Abstract

Customary dispute resolution institutions in Indonesia and the Philippines serve to provide indigenous peoples with access to justice beyond state courts. This research, employing a normative juridical approach with a descriptive-analytical specification, highlights key differences between the two systems. In Indonesia, customary courts derive recognition from the 1945 Constitution, while in the Philippines, they are explicitly regulated under the Indigenous Peoples’ Rights Act (IPRA) of 1997, leading to greater integration with the national legal system. Indonesian customary courts handle a broader range of disputes, whereas Philippine customary courts primarily focus on land rights and natural resource management. Additionally, Indonesian customary court decisions often face dualism in the application of customary and national law when reviewed by state courts, while Philippine customary court decisions are more systematically recognized and enforced within the formal legal framework.

Abstract

This article analyses the implementation of the Supreme Court Regulation Number 3 of 2017 concerning Guidelines for Trial of Cases Involving Women Facing Legal Challenges (which is then written as SC Reg. 3/2017) in Religious Affairs Courts. This regulation provides a guideline and serves as a reference point for judges which helps them to better understand and implement the principles of gender equality and non-discrimination in hearing and trying a case involving women. This study employs juridical-empirical approach method and purposive sampling as the data collection technique in interviewing several judges at multiple religious affairs courts in Java Island, as well as in literature review. The result of this study shows that judges at religious affairs courts have adopted Supreme Court Regulation Number 3 of 2017 (hereinafter, SC Reg. 3/2017), although in their practices, even after four years since the enactment, there still isn’t any consensus or shared views amongst judges in implementing matters such as post-divorce women’s rights, especially regarding verstek (in absentia) judgment. However, several religious affairs court judges have shown a good understanding of equality between men and women, indicated by judgments that favours women. Religious court judges in their ex officio capacity may grant rights to divorced wives, even if they are not requested.

Abstract

Introduction:  The marriage law was carried out through a long process, due to, religions, or national interests. Marriages in Indonesia are not only based on the beliefs of official religions in Indonesia, but there are also marriages carried out by the Faith in God Almighty. One of the faith streams in Indonesia is the Sunda Wiwitan school. Purposes of the Research:  In this study, researchers were interested in examining magical religious practices in the marriages of the Sunda Wiwitan indigenous people of West Java.Methods of the Research: The approach method used in this study is normative juridical research through legal principles, legal systematics, legal synchronization, and legal comparison. Results of the Research: The results showed that the marriage practice of indigenous peoples who live the Sunda Wiwitan faith is still thick with its customary rituals, this is done as a process in fulfilling the practice of marriage as one of the important life phases for the Sunda Wiwitan community. The characteristics of marriage of indigenous peoples who live in Sunda Wiwitan in West Java, having the concept of marriage containing the meaning of the beginning of the single end so sawaji (initially one, finally so unified), Marriage must be monogamous which is approved by the parents of both parties and the prohibition of marriage for Sunda Wiwitan believers is to marry between nations (marrying people outside Indonesia).

Abstract

This study aims to examine the role of customary villages in Bali in resolving customary disputes through kerta dea based on the principle of peace. The problem is focused on exploring the implementation based on the practice of village clerks in resolving disputes or customary violations that cause imbalances, so as to bring the reality that there are other dispute resolution systems in addition to formal courts. In order to approach this problem, it is necessary to study using the customary delicacies approach and dispute resolution. The data were collected through a normative juridical approach method, the research specification is descriptive analytical by describing the settlement of customary disputes through kerta desa in Balinese traditional villages based on the principle of peace associated with related regulations, legal theories, and customs. This study concludes that villages in Bali are differentiated from traditional villages and official villages. Village authorities, including customary villages, can carry out the function of dispute resolution as affirmed in the provisions of Article 103 letters (d), (e), and (f) of the Village Law. Kerta desa as the implementation of customary village authority can help as a prajuru partner institution or customary village management carry out the function of resolving customary disputes. Dispute resolution through village clerks is carried out with provisions and stages regulated in the type of pararem of Tata Titi Panepas Wicara and prioritizes peace in accordance with the principle of druwenang sareng-sareng, in Article 37 paragraph (2) of the Customary Village Regulation in Bali.

Abstract

This study examines the contested legal status of traditional sharecropping contracts among Islamic scholars and religious leaders in rural West Java, Indonesia. The primary objective is to analyze how Islamic law governs these contracts both normatively and in practice and how relevant regulations function within the local context. Employing an empirical legal approach, the research relies on direct observation and analysis of legal behavior in society. Findings indicate that the rising value of land and labor has turned traditional sharecropping arrangements into symbols of economic inequality. Ideologically, the legitimacy of such contracts is debated among village groups with varying socio-religious orientations. This contestation reflects an ongoing process of rural Islamization and highlights emerging pragmatism. The increasing accessibility of global information via the internet enables rural communities to reinterpret Islamic legal norms and agricultural practices, illustrating their adaptive responses to socioeconomic change and technological advancement.

Abstract

Penelitian ini mengkaji paduan antara logika mekanisme pasar serta aspek sosiokultural yang ada pada pasar tenaga kerja agrikultural di Desa Cikembang, Kabupaten Bandung, Jawa Barat. Melalui survei yang dilengkapi dengan wawancara mendalam, penelitian ini menghasilkan deskripsi atas jenis tenaga kerja. Pertama, sumber tenaga kerja pertanian didominasi atas perpaduan antara anggota rumah tangga dan buruh upahan. Penghitungan upah atasnya didasarkan dua bentuk kuantifikasi, yaitu durasi kerja yang terwujud lewat damel harian dengan 6 jam waktu kerja, serta damel borongan yang dihitung berdasarkan satuan kilogram berat angkutan hasil panen. Kedua, sistem kontrak pada tenaga kerja pertanian mengindikasikan bahwa buruh lepas mendominasi pasar Cikembang yang dipekerjakan berbasiskan klientalisasi. Ketiga, terdapat buruh tani khusus dengan keahlian spesifik yang didasarkan atas kebutuhan dari komoditi tani seperti kegiatan nilas untuk panen kubis, ngaramas di kebun kubis dan wortel, serta nyulikat di kebun bawang daun, dan keterjalan medan lahan seperti pada pekerjaan jaga kebun dan ojek gunung. Keempat, gender menjadi penentu pembagian kerja, misalnya perempuan untuk pekerjaan yang memerlukan ketekunan serta laki-laki pada pekerjaan yang membutuhkan tenaga fisik ekstra. Selain itu, perpaduan aspek moral dan logika pasar juga menjadi pertimbangan untuk mempekerjakan banyak buruh perempuan karena kebutuhan atas kopi dan rokok ditiadakan sehingga menekan biaya produksi. This study explores the intersection of market logic and sociocultural dynamics in the agricultural labor market of Cikembang Village, Bandung Regency, West Java. Combining surveys and in-depth interviews, the research identifies key characteristics of labor organization in the region. First, agricultural labor comprises both household members and wage workers. Wages are calculated either by duration (damel harian, with a six-hour workday) or output (damel borongan, based on kilograms of harvested produce). Second, the labor market is dominated by casual workers employed through clientelistic ties. Third, a subset of workers possesses crop-specific or terrain-specific skills, such as nilas (cabbage harvesting), ngaramas (work in cabbage and carrot fields), nyulikat (scallion fields), as well as roles suited to steep landscapes, like garden watchkeeping (jaga kebon) and mountain motorcycle transport (ojek gunung). Fourth, gender also influences labor division: women are typically assigned detail-oriented tasks, while men handle physically demanding work. Moreover, economic rationale intersects with moral considerations, as female labor is often preferred due to lower auxiliary costs—namely the absence of demands for coffee and cigarettes.

Abstract

In carrying out their obligations to pay debts, Debtors often make various efforts to avoid having their assets being included in the guarantee of payment. Moreover, Debtors occasionally contrive, by providing grants, their assets in the bankruptcy decision to not be subsumed in the bankruptcy court. The aim of this research is to analyze how the arrangements for giving grants made by Bankrupt Debtors are reviewed from the Civil Code and Bankruptcy law as well as the role of the Curator in protecting Creditors and Debtors in the bankruptcy process. This research uses a normative juridical approach, where library data or secondary data is the main data, in addition to being supported by field data. The research results show that in the context of bankruptcy law, grants are an action that must be paid close attention because it can be said to be a legal action that is not required. If the Debtor gives away assets before being declared bankrupt, it can be indicated as an effort to avoid confiscation of collateral by the court. The curator has the authority to include a gift in the list of bankruptcy estates that will be sold to pay the debtor’s debts to his creditors. In such cases, the Curator can file an Actio Pauliana lawsuit with the commercial court to cancel the gift so that the assets can be included in the bankruptcy estate list. This study provides a focused examination on the legal status of gratuitous transfers in Indonesian bankruptcy law—a subject that, despite its practical urgency, remains underexplored compared to broader studies on bankruptcy proceedings or creditor protections.

Abstract

The Resolution of consumer disputes involving many consumers will be effective and efficient if carried out jointly through a class action mechanism. Class action is generally a lawsuit filed by a number of people who have the same interests and the same legal events and legal basis. The Objective of this community services is to increase consumer understanding of class action lawsuits in consumer protection law. The approach used in this community service is legal counseling using a participatory action research (PAR) approach. The results of this community service have increased consumer and public understanding of class action lawsuits in consumer protection. The understanding of consumers regarding class action lawsuits is expected to provide consumer with an effective and efficient means of resolving disputes, in addition to filling lawsuits individually. The increased understanding of consumer regarding class action lawsuits is expected to raise awareness and understanding among consumers, thereby realizing consumer protection.

Abstract

Perdamaian merupakan cara yang sangat baik dalam penyelesaian perkara perdata khususnya pada perkara perceraian, akan tetapi dalam kenyataannya di lapangan tidak selalu berhasil dalam menangani perkara di pengadilan, sebagaimana di Pengadilan Agama Kota Bandung yang mana berdasarkan data statistik putusan pengadilan menunjukan angka perceraian semakin tinggi dari tahun ke tahun. Tujuan penelitian ini adalah untuk mengetahui penyelesaian perkara perceraian, implementasi upaya perdamaian dalam penyelesaian perkara perceraian dan faktor penghambat implementasi upaya perdamaian dalam penyelesaian perkara perceraian di Pengadilan Agama Kota Bandung. Metode penelitian yang digunakan adalah yuridis normatif dengan spesifikasi penelitian deskriptif analitis. Hasil penelitian ini menunjukan bahwa penyelesaian perkara perceraian dimulai dari upaya perdamaian, pembacaan gugatan, jawaban tergugat, replik, duplik, kesimpulan, musyawarah majelis hakim dan terakhir putusan, implementasi upaya perdamaian dalam penyelesaian perkara perceraian merujuk kepada ketentuan Perma Prosedur Mediasi di Pengadilan dan faktor penghambat implementasi upaya perdamaian dalam penyelesaian perkara perceraian dipengaruhi oleh keinginan para pihak untuk bercerai dan keahlian mediator.

Abstract

Applying the principle of equality in law plays a vital role in protecting husbands and wives from the making of wills or deeds made without their consent. This can be examined through three main legal instruments: the Civil Code (KUH Perdata), the Compilation of Islamic Law (KHI), and Law Number 1 of 1974 concerning Marriage, as amended by Law Number 16 of 2019. This study applies a normative legal approach, namely a method that analyzes written legal norms that officially apply to the national legal system. In the context of managing joint property in marriage, the existence of consent from both parties—husband and wife—is an essential requirement that cannot be ignored. This is based on the principle that all forms of wealth obtained during the marriage bond are joint property, so they cannot be transferred, sold, donated, or used as collateral unilaterally without the consent of the spouse. Every legal action concerning joint property must be based on the agreement of both parties as a form of recognition of each party's rights to ownership. This provision aims to create justice and balance in household relationships and prevent the possibility of abuse of authority by one party. Therefore, the active involvement of the spouse in giving consent is an essential aspect to ensure the validity of a legal action and the proportional protection of rights over joint assets.
