Abstract

The purpose of writing this article is to identify, study, map research related to CSR in reducing agency conflict. This article begins with the presentation of the concepts of Good Corporate Governance (GCG), Corporate Social Responsibility (CSR), CSR in GCG, and agency conflict. Identification is made by collecting articles in the field of financial management that are related to CSR, agency conflict, and corporate value. Furthermore, an assessment of these studies is carried out to determine the results of each article. Articles are grouped into two articles that support the existence of agency conflict in CSR and group that do not have agency conflict. The method of review of CSR and agency conflict is carried out using previous studies. The identification, assessment and mapping of prior studies are not limited to new studies (less than ten years) but also reviews of more than 20 years. Based on the results of previous research, mapping can be synthesized the influence of CSR in reducing agency conflict. The Implementation of CSR related to agency conflict in the field of financial management is still being debated. Based on empirical evidence, the results are still inconsistent. CSR activities that synergize financial performance, the environment, and society can reduce the use of cash flow that benefits managers so that it will increase the value of the company. On the other hand, empirical evidence that does not support CSR considers that managers use CSR for personal gain.

Abstract

Dalam era pendidikan modern, kemampuan berpikir kritis menjadi kompetensi yang sangat penting untuk disiapkan pada siswa sekolah dasar. Tujuan penelitian ini adalah menganalisis penerapan konsep filsafat pendidikan sebagai strategi untuk meningkatkan kemampuan berpikir kritis siswa. Metode yang digunakan adalah studi literatur dengan pendekatan interaktif seperti pembelajaran berbasis proyek dan diskusi kelompok, yang mendorong partisipasi aktif siswa dalam proses belajar. Hasil penelitian menunjukkan bahwa penerapan filsafat pendidikan secara efektif meningkatkan kemampuan analisis dan evaluasi siswa, serta membantu mereka dalam mempersiapkan tantangan di masa depan. Kesimpulannya, kolaborasi antara guru, orang tua, dan masyarakat sangat penting dalam menciptakan lingkungan belajar yang mendukung pengembangan kemampuan berpikir kritis di sekolah dasar.

Abstract

This community service program is in the form of education at SD Negeri 01 Rantau Alai, Kilip Pulau Sila Village, Rantau Alai District, Ogan Ilir Regency, South Sumatra. Learning is a special aspect of education that includes the cognitive, affective, and psychomotor domains. This research is more focused on the learning process of Class VI students, totaling 11 people, by using the demonstration learning method in the learning process. This research aims to increase student activity in the classroom, make it easier for students to understand the material being studied, and make learning more effective and efficient. The results of the research obtained by the researcher are that first, students become active during the learning process, second, students become easier to understand the material being studied by the learning objectives, and third, learning becomes more effective and efficient.

Abstract

Penelitian ini mengkaji perlindungan hukum terhadap korban Non-Consensual Intimate Images (NCII) sebagai bentuk kekerasan berbasis gender online di Samarinda. Kasus NCII sering terjadi di sekitar kita, tetapi kenyatannya hanya ada tiga pelaporan di Polresta Samarinda dan dua pelaporan UPTD PPA Samarinda periode 2022-2024. Penelitian ini menggunakan pendekatan socio-legal dengan mengkaji data pelaporan di Samarinda, tujuan penelitian ini untuk menganalisis antara peraturan yang berlaku dengan implementasinya, dan mengidentifikasi faktor-faktor yang memengaruhi penegakan hukum pidana. Hasil penelitian menunjukkan bahwa implementasi peraturan terkait NCII belum optimal, dipengaruhi oleh belum adanya nomenklatur NCII dalam peraturan yang berlaku saat ini, pemahaman yang terbatas di kalangan aparat penegak hukum dan masyarakat, serta stigma sosial dan ketakutan korban untuk melapor. Selain itu, penegakan hukum pidana terhadap kasus NCII dipengaruhi oleh faktor internal dan eksternal.

Abstract

Perlindungan Hukum di Indonesia menganut asas keadilan dan kepastian hukum bagi seluruh warga negara, termasuk mereka yang secara tidak sengaja terlibat dalam jaringan kriminal. Penelitian ini mengkaji pertanggungjawaban pidana dan perlindungan hukum yang diberikan kepada individu yang menerima paket narkotika secara tidak sengaja, melalui studi kasus putusan nomor 890/pid.sus/2023/PN Sby. Kasus ini melibatkan seorang perempuan, Asfiyatun yang menerima paket berisi 17 Kilogram ganja tanpa sepengetahuannya. Meskipun tidak memiliki mens rea (niat), ia dihukum berdasarkan pasal 111 ayat (2) Undang-Undang No. 35 Tahun 2009. Penelitian ini mengadopsi metode Doctrinal Legal Search dengan menganalisis ketentuan perundang-undangan, doktrin hukum, dan penalaran hukum. Temuan menunjukkan adanya ketidaksesuaian antara perbuatan terdakwa dengan unsur hukum yang dibuktikan di pengadilan, khususnya dalam menafsirkan “kepemilikan” dan “penguasaan”. Penelitian ini berpendapat bahwa hakim harus mempertimbangkan asas kesengajaan dan memberikan perlindungan hukum bagi keterlibatan yang tidak disengaja dalam peredaran narkotika.

Abstract

This study examines law enforcement efforts against gambling offenses occurring during seasonal running races in Kutai Kartanegara Regency, particularly during the month of Ramadan. This phenomenon is often used by the community as a means of gambling, even though it is presented as a recreational and sporting event. The study employs a socio-legal method with a qualitative approach. The results show that although legal provisions clearly prohibit gambling under Article 303 of the Criminal Code and Article 15 of the Police Law, implementation remains suboptimal. The police do not possess official data on gambling in these events, despite empirical evidence from local communities. The main obstacles include a lack of public reports, weak field supervision, and limited proactive measures by law enforcement officers. The study emphasizes the need for improved coordination, consistent monitoring, and preventive legal education to enhance the effectiveness of law enforcement.

Abstract

Article 20 of the Personal Data Protection Law (PDP Law) normatively regulates the protection of data subjects and constitutes a pivotal provision that underscores the principle of consent as the legal basis for the processing of personal data for commercial purposes. This normative framework safeguards individuals’ right to privacy, encompassing the validity of explicit consent, the right to withdraw such consent, and the accountability of data controllers. In parallel, Articles 65 to 70 of the PDP Law substantively establish various categories of criminal offenses within the context of personal data protection. These include the unlawful acquisition, disclosure, processing, falsification, and utilization of personal data. Collectively, these provisions reflect the State’s commitment to ensuring criminal legal protection against violations of personal data.This research adopts a doctrinal legal methodology with a descriptive-normative approach to address two primary issues: First, to examine and identify the scope of legal protection concerning the trade of personal data under the PDP Law; and Second, to assess and determine the degree of legal certainty afforded to the trade of personal data within the framework of the PDP Law.Notwithstanding the protective intent embodied in Article 20—particularly concerning the commercial use of personal data—this provision gives rise to legal uncertainty due to the absence of comprehensive regulatory clarity on several critical aspects. Similarly, Articles 65 to 70 continue to exhibit significant legal ambiguities, particularly with respect to the constituent elements of offenses, the definition of harm, corporate liability, regulatory overlap with other legislative instruments, and the lack of clear enforcement mechanisms and implementing institutions.

Abstract

This study aims to analyze and compare the implementation of diversion as a mechanism for resolving juvenile criminal cases within the juvenile justice systems of Indonesia and Singapore. The research employs a doctrinal method using a statutory approach combined with a comparative approach. The analysis focuses on differences in regulatory frameworks, implementation mechanisms, and the roles of law enforcement authorities in applying diversion in both countries. The findings reveal that although Indonesia and Singapore both recognize diversion as an alternative to formal criminal proceedings for children, significant differences exist in terms of normative regulation, procedural implementation, and institutional support. Singapore demonstrates a more integrated diversion model, supported by strong institutional infrastructure, while Indonesia continues to face challenges related to coordination, consistency in application, and the effective realization of child protection objectives. This study concludes that Singapore’s diversion practices offer valuable insights for strengthening and reforming diversion policies in Indonesia, particularly to enhance their effectiveness, align them with the best interests of the child, and reinforce the principles of restorative justice.Keywords: Diversion; Juvenile Justice System; Juvenile Criminal Cases; Comparative Study; Restorative Justice

Abstract

Article 20 of the Personal Data Protection Law (UU PDP) normatively regulates the protection of data subjects and constitutes a key provision emphasizing the principle of consent as the legal basis for the processing of personal data for commercial purposes. This norm safeguards individual privacy rights, including the validity of explicit consent, the right to withdraw consent, and the responsibility of data controllers. Furthermore, Articles 65–70 of the UU PDP substantively regulate various forms of criminal violations in the context of personal data protection, including the acquisition, disclosure, processing, falsification, and illegal use of personal data, demonstrating the state’s commitment to providing criminal law protection against personal data breaches. This study employs doctrinal legal research with a descriptive-normative approach to address two main issues. First, it aims to examine and identify the legal protection of personal data trading under the UU PDP. Second, it seeks to analyze and identify the legal certainty of personal data trading as regulated by the UU PDP. Although Article 20 of the UU PDP is intended to provide strong protection against the commercial use of personal data, the provision still gives rise to legal uncertainty due to the lack of clear regulation of several crucial aspects. Similarly, Articles 65–70 contain significant legal uncertainties, particularly with regard to the elements of criminal offenses, forms of harm, corporate criminal liability, overlap with other regulations, and the absence of clear enforcement mechanisms and implementing institutions.

Abstract

This study aims to apply the Deep Learning approach in science subjects to foster students' healthy attitudes towards the gift of hearing through in-depth scientific understanding and the reinforcement of Islamic spiritual values. This study uses a field study method with a quantitative approach. The research subjects consisted of 120 fifth-grade students at SDN 050 Cibiru. Data were collected through observation, interviews, and tests of concept understanding and healthy lifestyle attitudes. Data analysis was conducted by comparing the pre-test and post-test results using descriptive statistical tests. The results showed that the application of Deep Learning in science education significantly improved students' conceptual understanding of the human auditory system. In addition, there was an increase in healthy lifestyle attitudes, such as awareness of maintaining ear hygiene and avoiding the habit of listening to loud sounds. Students also demonstrated an understanding of spiritual values related to gratitude and responsibility for the gift of hearing. The application of Deep Learning in science learning is effective in fostering healthy lifestyles based on Islamic values. The integration of technology, innovative learning strategies, and spiritual values can strengthen character education in elementary schools. This article makes an important contribution to the development of learning strategies that synergize science and faith in the elementary education environment.
