Abstract

From time to time, it is considered that Constitutional Amendments are lack of public participation and contains political aspects. Therefore, many nations regulate certain provisions to ensure that the Constitutional Amendments are merely for public order and welfare. One of the provision is the temporal unamendability. In the shape of deliberation requirements, which is essentially the involvement of the public in submitting constitutional amendments within a certain time limit. Indonesian Law doesn’t recognize the concept of deliberation requirements, therefore, the authors will analyze Sweden and South Korean Law, two countries that are also using civil law system and have regulated deliberation requirements in submitting constitutional amendments. This paper will discuss two problems: 1) the legal provisions for constitutional amendments in Indonesia, Sweden, and South Korea, and 2) the guarantee model for public participation in constitutional amendments using the deliberation requirements model. This paper uses legal research method, with a conceptual, statutory, and comparative approach. The results show that Sweden and South Korean Law have involved both the public and the Representative Body to determine wether constitutional amendment will be performed, meanwhile Indonesia hasn’t involve the public to vote for a constitutional amendments. Therefore, to guarantee public participation in constitutional amendments, the authors provide a model which include the public participation through vote or referendum to decide a constitutional amendments and a period of time to file for constitutional amendment.

Abstract

The nature of law enforcement in resolving multi-dimensional information disputes has a logical consequence on the need for constructive law enforcement. This research aims to examine the forms of law enforcement that exist in resolving disputes over requests for public information and to formulate a constructive mechanism to realize a series of law enforcement procedures with legal certainty. This research is normative legal research using a statutory and conceptual approach. The results showed that law enforcement in the settlement of public information disputes consists of the objection, non-litigation adjudication, and litigation covering civil, state administration, and criminal law. In this case, The Criminal law instruments are placed as the final law enforcement if the relevant public agency does not carry out a decision that has permanent legal force. In addition, in the context of realizing comprehensive and constructive law enforcement, a Memorandum of Understanding was held between the Information Commission and the Police to synergize and effectively implement the criminal law as a final resort.

Abstract

Penulisan ini bertujuan untuk membahas mengenai realisasi penggunaan Verifikasi Manual (Fakta Sosial) sebagai manifestasi Asas Kecermatan dalam Batu Uji terhadap KTUN. Latar belakang dari penulisan ini adalah terkait peran AUPB sebagai Batu Uji KTUN yang sudah diterapkan di ruang lingkup PTUN, namun belum secara spesifik menjelaskan mengenai realisasi bentuk dari AUPB. Penulisan ini menggunakan metode yuridis normatif dengan pendekatan perundang-undangan dan pendekatan konseptual. Penulisan hukum melalui pendekatan peraturan perundang-undangan dilakukan dengan menelaah semua undang-undang dan regulasi yang terkait dengan isu hukum yang sedang ditangani. Pendekatan konseptual dilakukan dengan menganalisis dan mengkritisi terhadap pelaksanaan Verifikasi Manual (Fakta Sosial) sebagai manifestasi dari Asas Kecermatan dalam KTUN. Penulisan ini akan melengkapi penulisan sebelumnya, kelebihan penelitian ini adalah secara spesifik membahas Verifikasi Manual (Fakta Sosial) sebagai realisasi dari Asas Kecermatan yang merupakan bagian dari AUPB, serta peran dan kedudukan Verifikasi Manual sebagai Batu Uji dalam KTUN. Hasil penulisan ini menunjukkan bahwa penggunaan Verifikasi Manual (Fakta Sosial) sebagai batu uji KTUN berperan dalam memberikan jaminan agar setiap KTUN yang dikeluarkan oleh pejabat administrasi tidak hanya sejalan dengan hukum yang berlaku, tetapi juga sesuai dengan fakta yang ada di lapangan, sehingga mampu mewujudkan keadilan yang sebenar benarnya, berdasarkan fakta yang sesungguhnya.

Abstract

Article 335 paragraph (1) of the Criminal Code and Article 21 paragraph (4) of the Criminal Procedure Code are deemed to be contradicting Article 28D of the 1945 Constitution. Through the Decision of the Constitutional Court Number 1 / PUU-XI / 2013 excluding the phrase "unpleasant actions" because they are considered to cause multiple interpretations and put forward subjectivity. This article is exposed to arbitrary actions by the authorities to criminalize someone. In fact, after the Constitutional Court Decision Number 1 / PUU-XI / 2013, there are still pre-trial cases of determining suspects based on unpleasant acts. The formulation of Article 335 Paragraph (1) of the Criminal Code, which is used after the decision, requires the fulfillment of 2 (two) elements, namely "using violence" or "threat of violence." Abstract

One of the places that is often targeted by thieves is in a villa. In Article 363 paragraph (1) 3 of the Criminal Code, there is a regulation related to theft with a aggravating if the theft is carried out at night in a house or closed yard where the house is, but there is no provision that explicitly states that it is related to theft in a villa. Based on this background, the formulation of the objectives of this article is to understand: 1. What are the elements of the aggravated theft offense ? 2. Can a villa be conaidered with a “house” as an element of the aggravated theft offense ? This research is a normative legal research with statutory, conceptual, and case approaches. Based on the analysis in this article, it can be understood that 1. The elements in the offense are the same as ordinary theft, but there are additional elements that are alternative. 2. The theft in a villa at night can be qualified for theft with a aggravating factor as stipulated in Article 363 paragraph (1) of the Criminal Code, on the basis of socio-historical interpretation and extensive interpretation.

Abstract

The Constitutional Court Decision No. 118/PUU-XX/2022 redefined the paradigm of the statute of limitations for document forgery offenses in Indonesia. Previously calculated from the date of the offense, it is now determined based on when the forged document is discovered, used, and causes loss. This article examines the legal implications of the court decision on the state of limitations to legal certainty and law enforcement practices, particularly those carried out by the Indonesian National Police. A conceptual and statutory approach is employed to analyze the amendments to Article 79(1) of the Indonesian Criminal Code and the Court’s legal reasoning. The findings indicate that this change enhances legal protection for victims and requires investigators to cumulatively evaluate the elements of “discovery,” “usage,” and “loss” to determine the statute of limitations. The decision has erga omnes effect and serves as a binding precedent and guideline for investigating document forgery cases in Indonesia.

Abstract

Kejahatan terhadap harta kekayaan merupakan kejahatan yang dapat pula terjadi dalam lingkup keluarga. Kejahatan terhadap harta kekayaan dalam lingkup keluarga sendiri secara materiil merupakan tindak pidana yang memiliki aturan yang lebih khusus dan spesifik dalam Pasal 367 dan Pasal 376 KUHP, dimana Kejahatan yang dilakukan dalam lingkup keluarga tersebut merupakan delik aduan. Kedudukannya sebagai delik aduan telah secara khusus menempatkan keluarga sebagai korban sebagai acuan terhadap proses penegakan hukum kejahatan terhadap harta kekayaan. Pentingnya keluarga selaku korban dan pengadu sebagai aspek penting yang ditetapkan hukum materiil tersebut nyatanya tidak dianut hukum formil dalam penegakannya. Berbeda dengan KUHP yang menempatkan keluarga sebagai aspek penting dalam kekhususan kejahatan terhadap harta kekayaan dalam lingkup keluarga, Pasal 168 KUHAP justru memberikan ancaman terhadap nilai pembuktian keterangan yang diberikan oleh saksi yang memiliki hubungan keluarga dengan pelaku. Antinomi yang ada diantara hukum materiil dan formil ini selanjutnya melandasi dua masalah hukum, yaitu mengenai kedudukan keterangan saksi dalam pembuktian hukum pidana di Indonesia dan kedudukan keterangan korban terkait kejahatan terhadap harta kekayaan dalam lingkungan keluarga di Indonesia.

Abstract

The existence of regional autonomy in Indonesia is implemented through regional leaders who have the authority to run local government. When carrying out their duties, regional leaders are supervised by other state institutions as a form of checks and balances in government power. Hence, the procedure to dismiss regional leaders regulates to involve the Regional People's Representative Assembly, the Supreme Court, and the President through the Minister of Home Affairs as a form of right to dismiss. However, the existence of the proportionality principle in the procedure to dismiss regional leaders, through the right given to regional leaders to defend themselves, has yet to be regulated in the law. This article talks about two things: first, the procedure to dismiss regional leaders, and second, the legal consequences and the position of a chance to summon regional leaders to explain and defend themselves in the procedure to dismiss regional leaders. This article aims to find the importance of proportionality principles in the procedure to dismiss regional leaders. The method used in this article is legal research, with statutes, conceptual, and case approaches. The results of this research show that although the procedure to dismiss regional leaders has been regulated in law, applying the proportionality principle only exists in jurisprudences. Hence, an ius constituendum is needed to determine legal consequences and certainty regarding the procedure to dismiss regional leaders.

Abstract

Dewan Kehormatan Penyelenggara Pemilu (DKPP) merupakan salah satu dari triumvirat penyelenggara pemilu di Indonesia. Politik hukum pemilu di Indonesia dalam status a quo memberikan kewenangan yang begitu koersif kepada DKPP terkait dengan penegakkan kode etik. Namun, begitu koersifnya kewenangan yang DKPP sejatinya menimbulkan pertanyaan mendasar, yaitu terkait dengan : 1.Bagaimana korelasi kode etik dengan penyelenggaraan Pemilu yang demokratis di Indonesia?2.Bagaimana korelasi kewenangan DKPP dengan terciptanya Pemilu yang demokratis?Penelitian ini merupakan penelitian yuridis yang menggunakan pendekatan statute approach, conceptual approach, dan case approach untuk menjawab problematika tersebut. Berdasarkan penelitian ini, ditemukan bahwa Kode Etik pemilu berkorelasi sebagai perwujudan aturan main yang dibentuk bersama agar terciptanya pemilu yang jujur dan adil agar terciptanya pemilu yang demokratis secara substansial, bukan hanya prosedural. Selain itu, ditemukan bahwa kewenangan DKPP yang koersif adalah untuk menjamin agar Penyelenggara Pemilu mentaati Kode Etik yang merupakan aturan main dalam penyelenggaraan Pemilu.  Ketika DKPP tidak memiliki wewenang yang koersif tersebut, akan membuat DKPP seolah menjadi harimau tanpa taring yang akan menyebabkan terjadinya pemilu yang tidak mencerminkan demokrasi yang substantif

Abstract

This article discusses the problems encountered in the preliminary court proceeding of gross human right violation cases in Indonesia.  Identified are two state institutions, i.e. the National Human Right Commission and the Attorney General, who possess the authority to initiate investigation and subsequent successful prosecution of gross human right violation cases. Good cooperation and relation between these two agencies is therefore a must.  This article looks into the problems encountered by these two institutions in doing the preliminary process and discusses possible redistribution of these two state agency authorities. To do this a doctrinal approach will be used.
