Abstract

Introduction: This article is to examine the arrangement of the Inventory of Communal Intellectual Property (ICP) in the perspective of the Culture Advancement or IPR and to locate the ideal future concept regarding the Inventory of Communal Intellectual Property (ICP).Purposes of the Research: The purpose of this research is to analyze the Communal Intellectual Property (ICP) inventory concept in the perspective of IPR or Cultural Advancement.Methods of the Research: This research uses normative legal research with the statutory approach and conceptual approach.Results of the Research: In this research was found that the inventory concept in the Cultural Advancement Law is more sustainable rather than Regulation of the Minister of Law and Human Rights of the Republic of Indonesia Number 13 of 2017, subsequent to the inventory is conducted and it will be continued to the next stage are securing, maintaining, salvaging, and publishing.

Abstract

Introduction: Non-communicable diseases are chronic diseases that are the most common causes of death worldwide, including in Indonesia. The increase in the prevalence of NCDs occurs year after year and becomes a problem for national health and budget. This challenge is why the enactment of Law Number 17 of 2023 on Health was subsequently followed by the implementation of Government Regulation Number 28 of 2024 on the Implementation Regulations of Law Number 17 of 2023 on Health. This research aims to understand the prevention of non-communicable diseases outlined in this regulation. Method: The research design used a descriptive-analytical approach with a normative-juridical approach. Searching for constitutional norms was used to gather legal resources. Since the analysis was about a legal event or state, a descriptive technique was employed to present it. The case method for the research problem was used. Results: Health promotion, early detection, limiting sugar, salt, and fat intake, controlling tobacco products, physical activity, immunization, and health services are all part of the NCD control strategy, according to Article 192 of Government Regulation Number 28 of 2024 concerning the Implementation Regulation of Law No. 17 of 2023 concerning Health. Conclusion: The prevention of NCDs requires holistic and comprehensive actions,, starting with the formation of government regulations. The government is the policy executor authorized by law to implement public policies to achieve the health administration goals in Indonesia.

Abstract

This study aims to compare trademark protection systems adopted in Indonesia and Malaysia on exclusive rights to trademarks, especially in the human rights context, and to analyze regulations in both countries in supporting small business in the tourism sector through trademark registration incentives. The normative legal research method is used in this study by using statutory, conceptual, and comparative approaches with descriptive qualitative analysis. The study reveals that trademarks as intangible property rights and the right to own property can be considered human rights refer to Arts. 27(2) and 17 UDHR. To strengthen trademark protection in human rights and Intellectual Property Rights contexts, Indonesia adopts a first-to-file system where trademark registration is an obligation, because it protects those who file it first, as stipulated in Law No. 20 of 2016. Gianyar as tourism area in Bali-Indonesia has Regent Regulation Number 86 of 2021 that supports small businesses in tourism through trademark registration incentives. Meanwhile, Malaysia adopts a first-to-use trademark protection system stipulated in the Trademark Act 2019.  However, trademark registration is an essential step to ensure business continuity. Both Indonesia and Malaysia governments have at least attempted to play a positive role in supporting the growth of their economies.

Abstract

The disharmony between Laws and the Regulations of Balinese cultural tourism’s regulation and policy is still exist, specifically in terms of tourism management’s purpose and authority. The clarity of the purpose and the scope in the setting of Balinese cultural tourism Laws and Regulations need to be conducted comprehensively and structured, so the substantial dynamic that included and stated in the law will not be partial. According to the analysis of regulation content of laws and regulation for the application of Tri Hita Karana (THK) in Balinese culture tuorism’s operation, there are numerous disharmonisation that happened between Undang-undang Nomor 10 Tahun 2009 about tourism, as the Laws and Regulations that organizes the tourism, and sectoral Laws and Regulations that organizes limited tourism (whether forest, marine, and culture tourism). Although the disharmonisation already harmonized through Undang-undang Cipta Kerja (Laws of Work Creation), the comprehensive and structured clarity of purpose is still achieved yet, so the substantial dynamic that included and stated in the law will not be partial.

Abstract

Emergency situations in midwifery care during pregnancy, labor, and the postnatal period can arise unexpectedly. It is crucial for midwives to be knowledgeable about the legal frameworks governing the protection provided to them in the execution of their professional responsibilities. This scoping review aims to explore the legal protection provided to midwives in emergency situations through a search of relevant literature in bibliography databases and hand-searching, and employed the Participant, Concept, and Context (PCC) principle to formulate the eligibility criteria. Data extraction was conducted using the PRISMA flow diagram. The analysis was conducted using a meta-aggregation approach to map the legal framework for emergency midwifery care from available studies. The review found key themes that emerged from the review included legal protection and scope of practice, midwives' authority in emergency care, importance of competencies and certifications, challenges and power imbalances in midwifery practice, and midwives' dissatisfaction and professional deviation.  This scoping review underscores the importance of legal protection and scope of practice for midwives

Abstract

Household food security is an essential issue for a country and has become a national issue in poor and developing countries worldwide during the COVID-19 pandemic. Various problems could arise if household food-nutrition needs are not met. This study aims to explore factors related to household food security during the COVID-19 pandemic in Indonesia. A systematic literature review that was used twelve articles. Three electronic databases (Google Scholar, ProQuest, and ScienceDirect) were used to find the articles between January 2020 to April 2023. The original articles were selected based on the PRISMA-P flowchart model. The results show the socio-demographic (sex of household’s head, age, education, literacy) and socio-economic (occupation, income, wealth, area of living) factors influencing household food security. Households having a male head of household, good literacy, and an adequate economy have a significant effect on having nutritious food security during COVID-19 pandemic. These findings recommend that the central government of Indonesia provide financial assistance to food-insecure households, improve access to food, and promote healthy food products

Abstract

Professional health workers in community health centers and sub-centers are required to provide nutrition services. However, nowadays not all community health centers and sub-centers have nutritionists, so all health workers need to have strong teamwork to ensure nutrition programs can occur effectively. This study aimed to describe the types of professional health workers and their history of receiving training in nutrition. This study used IFLS (Indonesia Family Life Survey) 2014-15 from the Community Facility Book to address the health worker's experience in nutrition training. The result of this study revealed that medical doctors had more experience in attending the training in nutrition. Even though there was limited training in the last 12 months. This situation might occur due to the limited number of health workers who can join the training or the limited budget to provide training to all health workers. Education about nutrition is essential to all health workers, not only nutritionist because community health center/sub-centers is the closest health services in the community. Preventing the prevalence of stunting and other health-related nutrition problems can be done by educating health workers immediately.

Abstract

Pengaturan pemberdayaan sosial di Indonesia memiliki urgensi bagi penyandang disabilitas untuk mendapatkan hak kesejahteraan sosial. Pentingnya pemberdayaan sosial khususnya dalam perspektif pengembangan potensi keterampilan, akses magang dan ekonomi diatur dalam Peraturan Pemerintah Nomor 52 Tahun 2019 tentang Penyelenggaraan Kesejahteraan Sosial bagi Penyandang Disabilitas. Potensi tersebut berkaitan dengan Undang-undang Nomor 8 Tahun 2016 tentang Penyandang Disabilitas dan menjadi penting mengingat pada pengaturan tersebut menekankan bahwa penyandang disabilitas bukan sebagai objek namun sebagai subjek. Tujuan penelitian ini untuk mengetahui pengaturan pemberdayaan sosial bagi penyandang disabilitas serta untuk mengetahui bentuk-bentuk pengembangan yang dilakukan dalam rangka pemberdayaan sosial bagi penyandang disabilitas. Metode penelitian hukum normatif digunakan, yang melibatkan pemeriksaan undang-undang dan peraturan yang relevan, serta tinjauan pustaka. Hasil studi menunjukkan bahwa Indonesia telah mengakomodir ketentuan peraturan perundang-undangan terkait pemberdayaan sosial terutama pada pengembangan potensi keterampilan, akses magang dan ekonomi dalam bentuk penumbuhan iklim, pelatihan, pendampingan, peningkatan akses pemasaran hasil usaha, sekaligus penguatan kelembagaan dan kemitraan. Selain itu, bidang kesenian seperti kerajinan tangan dan tari-tarian banyak dipamerkan sebagai bentuk pemberdayaan sosial.

Abstract

The rapid development of Indonesia’s digital economy has created new opportunities but also significant challenges, particularly regarding the illegal sale of shared premium accounts on e-commerce platforms. This study examines the legal frameworks governing platform liability for these illegal activities, comparing Indonesia’s regulations with the United States' Digital Millennium Copyright Act (DMCA). Using a doctrinal legal research method, the research focuses on key Indonesian laws such as the Copyright Law (Law No. 28 of 2014) and the Information and Electronic Transactions Law (ITE Law), alongside Section 512 of the DMCA. The study finds that Indonesia's legal framework provides only implicit protections, relying on general principles like good faith and fault-based liability, which leads to legal uncertainty. In contrast, the United States’ DMCA offers clearer protections through its Safe Harbor provisions, including a specific notice-and-takedown procedure. This comparative analysis highlights the vulnerability of Indonesian platforms to lawsuits and the broader economic consequences, such as lost revenue, hindered innovation, and potential reputational damage. Furthermore, it emphasizes the need for clearer, consolidated regulations in Indonesia to effectively protect copyright holders and digital platforms. The study proposes a Sui Generis Safe Harbor Model that combines the procedural clarity of the DMCA with Indonesia’s civil law tradition, including the establishment of clear Red Flag Knowledge standards, a mandatory notice-and-takedown procedure, and data disclosure requirements. The research underscores the importance of regulatory reform, enhanced law enforcement coordination, and technological investment to address illegal premium account sales and secure a fair digital environment.
