Abstract

Tanaman tin (Ficus carica) memiliki beraneka ragam aksesi salah satunya yaitu Blue Giant. Abstract

Judicial activism, commonly translated as judicial activism or judicial engagement, is a philosophy in which judges make decisions by considering the development of legal consciousness and justice, or the latest developments in public policy. This writing aims to understand: 1) how Administrative Court judges implement judicial activism in realizing a legal system for environmental law, and 2) the position of Administrative Court decisions in realizing the environmental law system. This research is normative juridical in nature, using a statutory and conceptual approach, which will be analyzed descriptively and qualitatively. The results of the study show that: 1) Judges play a very important role in enforcing environmental law by realizing various rules for environmental management and protection in various environmental disputes in Administrative Court. The important role of judges in implementing the legal framework set out in legislation is crucial for protecting the environment. 2) The position of the Administrative Court's decisions in environmental disputes is highly strategic for two reasons: 1) From a legal scientific perspective, court decisions serve as: a source of law; the result of legal rule formulation; the transformation of abstract legal norms into actual law; the embodiment of checks and balances among branches of state power; and a reformer of the legal system. Therefore, without judicial decisions, the legal system would not function. 2) From a practical perspective, judicial decisions resolve concrete disputes and provide interpretations that determine what the law is.

Abstract

This study aims to identify, understand, and analyze the regulations governing electronic catalog system providers concerning the quality and pricing of goods/services in government procurement, as well as to determine the form of responsibility of electronic catalog system providers for the quality and pricing of goods/services in government procurement. The method used in this study is a normative juridical research method with a legislative approach and a legal concept analysis approach. The results of the study indicate that the regulation of electronic catalog system providers regarding the quality and pricing of goods/services in government procurement is governed by the Regulation of the National Public Procurement Agency (LKPP) Number 9 of 2021 on Online Stores and Electronic Catalogs in Government Procurement, which was further refined by the Decision of the Head of the National Public Procurement Agency of the Republic of Indonesia Number 122 of 2022, dated April 1, 2022. This regulation provides a more detailed explanation of the process for listing a product/commodity in the electronic catalog. The form of responsibility of electronic catalog system providers for discrepancies in the quality and pricing of goods/services in government procurement is that catalog providers are held accountable for any consequences arising from the low quality of products used by Ministries/Agencies/Local Governments. Therefore, if there is a difference between the quality and price listed in the electronic catalog and the actual product, the electronic catalog provider is responsible for compensating the losses incurred by the procuring party.
The Procedural Law of State Administrative Courts As The Rule of Adjudication: Exploring Hart’s Theory Efendi, Aan; Sudarsono

Abstract

In Hart’s theory, law is a combination of two types of rules: primary and secondary. Primary rules regulate the behavior of individuals or institutions, while secondary rules relate to primary rules, including the rule of recognition to identify the primary rules, the rule of change to modify primary rules, and the rule of adjudication to address violations of primary rules. The law of administrative procedure is an adjudication regulation that resolves violations of primary rules governing the behavior of government organs in administering government. Using a doctrinal legal method, this study explores two problems: the rule of adjudication in Hart’s theory and the procedural law of administrative courts understood as the rule of adjudication according to Hart’s theory. The study results reveal that, first, in Hart’s theory, the rule of adjudication does not stand alone but is, instead, attached to the primary rules, which function to identify violations, adjudicate, and provide punishment or compensation for violations of the primary rules; second, based on Hart’s theory, the procedural law of administrative courts serves as a rule of adjudication for the adjudication process dealing with violations of primary regulations regarding the obligations of government organs in administering government which must be guided by legislation and the general principles of good governance.

Abstract

The use of gamma rays to improve Indigofera zollingeriana is beneficial for developing new superior varieties with genetic characteristics inheritable by other generations. During the development, selecting genotypes from I. zollingeriana putative mutant under shaded conditions can create stable shade-tolerant varieties, with the potential to be developed into new cultivars. Therefore, this study aimed to explore the selection of I. zollingeriana putative mutant in the M2 generation for assessing and evaluating plant growth performance, biomass production, as well as nutrient content and digestibility under shading. Seedlings of 10 I. zollingeriana putative mutants along with 2 control plants, were subjected to 5 levels of shade, namely 0%, 55%, 65%, 75%, and 85%, to identify genotypes with shade tolerance. The results showed that shading significantly (p<0.05) increased plant height, chlorophyll content, leaf length, and leaf width, but decreased the number of leaves, nodes, stem diameter, and branches, also leading to decreased biomass production, high nutritional content, and improved digestibility values. Genotypes R4.10 and R5.10 showed enhanced plant growth, stable biomass production, and increased nutritional content, with low digestible neutral detergent fiber (dNDF), and higher in vitro true digestibility (IVTD) values compared to control under shaded and unshaded conditions. The identified superior genotypes are promising for breeding programs and practical application in agroforestry or silvopasture systems.
