Abstract

This study examines law enforcement efforts against gambling offenses occurring during seasonal running races in Kutai Kartanegara Regency, particularly during the month of Ramadan. This phenomenon is often used by the community as a means of gambling, even though it is presented as a recreational and sporting event. The study employs a socio-legal method with a qualitative approach. The results show that although legal provisions clearly prohibit gambling under Article 303 of the Criminal Code and Article 15 of the Police Law, implementation remains suboptimal. The police do not possess official data on gambling in these events, despite empirical evidence from local communities. The main obstacles include a lack of public reports, weak field supervision, and limited proactive measures by law enforcement officers. The study emphasizes the need for improved coordination, consistent monitoring, and preventive legal education to enhance the effectiveness of law enforcement.

Abstract

Article 20 of the Personal Data Protection Law (PDP Law) normatively regulates the protection of data subjects and constitutes a pivotal provision that underscores the principle of consent as the legal basis for the processing of personal data for commercial purposes. This normative framework safeguards individuals’ right to privacy, encompassing the validity of explicit consent, the right to withdraw such consent, and the accountability of data controllers. In parallel, Articles 65 to 70 of the PDP Law substantively establish various categories of criminal offenses within the context of personal data protection. These include the unlawful acquisition, disclosure, processing, falsification, and utilization of personal data. Collectively, these provisions reflect the State’s commitment to ensuring criminal legal protection against violations of personal data.This research adopts a doctrinal legal methodology with a descriptive-normative approach to address two primary issues: First, to examine and identify the scope of legal protection concerning the trade of personal data under the PDP Law; and Second, to assess and determine the degree of legal certainty afforded to the trade of personal data within the framework of the PDP Law.Notwithstanding the protective intent embodied in Article 20—particularly concerning the commercial use of personal data—this provision gives rise to legal uncertainty due to the absence of comprehensive regulatory clarity on several critical aspects. Similarly, Articles 65 to 70 continue to exhibit significant legal ambiguities, particularly with respect to the constituent elements of offenses, the definition of harm, corporate liability, regulatory overlap with other legislative instruments, and the lack of clear enforcement mechanisms and implementing institutions.

Abstract

This study aims to analyze and compare the implementation of diversion as a mechanism for resolving juvenile criminal cases within the juvenile justice systems of Indonesia and Singapore. The research employs a doctrinal method using a statutory approach combined with a comparative approach. The analysis focuses on differences in regulatory frameworks, implementation mechanisms, and the roles of law enforcement authorities in applying diversion in both countries. The findings reveal that although Indonesia and Singapore both recognize diversion as an alternative to formal criminal proceedings for children, significant differences exist in terms of normative regulation, procedural implementation, and institutional support. Singapore demonstrates a more integrated diversion model, supported by strong institutional infrastructure, while Indonesia continues to face challenges related to coordination, consistency in application, and the effective realization of child protection objectives. This study concludes that Singapore’s diversion practices offer valuable insights for strengthening and reforming diversion policies in Indonesia, particularly to enhance their effectiveness, align them with the best interests of the child, and reinforce the principles of restorative justice.Keywords: Diversion; Juvenile Justice System; Juvenile Criminal Cases; Comparative Study; Restorative Justice

Abstract

This norm safeguards individual privacy rights, including the validity of explicit consent, the right to withdraw consent, and the responsibility of data controllers. Furthermore, Articles 65–70 of the UU PDP substantively regulate various forms of criminal violations in the context of personal data protection, including the acquisition, disclosure, processing, falsification, and illegal use of personal data, demonstrating the state’s commitment to providing criminal law protection against personal data breaches. This study employs doctrinal legal research with a descriptive-normative approach to address two main issues. First, it aims to examine and identify the legal protection of personal data trading under the UU PDP. Second, it seeks to analyze and identify the legal certainty of personal data trading as regulated by the UU PDP. Although Article 20 of the UU PDP is intended to provide strong protection against the commercial use of personal data, the provision still gives rise to legal uncertainty due to the lack of clear regulation of several crucial aspects. Similarly, Articles 65–70 contain significant legal uncertainties, particularly with regard to the elements of criminal offenses, forms of harm, corporate criminal liability, overlap with other regulations, and the absence of clear enforcement mechanisms and implementing institutions.

Abstract

This study aims to apply the Deep Learning approach in science subjects to foster students' healthy attitudes towards the gift of hearing through in-depth scientific understanding and the reinforcement of Islamic spiritual values. This study uses a field study method with a quantitative approach. The research subjects consisted of 120 fifth-grade students at SDN 050 Cibiru. Data were collected through observation, interviews, and tests of concept understanding and healthy lifestyle attitudes. Data analysis was conducted by comparing the pre-test and post-test results using descriptive statistical tests. The results showed that the application of Deep Learning in science education significantly improved students' conceptual understanding of the human auditory system. In addition, there was an increase in healthy lifestyle attitudes, such as awareness of maintaining ear hygiene and avoiding the habit of listening to loud sounds. Students also demonstrated an understanding of spiritual values related to gratitude and responsibility for the gift of hearing. The application of Deep Learning in science learning is effective in fostering healthy lifestyles based on Islamic values. The integration of technology, innovative learning strategies, and spiritual values can strengthen character education in elementary schools. This article makes an important contribution to the development of learning strategies that synergize science and faith in the elementary education environment.

Abstract

Berdasarkan Undang-Undang Nomor 17 Tahun 2003 tentang Kesehatan, kosmetik termasuk dalam sediaan farmasi yang peredaranya harus memenuhi persyaratan standar dan mutu yang telah ditetapkan di Indonesia. Penelitian ini bertujuan untuk mengetahui seberapa efektif implementasi pengaturan hukum positif yang berlaku dalam mengendalikan peredaran kosmetik berbahaya dan untuk mengetahui bagaimana proses penegakan hukum peredaran kosmetik berbahaya khususnya di Kota Samarinda agar mengetahui apakah terdapat kendala dalam proses penegakan hukum tersebut. dengan menggunakan pendekatan penelitian Socio-Legal Research. Hasil penelitian diperoleh melalui wawancara dan permintaan data kosmetik dengan Instansi terkait seperti BPOM, Dinas Kesehatan, Kepolisian, Kejaksaan, Hakim. Serta dengan melakukan observasi ke toko-toko kosmetik di 10 (sepuluh) Kecamatan Kota Samarinda. Secara keseluruhan efektivitas implementasi hukum dalam mengendalikan peredaran kosmetik berbahaya di Kota Samarinda tidak efektif secara keseluruhan. Dalam proses  Penegakan hukum lembaga-lembaga menjalankan perannya dengan aktif, Namun terkendala kurangnya Sumber Daya Manusia (SDM), Uji Laboratorium. Mengakibatkan kosmetik berbahaya masih marak beredar di Kota Samarinda. Penelitian ini menekankan perlunya memperkuat koordinasi antar instansi seperti Dinas Kesehatan dan BPOM untuk meningkatkan pengawasan terhadap peredaran kosmetik berbahaya, optimalisasi laboratorium agar efisien, melakukan sosialisasi rutin bahaya kosmetik ke masyarakat dan pelaku usaha, tingkatkan literasi masyarakat terkait komposisi atau bahan pada kosmetik, dan kesadaran akan kesehatan masyarakat.

Abstract

Permohonan dispensasi kawin pada Pengadilan Agama Samarinda Kelas 1-A mencapai 951 permohonan selama 5 tahun terakhir merupakan satu isu hukum yang berpotensi menimbulkan dampak buruk. Karena itu, peneliti tertarik untuk melakukan penelitian yang berfokus dampak hukum yang buruk dari permohonan dispensasi kawin pada Pengadilan Agama Samarinda. Hasil penelitian menunjukkan bahwa dikabulkannya permohonan dispensasi kawin Pengadilan Agama Samarinda Kelas 1-A karena hampir 90% permohonan dispensasi kawin yang masuk disebabkan oleh pergaulan bebas. Hal ini dijadikan alasan mendesak sebab Hakim berpendapat bahwa jika permohonan tersebut tidak dikabulkan, maka dampak buruk yang timbul akan lebih besar. Terdapat empat alasan masuknya permohonan dispensasi kawin, yakni sebesar 60% permohonan diajukan karena pihak perempuan sudah dalam keadaan hamil, sebesar 40% permohonan diajukan karena kekhawatiran orang tua (pemohon) terhadap anaknya yang melanggar aturan syariat agama Islam, menjaga nama baik keluarga dan perjodohan dari orang tua. Pencegahan oleh Pengadilan Agama Samarinda Kelas 1-A supaya dampak buruk permohonan dispensasi kawin tidak terjadi ialah dengan melakukan kompleksitas persyaratan administrasi pengajuan permohonan dispensasi kawin dengan menambahkan dua dokumen tambahan, yakni Surat Rekomendasi dari Dinas Pemberdayaan Perempuan dan Perlindungan Anak (DP2PA) Kota Samarinda dan Surat Keterangan Sehat dari Fasilitas Kesehatan Milik Pemerintah supaya hanya pasangan yang memiliki kesiapan ekonomi, kesehatan dan sosial yang dapat melangsungkan perkawinan.

Abstract

Elementary education plays a strategic role in shaping students' character and integrity. One important effort in this regard is the integration of anti-corruption values into the learning process, including mathematics learning. This study aims to describe the forms and strategies for integrating anti-corruption values into mathematics learning at the elementary school level. Using a qualitative descriptive approach through literature analysis and classroom-based contextual practice, this study identifies mathematics learning as an effective medium for fostering honesty, responsibility, and transparency among students. The research findings indicate that mathematics learning thatemphasizes logical reasoning, transparent group work, and problem-solving in a social context can foster anti-corruption awareness from an early age. The implementation of projects such as “classroom financial transparency” and integrity-based assessments encourage students to develop habits of honesty and fairness. Therefore, the integration of anti-corruption values into mathematics education not only improves students' numeracy skills but also contributes to building an integrity-based culture as the foundation of national character.

Abstract

This research aims to analyze criminal acts that may be qualified as perpetrators of the crime of obstruction of justice from the perspective of the criminal law applicable in Indonesia, as well as to analyze the application of the law against perpetrators of obstruction of justice in Indonesia. The type of research used in this thesis is doctrinal research. The doctrinal approach has a normative character; therefore, its object of study consists of a set of legal norms (black letter law) at the level of application (professional constituency), or, at certain levels of analysis, this approach extends to the examination of legal theory. Based on the results of the research, the author finds that the provisions governing acts that may be qualified as the crime of obstruction of justice in Indonesia encompass all forms of interference, from the beginning to the end, with the entire ongoing legal and judicial process. A perpetrator of obstruction of justice is aware that a person has committed a crime or is undergoing a legal process and then deliberately commits acts that may hinder or obstruct law enforcement officials in conducting examinations of the criminal offender, with the purpose that the processes of investigation, prosecution, or examination before the court are impeded, cannot be carried out, or ultimately fail to be carried out. The forms of legal enforcement against perpetrators of acts obstructing the judicial process (obstruction of justice) in Indonesia include, among others, intentionally damaging, concealing, or destroying evidence before or after the commencement of the investigation process.

Abstract

Meningkatnya pemberitaan mengenai kasus perundungan di lingkungan pesantren mengungkap kenyataan bahwa praktik tersebut sesungguhnya kerap terjadi, namun sering luput dari perhatian hukum maupun media. Berangkat dari pengalaman pribadi peneliti sebagai salah satu korban perundungan di pesantren, kondisi tersebut mendorong peneliti untuk menelaah lebih jauh fenomena ini sebagai dasar pemilihan topik penelitian. Oleh karena itu, penelitian ini difokuskan pada pengungkapan faktor-faktor penyebab terjadinya perundungan serta upaya perlindungan yang seharusnya diberikan kepada korban. Penelitian ini menggunakan pendekatan sosio-legal dengan metode kualitatif deskriptif. Data primer diperoleh melalui wawancara menggunakan teknik purposive sampling yakni dengan pihak pesantren, santri, serta lembaga seperti LPKA Kelas II dan PPA Kota Samarinda. Data sekunder berasal dari studi literatur dan regulasi terkait, seperti KUHP dan Undang-Undang Nomor 35 Tahun 2014 tentang Perlindungan Anak. Analisis dilakukan dengan mengaitkan temuan lapangan dengan teori kriminologi dan viktimologi untuk mengungkap pola penyebab dan dampak dari tindak perundungan terhadap santri putra. Hasil penelitian menunjukkan bahwa perundungan di Pondok Pesantren Nabil Husein Samarinda dipengaruhi oleh faktor struktural, kultural, dan kelembagaan, seperti budaya senioritas berlebihan, lemahnya pengawasan, serta budaya diam yang menghambat pelaporan. Meskipun secara normatif perlindungan hukum terhadap korban telah diatur, implementasinya di lingkungan pesantren belum optimal, baik dalam aspek pencegahan maupun penindakan. Namun demikian, meningkatnya kesadaran hukum dan komitmen pengelola pesantren menjadi langkah awal menuju terciptanya lingkungan pendidikan yang lebih aman dan berorientasi pada perlindungan hak anak.
