Abstract

Salah satu bentuk penyelesaian sengketa alternatif yang biasa digunakan adalah melalui mediasi. Mediasi ini secara langsung merupakan suatu kewajiban yang harus dilakukan dalam proses persidangan di pengadilan. Instansi yang bertanggung jawab di Bidang Ketenagakerjaan Kabupaten/ Kota yang berwenang untuk menerima pencatatan perselisihan hubungan industrial dan melakukan mediasi adalah instansi yang bertanggung jawab di Bidang Ketenagakerjaan Kabupaten/Kota tempat pekerja/buruh bekerja. sejauh mana kesiapan Disnakertrans dalam menghadapi konfl ik antara buruh dan perusahaan di masa pandemi. Penelitian ini menggunakan metode yuridis normatif dengan spesifi kasi penelitian deskriptif analitis. Berdasarkan uraian di atas maka sesuai dengan ketentuan Undang-undang No. 2 Tahun 2004 Tentang Penyelesaian Hubungan Industrial maka Disnakertrans memiliki peranan yang penting dalam menyelesaikan perselisihan hubungan industrial melalui proses mediasi, hal ini membuktikan pemerintah juga (dalam hal ini Disnakertrans) mendukung proses penyelesaian arbitrase, konsiliasi dan bipatride. Proses tersebut sangat berpengaruh besar terhadap penyelesaian suatu permasalahan hubungan industrial dan proses yang kerap dipakai untuk menyelesaikan tersebut adalah mediasi. Kelancaran mediasi sangat berpengaruh terhadap peranan mediator yang terampil dan pakar untuk menyelesaikan suatu masalah, namun hambatan mediasi di Disnakertrans ini adalah minimnya jumlah mediator tidak sebanding dengan jumlah perkara Perselisihan Hubungan Industrial yang masuk dan perlu diselesaikan.

Abstract

This research aimed to analyze the punishment of Sapayuang marriage according to Mashlahah perspective, ‘urf, and Human Rights correlated with the custom philosophy, Adat Basandi Syarak, Syarak Basandi kitabullah (Custom based on Islam, Islam based on Al-Qur’an) which is life foundation of Minangkabau people, the offender of sapayuang marriage accepts severe punishment. This research utilized the empirical juridical method wherein qualitative research was used as the research approach. Primary data was derived from the interview and field findings. Then, these data were analyzed using the relevant theories correlated with this issue such as classic books, books, journals, articles, law dictionaries, encyclopedia, and the previous correlated research to obtain a conclusion. There are several findings of this research, 1) the witness of sapayuang marriage is classified into mashlahah dharuriyah because maintaining the self-respect and prestige is included in mashlahah dharuriyah. If it is viewed from the perspective whether mashalahah changed or not, the prohibition of sapayuang marriage is categorized into mashlahah mutaqaiyyirah. If it is reviewed from the mashlahah side, it is characterized into mashlahah mursalah, because there is no nash which bann it. However, there is no nash which supports it. As a result, it cannot be classified into mashlahah mulghah, 2) If it is reviewed from the ‘urf object perspectives, the prohibition and punishment of sapayuang marriage are included in ‘urf amali, which means the society habits related to actions. Then, if it is seen from the scope, this prohibition is included in ‘urf  khashah which means the habit which is particularly obeyed by the people in certain region. If it is reviewed from the validity of ‘urf related to the punishment of sapayuang marriage, it is ‘urf shahih, and 3) according to the Western human rights perspective, the punishment dibuang dari nagari (expelled) and excommunicated is included in Human Right violation. It is different from the concept of Eastern human rights which emphasizes human rights as part of Islamic teaching implementation.

Abstract

Indonesia menganut sistem hukum pluralisme, yaitu menggunakan sistem hukum tertulis, hukum adat, dan hukum Islam secara sekaligus. Penerapan hukum adat dan hukum Islam di Indonesia diakui dan dapat diterapkan hanya dalam beberapa bidang, seperti hukum waris. Metode penelitian yang digunakan adalah metode yuridis-normatif dengan spesifikasi penelitian yang bersifat deskriptif-analitis, dengan teknik pengumpulan data yang digunakan yaitu studi dokumen kepustakaan. Kesimpulan dari penelitian ini adalah pertama, eksistensi hukum adat walaupun merupakan hukum tidak tertulis tapi masih tetap diberlakukan di Indonesia karena masyarakat adat yang masih menganut dan taat pada hukum adat tersebut dengan keberadaannya diakui dalam Peraturan Perundang-undangan di Indonesia. Kedua, pembagian waris dalam hukum adat di Indonesia, penerapan dalam setiap wilayah akan berbeda-beda dan dapat juga dilihat dari garis keturunan dalam hukum adat yang dianut seperti garis keturunan patrilineal dalam pembagian warisnya hanya anak laki-laki yang berhak mewarisi harta peninggalan dari pewaris (ayahnya). Ketiga, pembagian waris dalam hukum Islam telah ditentukan nilai mutlak pembagiannya atau jumlah besarnya berdasarkan Al-Qur’an. Keempat, pembagian waris dalam hukum adat secara garis keturunan patrilineal dan hukum Islam memiliki perbedaan dalam menetapkan nilai mutlak pembagian kepada ahli waris dan juga perbedaan dalam menentukan ahli waris yang berhak mewarisi.

Abstract

A child of a indigenous faiths community is someone who has grown up in a community that holds certain traditional beliefs or faiths, which are often local and not tied to a major religion or official doctrine. They may follow or practice traditions such as the worship of nature, ancestral spirits, or rituals passed down through generations. In general, protection for minority groups. This research will examine the problematic fulfillment of children's rights of indigenous faiths in Indonesia. The approach method used in the research is normative juridical through legal principles, legal systematics, legal synchronization, and legal comparison. The data analysis method is qualitative juridical obtained through primary, secondary and tertiary data related to case studies of the fulfillment of children's rights of indigenous peoples in the region. The results of the research obtained from the problematic fulfillment of children's rights of indigenous faiths, first, the lack of legal recognition and identity/rejection of childbirth certificate registration for indigenous faiths couples. Second, the right of children to receive education in accordance with the curriculum and teachings of their beliefs. Third, protection from discrimination: Children from indigenous faith communities may be vulnerable to discrimination, and fourth, freedom of religion. The right of children to choose and practice their own religion or belief should be respected and protected.

Abstract

The position of children out of marriage in everyday life by some people is seen as low, on the other hand in terms of welfare and civil rights still get limitations. This research focuses on the implementation of Constitutional Court Decision No. 46/ PUU-VIII /2010 on illegitimate children of Indonesian Women Workers. The research confirmed that the addition of Article 43 paragraph (1) made by the Constitutional Court through Decision No. 46/PUU-VIII/2010 is not only limited to the right to protection but has a very broad meaning that also includes illegitimate children born to Indonesian Women Workers. In accordance with the principle of equality before the law, the law must provide fair protection and legal certainty. The findings of this study revealed that illegitimate children of migrant workers can obtain constitutional rights as Indonesian citizens adhering to the principles of the rule of law. Therefore, the Constitutional Court’s decision does not only affect children’s inheritance rights, but also has implications for guaranteeing and protecting illegitimate children born to migrant workers, such as the right to earn a living, guardianship rights, and the right to get child support from a biological father.

Abstract

Due to the existence of three distinct systems of inheritance law—civil heirship law, Islamic inheritor ship law, and customary inherited law—Indonesian inheritance law is still pluralistic. There are parallels and variances among the components of inheritance law because there are variations in the legal system governing such inheritance. Finding out how inheritance disputes are resolved in Banceuy Customary Village in relation to Islamic law is the aim of this study. This normative research approach employs descriptive analytical research specifications, which involve describing, analyzing, and putting into practice the relevant legal laws. Research indicates that, even though the indigenous communities in the Banceuy district of Subang are Islamic, the law of parental inheritance appears to apply to the indigenous village. However, the division of inherits appears to be dependent on the affinity system in place, as the group of heirs equally accounted for the relationship of relativity through the male and female lines. This division of inheritance falls under the category of the receptie theory, which was abandoned but held that Muslims are subject to Islamic law if it is accepted or mandated by customary law. The concept of equal inheritance division in the indigenous village of Banceuy, if linked to Islamic law, the author claims, originated from a cooperative agreement that was carried out successively so that it became a customary practice that was initially a disclaimer for the implementation of division of heritage religiously or disclaimed.

Abstract

Jabatan Rektor merupakan jabatan yang bergengsi, menyebabkan banyak yang berminat untuk mendudukinya. Hal ini tentunya memiliki potensi konflik, biasanya yang tidak sejalan berusaha mencari kesalahan untuk menjatuhkan. Hal ini tentunya akan mengganggu aktivitas perguruan tinggi dan juga menurunkan kredibiltas institusi oleh masyarakat. Sehingga perlu adanya resolusi konflik, karena permasalahan karena persaingan Rektor di PTN cukup banyak kasusnya. Di dalam hukum dikenal Asas Equality Before the Law (persamaan dihadapan hukum), semua insan harus mendapatkan perlakuan yang adil, konsep moratorium pemberian sanksi hanya menghentikan sementara penjatuhan sanksi pelanggaran yang diduga pernah dilakukan sebelum menjabat. Moratorium ini diharapkan menjadi resolusi karena konflik pada Jabatan Rektor harus diminimalisir karena efeknya yang melibatkan banyak pihak. Metode yang digunakan dalam penelitian ini adalah Yuridis-Sosiologis dengan menggunakan Norma Hukum sebagai landasan, kemudian melihat gejala masyarakat untuk mendapatkan pemecahannya. Hasil dari penelitian ini, perlu adanya kesadaran dari sivitas akademis untuk mengedepankan  Presumption of Innocence (Asas Praduga Tak Bersalah), adanya aturan tertulis mengenai jabatan rektor untuk mendapat hak moratorium atas pelanggaran yang pernah dilakukan sebelum menjabat. The rector's office is a prestigious position, causing a lot of people to be interested in holding it. It has the potential for conflict; usually, disharmony is trying to find mistakes to drop. This will undoubtedly disrupt the activities of the college and also reduce the credibility of the institution in the community. So there needs to be a resolution to the conflict because the problem is the competition among the rectors in state colleges in quite a few cases. Under the law known as Equality Before the Law, all human beings must be treated fairly. The concept of a moratorium on sanctions only stops the temporary fall of sanctions for alleged violations that have ever been committed before taking office. This moratorium is expected to be a resolution because the conflict in the Rector's Department must be minimized due to its multi-party effects. The method used in this research is Yuridis-Sociological, using the Law Norms as a basis, then looking at the symptoms of the community to find its solution. As a result of this research, there is a need for a consciousness of academic civilization to advance the Presumption of Innocence, a written rule on the post of rector to obtain the right to a moratorium on violations committed before taking office.

Abstract

The issue of human rights among Muslim countries is nothing new. Islamic Shari'a which is universal explains a lot of basic principles regarding equality of human rights and freedoms, even when the Prophet Muhammad declared the Medina Charter. The history of the enactment of Islamic law among Muslim communities has shifted from a vertical normativity point to a horizontal one. This is because the development of the enactment of Islamic law has also been influenced by socio-cultural dynamics and legal politics in Islamic society itself. Islam has first taught mankind about the concept of egalitarianism, universalism and democracy. This beautiful and comprehensive concept is allegedly adopted by the West through the emergence of universal ideas which are standardized in the Universal Declaration of Human Rights convention. Islam is an ash-Syumul religion. Islamic teachings cover all aspects of human life. Islam provides regulations and demands on humans, ranging from the smallest affairs to large-scale affairs. And of course, it includes rules and high respect for human rights (HAM). However, it is not in one structured document but is spread out in the holy verses of the Koran and the Sunnah of the Prophet Muhammad.

Abstract

It is fascinating how customary laws are accepted by judges in the Indonesian legal system. In Aceh, particularly, its customary law is inspired by sharia or Islamic law. In addition to the national law, this law also influences judges’ consideration in making their decisions. According to Van Den Berg’s theory of receptio in complexu, Islamic law has been recognized in Indonesian legal system as a customary law. This article tries to find out how judges accept sharia-inspired customary law to pass their decisions. The research used normative-legal method. Based on the research results, the author concluded the judge’s acceptance of customary law could be seen from a Sharia Court decision related to customary disputes. This decision was passed by the Takengon Sharia Court under No. 269/Pdt.G/2017/Ms-Tkn dated May 2, 2018. It concerned with the division of joint property. This decision referred to Islamic law in giving each party a half of the total assets after being deducted by the joint debts. This decision strengthened the foothold of Islamic law in customary law and national law enforcement, especially in Aceh Province. However, it would be a different case if the customary law was in conflict with Islamic law. In such a case, the panel of judges would not accept the customary law. An example of this was the case of adopted children. Rather than receiving an inheritance, as in the traditional parental communities, they would only receive a mandatory will. One of such decisions was the Aceh Sharia Court’s Decisions No. 125/Pdt.G/2011/MS and No.084/ Pdt.P/2016/MS.Bna.

Abstract

Inheritance is an important part of one legal event, namely death. The legal consequences that arise are the management and continuation of the rights and obligations of someone who has died. This paper examines the juridical aspect of inheritance distribution to grandchildren as substitute heirs who control the inheritance. The research method used is a normative juridical approach with analytical descriptive specifications. The purpose of this study is to determine the position of the substitute heir who controls the inheritance in obtaining a share of the inheritance. Grandchildren as substitute heirs according to Islamic Law are not entitled to control and obtain inheritance. However, in KHI, grandchildren as heirs have the right to inherit no more than the other heirs, which is only 1/3 of the share.
