Abstract

Along with the development of increasingly modern globalization, the authority and existence of customary institutions for dispute resolution began to be questioned, especially now that some people tend to resolve their disputes through formal institutions such as state courts and the police. This article examines the legal politics of the existence of customary courts in civil procedure law. The research approach is normative juridic and is analyzed through qualitative juridic, which studies data based on legal aspects. The study's findings indicate that legal discrepancies regarding customary justice in the law of civil events remain. However, there is a history of cooperation between the state and the village courts as regulated in Article 86 letter A, article 103, paragraphs (2) and (3). article 120 letter a and article 135 letter a HIR (KUH Perdata Hindia Belanda). Since the entry into force of Emergency Law No. 1 of 1951, these articles have been abrogated, except for Article 135 letter a HIR. The practical implications of the political study of customary law include adopting a common law recognizing the right to justice for indigenous peoples in Indonesia.

Abstract

This research aims to compare the mobile court case settlement practices in Malaysia and Indonesia, such as legal framework and jurisdiction, operational structure, successes and challenges and implementation strategies in both countries. Research methods used in this paper is a normative juridical approach, and the collection of data is conducted through statutory law: gathering relevant statutes, regulations, and legal provisions governing the establishment and operation of mobile courts in Indonesia and Malaysia. The findings reveal a comparison of mobile court case settlement practices in Malaysia and Indonesia, where the mobile court service is advantageous because it facilitates access to the court for justice seekers. Beyond the logistical benefits, these services offer psychological comfort by allowing proceedings to occur in familiar and less intimidating environments. The difference in the implementation of mobile courts is that in Indonesia mobile courts only exist at the district level religious courts, where judges go to the field to conduct trials in rural locations, for example in the village hall, and the cases handled only involve minor cases such as isbat marriage, divorce, divorce, child custody and determination of heirs. To overcome the geographical and logistical challenges, enhancing collaboration between different government agencies is crucial. In both countries, coordination between the judiciary, local governments, and other relevant agencies, such as transportation and communication departments, can improve the effectiveness of mobile courts.

Abstract

Smartphone menjadi perangkat yang hampir dimiliki semua orang dewasa, dari perangkat tersebut tidak hanya komunikasi, untuk keperluan informasi dan transaksi pun menggunakannya. Monetisasi dapat optimal dengan penggunaan smartphone dalam penjulan untuk media sosial, marketplace, dan alat transaksi. Metode dalam pengabdian dilakukan melalui difusi teknologi pada kegiatan workshop ”Digital Festival” yang didanai Universitas Padjadjaran terintegrasi dengan KKN Mahasiswa. Kegiatan pengabdian dengan mengedukasi pelaku usaha mikro dalam memanfaatkan media sosial melalui pembuatan konten informatif untuk menambah kepercayaan audiens. Terselenggaranya pengabdian ini berkolaborasi dengan Perangkat Desa Cileunyi Kulon dan Bank BCA selaku stakeholders transaksi digital yang dapat diakses pelaku usaha sebagai langkah simbiosis mutualisme. Hasil kegiatan workshop ini dapat memanfaatkan smartphone untuk mendukung usahanya dengan aplikasi pesan instant, media sosial, dan marketplace sehingga dapat termonetisasi yang menghasilkan keuntungan. Kolaborasi dengan Bank BCA, mendorong pelaku usaha untuk menyediakan fasilitas perbankan yang dapat memudahkan konsumen dalam bertransaksi.
