Abstract

Ideally, participatory democracy positions citizens as active subjects in the formation of regional regulations through the representative role of the Regional People’s Representative Council (DPRD) as a local legislative body. In practice, however, public participation in regional law-making remains largely procedural, elitist, and insufficiently influential on the substantive orientation of regional legal politics. This condition creates a gap between the normative ideals of local democracy and the empirical reality of adaptive and responsive local governance. This study aims to analyze the constitutional role of the DPRD within the political framework of regional legislation and to assess the extent to which the institutionalization of public participation contributes to the quality of regional regulations. This article employs normative legal research using a qualitative approach, combining the statute approach and the conceptual approach. The data are derived from primary and secondary legal materials and analyzed through descriptive-analytical methods. The findings demonstrate that strengthening the deliberative function of the DPRD and embedding substantive public participation mechanisms are essential to producing legitimate, adaptive, and socially responsive regional legislation in a dynamic democratic context.

Abstract

Penelitian ini mengkaji evolusi Hukum Adat di Indonesia dari masa kolonial hingga era modern, menyoroti tantangan dan peluang dalam integrasinya ke dalam Sistem Hukum Nasional. Dengan menggunakan pendekatan penelitian hukum normatif, penelitian ini menganalisis norma hukum, doktrin, dan putusan pengadilan yang relevan, termasuk pengakuan konstitusional terhadap Masyarakat Hukum Adat (MHA) melalui Pasal 18B UUD 1945 dan Putusan MK No. 35/2012. Hasil penelitian menunjukkan bahwa meskipun Hukum Adat telah mendapatkan pengakuan formal, implementasinya masih terhambat oleh dualisme hukum dan konflik dengan undang-undang sektoral yang lebih mengedepankan kepentingan ekonomi. Temuan ini menegaskan perlunya harmonisasi antara Hukum Adat dan hukum nasional untuk menciptakan sistem hukum yang lebih inklusif dan berkeadilan. Selain itu, rekomendasi untuk pengesahan RUU MHA menjadi prioritas guna memberikan perlindungan yang lebih baik terhadap hak-hak tradisional masyarakat adat. Penelitian ini diharapkan dapat memberikan kontribusi signifikan dalam pengembangan kebijakan hukum yang responsif terhadap kebutuhan masyarakat adat di tengah tantangan globalisasi hukum.

Abstract

Forest governance has become a central issue in environmental law, particularly in regions vulnerable to deforestation and ecological degradation. Dompu District in West Nusa Tenggara, Indonesia, presents a critical case of forest area management where complex interactions between legal norms, institutional capacity, and community involvement shape the effectiveness of forest policies. This paper aims to analyze the implementation and challenges of forest governance in Dompu through the lens of environmental law. The study adopts a qualitative sociolegal methodology by examining statutory regulations, regional policies, and institutional roles, complemented by field interviews involving local government officials, environmental NGOs, forest rangers, and indigenous community representatives. The research reveals several systemic issues: overlapping legal jurisdictions, limited law enforcement capacity, insufficient public participation, and the marginalization of local wisdom in policy processes. Despite existing legal frameworks and conservation programs, unsustainable land use practices and weak coordination among stakeholders continue to hinder policy effectiveness. The findings suggest that reforming institutional structures, enhancing interagency coordination, and integrating traditional ecological knowledge into formal legal frameworks are essential steps toward improving forest governance. In conclusion, this paper contributes to the broader discourse on environmental legal reform and sustainable natural resource management by highlighting the local dynamics and legal complexities in the Dompu District context.

Abstract

Money laundering crimes are generally classified into active and passive forms. In the Indonesian context, passive money laundering based on Article 607 paragraph (1) letter (c) of the Criminal Code adopts the pro parte dolus pro parte culpa model which equates criminal liability between intentional acts and those committed due to negligence. This approach raises normative issues related to the principle of proportionality which requires differentiating sanctions based on the degree of error. This study aims to analyze the principle of proportionality in Islamic criminal law and evaluate the suitability of the formulation through a comparative approach. This study uses normative legal methods with legislative, conceptual, and comparative approaches. The analysis was carried out on the provisions of Indonesian criminal law, Islamic criminal law principles, and several relevant foreign legal systems. The results of the study show that Islamic criminal law expressly distinguishes the level of error in the imposition of sanctions, as reflected in the concepts of qisas and diyat. This principle is also in line with a number of modern legal systems that separate intentional crimes (dolus) and negligent crimes (culpa) with different criminal consequences. On the other hand, the pro parte dolus pro parte culpa model in the Criminal Code has the potential to obscure these differences by imposing equivalent sanctions, thereby weakening the principle of proportionality and risking substantive injustice. This research contributes theoretically through strengthening the study of comparative criminal law based on the integration of Islamic law perspectives, as well as practically by recommending the reformulation of criminal policies to ensure more optimal proportionality and justice.

Abstract

Penelitian ini mengkaji akar historis restorative justice melalui refleksi terhadap prinsip-prinsip yang terkandung dalam Code of Hammurabi serta relevansinya bagi pembaruan sistem hukum Indonesia. Latar belakang penelitian ini didasarkan pada semakin meluasnya penerapan restorative justice di Indonesia yang masih menghadapi tantangan konseptual dan filosofis. Penelitian ini bertujuan untuk menganalisis unsur-unsur restoratif dalam sistem hukum kuno serta menilai kontribusinya terhadap pembaruan hukum nasional. Metode penelitian yang digunakan adalah penelitian kualitatif dengan pendekatan historis dan yuridis normatif melalui studi kepustakaan terhadap teks hukum klasik, peraturan perundang-undangan, dan literatur ilmiah bereputasi. Hasil penelitian menunjukkan bahwa meskipun Code of Hammurabi didominasi oleh paradigma retributif, terdapat mekanisme restitusi dan kompensasi yang mencerminkan nilai restoratif awal. Namun, mekanisme tersebut bersifat hierarkis dan tidak melibatkan korban secara aktif sehingga tidak sejalan dengan prinsip restorative justice modern. Dalam konteks Indonesia, restorative justice telah mengalami perkembangan signifikan melalui berbagai regulasi, termasuk sistem peradilan pidana anak dan KUHP baru, tetapi masih menghadapi kendala kultural, struktural, dan normatif. Penelitian ini menyimpulkan bahwa refleksi historis terhadap Code of Hammurabi mempertegas keterbatasan keadilan retributif serta pentingnya penguatan kerangka restorative justice yang humanis, adil, dan akuntabel di Indonesia

Abstract

Discoursing between law and morality is an interesting conversation among a legal scholars and jurists. Observing of legal developments are reviewed historically, the morality of jurisprudence from time to time undergoes sharp reductions. In the early stages of modern human civilization, the morality of jurisprudence still stands firmly on the foundation of the religion (christian). Moral judgments about good or bad, right or wrong, are consistently restored to the divine rules. Faced with the power of the church and the kings, came the antithesis of contradictory extreme thought, the idea that denied the existence of God or rejected the hegemony of religion and the church. The opposing of two rivals in concepts, theories and practices are concerning of the moral role of life. In turn, it had a significant influence on the development of jurisprudence in Europe at the time, leading to the spread of colonization in the eastern hemisphere.

Abstract

Penelitian ini bertujuan untuk mengkaji dan menganalisis pelaksanaan penegakan hukum terhadap korban kekerasan dalam rumah tangga (KDRT) di wilayah hukum Polsek Dompu. Permasalahan yang diangkat berfokus pada efektivitas implementasi hukum, respons institusi kepolisian terhadap korban, serta hambatan struktural dan kultural yang memengaruhi jalannya proses hukum. Metode penelitian yang digunakan adalah pendekatan yuridis-sosiologis dengan teknik pengumpulan data berupa wawancara, observasi, dan studi dokumentasi. Hasil penelitian menunjukkan bahwa meskipun aparat kepolisian memiliki kesadaran normatif terhadap pentingnya perlindungan korban, praktik di lapangan belum sepenuhnya mencerminkan perlakuan yang berpihak pada korban. Faktor seperti keterbatasan fasilitas khusus, minimnya petugas yang terlatih secara profesional, dan tekanan budaya patriarki menjadi penghambat utama dalam pemenuhan hak-hak korban. Di samping itu, koordinasi antara lembaga penegak hukum dan lembaga pendukung lainnya belum berjalan optimal, sehingga mengakibatkan proses penanganan yang parsial dan tidak terintegrasi. Penelitian ini menyimpulkan bahwa diperlukan penguatan kelembagaan, pelatihan berbasis perspektif gender bagi aparat, serta sistem layanan terpadu agar penegakan hukum dapat berjalan secara adil, humanis, dan efektif dalam melindungi korban KDRT. Temuan ini diharapkan dapat menjadi dasar pertimbangan bagi pembuat kebijakan dan aparat penegak hukum dalam merumuskan strategi penanganan kekerasan dalam rumah tangga yang lebih responsif terhadap korban.
