Abstract

This literature study aims to reconstruct the class action lawsuit as an effective private enforcement instrument in addressing counterfeit products that endanger consumer safety. Employing a qualitative normative juridical method with content analysis techniques, this research examines secondary data from legislation, legal literature, and judicial practices. The findings indicate that the theoretical construction of class action requires a paradigm shift from mere procedural efficiency to an active private enforcement mechanism prioritizing consumer safety. Normative and procedural critical points, particularly in proving collective causation and calculating latent damages, can be overcome through risk-based evidence, a redefinition of commonality, and a differentiated compensation scheme. An effective enforcement design must integrate a court-supervised collective compensation fund, specific execution of injunctive relief such as mandatory recalls, the application of disgorgement of profits and coercive fines (astreinte), and robust post-judgment monitoring. This study concludes that a comprehensively redesigned class action mechanism, synchronized with consumer protection law and coordinated with public enforcement, can simultaneously achieve restorative justice for victims and optimal deterrence for violators. This reconstruction enriches civil procedure theory and offers practical guidance for judges, legislators, and consumer advocates in combating the circulation of hazardous counterfeit goods.

Abstract

This literature study conducts a normative comparative analysis of digital evidence adduction strategies in Indonesian civil law and United States common law systems. The research examines the legal construction of authentication, integrity assessment, and the strategic challenges and opportunities in utilizing various digital evidence types, such as chats, emails, CCTV footage, blockchain data, and metadata. Using a qualitative library research method with content and comparative analysis, the study finds that Indonesia's approach is codification-based, placing the judge as an active seeker of material truth who evaluates digital evidence against formal and material requirements stipulated in the Electronic Information and Transactions Law and its implementing regulations. In contrast, the U.S. common law system employs a rigorous adversarial strategy, where digital evidence is tested through extensive discovery and cross-examination, with the judge acting as a procedural gatekeeper under the Federal Rules of Evidence. The core difference lies in the locus of substantive evaluation: Indonesian judges assess probative value directly, while common law juries do so after judicial admissibility screening. The study concludes that both systems are converging on the necessity of technical expertise but recommends that Indonesia enhance judicial digital literacy and consider limited e-discovery mechanisms to strengthen its evidentiary framework.

Abstract

Previous studies have shown that playing with Lego is significantly associated with mental rotation ability in children. This study aimed to examine the effect of block construction play on mental rotation ability in young adults. The study employed a quantitative experimental approach using a non-randomized pre-test post-test control group design. The participants were 30 young adults, divided into 15 individuals in the experimental group and 15 in the control group, all with low to moderate mental rotation ability. Participants were selected using purposive sampling. Mental rotation ability was measured using a mental rotation task. Data were analyzed using the Mann-WhitneyU test to compare scores between groups and the Wilcoxon signed-rank test to compare pre-test and post-test scores within each group. The results showed a significant difference between the experimental and control groups at post-test (p = 0.009 < 0.05). In addition,the experimental group showed a significant improvement (p = 0.002 < 0.05), while the control group showed no significant change (p = 0.189 > 0.05). These findings indicate that block construction play has a positive effect on improving mental rotation ability in young adults with characteristics similar to those of the study participants.

Abstract

The Afvoer Kemambang River Cleanup program aims to analyze the implementation of river conservation programs as a strategy to increase community responsibility for environmental sustainability in Waru District, Sidoarjo. The river previously experienced blockages due to garbage accumulation and the growth of water hyacinth, indicating low public awareness of environmental cleanliness. This activity involved residents in concrete actions that improved the river ecosystem while providing a positive example for the wider community. The Participatory Action Research (PAR) approach was applied to involve the community from planning, coordination, and implementation of the activity. The activity began with a general briefing and division of tasks, followed by cleaning the river flow and removing garbage from the riverbanks. The results showed increased environmental awareness, social solidarity, and a sense of responsibility from residents towards nature conservation. It is recommended to expand this program to other areas with greater participant involvement and government support to ensure sustainable river conservation. Community participation has been proven to improve river conditions and foster a culture of sustainable environmental care, making this program a replicable model for community empowerment in other regions.
