Abstract

This research is intended to examine the existence of criminal sanctions against children under the age of 12 as criminals and how there are regulations that confirm that they cannot be held a criminal responsibility. This gives rise to the view that the Principle of Equality Before the Law is not fulfilled. The transformation of the times has resulted in more and more criminal acts occurring so it does not rule out the possibility that similar things can be done by children under the age of 12. Therefore, it is necessary to carry out legal efforts related to punishment and criminal responsibility for children under the age of 12 who are proven to have done criminal acts (Strafbaarfeit) which are intended as an effort to re-function and learn for children so that justice, equality and legal certainty are met. In studying it, this research uses normative legal research methods and interprets it using prescriptive analysis techniques, namely regarding the study, especially of the Article on the elimination of criminal law as regulated in Article 21 paragraph 1 of Law Number 11 of 2012 concerning the Juvenile Criminal Justice System and the Article on the elimination of responsibility by Child Offenders, which is regulated in Article 40 of Law Number 1 of 2023 concerning the Criminal Code and is linked to the principle of equality before the law.

Abstract

Pandemi COVID-19 telah memberikan dampak signifikan terhadap berbagai sektor, termasuk industri pariwisata. Pembatasan perjalanan, penutupan tempat-tempat wisata, dan penerapan protokol kesehatan yang ketat telah mengakibatkan penurunan tajam dalam jumlah wisatawan domestik maupun internasional. Taman Margasatwa Ragunan, sebagai salah satu destinasi wisata utama di Jakarta, mengalami penurunan drastis dalam jumlah pengunjung serta pendapatan selama masa pandemi. Penutupan sementara, pembatasan kapasitas, dan penerapan protokol kesehatan ketat menjadi beberapa langkah yang diambil untuk mencegah penyebaran virus, namun hal ini juga berdampak negatif pada operasional dan keuangan taman margasatwa tersebut, utamanya pada UMKM di dalam kawasan Taman Margasatwa Ragunan. Penelitian ini bertujuan untuk menganalisis dampak pandemi COVID-19 terhadap industri pariwisata Taman Margasatwa Ragunan serta mengevaluasi strategi pemulihan yang diterapkan. Data dikumpulkan melalui metode kualitatif, termasuk wawancara dengan ibu Tini selaku pelaku UMKM di Taman Margasatwa Ragunan. Penelitian ini menyimpulkan bahwa adaptasi cepat dan inovatif sangat diperlukan untuk memfasilitasi pemulihan yang berkelanjutan di sektor pariwisata.

Abstract

Hukuman mati adalah salah satu bentuk hukuman yang paling ekstrim dan kontroversial dalam sistem hukum Indonesia. Hukuman mati telah menjadi subjek dari perdebatan di Indonesia. Beberapa kritik yang terkait dengan praktik ini meliputi keberatan terhadap keadilan hukum, keberatan terhadap kepastian hukum, dan keberatan terhadap perlindungan hak asasi manusia. Melihat bahwa implementasi hukuman mati dalam sistem hukum Indonesia masih banyak menghadapi kritik dan perdebatan, penulis akan berusaha mengetahui alasan serta solusi dengan melakukan penelitian terhadap pemikiran mahasiswa dan mahasiswi Fakultas Hukum UPNVJ angakatan 2023. Dalam penelitian ini, kita akan menganalisis implementasi hukuman mati dalam sistem hukum Indonesia dan meninjau kritik terkait dengan praktik ini. Penelitian ini menggunakan pendekatan kuantitatif untuk menganalisis data yang terkait dengan implementasi hukuman mati dalam sistem hukum Indonesia. Kita berharap bahwa penelitian ini dapat membantu dalam meningkatkan kesadaran masyarakat tentang pentingnya perlindungan hak asasi manusia dan kepastian hukum dalam sistem hukum Indonesia.

Abstract

Introduction: Perpetrators of obscene acts have carried out various criminal acts. Obscene acts are included in sexual violence that results in physical and psychological suffering.Purposes of the Research: This study aims to analyze the fulfillment of the rights of victims of obscene acts, whether it is appropriate or not. This is based on the phenomenon of indecent acts; the more extended the number of victims increases.Methods of the Research: This study uses a normative juridical method with a statute and case approach.Results of the Research: The results of the study indicate that the rights of victims of obscene acts have been regulated and guaranteed in the 1945 Constitution of the Republic of Indonesia, the Law on Human Rights, the Law for the Protection of Witnesses and Victims and the Act on the Crime of Sexual Violence. However, the problem is in the fulfillment of these rights, even though constitutionally, the duties and obligations of fulfilling the rights of victims are borne by the State, which in this case is in the components of the Criminal Justice System, the Ministry of Law and Human Rights, the Ministry of Women's Empowerment and Child Protection, The National Commission on Human Rights, the National Commission on Violence Against Women and the Witness and Victim Protection Agency. The importance of supervision and compliance with the application of rights in everyday life will determine how successful the State is in carrying out its obligations in fulfilling the requests of victims. So it is essential to cooperate between Ministries, Institutions, National Commissions, and law enforcement officials to realize the fulfillment of the rights of victims of criminal acts of obscenity.

Abstract

One of the crimes that disturbs the community is crime by using firearms to carry out criminal acts. Recently, this type of crime has been rampant, especially in 2025, where the National Police provided data on 66 cases that occurred at the beginning of this year. On the other hand, the use of weapons is also legalized through licensing procedures. However, this legalization actually creates a situation like a double-edged knife. This is shown by the case of police officer Ferdy Sambo who used his weapon to carry out his murder. Then the case of an ASN in Palembang who used his weapon and he got it illegally. From this, the problem formulations raised from these problems are: 1) how are the mechanisms and requirements for firearms ownership by civilians in terms of Indonesian positive law; and 2) how is the role of the National Police in tackling the misuse of firearms by civilians in terms of firearms ownership procedures. The research method is normative juridical with a statutory, case, and conceptual approach. The results of this study found that the mechanism of ownership and use of firearms is regulated in Chief of Police’s Regulation No. 1/2022 which regulates the mechanism and parties entitled to obtain permission to use weapons. Then, the role of the police starts from providing preventive and repressive legal protection to the community. Preventive protection can be provided from counseling and socialization. Repressive protection can be done by carrying out strong law enforcement against firearms users who cross the line and without going through the licensing process first.

Abstract

Penelitian ini mengkaji implikasi keberpihakan pejabat negara dalam penyelenggaraan pemilu di Indonesia, serta upaya untuk mewujudkan keadilan dan kedamaian sesuai dengan Tujuan Pembangunan Berkelanjutan (SDGs) Nomor 16. Indonesia sebagai negara kepulauan dengan jumlah penduduk yang besar harus menjaga persatuan dan mencapai tujuan bersama, termasuk dalam konteks penyelenggaraan pemilu. Namun, keberpihakan pejabat negara, baik secara terang-terangan maupun terselubung, dapat merusak integritas dan legitimasi pemilu, mengarah pada ketidakadilan politik, pelanggaran hak asasi manusia, serta ketidakstabilan politik. Artikel ini menelaah bagaimana regulasi terkait netralitas pejabat negara, seperti Undang-Undang Nomor 5 Tahun 2014 tentang Aparatur Sipil Negara dan Peraturan Pemerintah Nomor 53 Tahun 2010 tentang Disiplin Pegawai Negeri Sipil, berkaitan erat dengan prinsip SDGs Nomor 16 untuk menciptakan masyarakat yang damai, adil, dan inklusif. Penelitian ini menggunakan metode kualitatif dengan studi pustaka, melakukan analisis terhadap regulasi dan kebijakan terkait netralitas pejabat negara dalam pemilu. Data yang dikumpulkan meliputi peraturan perundang-undangan, dokumen resmi, dan literatur terkait. Hasil penelitian menunjukkan bahwa keberpihakan pejabat negara dapat berdampak signifikan terhadap integritas, transparansi, dan keadilan dalam penyelenggaraan pemilu. Pelanggaran netralitas pejabat negara dapat mengarah pada ketidakadilan politik, pelanggaran hak asasi manusia, dan ketidakstabilan politik yang berpotensi mengganggu proses menuju pembangunan berkelanjutan. Oleh karena itu, diperlukan langkah-langkah strategis untuk meningkatkan integritas dan keadilan dalam proses pemilu di Indonesia, sejalan dengan tujuan pembangunan berkelanjutan.

Abstract

This study examines the modus operandi of child grooming that utilizes identity forgery (faker) in the online roleplayer (RP) community, as well as analyzes legal protection and psychological impact on victims. Using a normative juridical approach, the study found that perpetrators systematically build an emotional relationship with child victims through false identities for the purpose of exploitation. This faker practice has been shown to cause deep psychological trauma and mental destruction. Juridically, this action can be charged through Article 378 of the Criminal Code concerning fraud, the Child Protection Law, and the ITE Law. The results of the study confirm the importance of digital literacy, parental supervision, and ongoing psychological support for victims. We suggest the need for more protective platform policies and legal adaptations that are responsive to these cybercrimes. Abstract

Setiap anak berhak atas kelangsungan hidup, tumbuh dan berkembang serta berhak atas perlindungan dari kekerasan dan diskriminasi sebagaimana telah diamanatkan dalam Undang-Undang Dasar Negara Republik Indonesia Tahun 1945. Anak adalah buah hati yang tak ternilai harganya bagi sebuah keluarga, maka dari itu saling menjaganya untuk tumbuh baik, dan berkembang sebagaimana yang diharapkan adalah merupakan kewajiban mutlak bagi kedua orang tua yaitu ayah dan ibu. Bagaimana memilih Pendidikan yang baik, pergaulan yang baik, lingkungan yang mendukkung sudah sepantasnya orang tua wajib mengarahkan anak, karena anak merupakan calon pemimpin masa depan bangsa, maka saat ini  program sosialisasi dan pendampingan untuk siswa di MTS Al-Husna Depok, dalam rangka mencegah diskriminasi dan kekerasan terhadap anak. Program ini mencakup berbagai kegiatan seperti konseling, pendampingan, dan workshop tentang pendidikan karakter, penyelesaian konflik, dan hak asasi manusia. Artikel ini menekankan pentingnya pencegahan dan intervensi dini dalam mengatasi kekerasan dan diskriminasi di MTS. Program ini telah berhasil meningkatkan kesadaran di antara siswa, guru, dan orang tua tentang pentingnya mencegah kekerasan dan diskriminasi, dan telah membantu menciptakan lingkungan belajar yang lebih aman dan inklusif. Artikel ini menyimpulkan bahwa program sosialisasi dan pendampingan dapat efektif dalam mengurangi kekerasan dan diskriminasi di MTS, dan merekomendasikan agar program serupa diimplementasikan di sekolah lain. Proses penelitian meliputi tahap persiapan, perizinan, perolehan dan pengumpulan data, pelaksanaan, pelaporan, dan publikasi dalam jurnal pengabdian masyarakat. Tahap pelaksanaan meliputi diskusi dengan mitra mengenai peran, diskusi dengan stakeholder dan psikolog, komunikasi dengan mitra mengenai kesulitan yang mungkin terjadi, koordinasi bersama orang tua dan anak sesuai dengan program yang disepakati, dan melaporkan kemajuan setelah koordinasi dengan mitra.

Abstract

This study aims to analyze the settlement of cases of children in conflict with the law through a diversion approach at the investigation stage in order to realize restorative justice. . Diversion efforts at the investigation stage need to be carried out if cases of children in conflict with the law meet the requirements for diversion. Diversion means the granting of authority to law enforcement officials to take policy actions in dealing with or resolving the problem of child violations by not taking formal steps, including stopping or not continuing from the criminal justice process or returning it to the community. Or in other words, diversion is the transfer of a child's case from the criminal justice process to a process outside of criminal justice. This effort is carried out, especially in the investigation stage, which needs to be carried out in order to provide protection for children in conflict with the law, especially if the crime committed meets the diversion requirements. However, in reality in the field there are still many law enforcers, especially the police, who do not use this authority, this is due to various factors such as a lack of understanding from law enforcement officials regarding the treatment and handling of children in conflict with the law at every stage of the legal process. If diversion can be carried out early, it can prevent children in conflict with the law from having to go through all the long legal processes that can ultimately affect the child's psychological development. Diversion efforts are also in the context of realizing restorative justice which emphasizes recovery back to its original state rather than retaliation. The research method used is a juridical-normative approach with a statute approach and a conceptual approach. The results of the study conclude that firstly, for the best interests of the child, both as the perpetrator and the victim, it is necessary to make diversion efforts at the investigation stage if it meets the requirements to protect children. Second, the concept of diversion at the investigation stage experienced problems or was not carried out due to several factors such as the lack of understanding of law enforcement officials and the absence of agreement in the diversion deliberation.

Abstract

This research discusses the rights of workers / laborers during the COVID-19 pandemic and what if the employers do not meet these rights. Problem which is more in-depth about the employment that emerged during this pandemic, namely the occurrence of massive layoffs. The research was conducted using the Normative Juridical method. By applying the Statute Approach, Conceptual Approach, and Case Approach, the results show that employers have not been able to fulfill workers / labor rights during the COVID-19 pandemic. There are companies that have not implemented the clean lifestyle and occupational health standards K3 protection such as masks, hand sanitizer and personal protective equipment. Prevention and handling policies are still not optimal, the principle of maintaining social distancing has not been implemented optimally, there are still many workers who are jostling for work when they come to work, not to mention during the trip to work in public transportation.  This situation makes them vulnerable to infection. However, they still have to go to work because of the risk of losing their income. Efforts that can be made if wages are not paid are to take the route or methods as regulated in Law Number 2 of 2004 concerning Settlement of Industrial Relations Disputes. The basis of a dispute between a worker/ laborer and an entrepreneur is a dispute over rights.
