Abstract

The purpose of this study was to analyze legal protection for persons with disabilities in Indonesia and the implementation of the convention on the rights of persons with disabilities in Indonesia. The approach used in this research was a qualitative approach with a descriptive analysis method. The type of research used normative juridical. Data collection techniques used literature study. The results of the study indicated that legal protection for persons with disabilities in Indonesia had been included in the constitution and several laws and regulations. The principles of equality and non-discrimination were contained in several instruments. The existence of special rights granted to persons with disabilities to be able to maintain their identity, characteristics, and traditions. Non-discriminatory treatment was equally important to achieve equal treatment. The implementation of the convention on the rights of persons with disabilities in Indonesia was evidenced by the ratification of Law Number 19 of 2011 concerning Ratification of the Convention on the Rights of Persons with Disabilities. Providing equal opportunities for persons with disabilities in all aspects of state and community administration, respecting, protecting, and fulfilling the rights of persons with disabilities, including the provision of adequate accessibility and accommodation aimed at protecting from neglect, exploitation, harassment, all discriminatory actions, and violations of human rights.

Abstract

The Industrial Revolution 4.0 brings new challenges in the protection of intellectual property rights (IPR) for business activities, such as the increased potential for IPR violations through massive digital dissemination, cross-border infringements, and the need for regulatory adjustments to accommodate the latest technological developments. Efforts to protect IPR in the digital era require more effective law enforcement, strong international cooperation, increased public awareness, and the availability of competent human resources in the field of IPR. The aim of this study is to analyze the legal protection for intellectual property rights holders in business activities during the Industrial Revolution 4.0 and to identify the challenges faced in these legal protection efforts. This research is normative legal research using a statute approach and a conceptual approach to examine primary, secondary, and tertiary legal materials related to the protection of intellectual property rights in business activities during the Industrial Revolution 4.0. Data collection techniques are carried out through literature studies and qualitative data analysis to understand legal concepts, identify problems, and find solutions in the legal protection of intellectual property rights holders. The results of the study show that the legal protection for intellectual property rights (IPR) holders in business activities during the Industrial Revolution 4.0 is regulated by various laws in Indonesia, such as the Copyright Law, Trademark Law, Patent Law, and Trade Secrets Law. Although there is already a legal framework, IPR protection in the digital era faces new challenges such as digital infringement, trade secret theft through illegal access, and online trademark and patent violations. The government has taken steps such as the enactment of the Information and Electronic Transactions Law (ITE Law), the establishment of the Directorate General of Intellectual Property (DJKI), and the signing of international agreements related to IPR. However, comprehensive efforts are needed from the government, businesses, and the public through regulatory improvements, law enforcement, socialization, IPR registration, information system security, monitoring, and international cooperation to effectively protect IPR. The main challenges include rapid technological development, cross-border violations, lack of public understanding, limited competent human resources, and still less effective law enforcement.

Abstract

This study aims to elaborate the policies related to the protection of communal intellectual property related to creative economy businesses in the tourism sector and to strengthen the protection of communal intellectual property by carrying out an inventory of traditional cultural expressions in Bali, especially in Gianyar Regency based on a penta-helix collaboration. This is socio-legal research with statutory, conceptual, economic, and technological approaches. The study indicated that communal intellectual property in the form of traditional cultural expressions has high economic value hence, it can be used to support the tourism creative economy business while still prioritizing the values ??that are believed by the community. Inventory must be carried out in accordance with Article 7 of Permenkumham 13/2007. The inventory has been carried out in Bali, although it has not been maximized. Inventory of traditional cultural expressions shall be carried out sustainably in the form of a penta-helix collaboration.

Abstract

This article aims to analyze legal arrangements related to the protection of non-civil servant radiation workers in the Province of Bali, identify legal protection gaps between civil servant and non-civil servant radiation workers, and provide recommendations to ensure proper and fair protection for all radiation workers. This study uses normative legal methods to analyze regulations on the protection of non-civil servant radiation workers. Qualitative-descriptive analysis is used to identify legal gaps and formulate recommendations based on the principles of justice. The results of the study show that the analysis of legal protection for non-civil servant radiation workers in Bali Province shows a significant gap compared to civil servants, especially in benefits, access to health facilities, and legal support. Despite the regulations, their implementation still faces challenges in monitoring and workers' awareness of their rights. Regulatory revisions, increased oversight, and equality of benefits are needed to ensure equitable protection for all radiation workers. This strategic step will create a safe work environment, respect human rights, and uphold the principle of justice without discrimination.

Abstract

Indonesia has a culture and natural wealth that has the potential to be protected by Communal Intellectual Property (CIP). Indonesian national law has shown seriousness in the legal protection of CIP by issuing various CIP laws and regulations. However, the protection of CIP at the international level has only appeared with the issuance of the WIPO Treaty on Intellectual Property, Genetic Resources and Associated Traditional Knowledge GRATK/DC/7 2024 (WIPO Treaty GRATK/DC/7 2024) 2024. This paper examines the protection of Traditional Knowledge (TK) and Traditional Cultural Expressions (TCE) as CIP in Indonesia and internationally through the WIPO Treaty GRATK/DC/7 2024. The normative legal research method is used with a statutory, conceptual, comparative and analytical approach. The results show that PP 56/2022 and Permenkumham 13/2017 provide sufficient protection for CIP works including TK and TCE, especially in the form of defensive protection (inventory and recording of CIP). WIPO Treaty GRATK/DC/7 2024 emphasizes genetic resources (GR) protection and TK related to GR and not TCE. However, TCE protection internationally is seen in the amendment to the Berne Convention, Article 15.4 through "anonymous works". WIPO Treaty GRATK/DC/7 2024 is an advancement in international recognition of the protection of CIP, especially TK related to GR. Internationally, this document is a legal umbrella to protect Indonesian CIP including TK that is used commercially considering that communities from regions in Indonesia are very rich in TK that they have inherited across generations.

Abstract

Indonesia is the highest country in Southeast Asia using electronic wallets or e-wallets. However, e-wallets as mobile payment services provide risks and problems for their users. The submission of personal data by users and the acceptance of personal data by e-wallet application providers are seen as legally enforceable statements of will. Protection of personal data on e-wallets is very necessary. The purpose of this research is to find out the protection of personal data which is the protection of human rights and the enforcement of the values of justice for consumers. This research is normative juridical research using analytical and conceptual approach, the statute approach and comparative approach. Literature study was conducted on the collection of primary and secondary legal materials, then the analysis was carried out qualitatively. The results of the research show that the regulatory model for the protection of personal data on e-wallets in the future requires arrangements regarding the obligation of consent from personal data subjects in personal data transfer activities both at home and abroad. Technical arrangements regarding the protection of personal data on e-wallets must be outlined in Bank Indonesia Regulations and Financial Services Authority Regulations.

Abstract

This study aims to elaborate on the policies regarding the protection of TCEs related to creative economy businesses in the tourism sector, and the implementation of these policies in Bali. The study uses a socio-legal research method by using statutes, conceptual, economic, and technological approaches. The study indicated that TCEs are transformed across generations in custodian communities that are not sacred can be categorized as open TCEs and can be developed to support tourism creative economy businesses. Meanwhile, the type of TCEs that are sacred can only be used by the community carrying them for sacred purposes, categorized as closed TCEs. The policies at the international, national, and local levels related to open TCEs have regulated access for it to be developed for creative economy businesses including the tourism sector as well as protection of benefit sharing for the community. Meanwhile, the Indonesia Copyright Law and Provisions on Communal Intellectual Property Data have not accommodated benefit sharing. In Bali, policy related to sacred TCE can be observed through the 2019 Joint Decree on the Strengthening and Protection of Balinese Sacred Dances that prohibits Balinese Sacred Dances from being performed outside of sacred purposes. The implementation of an inventory of the protection of TCEs in Bali has been carried out by the Office of the Ministry of Law and Human Rights of Bali Province in collaboration with the Regional Government in Bali including university, although has not been maximized due to the large variety of cultural expressions in the community.

Abstract

Lagu dan musik yang dihasilkan oleh musisi dapat memiliki nilai ekonomi yang mampu menghidupi rumah tangga begitu pula dengan royalti yang dihasilkan dari adanya hak cipta. Pada berlangsungnya perkawinan permasalahan dan konflik kerap terjadi yang berujung pada perceraian. Dalam proses perceraian terdapat hak cipta yang menghasilkan royalti, maka royalti tersebut tidak luput menjadi salah satu tuntutan perceraian baik oleh pihak suami maupun pihak istri. Penelitian ini bertujuan untuk mengelaborasi keberadaan royalti yang diperoleh atas hak cipta dalam harta benda perkawinan kaitannya dengan perceraian serta mengetahui pembagian royalti atas hak cipta sebagai harta bersama dalam perceraian dan memberikan solusi kepastian hukum dalam hal distribusi royalti. Studi ini menggunakan metode penelitian normatif dengan pendekatan perundang-undangan, pendekatan konsep dan pendekatan analisa hukum. Hasil penelitian menunjukkan bahwa royalti dapat menjadi harta bersama. Apabila kemudian terjadi perceraian, maka royalti dapat dibagi secara sama rata antara suami dan istri atau keputusan pengadilan dapat menentukan persentase yang berbeda berdasarkan pertimbangan keadilan Hakim. Seperti pada Putusan Nomor 1622/Pdt.G/2023/PA.JB yang menetapkan membagi dan menyerahkan ½ (setengah) bagian dari 50% (lima puluh persen) dari Pendapatan Bersih kepada mantan pasangannya. Selain itu pembagian royalti dapat berdasarkan kesepakatan antara pasangan suami istri yang telah dimuat ke dalam perjanjian perkawinan. Maka diperlukan peran LMKN untuk menghindari perselisihan mengenai besaran royalti, melalui pelaksanaan Pasal 14 ayat (2) PP 56/2021 sehingga terdapat kejelasan pendistribusian royalti berdasarkan laporan penggunaan data lagu dan/atau musik.

Abstract

Tie-dye is known as a method of dyeing which results in a design on the fabric by which the fabric is collected and tied tightly with fibres, rope, or yarn, then dyed or coloured. The cloth is then processed into clothes, masks, and other accessories which can now be easily found in several online shops. This paper aims to identify, analyze, and elaborate on the legal protection of tie-dye motifs based on Indonesia Law Number 28 the Year 2014 concerning Copyright and the responsibilities of influencers who promote tie-dyed motif products. This is normative legal research with a statutory approach and a conceptual approach. The technique of tracing legal materials uses document study techniques and the analysis of studies uses qualitative analysis. The study shows that the tie-dye motif has been protected under Copyright law both nationally and internationally. Tie-dye motif as a form of continues to be developed with a high economic value has received clear protection under Indonesia Law Number 28 of 2014 concerning Copyright. The clear arrangement of tie-dyes is becoming increasingly important, especially when tie-dyes are used commercially. Regarding the Announcement of a copyrighted work, such as tie-dye products, the element of the uniqueness of form and originality are important points in copyright protection, so it is only natural for an influencer not to allow the sale and/or duplication of goods resulting from infringement of copyright and/or Related Right as regulated in Indonesia Copyright Law.

Abstract

Legal pluralism in the resolution of business disputes in Indonesia, Vietnam, and Thailand illustrates the intricate interplay between the particular and the general elements of the national laws, international laws, and other legal systems, which allow for flexibility in resolving disputes, but at the same time brings problems for legal integration and certainty for the business people. This study examines the role of legal pluralism in the resolution of business disputes in Indonesia, Vietnam, and Thailand. Legal pluralism creates an interaction between national law, international law, and other legal systems, providing flexibility in dispute resolution while also posing challenges to integration and legal certainty for business practitioners. The research approach employed is a legal study focusing on literature regarding legal pluralism and business dispute resolution systems. The analysis method used is normative-qualitative, utilizing legislative, conceptual, and comparative methods. The research findings show that legal pluralism in business dispute resolution in Indonesia, Vietnam, and Thailand offers flexibility but also creates legal uncertainty. In Indonesia, the coexistence of civil, Islamic, and customary law leads to overlapping jurisdictions. Vietnam's state-controlled legal system incorporates arbitration and mediation but struggles with enforcing international awards. Thailand balances civil law with Buddhist-influenced mediation, favoring informal resolution but facing enforcement challenges. While legal pluralism enhances accessibility to justice, its effectiveness depends on legal integration and enforcement mechanisms to ensure certainty and fairness in business disputes.
