Abstract

Indonesia has experienced significant growth in foreign direct investment (FDI) inflows, reaching USD 47.5 billion in 2023 and exceeding the target of IDR 1,714 trillion in 2024. However, strict foreign worker regulations potentially affect the investment decisions of multinational companies. This research aims to analyze the impact of foreign worker restrictions on FDI realization in Indonesia with a case study in North Sumatra Province. The research method uses a qualitative approach with regulatory analysis and secondary data. The results show that although foreign worker restrictions through Government Regulation Number 34 of 2021 and Minister of Manpower Regulation Number 8 of 2021 aim to protect local workers and encourage technology transfer, these policies create trade-offs against Indonesia's investment attractiveness. Requirements such as mandatory local counterparts, Foreign Worker Utilization Compensation Fund (DKPTKA), and position restrictions create additional costs for investors. The Omnibus Law on Job Creation has simplified licensing procedures, but implementation challenges remain, particularly in regions like North Sumatra. The research recommends a balance between local workforce protection and investment facilitation through more flexible sector-based regulatory reforms.

Abstract

Price fixing is one of the prohibited agreements under competition law due to its inherently anti-competitive nature and harm to consumers. This research aims to analyze price fixing regulations under Law Number 5 of 1999 concerning Prohibition of Monopolistic Practices and Unfair Business Competition, focusing on the application of per se illegal approach, evidence using indirect evidence, and law enforcement challenges in Indonesia. The research method used is normative juridical with statutory, conceptual, and case study approaches. The results show that price fixing is regulated under Article 5 of Law No. 5 of 1999 with a per se illegal approach that does not require proof of impact. However, in practice, the Business Competition Supervisory Commission (KPPU) often faces difficulties in proof as business actors tend to avoid written agreements. The use of indirect evidence consisting of economic and communication evidence has become an increasingly developed alternative proof. This research recommends strengthening regulations regarding the position of indirect evidence and enhancing KPPU's capacity in economic analysis for effective competition law enforcement.

Abstract

Healthcare workforce shortages in hinterland areas represent a critical global health challenge, particularly affecting remote communities that struggle to attract and retain qualified healthcare professionals. This cross-sectional study analyzed the influence of organizational support and health infrastructure on healthcare staff retention among 182 healthcare workers in hinterland communities of Riau Islands, Indonesia, using Structural Equation Modeling with Partial Least Squares (SEM-PLS). The measurement model demonstrated excellent reliability and validity with Cronbach's Alpha values ranging from 0.924-0.947 and Average Variance Extracted above 0.5 for all constructs. Results revealed that health infrastructure had the strongest direct positive effect on staff retention, followed by organizational support, while health infrastructure also significantly influenced organizational support, creating a mediation pathway. The indirect effect analysis confirmed that organizational support partially mediates the relationship between health infrastructure and staff retention, with all hypothesized relationships being statistically significant and the model explaining substantial variance in retention outcomes. These findings suggest that healthcare organizations in hinterland areas should adopt integrated strategies that simultaneously invest in infrastructure improvements and strengthen organizational support systems to achieve optimal staff retention outcomes in challenging remote environments.

Abstract

The development of digital business in Indonesia has brought significant impacts on the increase of cybercrime, particularly phishing. This research aims to analyze the legal aspects of consumer protection against phishing crimes in the context of digital business in Indonesia with a case study in Medan City. The research method used is normative juridical with statutory and case approaches. The research findings indicate that the legal framework for consumer protection against phishing crimes in Indonesia has been regulated in various regulations, including Law Number 8 of 1999 concerning Consumer Protection, Law Number 19 of 2016 concerning Amendment to Law Number 11 of 2008 concerning Electronic Information and Transactions, and Law Number 27 of 2022 concerning Personal Data Protection. However, the implementation of legal protection still faces various obstacles, such as low digital literacy among the public, limited cyber law enforcement infrastructure, and complexity of evidence in phishing cases. This research recommends strengthening more specific regulations regarding phishing, increasing law enforcement capacity, and continuous public education.

Abstract

Actio pauliana is a fundamental legal instrument in the Indonesian bankruptcy system to protect creditors' interests from debtor's detrimental legal acts. This research aims to analyze the application of actio pauliana based on Law Number 37 of 2004 concerning Bankruptcy and Suspension of Debt Payment Obligations (UUK-PKPU), focusing on filing requirements, burden of proof, and practical challenges in court proceedings. The research method used is normative juridical with statutory, conceptual, and case study approaches. The results show that actio pauliana as an effort to annul debtor's legal acts has a strategic role in maximizing the bankruptcy estate (boedel pailit) for creditor debt settlement. However, the effectiveness of actio pauliana implementation still faces various obstacles, particularly regarding the heavy burden of proof on curators, differing judicial perceptions in assessing debtor fraud elements, and legal protection for good faith third parties. This research recommends the need for reformulating actio pauliana provisions to provide better legal certainty for all parties involved in bankruptcy proceedings.

Abstract

Abstract This study examines the mediating role of retirement planning in the relationship between risk tolerance and financial resilience among industrial workers in Batam City, Indonesia. Using a quantitative cross-sectional survey design, data were collected from 78 permanent industrial workers employed in manufacturing companies across Batam's industrial zones through purposive sampling. The study employed Partial Least Squares Structural Equation Modeling (PLS-SEM) to test the proposed hypotheses regarding direct relationships and mediation effects. The measurement model demonstrated satisfactory reliability and validity, with Cronbach's Alpha values ranging from 0.892 to 0.968 and Average Variance Extracted (AVE) meeting acceptable thresholds. The structural model analysis revealed significant positive relationships across all hypothesized paths. Risk tolerance showed the strongest relationship with retirement planning (β = 0.640, t = 9.317, p < 0.001), while retirement planning demonstrated substantial positive effects on financial resilience (β = 0.609, t = 5.202, p < 0.001). Risk tolerance also exhibited a direct positive relationship with financial resilience (β = 0.339, t = 2.555, p = 0.011). Most importantly, the mediation analysis confirmed that retirement planning partially mediates the relationship between risk tolerance and financial resilience, with a significant indirect effect (β = 0.390, t = 3.898, p < 0.001) that exceeds the direct effect. The findings contribute to behavioral finance literature by demonstrating that retirement planning serves as a critical mechanism through which individual risk preferences translate into financial resilience outcomes among industrial workers in emerging market contexts. The results support lifecycle theory and planned behavior theory, showing that systematic retirement planning behaviors are more effective than spontaneous risk-taking activities in enhancing financial resilience. Practical implications suggest that financial literacy programs should focus on retirement planning education tailored to workers' risk tolerance levels, while policymakers can develop targeted interventions leveraging individual risk preferences to improve workers' long-term financial well-being. The study provides valuable insights for enhancing financial resilience among Indonesia's industrial workforce in the context of evolving social security systems and demographic transitions.

Abstract

This study investigates the impact of capital structure on firm value with profitability as a moderating variable in consumer goods companies listed on the Indonesia Stock Exchange (IDX) during the period 2019-2023. Utilizing signaling theory and trade-off theory as the theoretical framework, this research examines whether the relationship between capital structure and firm value is contingent upon the level of profitability. The sample comprises 35 consumer goods companies selected through purposive sampling, resulting in 175 firm-year observations. Capital structure is measured using Debt to Equity Ratio (DER), firm value is proxied by Price to Book Value (PBV), and profitability is measured using Return on Assets (ROA). The analytical method employed is Moderated Regression Analysis (MRA) with panel data regression using EViews 13. The findings reveal that capital structure has a significant negative effect on firm value. Furthermore, profitability significantly strengthens the negative relationship between capital structure and firm value. These results suggest that highly profitable firms experience greater value deterioration when employing higher leverage. The findings contribute to the existing literature by providing empirical evidence on the moderating role of profitability in emerging market contexts and offer practical implications for corporate financial decision-making.

Abstract

This study examines the legal framework governing electoral integrity in regional head elections (Pilkada) in Batam City, a unique administrative region with dual status as both a Free Trade Zone (FTZ) and Special Economic Zone (SEZ). The research addresses the intersection of electoral law, decentralization policies, and special economic governance that creates distinctive challenges for democratic processes. Using normative legal research methodology with statutory, conceptual, and comparative approaches, this study analyzes how the overlapping regulatory frameworks between Law Number 7 of 2017 on General Elections, Law Number 10 of 2016 on Regional Elections, and Government Regulation Number 4 of 2025 on Batam FTZ affect electoral governance and integrity. The findings reveal that Batam faces unique electoral challenges stemming from its heterogeneous population composition, high labor mobility, complex institutional arrangements between Batam Concession Agency (BP Batam) and Batam City Government, and susceptibility to money politics due to economic disparities. This research proposes a legal framework for strengthening electoral integrity through enhanced voter registration mechanisms, improved election supervision coordination, and integrated governance between electoral management bodies and special zone authorities. The study contributes to the scholarly discourse on electoral democracy in special jurisdictions and offers policy recommendations for harmonizing economic zone governance with democratic electoral principles.
