Abstract

Illegal logging is a significant environmental issue in North Aceh Regency, which not only damages ecosystems but also threatens the livelihoods of communities dependent on natural resources. This study aims to analyze the role of Pawang Uteun, an indigenous institution, in combating illegal logging through the integration of customary law and state law. The Pawang Uteun plays a crucial role in regulating and conserving adat forests based on longstanding indigenous norms. Using a qualitative approach, this research gathers data through in-depth interviews with indigenous leaders, government officials, and local communities, as well as relevant literature review. The findings show that while state laws and regulations exist to address illegal logging, their implementation is often hindered by institutional limitations and resource constraints. In contrast, the customary law applied by Pawang Uteun has proven effective in managing forest use and engaging the community in direct oversight. The integration of customary law and state law strengthens the position of Pawang Uteun in combating illegal logging by providing socially accepted sanctions and fostering active participation in forest protection. This study recommends strengthening cooperation between indigenous institutions and the state to enhance monitoring of illegal logging and preserve adat forests, which are vital for the community's survival.

Abstract

This research is motivated by the need to re-understand the goals of Islamic education from a philosophical perspective, particularly in the effort to develop complete human beings with holistic character. The main problem of this research is the lack of a comprehensive understanding of the goals of Islamic education from a philosophical perspective, especially in forming complete human beings who are balanced in spiritual, intellectual, and moral aspects. This research aims to re-explain how philosophy views the goals of Islamic education and how this concept can be applied to contemporary education. The method used is a literature study by reviewing the books and writings of classical and modern Islamic educational thinkers. Data were obtained from the thoughts of figures such as Al-Ghazali, Ibn Miskawayh, and Syed Muhammad Naquib al-Attas, supplemented by the latest educational literature. The results of this study indicate that the goal of Islamic education is essentially to shape good, knowledgeable, moral, and capable human beings who are able to live lives based on Islamic values. Education emphasizes not only knowledge, but also the development of the soul, character, and strengthening of faith. In conclusion, a philosophical perspective helps provide a more complete picture of the goals of Islamic education so that it can be used as a basis for developing education that is relevant to the needs of the times without abandoning religious values.

Abstract

Tradisi tuhor dalam perkawinan masyarakat Tapanuli Selatan merupakan praktik adat yang memiliki makna sosial, ekonomi, dan religius yang mendalam. Penelitian ini bertujuan untuk menganalisis dinamika penentuan kuantitas tuhor serta dialektika antara nilai-nilai adat dan prinsip hukum Islam dalam pelaksanaannya. Metode penelitian yang digunakan adalah kualitatif dengan pendekatan sosio-hukum (socio-legal approach), melalui observasi lapangan, wawancara mendalam dengan tokoh adat, ulama, dan pasangan pengantin, serta studi dokumentasi. Hasil penelitian menunjukkan bahwa tuhor tidak hanya dipahami sebagai pemberian material kepada keluarga mempelai perempuan, tetapi juga sebagai simbol kehormatan, tanggung jawab moral, dan bentuk penghargaan terhadap hubungan kekerabatan. Dalam perspektif hukum Islam, tuhor memiliki kesamaan prinsip dengan mahar yang menekankan keikhlasan dan keadilan, namun praktik di lapangan sering kali dipengaruhi oleh gengsi sosial dan nilai prestise keluarga. Ketegangan antara adat dan hukum Islam terjadi ketika penentuan jumlah tuhor melampaui batas kemampuan ekonomi pihak laki-laki, sehingga berpotensi menyulitkan pelaksanaan akad nikah. Penelitian ini menegaskan perlunya harmonisasi antara nilai adat dan hukum Islam agar tradisi tuhor tetap mencerminkan kearifan lokal tanpa mengabaikan prinsip keadilan dan kemaslahatan yang diajarkan dalam Islam.

Abstract

This study systematically examines the level of relevance of marriage regulations in the Indonesian Civil Code (Kitab Undang-Undang Hukum Perdata) to the development of national marriage law and its implications for legal harmonization and legal certainty. The analysis focuses on the paradigm shift in legal regulation following the enactment of Law Number 1 of 1974 on Marriage and the position of the Civil Code within the Indonesian positive legal system. This research is a normative legal study employing statutory, conceptual, and historical approaches. The analysis is conducted through a systematic review of the hierarchy of laws and regulations, the principle of lex specialis derogat legi generali, and the principle of normative harmonization within the national legal system. This study also applies a normative juridical approach by examining statutory regulations, legal doctrines, and relevant court decisions. The findings indicate a paradigm shift from a secular-contractual model toward a religious-administrative model. The Civil Code no longer serves as the primary legal framework governing marriage but instead functions in a residual and complementary capacity, insofar as it does not conflict with the Marriage Law. Normative harmonization through systematic interpretation is therefore essential to ensure consistency and legal certainty in judicial practice.

Abstract

Illegal investments and Ponzi schemes pose a serious threat to the financial security of communities, particularly in rural areas and small towns, as residents often lack adequate legal understanding regarding investment mechanisms and consumer protection. This community service activity aims to enhance public legal awareness concerning the risks of illegal investments and Ponzi schemes through outreach, legal education, and practical assistance based on applicable regulations. The methods employed include participatory training, workshops, case studies, and simulations for identifying illegal investment schemes, complemented by legal consultation for participants. Data were collected through participatory observation, pre- and post-test questionnaires, in-depth interviews, and analysis of legal documents related to investment and consumer protection. The results indicate a significant improvement in participants’ understanding of the distinction between legal and illegal investments, the characteristics of Ponzi schemes, and the legal measures that can be taken when confronted with fraudulent investment practices. Participants also demonstrated enhanced capacity to critically analyze investment offers and make informed financial decisions. Short-term impacts are reflected in increased vigilance among community members toward suspicious investment offers, while long-term impacts are expected to reduce financial losses and foster a culture of legal compliance. These findings confirm that practice- and regulation-based legal education is effective in strengthening community legal literacy related to investments and provides a substantial contribution to consumer protection and local economic stability.

Abstract

Strengthening Qur’anic literacy in the community is a strategic effort to enhance the ability to read, write, and understand the Qur’an accurately, sustainably, and contextually. This community service activity was conducted through mosque-based guidance for reading and writing the Qur’an, supported by continuous evaluation, targeting local communities with limited access to Qur’anic education. The approach included intensive learning, personalized mentoring, repetitive practice, and routine monitoring by instructors and mosque administrators. Data were collected through direct observation, daily participant evaluation records, interviews with participants and mosque officials, and documentation of learning activities. Data were analyzed descriptively and qualitatively to assess literacy improvement, participation levels, emerging challenges, and the effectiveness of continuous evaluation. The results indicate significant improvement in participants’ Qur’anic reading and writing skills, heightened awareness of the importance of consistent practice, and increased motivation to continue learning through mosque-based guidance. Continuous evaluation proved effective as a monitoring tool, providing feedback and informing follow-up program planning. Active involvement of mosque administrators, instructors, and community members was identified as a key factor for the program’s success. This service model demonstrates that integrating community-based guidance with ongoing evaluation can be an effective strategy to build consistent, inclusive, and sustainable Qur’anic literacy in local communities.

Abstract

Inequality in the distribution of wealth has been a structural problem since pre-Islamic times to the modern era, including in Indonesia, where wealth tends to be concentrated in elite groups. This study aims to examine historically and normatively the ethos of justice in the distribution of wealth during the time of the Prophet Muhammad PBUH and his companions as a conceptual model to formulate the principle of sustainable economic justice. The research uses a qualitative-descriptive approach with normative-historical analysis to trace the values, policies, and practices of justice applied in early Islamic societies. The results of the study show that the Prophet PBUH built the foundation for wealth distribution through zakat, the prohibition of usury and hoarding, as well as ethical market arrangement. While the Khulafaur Rasyidin developed the system through the supervision of official assets, strengthening the baitul mall, fiscal reform, and the principle of equitable distribution of public assets. The findings show that economic justice in Islam is structural and preventive, aiming to protect the weak and prevent the concentration of wealth. The implications of the study confirm that the value of the distribution of wealth during the time of the Prophet and his companions is relevant as an ethical framework and public policy in dealing with modern economic inequality.

Abstract

The tradition of tuhor (bride-price) in the marriage customs of the Tapanuli Selatan community represents a complex intersection between local adat values and Islamic legal principles. This study aims to examine the dynamics of determining the quantity of tuhor through the dialectical relationship between customary norms and Islamic jurisprudence. Employing a qualitative field research approach, data were collected through interviews with religious leaders, adat elders, and community members involved in marriage negotiations. The analysis used a socio-legal framework to reveal the coexistence and tension between customary practices and Islamic legal ethics. The findings indicate that tuhor functions not merely as a material requirement but as a symbol of family honor, social responsibility, and mutual respect between kinship groups. From an Islamic perspective, the amount of tuhor should align with the principle of fairness (‘adl) and should not burden either party. However, in practice, social prestige and local status often influence the determination of its value, leading to disparities between religious ideals and customary expectations. The study concludes that harmonization between adat and Islamic law is essential to ensure that the implementation of tuhor reflects both cultural dignity and the spirit of justice as mandated in Islamic teachings.

Abstract

Perkembangan ruang digital telah mengubah pola produksi, distribusi, dan penerimaan fatwa keagamaan di Indonesia. Fatwa Majelis Ulama Indonesia (MUI) tentang etika bermedia sosial, yang lahir sebagai respons atas maraknya ujaran kebencian, disinformasi, dan konflik keagamaan di dunia digital, justru memunculkan polemik di ruang publik. Artikel ini bertujuan menganalisis kontestasi otoritas fatwa dalam ruang digital dengan menelaah posisi, legitimasi, dan efektivitas fatwa MUI di tengah pluralitas otoritas keagamaan dan kebebasan ekspresi digital. Penelitian ini menggunakan pendekatan kualitatif normatif-kritis dengan metode studi dokumen terhadap fatwa MUI, regulasi terkait media digital, serta wacana publik yang berkembang di media daring. Analisis dilakukan melalui perspektif ushul fikih dan maqashid syariah untuk menilai kesesuaian normatif fatwa dengan realitas sosial digital. Hasil penelitian menunjukkan bahwa otoritas fatwa di ruang digital tidak lagi bersifat tunggal, melainkan mengalami fragmentasi akibat hadirnya aktor-aktor keagamaan baru, seperti pendakwah media sosial dan komunitas digital. Kondisi ini menimbulkan ketegangan antara otoritas normatif ulama dan logika partisipatif ruang digital. Artikel ini menyimpulkan bahwa penguatan otoritas fatwa di era digital memerlukan pendekatan dialogis, kontekstual, dan adaptif agar tetap relevan secara normatif sekaligus efektif dalam membimbing etika bermedia sosial masyarakat Muslim Indonesia.
