Abstract

Business activities to establish a café require permission from Medan City government agencies. Licensing is one of the government tools as a legal tool used to control the behavior of its citizens, the permit is the approval of the authorities based on government laws or regulations, so it does not deviate from the provisions that prohibit the law. However, there are still many café business actors in Medan City who do not have licenses to carry out business activities. The focus of this research is how is the implementation of the implementation of the café establishment business license in the city of Medan?, what are the obstacles arising from the implementation of the application of a café establishment business license in the city of Medan? and how are sanctions applied to Kafes that do not have a café establishment business license in the city of Medan? The objectives of this study are to determine the implementation of the implementation of the café establishment business license in Medan City, to find out the obstacles arising from the implementation of the application of a café establishment business license in Medan City and to find out the application of sanctions against Kafes that do not have a café establishment business license in Medan City. The type of research used in the preparation of this research is a type of empirical normative legal research. This study used a data collection method which is an interview and literature research that is analyzed descriptively. The conclusion of the results of this study is business actors apply for NIB related first, NIB applications can be made through the OSS or SiCantik pages. Business actors must register business activities in TDUP. Business actors in obtaining NIB are required to register TDUP through informatics techniques made by the government in the form of a website, namely SiCantik which is made from the OSS system, with the aim of easing the burden of OSS applications so as to speed up and maximize the business activity permit process. However, there is a lack of knowledge of business actors in using electronic applications that have an online base so that business actors have difficulty in operating SiCantik. Based on Article 456 of Government Regulation No. 5 of 2021, every Business Actor who, based on the results of supervision, is found to have committed nonconformities or violations of Business Licensing in the tourism sector is subject to administrative sanctions in the form of warnings, Temporary suspension of business activities, administrative fines, and revocation of business licenses.

Abstract

This research contains a description of the ratification of extra-marital children as legal children. Recognition and ratification of extra-marital children often experience differences in their determination. The research method used by the author in writing this journal is normative legal research method, this legal research examines document studies using various secondary data, such as laws and regulations, court decisions, legal theories and opinions of scientists. Based on the results of the research, the Marriage Law does not regulate the recognition and validation of children, the Civil Code regulates recognition and validation while the Constitutional Court only focuses on the biological relationship between the child and the father. In the Determination of the Airmadidi District Court Number 175/Pdt.P/2021/PN Arm, the judge only looks at positive law without considering other aspects in the ratification of extra-marital children. This research is expected to contribute to the development of science, the author's achievement from this research is to produce scientific works in the form of theses, research journals, and as reference material for other writers in the future.

Abstract

The purpose of this examination is to determine the principle of legal remedies for the decision of the Business Competition Supervisory Commission (KPPU) through a follow-up examination based on the Law on Refusal Procedures. This research case study uses the principle of justice in legal efforts to challenge the KPPU's decision. The data analysis method used in this study is a normative legal analysis method that compares norms. The normative legal method is used to explain the data that defines the legal norms contained in the legislation. The results of the data analysis of this study indicate the neglect of the principle of justice in judicial efforts against the KPPU's decision. In carrying out the burden of proof, if the parties are unable to provide actual evidence, it can cause inconsistency, but if the judge determines that it is not clear, the KPPU will provide evidence through additional examination of the judge's order. added and integrated. As a result, the resistance applicant was unable to strengthen his defense because he could not provide new evidence that could acquit the applicant.

Abstract

The rule of Constitutional Court has eased on the essential interpretation inherent in the prevailing prenuptial agreement. The prenuptial agreement is understood no longer as the one drawn up prior to the marital process but thereafter as well, as long as it is not against the norms of religion, public order, morals, and third parties. Essentially, it is in accordance Act on Marriage and seemingly more comprehensive than the interpretation of marital agreement of inherence at civil law. The approach method used is a normative juridical approach, the research results obtained state that the implication that the marital agreement can be drawn up either after or before the nuptial execution. The nuptial agreement is compulsory to be legalized on the notarial deed before the execution. Abstract

The global climate crisis has driven countries, including Indonesia, to adopt sustainable financing mechanisms that channel capital into environmentally responsible projects. One prominent instrument is the green bond—debt securities issued by corporations or institutions to finance projects with measurable environmental benefits, such as renewable energy, sustainable transport, and climate change mitigation. In Indonesia, green bonds are regulated by the Financial Services Authority (OJK) through Regulation No. 60/POJK.04/2017, which sets administrative requirements for issuance. While this framework marks an important step, it remains inadequate to guarantee strong investor protection. Current provisions do not establish clear enforcement mechanisms or effective sanctions against fund misallocation or project deviation, leaving investors vulnerable to risks such as greenwashing. The absence of mandatory third-party verification and the lack of supporting jurisprudence further undermine transparency, accountability, and the legal standing of investors. This research analyzes the extent of legal protection for investors in Indonesian corporate green bond issuances and evaluates the adequacy of existing regulations. It also proposes reforms—such as mandatory independent verification, explicit liability provisions, and the integration of national standards—to enhance safeguards for investors and strengthen market credibility. In the context of global momentum toward ESG-based investment and Indonesia’s commitments under the Paris Agreement and the Sustainable Development Goals (SDGs), establishing a more comprehensive and enforceable legal framework is essential. Such a framework would not only ensure genuine environmental impact but also build investor confidence in Indonesia’s growing green finance market.

Abstract

Penelitian ini menganalisis penerapan prinsip Good Corporate Governance (GCG) di PT Bank KB Bukopin Syariah tahun 2022. Penelitian ini bertujuan untuk menganalisis sejauh mana implementasi GCG di PT Bank KB Bukopin Syariah pada tahun 2022, mengidentifikasi kelemahan dalam penerapan prinsip-prinsip GCG, serta mengkaji dampaknya terhadap risiko hukum dan operasional. Berdasarkan analisis hukum normatif, penerapan GCG berada pada kategori "cukup baik" (peringkat komposit 3), tetapi terdapat kelemahan signifikan, seperti kurangnya transparansi, belum selesainya sertifikasi fit and proper test, serta rangkap jabatan di Dewan Pengawas Syariah. Penelitian merekomendasikan penguatan transparansi, penyelesaian sertifikasi fit and proper test, pembatasan rangkap jabatan, dan percepatan penyelesaian sengketa hukum melalui mediasi dan arbitrase.

Abstract

This case involves a land sale and purchase agreement dispute between the buyer and seller. The buyer (Plaintiff) claims that the seller did not deliver the land certificate as promised in the agreement, then the seller (Defendant) submits an argument that the delivery of the certificate was delayed due to administrative problems which were not his responsibility. The Supreme Court considered that in a sale and purchase agreement, both parties have an obligation to fulfill the agreed provisions. Default occurs if one party does not fulfill its obligations without a valid reason. Therefore, the Supreme Court decided that the seller had committed a breach of contract because he did not hand over the land certificate in accordance with the agreement. As a result, the Supreme Court upheld the decision of the court of first instance which ordered the seller to immediately hand over the land certificate to the buyer and pay the fine as stipulated in the agreement. This decision emphasizes the importance of fulfilling obligations in the land sale and purchase agreement and providing legal protection to parties who suffer losses due to default.

Abstract

The urgency of the issue of environmental pollution caused by the mining industry in Indonesia is increasing, especially with the rise of mining activities that do not pay attention to sustainability aspects. The case of PT Gema Kreasi Perdana (GKP) on Wawonii Island, Southeast Sulawesi, is a concrete example of how mining activities can have significant ecological, social and legal impacts. This research aims to analyze the form of corporate legal liability for environmental pollution based on Law Number 32 of 2009 concerning Environmental Protection and Management (UU PPLH). This research uses descriptive qualitative method with normative juridical approach and case study. The results show that PT GKP can be subject to legal liability based on the principle of strict liability without the need to prove the element of fault. The company was also proven to have violated licensing regulations and community rights, which had a direct impact on the environment and community welfare. The conclusion of this study indicates that enforcement of environmental legal liability must be supported by a strong regulatory system and strict supervision. This study recommends periodic evaluation of mining licenses and ecological restoration as absolute requirements for the sustainability of the mining industry in Indonesia.

Abstract

The implementation of the Legal Aid Post (Posbakum) by the District Court includes 3(three) scopes of legal services by the provisions contained in Perma No. 1 of 2014. The three scopes are fee waiver services, and holding hearings outside the court building, and providing Court Posbakum. In connection with the implementation of this Posbakum, the District Court only provides room facilities to Posbakum for three accredited legal aid institutions or advocate organizations. The handling of legal aid funds for each case will be submitted by the Court through the Local Office of the Ministry of Law and Human Rights. However, this does not mean that the function of the facilitator can be ignored, considering that this Posbakum is located in the Constitutional Court, it is necessary to pay attention to the special mandate from the State Administrators to the Constitutional Court to ensure the success of free legal services for the poor. . Abstract

The land issue is an issue that affects the most basic rights of the people. Because it has a social function other than economic value, so that individual interests on land are sacrificed for common purposes. The purpose of this study is to analyze the payment of compensation for land acquisition in cash and in kind, to identify and analyze the land acquisition process based on Law no. 2 of 2012, as well as explaining the concept and its provisions. To investigate and analyze. This is done by searching for relevant regulations and literature through the search for library materials as a starting material for investigation, using normative legal procedures for problem analysis. Depending on the issue being investigated, the matter will be carried out to analyze the legal regulations in the area of ​​implementing the release of property rights. The results of the examination show that the payment of compensation for the purchase of land can be in the form of cash or non-cash. Change of money, land, resettlement. The land acquisition process that is being developed based on Law no. 2 of 2012 through three stages: The process of planning, compiling and implementing remuneration, concepts and regulations in land acquisition must be carried out in accordance with laws and regulations so that it is fair and does not harm the government or land owners.
