Abstract

Akad tabarru dalam bentuk memberikan sesuatu atau menjaminkan sesuatu adalah akad yang tujuannya untuk tolong menolong antar sesama. Akad tabarru ini bertujuan mencari keuntungan akhirat, bukan untuk keperluan komersil seperti akad tijarah. Akan tetapi dalam perkembangannya akad ini sering berkaitan dengan kegiatan transaksi komersil, karena akad tabarru ini bisa berfungsi sebagai perantara yang menjembatani dan memperlancar akad tijarah, sehingga terjadi banyak perbedaan persepsi tentang akad tabarru yang di komersilkan. Tujuan dari penelitian ini adalah untuk memaparkan konsep akad tabarru dalam bentuk menjaminkan diri dan memberikan sesuatu. Jenis penelitian ini adalah penelitian kepustakaan, penelitian ini menggunakan pendekatan kualitatif dengan metode deskriptif, Teknik pengumpulan data dalam penelitian ini adalah dengan dokumentasi, yaitu mencari data mengenai hal-hal atau variabel yang berhubungan dengan akad tabarru dari sumber buku, artikel, jurnal dan laporan penelitian, dan teknik analisis data menggunakan metode analisis data. Hasil penelitian menunjukkan bahwa akad tabarru dalam hal menjaminkan diri dalam praktik kafalah dan wakalah telah tumbuh berkembang di Indonesia, perlu adanya kehati-hatian dalam melakukan akad kafalah mengenai rukun dan syaratnya, karena praktik kafalah kontemporer sudah berkembang pesat dengan berbagai bentuk dan jenisnya. Terkait akad tabarru dalam hal memberikan sesuatu dalam praktik hibah, hadiah, wakaf, zakat, infak dan shadaqah tidak ada perdebatan ulama mazhab akan ketidakbolehannya, yang dibutuhkan di Indonesia adalah kesadaran masyarakat untuk melakukannya. Implikasi dari penelitian ini adalah semua pihak diharapkan berhati-hati dalam melakukan akad tabarru, jangan sampai mengambil keuntungan dari akad tabarru yang tujuannya adalah untuk tolong menolong antar sesama.

Abstract

The institutional framework and sustainability of waqf in Indonesia hold immense potential for supporting the social and economic development of the Muslim community. However, despite its promise, the sector remains fragmented, and its utilization has not yet been optimized due to the lack of specific legal regulations governing stock waqf. This study analyzes the regulatory framework for stock waqf from the perspectives of institutionalization and sustainability in Indonesia. Employing a qualitative method through normative legal research using a conceptual approach, this study examines the reconstruction of stock waqf from the perspectives of institutionalization and sustainability in Indonesia. The research findings emphasize the need for legal reconstruction regarding the institutional framework and sustainability of stock waqf to integrate collaborative legal regulations among the Indonesia Stock Exchange, the Financial Services Authority, and the Indonesian Waqf Board, as well as to strengthen Islamic financial literacy. Collaborative legal regulation is not only necessary for operational effectiveness but also to integrate waqf into a modern economic framework, including the integration of digital governance systems and the strengthening of electronic nazhir certification systems without compromising their ethical foundations. Recommendations include strengthening specific legal regulations for stock waqf, fostering synergy between the government and religious authorities, and implementing collaborative legal integration among the Indonesia Stock Exchange, the Financial Services Authority, and the Indonesian Waqf Board. These findings contribute to the reconstruction of the endowment system from an institutional perspective and to the sustainability of endowments that are responsive to national socioeconomic needs and the needs of the endowment itself.

Abstract

When the court explicitly acknowledges a father's economic incapacity, child support obligations after divorce create acute legal tension. This article looks at a confusing situation in child support decisions after divorce, based on Decision Number 4501/Pdt.G/2024/PA.Jr. from the Jember Religious Court, Indonesia, where the court required a fixed child support payment even though the father had proven he couldn't afford it. The case highlights a bigger problem that courts face in areas with different laws and economic challenges: how to balance the need to protect children with the reality that some financial obligations may not be possible to enforce. This study uses a legal approach to analyse laws, court decisions, and important Islamic legal sources to assess whether the court's reasoning is fair. The findings reveal a structural inconsistency. Even though the court referenced child protection rules and traditional legal views that support parental responsibility, the maintenance order was too high for the father to afford, making it very difficult for him to follow. Through the evaluative lens of Maqāṣid al-Sharīʿah, the decision demonstrates a failure of proportional balancing: the protection of offspring (ḥifẓ al-nasl) was prioritised without adequate consideration of economic preservation and basic welfare (ḥifẓ al-māl and ḥifẓ al-nafs), both foundational objectives within Islamic legal thought. The article argues that this pattern in court decisions shows a common problem in family courts with limited resources, where the legal responsibilities are recognised more than they can actually be enforced. By placing a local decision within this ongoing issue, the study adds to worldwide discussions about fairness, the ability to enforce choices, and the power of judges in child support cases after divorce.
