Abstract

It is fascinating how customary laws are accepted by judges in the Indonesian legal system. In Aceh, particularly, its customary law is inspired by sharia or Islamic law. In addition to the national law, this law also influences judges’ consideration in making their decisions. According to Van Den Berg’s theory of receptio in complexu, Islamic law has been recognized in Indonesian legal system as a customary law. This article tries to find out how judges accept sharia-inspired customary law to pass their decisions. The research used normative-legal method. Based on the research results, the author concluded the judge’s acceptance of customary law could be seen from a Sharia Court decision related to customary disputes. This decision was passed by the Takengon Sharia Court under No. 269/Pdt.G/2017/Ms-Tkn dated May 2, 2018. It concerned with the division of joint property. This decision referred to Islamic law in giving each party a half of the total assets after being deducted by the joint debts. This decision strengthened the foothold of Islamic law in customary law and national law enforcement, especially in Aceh Province. However, it would be a different case if the customary law was in conflict with Islamic law. In such a case, the panel of judges would not accept the customary law. An example of this was the case of adopted children. Rather than receiving an inheritance, as in the traditional parental communities, they would only receive a mandatory will. One of such decisions was the Aceh Sharia Court’s Decisions No. 125/Pdt.G/2011/MS and No.084/ Pdt.P/2016/MS.Bna.

Abstract

Inheritance is an important part of one legal event, namely death. The legal consequences that arise are the management and continuation of the rights and obligations of someone who has died. This paper examines the juridical aspect of inheritance distribution to grandchildren as substitute heirs who control the inheritance. The research method used is a normative juridical approach with analytical descriptive specifications. The purpose of this study is to determine the position of the substitute heir who controls the inheritance in obtaining a share of the inheritance. Grandchildren as substitute heirs according to Islamic Law are not entitled to control and obtain inheritance. However, in KHI, grandchildren as heirs have the right to inherit no more than the other heirs, which is only 1/3 of the share.

Abstract

The aim of law enforcement is none other than to ensure that legal subjects obtain every right. One law enforcement that must be considered is in the field of family law in marriage law. Marriage of children under the age of 18 is vulnerable to domestic violence. This research will enforce legal protection against domestic violence in child marriages, whether legalized by the state or child marriages carried out through sirri marriages.. The method used is juridical qualitative with a descriptive approach and the data is processed in a qualitative juridical manner. The results of the study show that there are differences in the legal protection of victims of domestic violence in sirri child marriages. Legal child marriage and obtaining marriage dispensation can be protected by Law No. 23 of 2004 concerning the Elimination of Domestic Violence and other relevant laws and regulations. Meanwhile, the protection of domestic violence in a sirri / unregistered child marriage can only be subject to the Criminal Code and Law No. 35 of 2014 concerning Child protection.

Abstract

Pelajar sebelum memasuki usia produktif tentunya harus memiliki kemampuan terhadap hal praktis yang dapat dikuasai, antara lain Hak Kekayaan Intelektual. Kekayaan intelektual dalam pengenalannya memiliki 2 (dua) sisi utama yang harus diketahui, yaitu sebagai aset yang harus dijaga kepemilikannya karena memiliki nilai ekonomis dan menghormati kekayaan intelektual yang dimiliki orang/perusahaan/masyarakat untuk tidak dilanggar kepemilikannya. Memberikan materi kepada pelajar apabila dilakukan dengan contoh praktis akan lebih mudah dipahami, melalui kegiatan penyuluhan batik, pelajar akan mengetahui dari motif batik yang diproduksi sebagai produk tekstil memiliki kekayaan intelektual. Hak Kekayaan Intelektual dalam motif batik, sebagai Hak Cipta yang diatur dalam Undang-Undang Nomor 28 Tahun 2014 Tentang Hak Cipta dan Indikasi Geografis yang diatur dalam Undang-undang Nomor 20 Tahun 2016 Tentang Merek dan Indikasi Geografis. Metode pengabdian kepada masyarakat yang digunakan adalah metode penyuluhan dengan ceramah dengan rancangan kompetisi untuk mengetahui pengetahuan yang sudah dimiliki siswa dengan mengadakan perlombaan tentang batik. Hasil dari pengabdian yang dilakukan pada siswa-siswi SMPN 4 Jatinangor diketahui 90% (sembilan puluh persen) telah mengetahui Hak Kekayaan Intelektual sebagai hak yang dapat diperoleh dari kreatifitas dan intelektualitas, siswa pun mengetahui bahwasannya kekayaan intelektual milik orang lain harus dihargai kepemilikannya sehingga tidak boleh dilanggar.

Abstract

Perkembangan Fintech Lending memberikan kemudahan bagi masyarakat untuk memperoleh pendanaan. Namun demikian, keberadaan Fintech Lending seringkali menimbulkan permasalahan hukum yang merugikan konsumen. Pemahaman secara komprehensif aspek hukum Fintech Lending diharapkan dapat meminimalisir terjadinya kerugian konsumen. Metode yang digunakan dalam Pengabdian Pada Masyarakat ini dilaksanakan dengan penyuluhan hukum yang diawalai dengan pemberian materi dan diskusi. Hasil Pengabdian Masyarakat bahwa perlindungan hukum terhadap konsumen Fintech Lending dapat dikategorikan menjadi dua yaitu perlindungan hukum terhadap Fintech Lending Ilegal dan Fintech Lending yang terdaftar atau memiliki izin dari Otoritas Jasa Keuangan. Masyarakat dan konsumen Fintech Lending harus bijak memanfaatkan layanan Fintech Lending untuk menghindari adanya potensi kerugian yang dialami konsumen.

Abstract

Persepsi merupakan pandangan individu terhadap suatu fenomena kehidupan yang berimplikasi terhadap tindakannya. Peningkatan kesadaran hukum berlalu-lintas, berupaya meningkatkan pengetahuan hukum yang dapat mempengaruhi persepsi yang menerimanya untuk meningkatkan kesadaran keselamatan dalam beralalu-lintas. Peningkatan pengetahuan dilakukan dengan penyuluhan kepada pelajar, sebagai usia yang sesuai karena pada usia remaja sudah menggunakan kendaraan bermotor dan diharapkan membawa dampak baik kepada masyarakat sekitarnya. Penyuluhan dilakukan secara atraktif dan lomba menarik, agar dapat memainkan emosi audiens agar lebih diserap dan diingat. Kegiatan pengabdian ini dilakukan di sekolah yang berada di Desa Cileunyi Wetan, yaitu: SMPN 2 Cileunyi, Pondok Pesantren Al-Jawami, dan pelajar lainnya yang berada di lingkungan Desa Cileunyi Wetan pada kegiatan Pengabdian Pada Masyarakat-KKN Integratif 2023/2024. Metode yang digunakan dalam pengabdian ini dengan penyuluhan untuk meningkatkan persepsi ketaatan berlalu-lintas bagi pelajar. Hasil dari pengabdian ini, mampu menjangkau sekitar 200 pelajar mayoritas pelajar belum memahami rambu-rambu, belum sadar safety driving, dan pentingnya defensive driving karena dalam berkendaraan mengutamakan keselamatan bukan kecepatan.

Abstract

The family itself was initially formed through a marriage between a man and a woman who was considered feasible. One of the purposes of marriage is the fulfillment of the biological needs, yet this biological needs fulfillment can be a problem when one party is suffering from hypersex. In the case of divorce numbered 350/PDT. G/2014/PA.JB. that happened in Religion of West Jakarta Court, the wife as the Plaintiff felt it was not capable of serving the biological desire of her husband that ultimately give rise to conflict in their marriage life. the case is decided in verstek by the judge because the defendant i.e., husband of the plaintiff is not present in the trial even though it was called officially and worth. Based on the results of the research, the psychological disorders hypesex as the reason for the divorce is not set explicitly in the Act of marriage, Islamic Law Compilation, nor the Goverment Rules No. 9 Year 1975. However, in this case the judge considers that the hypersex psychological disorders lead to continuous conflict and the conflict resulted in the defendant leave plaintiff. Consideration of the judge in the court decision that has complied with the provisions concerning the grounds for divorce are set forth in article 19 Government Regulation No. 9 years 1975 and section 116 Islamic Law Compilation, so that the judge has the right judges grant a divorce lawsuit plaintiff filed. In addition the verdict which decided in verstek by the judge had in accordance with existing procedures and his lawsuit is not against the rights so that is in compliance with existing provisions in article 125 of HIR. Abstract

The Indonesian people in fact use their minds not on the basis of the Qur'an and the Sunnah is only limited to taqlid ittiba the religious scholars who are not necessarily truthful can be justified. The purpose to understanding of taqlid ittiba and to obtain the consequences of taqlid ittiba for Muslim in implementing Islamic Law and Positive Law. Research methods by using normative research methods or library law research in finding taqlid ittiba material for mukallaf. The results showed that the implementation of taqlid ittiba for mukallaf performed by Muslims is still a lot that is not in accordance with the teachings of Allah SWT and does not follow the Sunnah of Rasullah SAW. The implementation of taqlid ittiba that is wrong can harm oneself and others who can be troubling to the surrounding community. Someone who carries out taqlid ittiba that is not appropriate in the Qur'an and Sunnah has a legal consequence that is sinful because it does not follow the commands of Allah SWT and Rasul while according to the Law Positive in Indonesia taqlid ittiba allowed for someone who is an adult and does not violate the existing Positive Law so as to create peace between religious communities.

Abstract

The mobile court policy is a way in which the court can provide the best and equal service to justice seekers by the principles of simplicity, speed and low costs. This research discusses the mobile court policy and its implementation in religious courts from a legal-political perspective. The research method uses empirical juridical. Interviews were conducted with judges and litigants in mobile courts at three Religious Courts, i.e.: Tasikmalaya, Soreang and Subang. Document studies are used to search for regulations and related case documents. The research findings show that the problems with implementing mobile courts in the three religious courts are: the infrastructure for mobile courts is still inadequate because they are held outside the building and far from the Religious Courts; public education is still low, they do not even have an understanding of the law and the judicial process; the judge also acts as a mediator in the mobile court and; case settlement was only carried out twice. This condition is increasingly problematic because most cases are divorces, so the facts in the trial are less accurate and affect the quality of court decisions. An interesting finding is that the mobile court is an effort to provide access to justice for people in unreachable areas by the Religious Courts and as a solution to reduce the divorce rate. However, in fact it increases the divorce rate in the target area. People think that the mobile court makes it easier for them to decide on divorce.

Abstract

The success of a peace effort through mediation is highly dependent on the strategy and skill of the mediator in reconciling couples who are about to divorce. The purpose of this study is to describe the factors related to the legal aspects regarding obstacles to the level of success of mediators as a peace effort in divorce cases and to formulate efforts to optimize the role of mediators in order to reduce the divorce rate in the Soreang Religious Court based on related laws and regulations. This writing uses a normative legal method with analytical descriptive research specifications. The author implements normative law to the facts and practices that occur in the field. Data collection techniques use literature and field studies to collect information on divorce case data and the role of mediators in the Soreang Religious Court. The results of this study indicate that first, the success of peace efforts in divorce cases in the Soreang Religious Court is influenced by various inhibiting factors, including the good faith of the parties who are less cooperative, the influence of legal counsel, the condition of the mediation room is less representative, the parties' lack of understanding of mediation, and the role of the mediator is less than optimal. Second, the mediator's skill and sincerity are the main supporting factors for achieving a successful mediation in the Soreang Religious Court. However, mediators still do not have sufficient skills and professionalism to explain and hold caucuses. This is addressed through education or training programs, as well as enforcement of mediator certification to ensure the quality, credibility, and professionalism of mediators in the Class IB Soreang Religious Court.
