Abstract

Illegal logging is a significant environmental issue in North Aceh Regency, which not only damages ecosystems but also threatens the livelihoods of communities dependent on natural resources. This study aims to analyze the role of Pawang Uteun, an indigenous institution, in combating illegal logging through the integration of customary law and state law. The Pawang Uteun plays a crucial role in regulating and conserving adat forests based on longstanding indigenous norms. Using a qualitative approach, this research gathers data through in-depth interviews with indigenous leaders, government officials, and local communities, as well as relevant literature review. The findings show that while state laws and regulations exist to address illegal logging, their implementation is often hindered by institutional limitations and resource constraints. In contrast, the customary law applied by Pawang Uteun has proven effective in managing forest use and engaging the community in direct oversight. The integration of customary law and state law strengthens the position of Pawang Uteun in combating illegal logging by providing socially accepted sanctions and fostering active participation in forest protection. This study recommends strengthening cooperation between indigenous institutions and the state to enhance monitoring of illegal logging and preserve adat forests, which are vital for the community's survival.

Abstract

This research is motivated by the need to re-understand the goals of Islamic education from a philosophical perspective, particularly in the effort to develop complete human beings with holistic character. The main problem of this research is the lack of a comprehensive understanding of the goals of Islamic education from a philosophical perspective, especially in forming complete human beings who are balanced in spiritual, intellectual, and moral aspects. This research aims to re-explain how philosophy views the goals of Islamic education and how this concept can be applied to contemporary education. The method used is a literature study by reviewing the books and writings of classical and modern Islamic educational thinkers. Data were obtained from the thoughts of figures such as Al-Ghazali, Ibn Miskawayh, and Syed Muhammad Naquib al-Attas, supplemented by the latest educational literature. The results of this study indicate that the goal of Islamic education is essentially to shape good, knowledgeable, moral, and capable human beings who are able to live lives based on Islamic values. Education emphasizes not only knowledge, but also the development of the soul, character, and strengthening of faith. In conclusion, a philosophical perspective helps provide a more complete picture of the goals of Islamic education so that it can be used as a basis for developing education that is relevant to the needs of the times without abandoning religious values.

Abstract

Tradisi tuhor dalam perkawinan masyarakat Tapanuli Selatan merupakan praktik adat yang memiliki makna sosial, ekonomi, dan religius yang mendalam. Penelitian ini bertujuan untuk menganalisis dinamika penentuan kuantitas tuhor serta dialektika antara nilai-nilai adat dan prinsip hukum Islam dalam pelaksanaannya. Metode penelitian yang digunakan adalah kualitatif dengan pendekatan sosio-hukum (socio-legal approach), melalui observasi lapangan, wawancara mendalam dengan tokoh adat, ulama, dan pasangan pengantin, serta studi dokumentasi. Hasil penelitian menunjukkan bahwa tuhor tidak hanya dipahami sebagai pemberian material kepada keluarga mempelai perempuan, tetapi juga sebagai simbol kehormatan, tanggung jawab moral, dan bentuk penghargaan terhadap hubungan kekerabatan. Dalam perspektif hukum Islam, tuhor memiliki kesamaan prinsip dengan mahar yang menekankan keikhlasan dan keadilan, namun praktik di lapangan sering kali dipengaruhi oleh gengsi sosial dan nilai prestise keluarga. Ketegangan antara adat dan hukum Islam terjadi ketika penentuan jumlah tuhor melampaui batas kemampuan ekonomi pihak laki-laki, sehingga berpotensi menyulitkan pelaksanaan akad nikah. Penelitian ini menegaskan perlunya harmonisasi antara nilai adat dan hukum Islam agar tradisi tuhor tetap mencerminkan kearifan lokal tanpa mengabaikan prinsip keadilan dan kemaslahatan yang diajarkan dalam Islam.

Abstract

This study systematically examines the level of relevance of marriage regulations in the Indonesian Civil Code (Kitab Undang-Undang Hukum Perdata) to the development of national marriage law and its implications for legal harmonization and legal certainty. The analysis focuses on the paradigm shift in legal regulation following the enactment of Law Number 1 of 1974 on Marriage and the position of the Civil Code within the Indonesian positive legal system. This research is a normative legal study employing statutory, conceptual, and historical approaches. The analysis is conducted through a systematic review of the hierarchy of laws and regulations, the principle of lex specialis derogat legi generali, and the principle of normative harmonization within the national legal system. This study also applies a normative juridical approach by examining statutory regulations, legal doctrines, and relevant court decisions. The findings indicate a paradigm shift from a secular-contractual model toward a religious-administrative model. The Civil Code no longer serves as the primary legal framework governing marriage but instead functions in a residual and complementary capacity, insofar as it does not conflict with the Marriage Law. Normative harmonization through systematic interpretation is therefore essential to ensure consistency and legal certainty in judicial practice.
