Abstract

Southeast Asia is part of the Asian continent located in Southeastern part of Asia or around Indochina and the islands of the Malay Peninsula. Southeast Asia is home to a largely Muslim demographic, such as Indonesia, Malaysia, Brunei Darussalam, Thailand, and the Philippines. Consequently, countries in Southeast Asia implement Islamic law into their national laws, either whole or partially. The primary sources of Islamic law are the Qur'an and Sunnah. Islamic law is frequently applied in business and banking transactions, requiring deeds or agreements. A notary is an authorised individual entitled to make authentic deeds and other documents as regulated in laws and regulations. In several Southeast Asian countries, notaries have the authority to attest an agreement or document. The making of these deeds and agreements also includes agreements based on Islamic law or Sharia law. Thus, notaries can make deeds and agreements based on Islamic law that is recognized and regulated by their respective national laws. However, in making Sharia deeds, not everyone understands the rules and principles of Islamic law, including notaries. There is a current urgency for the standardization of Sharia deed making. This serves as a crucial tool for achieving legal unification in the creation of Sharia deeds on a cross-border scale.

Abstract

Article 154A of Law of the Republic of Indonesia No. 13 of 2003 on Manpower and Article 36 of Government Regulation No. 35 of 2021 on Fixed-term Employment Agreements, Outsourcing, Working Time and Rest Time, and Termination of Employment have regulated the reasons for termination of employment in a limitation and enumerative. However, there is a legal vacuum regarding the non-fulfillment of targets by workers or laborers as a reason for termination of employment, even though employers often use this reason. Based on these legal issues, the problem formulation in this article is first, how is the validity of not achieving sales targets as a reason for termination of employment? Second, what are the legal considerations of the Panel of Judges regarding the non-achievement of sales targets as a reason for termination of employment? This research is a normative legal research with statutory, conceptual, and case approaches. The results of this research are first, the reason for termination of employment related to the non-fulfillment of targets by workers or laborers can be used as a reason for termination of employment if the reason is regulated in the Work Agreement, Company Regulation, or Collective Labor Agreement and has previously been given the first, second, and third warning letters consecutively each valid for a maximum of 6 (six) months unless otherwise stipulated in the Work Agreement, Company Regulation, or Collective Labor Agreement. Secondly, based on existing court decisions, the reasons for termination of employment related to non-fulfillment of targets by workers or laborers are valid.

Abstract

Nowadays, using GPS as a navigator from smartphone is increasing, but it turns out there is a legal issue. This is related to the concept of driving with full concentration in Article 106 paragraph (1) of Law Number 22 Year 2009. In the explanation of Article 106 paragraph (1), there is an ambiguity in the interpretation between being able to use GPS, as long as it does not cause a concentration disturbance in driving or it is prohibited from using a cellphone at all, which means, using GPS via a smartphone is not allowed. This research is a study using normative law, with primary legal materials is legislation related to the use of GPS through smartphones during driving, such as, Law Number 22 Year 2009 concerning Road Traffic and Transportation and Constitutional Court Decision No. 23 / PUU-XVI / 2018, while materials Secondary law consists of books, journals, and other sources that are relevant. Based on the results of this study, it was found that the Constitutional Court provided an interpretation, that using GPS via a smartphone during driving was permitted, but it should not cause a concentration disturbance while driving and the application of such sanctions was casuistic. Abstract

Pancasila sebagai dasar filsafat negara (philosopische grondslag) menjadikan Indonesia sebagai negara yang memandang kebebasan beragama dengan prinsip “netral-aktif”. Paradigma ini tertuang dalam Peraturan Bersama Menteri Agama dan Menteri Dalam Negeri No. 9 Tahun 2006 dan No. 8 Tahun 2006 (selanjutnya disingkat PBM No. 9/2006 dan No. 8/2006) yang mengatur terkait perizinan pendirian tempat ibadah. Namun dalam praktiknya, penggunaan syarat materiil dan formil yang sama terhadap seluruh jenis tempat ibadah yang didirikan justru menimbulkan berbagai celah diskriminasi yang pada akhirnya melanggar kebebasan beragama itu sendiri. Penelitian ini adalah penelitian hukum dengan menggunakan pendekatan peraturan perundang-undangan dan pendekatan konseptual. Hasil penelitian ini menunjukkan bahwa, PBM No. 9/2006 dan No. 8/2006 yang menggunakan landasan filosofi keadilan egaliter karena memberikan kewajiban yang sama untuk memperoleh izin pendirian tempat ibadah pada akhirnya akan selalu menimbulkan celah diskriminasi terhadap umat agama minoritas. Sejatinya, landasan filosofi yang tepat untuk digunakan dalam mengatur perizinan pendirian tempat ibadah di Indonesia adalah keadilan proporsional karena perbedaan dinamika tiap agama hendaknya juga diberikan kewajiban yang berbeda pula.

Abstract

One of the primary responsibilities of a Notary is to draft authentic notarial documents related to various legal acts, agreements, and determinations. In exercising this authority, a Notary must adhere to the principle of prudence, which is implicitly regulated in the Law on the Office of Notary (Undang-Undang Jabatan Notaris) and the Notary Code of Ethics. However, these regulations need to explicitly define the principle of prudence, creating ambiguity in its application. This article addresses two key research questions: first, how does a Notary implement the principle of prudence in executing their duties as mandated by the Law on the Office of Notary and the Notary Code of Ethics? Second, what indicators can be used to assess this principle’s application in exercising a Notary’s authority? This research adopts a normative legal approach, utilizing statutory, conceptual, and case-based methodologies. The findings of this study are twofold: first, the regulation of the Notary’s principle of prudence is not specifically defined, leaving it as an open norm subject to multiple interpretations. Second, to address these varying interpretations, seven indicators have been identified to evaluate whether a Notary has acted with prudence in carrying out their duties. These indicators should be comprehensively incorporated into the regulations through a Circular issued by the Ministry of Law and Human Rights or through revisions to the Law on the Office of Notary (hard law) and the Notary Code of Conduct (soft law). AbstrakSalah satu kewenangan Notaris adalah membuat akta autentik mengenai semua perbuatan, perjanjian, dan penetapan, dalam menjalankan kewenangan tersebut hendaknya Notaris menerapkan asas kehati-hatian, sebagaimana diatur secara implisit di dalam Undang-Undang Jabatan Notaris dan Kode Etik Notaris. Permasalahannya, kedua peraturan ini tidak menguraikan secara konkret asas kehati-hatian tersebut sehingga perlu dianalisis mengenai penerapannya. Oleh karenanya, rumusan masalah di dalam artikel ini, yaitu pertama, bagaimana penerapan asas kehati-hatian oleh notaris dalam menjalankan kewenangannya sesuai dengan Undang-Undang Jabatan Notaris dan Kode Etik Notaris? Kedua, apa saja indikator yang dapat digunakan untuk mengevaluasi penerapan asas kehati-hatian oleh Notaris dalam menjalankan kewenangannya? Penelitian ini merupakan penelitian hukum normatif dengan menggunakan pendekatan perundang-undangan, konseptual, dan kasus. Adapun hasil dari penelitian ini adalah pertama, karakteristik pengaturan dari asas kehati-hatian notaris tidak diatur secara spesifik atau sifat pengaturannya dapat dikatakan sebagai open norm, sehingga dalam penerapannya terjadi multitafsir. Kedua, untuk mengatasi keberagaman penafsiran maka ada 7 (tujuh) indikator yang dapat menjadi pertimbangan untuk menilai apakah notaris telah menjalankan kewenangannya dengan hati-hati atau tidak. Tujuh indikator tersebut hendaknya diatur secara komprehensif dalam Surat Edaran Kementerian Hukum dan Hak Asasi Manusia, dan penyempurnaan Undang-Undang Jabatan Notaris (hard law), serta Kode Perilaku Notaris (soft law).

Abstract

From time to time, it is considered that Constitutional Amendments are lack of public participation and contains political aspects. Therefore, many nations regulate certain provisions to ensure that the Constitutional Amendments are merely for public order and welfare. One of the provision is the temporal unamendability. In the shape of deliberation requirements, which is essentially the involvement of the public in submitting constitutional amendments within a certain time limit. Indonesian Law doesn’t recognize the concept of deliberation requirements, therefore, the authors will analyze Sweden and South Korean Law, two countries that are also using civil law system and have regulated deliberation requirements in submitting constitutional amendments. This paper will discuss two problems: 1) the legal provisions for constitutional amendments in Indonesia, Sweden, and South Korea, and 2) the guarantee model for public participation in constitutional amendments using the deliberation requirements model. This paper uses legal research method, with a conceptual, statutory, and comparative approach. The results show that Sweden and South Korean Law have involved both the public and the Representative Body to determine wether constitutional amendment will be performed, meanwhile Indonesia hasn’t involve the public to vote for a constitutional amendments. Therefore, to guarantee public participation in constitutional amendments, the authors provide a model which include the public participation through vote or referendum to decide a constitutional amendments and a period of time to file for constitutional amendment.

Abstract

The nature of law enforcement in resolving multi-dimensional information disputes has a logical consequence on the need for constructive law enforcement. This research aims to examine the forms of law enforcement that exist in resolving disputes over requests for public information and to formulate a constructive mechanism to realize a series of law enforcement procedures with legal certainty. This research is normative legal research using a statutory and conceptual approach. The results showed that law enforcement in the settlement of public information disputes consists of the objection, non-litigation adjudication, and litigation covering civil, state administration, and criminal law. In this case, The Criminal law instruments are placed as the final law enforcement if the relevant public agency does not carry out a decision that has permanent legal force. In addition, in the context of realizing comprehensive and constructive law enforcement, a Memorandum of Understanding was held between the Information Commission and the Police to synergize and effectively implement the criminal law as a final resort.

Abstract

Penulisan ini bertujuan untuk membahas mengenai realisasi penggunaan Verifikasi Manual (Fakta Sosial) sebagai manifestasi Asas Kecermatan dalam Batu Uji terhadap KTUN. Latar belakang dari penulisan ini adalah terkait peran AUPB sebagai Batu Uji KTUN yang sudah diterapkan di ruang lingkup PTUN, namun belum secara spesifik menjelaskan mengenai realisasi bentuk dari AUPB. Penulisan ini menggunakan metode yuridis normatif dengan pendekatan perundang-undangan dan pendekatan konseptual. Penulisan hukum melalui pendekatan peraturan perundang-undangan dilakukan dengan menelaah semua undang-undang dan regulasi yang terkait dengan isu hukum yang sedang ditangani. Pendekatan konseptual dilakukan dengan menganalisis dan mengkritisi terhadap pelaksanaan Verifikasi Manual (Fakta Sosial) sebagai manifestasi dari Asas Kecermatan dalam KTUN. Penulisan ini akan melengkapi penulisan sebelumnya, kelebihan penelitian ini adalah secara spesifik membahas Verifikasi Manual (Fakta Sosial) sebagai realisasi dari Asas Kecermatan yang merupakan bagian dari AUPB, serta peran dan kedudukan Verifikasi Manual sebagai Batu Uji dalam KTUN. Hasil penulisan ini menunjukkan bahwa penggunaan Verifikasi Manual (Fakta Sosial) sebagai batu uji KTUN berperan dalam memberikan jaminan agar setiap KTUN yang dikeluarkan oleh pejabat administrasi tidak hanya sejalan dengan hukum yang berlaku, tetapi juga sesuai dengan fakta yang ada di lapangan, sehingga mampu mewujudkan keadilan yang sebenar benarnya, berdasarkan fakta yang sesungguhnya.

Abstract

Article 335 paragraph (1) of the Criminal Code and Article 21 paragraph (4) of the Criminal Procedure Code are deemed to be contradicting Article 28D of the 1945 Constitution. Through the Decision of the Constitutional Court Number 1 / PUU-XI / 2013 excluding the phrase "unpleasant actions" because they are considered to cause multiple interpretations and put forward subjectivity. This article is exposed to arbitrary actions by the authorities to criminalize someone. In fact, after the Constitutional Court Decision Number 1 / PUU-XI / 2013, there are still pre-trial cases of determining suspects based on unpleasant acts. The formulation of Article 335 Paragraph (1) of the Criminal Code, which is used after the decision, requires the fulfillment of 2 (two) elements, namely "using violence" or "threat of violence." Abstract

One of the places that is often targeted by thieves is in a villa. In Article 363 paragraph (1) 3 of the Criminal Code, there is a regulation related to theft with a aggravating if the theft is carried out at night in a house or closed yard where the house is, but there is no provision that explicitly states that it is related to theft in a villa. Based on this background, the formulation of the objectives of this article is to understand: 1. What are the elements of the aggravated theft offense ? 2. Can a villa be conaidered with a “house” as an element of the aggravated theft offense ? This research is a normative legal research with statutory, conceptual, and case approaches. Based on the analysis in this article, it can be understood that 1. The elements in the offense are the same as ordinary theft, but there are additional elements that are alternative. 2. The theft in a villa at night can be qualified for theft with a aggravating factor as stipulated in Article 363 paragraph (1) of the Criminal Code, on the basis of socio-historical interpretation and extensive interpretation.
