commands those who believe and are pious to pay attention to, look after, assist, aid and protect orphans in the ways He has determined.

Abstract

This research aims to determine the benefits according to Najmuddin al-Tufi and the distribution of daughters' inheritance in terms of the concept of benefits. The research method used is descriptive analysis, the data is processed using content analysis. The results of this study show several important points. First: that the benefits according to al-Tufi are different from those understood by the majority of ulama, al-Tufi believes that the benefits are as follows: Benefits and mafsaadat can be assessed on the basis of reason alone, Maslahat is an argument that stands alone and is separate from the syarak text, the scope of benefit is muamalah and custom and benefit are the strongest Islamic arguments. Second: Based on this view, there is nothing wrong with dividing a daughter's inheritance 1:1 as long as there are benefits, even though it is contrary to the Islamic law.

Abstract

The aim of this research is to discuss the protection of women's rights in the MUI Fatwa in the field of Munâkaḥat from a Maşlaḥah perspective. This research is qualitative research with the type of library research. The data collection method used in this research is literature study. The research results show that there is Maşlaḥah obtained regarding the protection of women's rights in the MUI fatwa in the field of Munâkaḥat. The MUI or Indonesian Ulema Council, the main Islamic administrative body in Indonesia, considers such relations to be legally dangerous because they are considered to violate public regulations. The MUI generally underlines the importance of complying with Islamic norms and state regulations, which is legally dangerous because it is considered to violate public regulations requiring official registration.

Abstract

This article analyzes the value of maslahah mursalah in the marriage dispensation for pregnancy out of wedlock. This research study is a type of library research with a normative-empirical legal approach. Meanwhile, the type of data analysis is qualitative-descriptive. This research found that the phenomenon of out-of-wedlock pregnancies for minors is still widespread in social life institutions. One way to get married is to apply for a marriage dispensation. In the marriage dispensation there are maslahah mursalah values, including the community getting legal certainty and justice at the same time as minimizing harm.

Abstract

Culture and religion have an important role in shaping values, norms and views regarding gender roles and status in society. Viewed from a contemporary perspective, the influence of culture and religion on gender justice Perspektif Kontemporer is very complex and varied. Culture can influence gender equality by reinforcing unequal gender views and judgments between men and women. Religion also plays an important role in gender justice in a contemporary perspective. Certain religious interpretations and practices can reinforce unequal gender norms and roles. There are several religions that have rules and traditions that give men higher power than women in social and religious structures. The aim of the research is to understand how culture and religion influence gender justice from a contemporary perspective. The method used in this research is an exploratory oriented qualitative research method which attempts to analyze research problems from reading sources by applying content analysis. Researchers use qualitative research to examine the results of previous research and to interpret a phenomenon scientifically. Data collection techniques were carried out through documentation techniques from various journals, proceedings, online news and relevant books. The results of this research show that there is a better understanding of the influence of culture and religion on gender justice from a contemporary perspective. The conclusion of this research is to show that a better understanding of the influence of culture and religion will be able to build a society that is more inclusive and equal between all individuals, regardless of gender.

Abstract

The renewal of Islamic law essentially rests on something that already exists, then undergoes a qualitative change as a product of interactions in community life. It can be said that the process of Islamic legal renewal is viewed as something autonomous, but it also interacts with other elements in society so that it becomes interdependent. Therefore the concept of renewal of Islamic law demands the presence of an adaptive attitude, with the social conditions of the society in which it interacts. Thus, the renewal of Islamic law must be undertaken in response to the demands of change occurring among the society. The reform of schools in Islamic Law is carried out as an attempt to implement the Islamic law of Ijtihad, namely the results of ijtihad scholars who have lost their actual power in the context of today by re-studying by the competent authorities and ijtihad against new issues that have never been discussed by scholars. In the course of history, Islamic law has been a dynamic and creative force. This is characterized by the presence of various sects with different patterns and characteristics, according to the socio-historical and political background in which they grew and developed. In the paradigm of classical jurisprudence there are five principles that allow Islamic law to develop according to time namely 1) Principle of Ijma, 2) Principle of Qiyas, 3) Principle of Maslahah Mursalah, 4) Principle of maintaining Urf. Abstract

The rapid advancement of digital technology has transformed global financial systems and introduced new instruments such as cryptocurrencies, which have attracted widespread attention in modern society. This article, titled “Digital Transactions and Cryptocurrency in the Perspective of Contemporary Fiqh al-Muamalah,” aims to analyze the legal status, ethical dimensions, and socio-economic implications of digital assets within the framework of Islamic jurisprudence. The study employs a qualitative-descriptive approach, drawing upon classical and contemporary fiqh sources, scholarly fatwas, and modern Islamic financial regulations. The findings indicate that digital transactions, including cryptocurrency usage, are permissible (mubah) under Islamic law, provided they fulfill the principles of Islamic muamalah—namely contractual clarity (al-aqd al-sarih), justice (al-adl), and avoidance of gharar (uncertainty), riba (usury), and maisir (gambling). Cryptocurrencies may be recognized as a legitimate form of investment and medium of exchange when their intrinsic value, transparency, and purpose align with Shariah principles. However, the volatility of value and potential misuse in illicit transactions necessitate strong Shariah oversight and state regulation. Therefore, from the standpoint of contemporary fiqh al-muamalah, cryptocurrencies can be classified as mal istibdali (substitutable assets), permissible under Shariah when they serve public benefit (maslahah ammah) and uphold ethical financial practices.
