Abstract

The SKB ITE was established as a guideline for the implementation of specific articles within the Electronic Information and Transactions Law (UU ITE) that were deemed inherently confusing in their execution. However, the legality of the SKB ITE remains a current issue, particularly concerning its issuance procedures and status. This research employs a normative legal research approach. The findings indicate that SKB ITE serves as an implementation guideline for the UU ITE that lacks a legal basis and violates the Law on Legislation Formation, as its establishment does not conform to the prescribed mechanisms, thus SKB ITE must be declared null and void. Nonetheless, a subsequent issue arises regarding the divergent interests between legislators, regulatory observers, and all of whom are demanding amendments to the UU ITE. Considering the invalidity of the SKB ITE, the most appropriate course of action would be to revise the UU ITE by incorporating the substantive aspects outlined in the SKB ITE and aligning it with the provisions of cybercrime in the New Indonesian Criminal Code. Through these changes, the need for a implementation guideline for the UU ITE can be addressed, thereby enhancing the effectiveness of its implementation and reducing societal controversies surrounding it

Abstract

Enforcement of criminal law at the examination stage in court hearings plays a crucial role in SPP. The court decision is the end of this stage. The heart of a court decision is the judge's legal considerations and ruling. The judge's legal considerations explain why his decision was such. One thing that is often included in the judge's legal considerations is the reason for mitigation which is the cause of the judge's decision regarding the sentence being reduced. In practice, the judge's legal considerations and rulings are not always in line with the Supreme Court's cassation decision Number 3287 K/Pid.Sus/2019. The type of research in this writing uses normative legal research, a type of secondary data with a library research method which is then analyzed using qualitative methods and drawing conclusions deductively. The reasons for mitigation in the court's decision are manifested in the judge's legal considerations. For reasons of mitigation, the judge handed down a lighter sentence to the defendant. The verdict, which carries a lighter sentence, is given by the panel of judges by including the reasons for mitigation in the legal considerations so that the Ratio Decidendi is created, and the decision can be justified. Article 95 of the Juvenile Criminal Justice System Law states that judges who make mistakes in deciding cases can receive punishment in the form of administrative sanctions in accordance with statutory provisions. In practice, in the Supreme Court's cassation decision Number 3287 K/Pid.Sus/2019, the panel of judges gave a lighter sentence decision than the public prosecutor demanded but did not explain the reasons for mitigation in their legal considerations, on the contrary what was explained was the reasons for aggravation, even though this is required in Law on Judicial Power to judges. Thus, the decision is contrary to the law, materially flawed and cannot be held accountable by the panel of judges because it does not present the Ratio Decidendi which is the mandate of Article 8 paragraph (2) of the Judicial Power Law that in considering the severity and severity of the crime, the judge must be obliged to clearly see the nature of the crime. good and bad of a defendant.

Abstract

Improving the effectiveness of Bhabinkamtibmas in handling motorcycle theft in the jurisdiction of West Jakarta Police Resort requires a holistic approach and synergy among the police, the community, and other relevant stakeholders. By implementing the above strategies, it is hoped that a safer environment can be created, free from motorcycle theft crimes. The research methodology employed in this study is descriptive analysis, which depicts the symptoms and facts observed by the author in the field related to the existing issues. The research findings indicate that efforts to enhance the effectiveness of Bhabinkamtibmas in addressing motorcycle theft in the jurisdiction of West Jakarta Police Resort involve several strategic steps. These include enhancing the skills of Bhabinkamtibmas, strengthening collaboration with local communities, utilizing information technology, conducting regular patrols, providing education to the community, empowering the human resources of Bhabinkamtibmas, and evaluating performance. With this holistic approach, it is expected to create a safer environment and reduce cases of motorcycle theft in the area.

Abstract

Sexual violence reported in print and online media has both negative and positive impacts on victims of sexual violence. The identity of child victims must be kept confidential from the public. A child's identity that is not kept confidential can have a negative impact on child victims, especially child victims of sexual violence. The name of the Child Victim, which should be kept confidential, can be found in the Court Decision which can be accessed on the Supreme Court Directory Website (putusan3.mahkamahagung.go.id). The decision mentions details about the incident of sexual violence that is directly related to the Child Victim of sexual violence. For violation of this prohibition, the perpetrator should be subject to punishment according to applicable regulations.

Abstract

Considering Indonesia is a nation of laws, as stated in Article 1 paragraph (3) of the Constitution of 1945, the rule of law, not man, should govern the state. But when we examine this issue, we find that an authority figure who is meant to lead by example and safeguard the public is still negligent and has an insufficient comprehension of the law. A senior police officer can nevertheless be included in the "Whoever" part of Article 340 of the Criminal Code when it comes to organized murder proceedings because he acknowledges that the person being assaulted is a human being with legal status. This paper aims to examine the legal importance of prohibiting high-ranking police personnel from committing intentional murder as a type of official crime. This paper applies a normative legal research methodology that involves a statutory approach and a literature review. After the data is gathered, it is processed and given a descriptive explanation to allow for a factual explanation of the correlation between the data. The outcomes of the research lead to the conclusion that office crimes are covered by Article 52 of the Criminal Code and that offenders who hold senior police positions may face sanctions to discourage their actions and punish them for their accountability.

Abstract

Sebagai sebuah negara hukum, maka segala kegiatan yang terjadi di dalam negara harus dapat dilakukan dengan berlandaskan kepada hukum yang berlaku. Namun, dalam hal ini tidak menutup kemungkinan terhadinya pelanggaran hukum yang disebut juga dengan pelanggaran pidana. Salah satu pelanggaran hukum yang tidak sedikit terjadi adalah tindak pidana pembunuhan sebagaimana diatur dalam Pasal 338 Kitab Undang-Undang Hukum Pidana (KUHP). Pada kasus ini, kerap kali terjadi individu korban yang dijadikan sasaran oleh pelaku akan melakukan perlawanan balik sebagai bentuk perlindungan diri karena merasa terancam, sehingga individu yang seharusnya menjadi seorang Korban dapat terancam dengan melakukan perlawanan balik sebagai bentuk perlindungan diri. Adapun, metode yang digunakan di dalam penulisan ini adalah metode penelitian hukum normatif dengan sumber yang diperoleh oleh studi kepustakaan dengan menggunakan pendekatan perundang-undangan (statue approach) melalui data sekunder yang nantinya dianalisis secara deduktif. Apabila seluruh data tersebut telah terkumpul akan dijelaskan secara deskriptif agar dapat menjelaskan hal terkait secara sistematis di dalam penulisan. Muara dari penulisan ini adalah pentingnya pembuktian pembelaan terpaksa yang harus dilakukan di muka pengadilan sebagai pertimbangan bagi hakim untuk melakukan penalaran sebelum memberikan putusan atas tindak pidana yang terjadi. Di mana dalam hal ini hakim harus dapat memberikan keputusan dengan melakukan legal reasoning.

Abstract

A criminal act is something committed by an individual who deliberately violates the provisions of the Criminal Code Book II Chapter XIX (Articles 338 to Article 350) due to the loss of someone's life. One example of this case is the murder incident in Decision Number 1/Pid.Sus-Anak/2020/PN KPN. In this case, there was a child who murdered the victim with the motive of self-defense, because the victim asked for the perpetrator's belongings and had sex with the witness. The perpetrator was subject to a sentence based on Article 351 paragraph (3) of the Criminal Code regarding abuse resulting in death by the Panel of Judges. However, this caused a polemic because the perpetrator committed the murder by stabbing a knife into the victim's vital organs in the chest. The author uses a normative juridical approach to examine the judge's views regarding the fulfillment of the element of intent (opzet) in the crime of murder using secondary data obtained through literature study. Based on the research results, the judge's consideration of the use of Article 351 paragraph (3) of the Criminal Code in this decision was considered inappropriate because the judge simply did not review the jurisprudence, the opzet element in this incident, and only relied on the Criminal Code and subjective reasoning. In criminal law, it is important to consider the element of intent or opzet, even though the consequences are the same, namely the loss of the victim's life, the element of intent in each article is different. Article 338 of the Criminal Code requires the victim to lose their life, while Article 351 paragraph (3) of the Criminal Code only wants the victim to feel pain without wanting the victim to die.

Abstract

Enforcing legal certainty in criminal acts of serious abuse is an important aspect of a just justice system. This study analyzes the application of the elements "whoever" and "commits serious maltreatment" in the crime of serious maltreatment and their relevance to legal certainty in law enforcement. Clear provisions regarding actions that are considered serious abuse and who is responsible for these actions are the main key. With this clarity, justice can be better served because all parties are subject to the same laws. Apart from that, applying appropriate punishment is also a means of providing justice to victims and society as a whole. The research results show that the application of these two elements is in accordance with the principles of justice and legal certainty. Thus, legal certainty in enforcing criminal acts of serious ill-treatment is an important basis for creating a just and civilized society. Through normative juridical analysis research methods, and supported by the fact that clarity in the law provides certainty for society and upholds justice. So enforcing legal certainty in criminal acts of serious abuse is a crucial step in maintaining justice and public order. By understanding and applying the principles of legal certainty, the justice system can function effectively to protect individual rights and provide justice to all parties involved.

Abstract

The rehabilitation system for narcotics abusers is implemented in correctional institutions, based on the provisions of Law of the Republic of Indonesia Law Number 35 of 2009 concerning Narcotics serves as the legal basis for the prevention and combating of drug abuse in Indonesia. Despite the government's vigorous efforts through the National Narcotics Agency (BNN) This research aims to understand and analyze optimization in rehabilitation, the factors that cause rehabilitation to fail for addicts and victims of narcotics abuse. as well as to understand and analyze the efforts made so that rehabilitation of addicts and victims of narcotics abuse can be carried out to address this issue, drug abuse is estimated to affect 3.8 to 4.1 million people. This research adopts a field research approach with a socio-legal juridical perspective. In the context of overcrowding, the study highlights its impact on rehabilitation programs and emphasizes the importance of a holistic approach. In-depth analysis indicates that limited prisoner access to adequate services can hinder the effectiveness of rehabilitation programs. The integration of criminal law policy theory, prisonization theory, and rehabilitation theory becomes crucial in designing holistic and targeted solutions. Based on the research analysis, it can be concluded that overcrowding creates pressure on human resources, impedes rehabilitation programs, and potentially harms the well-being of prisoners. A profound understanding of criminal law policy theories, including prevention, punishment, rehabilitation, deterrence, utilitarianism, and restorative justice, forms the foundation for formulating policies that guide prisoners not only toward punishment but also towards recovery and social reintegration.

Abstract

This study aims to analyze the fulfillment of the planned elements in Article 340 of the Criminal Code against the Tanjung Karang High Court Decision Number 145 / Pid / 2020 / Pt Tjk. Where the Judge in deciding this case explained that the planned element was not fulfilled on the grounds that the actions committed by the defendant were spontaneous. The research method used is: normative juridical legal research conducted with literature studies or secondary data as a basis for researching by conducting searches of regulations and literature related to the problem under study. The data collected is then processed and explained descriptively so that the relationship of data with one another can be described factually. The results of the study showed: that in the Tanjung Karang High Court Decision Number 145 / Pid / 2020 / PT Tjk, the judge decided the defendant Edi Antoni alias Edi Recing bin Kemis using Article 338 of the Criminal Code, which was previously the defendant through Kalianda District Court Decision Number 209 / Pid.B / 2020 / PN Kla the defendant received a verdict for participating in murder. In the appeal process at the Tanjung karang High Court, the defendant can be convicted using Article 340 of the Criminal Code concerning Premeditated Murder because of the fulfillment of the premeditated element in Article 340 of the Criminal Code, it can be proven by the defendant admitting he was conscious when committing his act and wanted the death of the victim and the defendant could not prove the origin of the knife used to commit the murder.
