Brand is a sign in the form of pictures, names, words of letters, numbers, arrangement of colors, or combinations of those elements which have distinguishthing power and are used in goods or service trade activities. The terms in the brand, especially regarding the protection of famous brands, can actually be applied in the case of domain names. "There is a provision in the TRIPs that governs the issue of protection of this famous brand, and the public becomes bound by the provision because it has been ratified". The meaning is Article 16 (3) TRIPs (Trade Related Aspect of Intellectual Property Rights). Article 16 (3) states that Article 6 bis of the Paris Convention on Protection of Industrial Property Rights shall apply, mutatis mutandis to goods and services which are not similar to goods and services to which a trademark has been registered.

Changes in the legal construction begin with a paradigmatic shift in the relationship between the consumer and businesses, as reflected in the preference of let the producer aware principle in favor of letting the buyer aware principle. This study aims to find out the implication of the let the producer aware principle for goods and services, and its development in consumer protection law in Indonesia and to find out the legal system of Indonesia adopts the let the producer aware principle in order to protect Indonesian consumers. The research method applied in this study is normative juridical approach. The data obtained from the study of literature which is used as secondary data. Furthermore, interviews were conducted to obtain primary data, and then the data were analyzed by juridical qualitative method. As a result of analysis, it shows that firstly: the implementation of let the producer aware principle in Indonesia has not been properly conducted because of the common perception that consumers’ opinion is less valuable than producers’. Secondly, the adoption of the let the producer aware principle for consumer protection by Indonesian Legal policy is shown by Law Number 8 Year 1999 about Consumer Protection (Indonesian Consumer Protection Act), which is based on the principle of fault liability, utilizing reversed burden of proof. This way, both parties are protected, because it proportionally distributes the liability to each party. In conclusion, both producers and consumers are equally protected on condition that they can provide evidence of the losses obtained.

Sunda Wiwitan as a religion had existed prior to the other, more well known religions in Indonesia, but is currently isn’t recognized as an official religion by Act No.1/PNPS/1965. The state, as opposed to guaranteeing the freedom of belief and its practice, instead imposes restrictions on religion in this particular case, leaving the believers of Sunda Wiwitan feeling abandoned and as outcasts. As a result, many violations and discriminations are experienced by adherents of Sunda Wiwitan. One example of such discrimination is the “whiting-out” of the “religion” column in ID Cards. The result of this discrimination is difficulty in accessing civil documents, in addition to verbal violence from certain parts of the society who assume the Sunda Wiwitan belief as heretic.

Penelitian ini mengjaki penyelesaian sengketa pembagian harta bersama pasca terjadinya perceraian di Kabupaten Aceh Tengah yang diselesaikan dengan beberapa cara yakni musyawarah keluarga, musyawarah dengan melibatkan lembaga adat Sarak Opat dan dengan mengajukan gugatan harta bersama ke Mahkamah Syar’iyah Takengon. Pada umumnya pembagian harta bersama pasca terjadinya perceraian di Kabupaten Aceh Tengah dilakukan secara musyawarah dengan melibatkan lembaga adat Sarak Opat. Pembagian harta bersama pasca terjadinya perceraian di Kabupaten Aceh Tengah yang dilakukan berdasarkan musyawarah dengan mempertimbangkan dengan siapa anak tinggal besaran kontribusi pencaharian harta bersama walaupun tidak sesuai dengan aturan yang terdapat dalam Undang-Undang Perkawinan dan Kompilasi Hukum Islam namun mungkin berpedoman kepada Pasal 37 Undang-Undang Perkawinan dan hal ini tidak menyalahi aturan baik Hukum Islam maupun Hukum Adat. Karena pada dasarnya menurut Hukum Islam dan Hukum Adat tidak ada aturan khusus terkait presentase pembagian harta bersama pasca terjadinya perceraian

Marriage requirements must be fullfiled by the prospective bride and groom before marriage, but when it does not fulfill the requirements one of that the refusal of the marriage guardian called Islamic law wali adhal, then marriage registration cannot be conducted. First study aims to determine the legal certainty and validity of the marriage of guardian adhal according the law of Islamic and Marriage law. The second aims to find out and analyze the implementation of the principles of the Religious Justice in determining the guardian adhal in the practice of the settlement process and the judges considerations at the Bogor Religious Court. The object of journal is determination 0242/Pdt.P/2017/PA.Bgr and 57/Pdt.P/2021/PA.Bgr. The first result study is show the marriage registration with the determination of adhal guardian which was granted by the judge valid in the point of Islamic law. Marriage Law tell the marriage registration is legal but the marriage guardian hasn’t been regulated. The second result study is stated with related number determination was inkrah because judges at the Bogor Religious Court made considerations through the relevant principles of the Judicial Law namely is Islamic personality, legality, equality and active judges providing assistance. The issue of human rights among Muslim countries is nothing new. Islamic Shari'a which is universal explains a lot of basic principles regarding equality of human rights and freedoms, even when the Prophet Muhammad declared the Medina Charter. The history of the enactment of Islamic law among Muslim communities has shifted from a vertical normativity point to a horizontal one. This is because the development of the enactment of Islamic law has also been influenced by socio-cultural dynamics and legal politics in Islamic society itself. Islam has first taught mankind about the concept of egalitarianism, universalism and democracy. This beautiful and comprehensive concept is allegedly adopted by the West through the emergence of universal ideas which are standardized in the Universal Declaration of Human Rights convention. Islam is an ash-Syumul religion. Islamic teachings cover all aspects of human life. Islam provides regulations and demands on humans, ranging from the smallest affairs to large-scale affairs. And of course, it includes rules and high respect for human rights (HAM). However, it is not in one structured document but is spread out in the holy verses of the Koran and the Sunnah of the Prophet Muhammad.

Marriage Isbat is a validation of marriage. Not all application of marriage isbat are accepted, one of which is Decision No. 0637/Pdt.G/2021/PA.Kab.Mlg where the Religious Court decided to cancel the marriage isbat that has been granted. The main issue in Decision No. 0637/Pdt.G/2021/PA.Kab.Mlg is that the application of marriage isbat is formally flawed due to the lack of parties in it. The writing method used is a normative juridical method with a qualitative juridical analysis method. The purpose of this study is to find out the consideration of the Court in deciding this case and the legal consequences of the cancellation of marriage isbat according to Indonesian Marriage Law and Islamic Law. Based on the result of the study, the Judge’s consideration in Decision No. 0637/Pdt.G/2021/PA.Kab.Mlg is in accordance with the relevant regulations. Meanwhile the legal consequences of the marriage isbat cancellation is that the registered marital status is reverted to the unregistered marriage. Based on the Marriage Law, unregistered marriages have very detrimental effects for both wife and children. While based on Islamic law the legal consequences are the same as the validity of marriage based on the Marriage Law.

Hukum Islam mengatur beberapa cara untuk menyelesaikan berbagai permasalahan sengketanya, pertama ada yang disebut dengan Al sulh (perdamaian). Al-Qur’an dan hadis dalam Islam menawarkan cara penyelesaian sengketa baik melalui pengadilan (litigasi) melalui pembuktian fakta hukum maupun di luar pengadilan (nonlitigasi) melalui perdamaian.Tim Penyuluh RKDU mengadakan penyuluhan Mediasi Hukum Islam di Desa Sayang Kabupaten Jatinangor dengan bertujuan warga masyarakat dapat meningkat kesadaran hukumnya. Metode yang digunakan adalah penyuluhan secara langsung melalui ceramah, diskusi terarah antara tim penyuluh dan warga masyarakat. Setelah penyuluhan hukum dilakukan maka didapat kesimpulan, pada tahap pengetahuan hukum, warga masyarakat Desa Sayang mengetahui sejumlah bagaimana mekanisme mediasi Islam secara non litigasi dan litigasi. Selain itu warga masyarakat Desa Sayang menjadi kesadaran hukum menjadi setelah tim penyuluh memberikan paparan mengenai materi penyelesaian sengketa melalui mediasi hukum Islam.

Female civil servants are absolutely prohibited from becoming second/third/fourth wives as regulated in Government Regulation Number 45 of 1990 concerning Marriage and Divorce Permits for Civil Servants, with the threat of sanctions for those who violate. Problems occur if the judge grants the request for polygamy with the prospective second wife's position as a civil servant with one of the judge's considerations which is not in accordance with the Legislative Regulations, namely ordering the prospective second wife to attach a Certificate of Giving Permission from Her Superior, as in the Decision of the Demak Religious Court Number 539/Pdt. G/2019/PA.Dmk. This research aims to determine the validity of the Certificate of Giving Permission from the Superior submitted by the prospective second wife in the decision in terms of the relevant Legislation. The approach method used in this research is normative juridical with research specifications, namely analytical descriptive, meaning that the events being researched are described using primary, secondary and tertiary legal materials. This research uses qualitative juridical analysis methods to produce descriptive data. The results obtained from this research are that the validity of the Certificate of Granting Superior Permission submitted by the prospective second wife should not have perfect legal force and can be canceled because it does not comply with the provisions in Article 4 paragraph (2) of Government Regulation Number 45 of 1990 concerning Marriage Permits and Divorce for Civil Servants.

Pasal 1 Undang-Undang Nomor 16 Tahun 2019 tentang Perubahan atas Undang-Undang Nomor 1 Tahun 1974 tentang Perkawinan (selanjutnya disebut UU Perkawinan) telah menyatakan bahwa Perkawinan adalah ikatan lahir batin antara seorang pria dengan seorang wanita sebagai suami istri dengan tujuan membentuk keluarga (rumah tangga) yang bahagia dan kekal berdasarkan Ketuhanan Yang Maha Esa. Ketentuan hukum tersebut secara jelas telah mengatur bahwa unsur perkawinan adalah seorang pria dan seorang wanita sebagai pihak yang dapat melaksanakan perkawinan. Pada praktiknya, masih terdapat penyimpangan terhadap aturan hukum tersebut, yakni terjadinya suatu perkawinan sesama jenis karena pemalsuan identitas, terlebih perkawinan tersebut terjadi secara siri. Perkawinan siri merupakan suatu pelanggaran terhadap Pasal 2 ayat (2) UU Perkawinan. Tidak dilaksanakannya perkawinan tersebut sebagaimana ketentuan UU Perkawinan sehingga pihak yang dirugikan tidak dapat mengajukan tuntutan terhadap hak-hak keperdataannya terhadap terjadinya perkawinan tersebut. Penelitian ini mengkaji bagaimana perlindungan hukum bagi korban perkawinan siri sesama jenis yang terjadi karena pemalsuan identitas salah satu pihak menggunakan metode pendekatan yuridis normatif dengan menggunakan pengumpulan data informasi diperoleh dari penelitian kepustakaan dan penelitian lapangan (wawancara). Hasil penelitian menunjukkan bahwa terdapat 2 (dua) perlindungan hukum yang dapat dilakukan, yakni perlindungan hukum preventif dan represif.
