Abstract

Praktik overcharge dalam layanan transportasi online merugikan wisatawan, terutama di destinasi pariwisata Indonesia. Penelitian ini menganalisis landasan hukum dan bentuk perlindungan hukum bagi wisatawan sebagai konsumen terhadap praktik tersebut. Metode penelitian yang digunakan adalah penelitian hukum normatif dengan pendekatan perundang-undangan dan konseptual. Hasil penelitian menunjukkan bahwa perlindungan hukum telah diatur melalui Undang-Undang Perlindungan Konsumen, Undang-Undang Kepariwisataan, dan Peraturan Menteri Perhubungan Nomor 12 Tahun 2019, yang menjamin hak atas transparansi tarif, keamanan, dan kompensasi. Praktik overcharge dilarang dengan ancaman sanksi administratif hingga Rp200 juta dan pidana penjara hingga lima tahun, serta penyelesaian sengketa melalui BPSK. Namun, implementasi masih menghadapi kendala berupa ketimpangan posisi tawar wisatawan, rendahnya kesadaran hukum pengemudi, dan koordinasi antarlembaga yang belum optimal.

Abstract

This study discusses the legal framework and the obligations of tourism operators in implementing the principles of sustainable tourism in Indonesia. The main focus of this research is to analyze the implementation of sustainability principles within Law No. 10 of 2009 on Tourism and related international regulations such as ISO 21401 and the International Tourism Ethics Code. The methodology used is normative legal research with legislative and conceptual approaches, aiming to critique ambiguities in existing regulations and propose solutions regarding the obligations of tourism operators. The findings show that there is a lack of clarity in the legal provisions regulating sustainability, which may negatively impact social and environmental aspects. Therefore, this study suggests the need for revisions to clarify the obligations of tourism operators to conduct environmental and social impact assessments. In conclusion, the study advocates for a stronger integration of national regulations with international standards to ensure the development of tourism that is sustainable, equitable, and environmentally friendly.

Abstract

Penelitian ini membahas konflik norma antara hukum positif dan hukum adat terkait pergeseran fungsi tabuh rah di Bali. Awalnya, tabuh rah merupakan ritual suci dalam upacara caru yang dilindungi UUD 1945 dan diatur dalam awig-awig desa adat, namun dalam praktik berkembang menjadi tajen yang mengandung unsur perjudian dan dikriminalisasi oleh KUHP serta UU Nomor 1 Tahun 2023. Dengan metode penelitian hukum normatif melalui pendekatan perundang-undangan dan konseptual, penelitian ini menemukan adanya kekaburan norma akibat ketiadaan regulasi daerah yang menetapkan batasan yuridis yang jelas, sehingga menyulitkan penegakan hukum dan memicu resistensi masyarakat adat. Oleh karena itu, diperlukan pengaturan khusus yang membedakan tabuh rah ritual dari perjudian serta penguatan kewenangan desa adat guna mewujudkan harmonisasi hukum yang adil.

Abstract

Artikel ini mengkaji dilema etis dan batasan hukum Medically Assisted in Dying (MAiD) serta perbedaannya dengan Physician Assisted Suicide (PAS). Analisis menelusuri latar historis MAiD dan menyoroti argumen kemanusiaan bagi pasien penyakit terminal yang mengalami penderitaan tak tertahankan. Meskipun MAiD telah dilegalkan di beberapa yurisdiksi seperti Kanada dan New Jersey, praktik ini masih menimbulkan persoalan etis dan hukum serius, khususnya di Indonesia yang mengkategorikannya sebagai pembunuhan. Melalui penelitian yuridis normatif, artikel ini mengkritisi ketiadaan kerangka hukum internasional yang jelas dan menilai implikasi MAiD terhadap hak asasi manusia, terutama hak untuk hidup dan hak menentukan nasib sendiri. Kajian ini bertujuan memperkaya diskursus MAiD dengan menawarkan perspektif hukum yang menyeimbangkan otonomi individu dan nilai-nilai etis masyarakat.

Abstract

This study examines the legal position of women in inheriting residential houses under Bajawa customary law in Ngada Regency, East Nusa Tenggara. Although the Bajawa community follows a matrilineal system that places women at the center of lineage continuity, in practice their inheritance rights are not always absolute and may be influenced by various socio-cultural factors. This research aims to analyze women’s legal status in such inheritance and to identify factors that limit or shape the realization of these rights. An empirical juridical method was employed using factual and historical approaches. Primary data were obtained through in-depth interviews with customary leaders (mosalaki), community members, and relevant stakeholders, while secondary data were collected from legal documents and scholarly literature. The findings indicate that women, particularly the eldest daughter, hold primary genealogical rights over the family house as a symbol of lineage continuity. However, these rights are conditioned by social stratification, marital patterns, and customary recognition. The study highlights that Bajawa customary law provides strong social legitimacy for women’s inheritance rights, yet lacks formal legal certainty due to the absence of codification.

Abstract

The illegal trade of protected wildlife in Indonesia continues to occur, including through digital platforms such as social media and instant messaging applications. This condition raises legal issues, particularly regarding the validity of sale and purchase agreements when the object being traded is prohibited by law. This study aims to examine the validity of agreements involving protected birds from the perspective of Indonesian civil law and to analyze the legal consequences arising from such transactions. The research applies a normative legal method using statutory, conceptual, and case approaches. The findings indicate that although agreements between parties may fulfill elements of consent and capacity, they fail to meet the requirement of a lawful cause as stipulated under Article 1320 of the Indonesian Civil Code. The object of the agreement contradicts Law Number 5 of 1990 concerning the Conservation of Natural Resources and Ecosystems. Consequently, such agreements are considered null and void by law and do not produce binding legal effects. Therefore, civil law does not provide legal protection for transactions involving prohibited objects.

Abstract

Penelitian ini bertujuan untuk menganalisis kedudukan hukum perempuan dalam memperoleh hak waris atas rumah tinggal menurut hukum adat Bajawa di Bajawa, Kabupaten Ngada, Nusa Tenggara Timur, serta mengidentifikasi faktor-faktor yang memengaruhi dan membatasi hak waris tersebut. Penelitian ini menggunakan metode yuridis empiris dengan pendekatan fakta dan pendekatan sejarah. Data primer diperoleh melalui wawancara dengan tokoh adat (mosalaki), tokoh agama, kepala desa, serta perempuan yang pernah menerima warisan rumah tinggal. Data sekunder diperoleh melalui studi kepustakaan terhadap peraturan perundang-undangan dan literatur yang relevan. Hasil penelitian menunjukkan bahwa masyarakat adat Bajawa menganut sistem kekerabatan matrilineal yang menempatkan perempuan, khususnya anak perempuan pertama, sebagai penerus utama rumah tinggal keluarga. Perempuan memiliki hak genealogis atas rumah adat, sementara laki-laki berperan dalam pengelolaan dan perlindungan rumah adat tersebut. Namun demikian, hak tersebut tidak bersifat mutlak karena dipengaruhi oleh faktor sosial seperti sistem stratifikasi sosial (rang), perkawinan endogami, pengakuan keluarga, serta legitimasi adat. Selain itu, terdapat perbedaan pandangan mengenai kedudukan anak di luar kawin dalam pewarisan rumah tinggal. Secara keseluruhan, hukum adat Bajawa memberikan legitimasi sosial yang kuat terhadap hak perempuan atas rumah tinggal, meskipun belum memiliki kepastian hukum formal karena tidak dikodifikasi secara tertulis.

Abstract

This study aims to conduct a comparative analysis between recipients of pro bono legal services and paid legal services in Indonesia, focusing on their effectiveness, quality of legal assistance, and practical challenges, particularly in the Bali region. The research employs an empirical juridical method, which examines how law operates in practice (law in action). Primary legal materials include Law Number 16 of 2011 on Legal Aid, Supreme Court Regulation Number 1 of 2014 on Guidelines for Providing Legal Services for the Poor in Court, and the Indonesian Advocates’ Code of Ethics, while secondary materials consist of legal literature and previous research. The findings reveal that the implementation of pro bono legal services has not been fully effective despite having a solid legal foundation. Major challenges include delayed disbursement of government funds, limited budget allocation, and insufficient facilities and human resources within legal aid institutions. These factors negatively affect the motivation, professionalism, and effectiveness of advocates in providing legal assistance to underprivileged communities. Conversely, paid legal services tend to operate more efficiently due to clear contractual relationships between lawyers and clients, supported by sufficient financial resources, resulting in higher service quality and client satisfaction. In conclusion, the disparity in effectiveness between pro bono and paid legal services is not solely driven by economic factors but also by the suboptimal implementation, funding mechanisms, and oversight of legal aid policies in Indonesia.

Abstract

In the current era of digitalization, where information technology continues to develop, accompanied by the competitive demands of the technology-based business world, new business ideas are being seen which are seen as great opportunities by business people. One of the businesses that is currently very popular is the online entrustment service business for purchasing concert tickets via Instagram. The purpose of this research is to determine and analyze the legal responsibility of online entrustment service entrepreneurs who default on consumers due to unclear concert ticket information and related forms of legal protection for consumers for unclear information by online entrustment service entrepreneurs in purchasing concert tickets via Instagram. The research method used is normative juridical using legal materials obtained from primary, secondary and tertiary legal materials. The existence of a breach of contract regarding unclear concert ticket information carried out by online entrustment service entrepreneurs on Instagram means that jastip entrepreneurs who violate the agreement can be held responsible for compensating consumers for losses with sanctions as regulated in the relevant regulations. Therefore, this creates the creation of consumers' rights to obtain legal protection, both preventively and repressively, where in order to realize this legal protection it is also necessary to have joint synergy between the government, society, institutions and related parties.

Abstract

This study explores the impact of educational visits to Jungle Pod Chocolate and Secret Garden Village on participants' understanding and appreciation of the chocolate industry and sustainability practices. Through a qualitative approach involving participatory observation and in-depth interviews, this research reveals a significant increase in participants' knowledge about the chocolate-making process, from cocoa beans to the final product, and their awareness of sustainability. The visit outcomes indicate a positive change in participants' perception of chocolate, encouraging them to support more responsible and sustainable practices. Thus, this study highlights the importance of direct educational initiatives in raising awareness and inspiring a change in attitude towards more ethical and sustainable chocolate consumption, while recognizing the contribution of various parties that made this educational experience valuable. This research provides important insights for chocolate producers, educators, and other stakeholders about the effectiveness of educational visits as a tool to promote sustainability and ethics in the chocolate industry.
