Abstract

Cartels as a Form of Unfair Business Competition KPPU often has difficulty proving it through direct evidence in accordance with Law No. 5/1999, so the alternative used by KPPU to obtain evidence is indirect evidence, and in practice this indirect evidence It is also not easy because it has not been regulated in Law No. 5/1999 so that the Supreme Court has not given any information regarding indirect evidence. The research method used by the author is normative research using library research to obtain data, and there is a need for clarity regarding procedural law from the KPPU. And the Authority of the KPPU in order to facilitate the handling of the KPPU on the Cartel Problem in Indonesia and amid the uncertainty of indirect evidence, the leniency of the program can also be used as an alternative in proving the occurrence of cartel actions carried out by business actors, and the application of evidence is not This directly was also adopted by other countries as well as the leniency program, and Indonesia also needs to follow this step to reduce cartels in Indonesia.

Abstract

This study aims to analyze marriage regulations with child protection, namely Law Number 16 of 2019 on Marriage and Law Number 35 of 2014 on Child Protection. These two regulations will be analyzed to protect children who marry underage. The study method used is normative juridical. As a novelty, the study tries to compare marriage arrangements with child protection arrangements. The purpose and perspective of underage marriage between the two regulations are different. The research results show that marriage law has a different spirit than child protection law. This is shown in the marriage law, which states that children are still allowed to marry for urgent reasons by applying for a dispensation to the court. However, child protection law explicitly does not allow this. Therefore, there is a need for more detailed regulation regarding the category of "urgent reasons" regulated in the marriage law.

Abstract

Introduction to The Problem: Marriage is everyone's right. However, the phenomenon that occurs is the practice of underage marriage, this also occurs in the indigenous community of the Orang Laut tribe in Lingga Regency.Purpose/Objective Study: The aim of this research is to analyze the regulation of national law and customary law in dealing with underage marriage in the Orang Laut tribal community and to find a concept of legal harmonization that can resolve the practice of underage marriage.Design/Methodology/Approach: The research method used is empirical juridical. The type of data sourced from primary data is through observation and interviews as well as primary data. The basic theories used are the Theory of Legal Work and the Theory of Development Law.Findings: The results of the research state that there is a regulatory inconsistency between marriage law and child protection law. The marriage law allows for underage marriages by applying for dispensation, while Article 26 of the child protection law strictly stipulates that parents are obliged to prevent child marriages from occurring. And there is a culture of "reciprocation" which is the basis for the Sea People tribe to perpetuate the practice of underage marriage. In fact, marriages are only carried out through traditional ceremonies and according to their respective religions without applying for dispensation to the court. This means that the marriage carried out is only valid according to custom and religion and is not legally valid. Therefore, it is necessary to harmonize the law with an institutional approach in overcoming the phenomenon of underage marriage in the indigenous people of the Orang Laut tribe, Lingga Regency.Paper Type: Research Article

Abstract

This study highlights the importance of restricting residential land ownership and control in Indonesia because land is a capital asset. This study examines the social and economic impacts of this phenomenon, focusing on the Basic Agrarian Law, and provides policy recommendations to address the conflicts and inequalities that arise. This study uses a normative legal method. The results of the study show that the authorities of the Republic of Indonesia have attempted to restrict ownership and management of land rights for residential purposes, but these efforts have not been fully effective and clearly regulated in one law. The solution to restrict this is to create legal regulations that consider legal provisions and consider philosophical, legal, and sociological bases. The limitations of this study's findings lie in the lack of elaboration of the actual implementation of efforts to restrict residential land ownership and control in Indonesia, as well as the lack of analysis of the specific obstacles faced by the authorities in implementing them. In addition, recommendations for creating new legal regulations are still general in nature and do not include concrete mechanisms or steps to integrate philosophical, legal, and sociological aspects into regulations. However, the originality of this study lies in emphasizing the importance of a holistic approach in formulating policies, which considers not only the formal legal dimension, but also social values and the philosophy of justice in dealing with land as an investment commodity. This finding provides a significant contribution to the discourse on policy reform related to land ownership, especially in the context of facing pressure from the investment market.

Abstract

This study aims to analyze the effectiveness of fulfilling children's rights in the judicial system of sexual violence crimes in Batam City, as well as to identify the challenges and realities faced during its implementation. The research method used is an empirical juridical approach, with data collected through in-depth interviews with law enforcement officials, including investigators and police in Batam City. The findings reveal that although comprehensive regulations exist, their implementation remains suboptimal due to limited human resources, insufficient child-friendly facilities, and ineffective inter-agency coordination. These barriers hinder the protection and recovery of child victims of sexual violence. The study also highlights the importance of applying the principles of Best Interests of the Child and the Restorative Justice approach to create a more child-friendly judicial system. Therefore, improvements in law enforcement training, strengthening inter-agency coordination, and developing facilities to support the recovery of child victims of sexual violence are urgently needed.

Abstract

Assault crimes are violent by nature and are often perceived as a serious threat to public safety. However, the complexity of each crime needs to be analyzed thoroughly in a legal procedure to make sure that important values and principles are applied. This is particularly important among juvenile offenders, where the enforcement of justice needs to be upheld without sacrificing the future of youth. This research is done to analyze the challenges in ensuring procedural rights for juvenile assault offenders in Indonesia. Through the normative legal research method combined with a statutory approach, this research uncovers the legal challenges that juveniles face in accessing their procedural rights in Indonesia’s juvenile justice system and how these challenges can be improved. Analysis of this research finds that the Indonesian legal framework is still lacking in many ways, particularly in ensuring the right to ease of access to information regarding the case and the protection of privacy. The analysisThe analysis also shows that these issues cause conflicts with other laws, constitutional principles, and international standards. This research not only highlights the gaps in Indonesia’s juvenile justice system but also lays a theoretical foundation for developing a more holistic and rights-based approach to juvenile justice reform.

Abstract

Research on the effectiveness of the implementation of Bengkalis Regency Regional Regulation Number 3 of 2022 concerning the provision of wages for local workers is conducted to ensure that the payment of wages to local workers in Bengkalis Regency complies with the applicable laws and regulations, while also promoting the welfare of its workforce. The provision of fair and timely wages, along with supporting welfare facilities, remains an issue that has not yet been fully realized in Bengkalis Regency. Various factors influence the effectiveness of this regulation in ensuring the proper payment of wages to local workers. Therefore, this study examines five factors influencing legal effectiveness as proposed by Soerjono Soekanto and reviews the implementation of wage distribution for local workers in Bengkalis Regency by employers. In addition to employers, the regional government  through collaboration between the Regent and other local institutions, such as the Department of Manpower and Transmigration of Bengkalis Regency and the Technical Implementation Unit of Manpower, can play a a role in taking preventive and repressive measures to achieve the effectiveness of Bengkalis Regency Regional Regulation Number 3 of 2022 (Perda Kab. Bengkalis No. 3/2022. This study further identifies the causes of non-compliance in wage provision for local workers and proposes solutions to ensure the objectives of the regulation can be met. Accordingly, the solutions offered by this research aim to provide stronger protection for local workers in Bengkalis Regency and to advance the welfare of the local community. [Penelitian mengenai efektivitas penerapan Peraturan Daerah Kabupaten Bengkalis Nomor 3 Tahun 2022 terhadap pemberian upah tenaga kerja lokal dilakukan agar pembayaran upah tenaga kerja lokal di Kabupaten Bengkalis dapat sesuai dengan peraturan perundnag-undangan yang berlaku dan memberikan kesejahteraan bagi tenaga kerjanya. Pemberian upah tenaga kerja yang sesuai dan tepat waktu serta fasilitas penyokong kesejahteraan lainnya menjadi hal yang masih belum dilakukan di Kabupaten Bengkalis. Banyak faktor yang mempengaruhi efektivitas pelaksanaan Perda ini dalam pemberian upah tenaga kerja lokal yang sesuai, sehingga penelitian ini akan mengkaji 5 faktor yang mempengaruhi efektivitas hukum milik Soerjono Soekanto dan meninjau pelaksanaan pemberian upah tenaga kerja lokal di Kabupaten Bengkalis oleh pengusaha. Bukan hanya pengusaha, pemerintah daerah melalui kerja sama Bupati dan perangkat-perangkat daerah lainnya, seperti Dinas Ketenagakerjaan dan Transmigrasi Kabupaten Bengkalis dan Unit Pelaksana Teknis Ketenagakerjaan dapat berperan dalam mengambil langkah preventif dan represif agar efektivitas pelaksanaan Perda Kab Bengkalis No. 3 Tahun 2022 dapat tercapai. Dalam penelitian ini, penyebab dari pemberian upah tenaga kerja lokal masih banyak yang tidak sesuai akan diberikan solusi agar harapan dari Perda ini dapat tercapai. Maka, solusi-solusi yang diberikan dari penelitian ini akan melindungi tenaga kerja lokal di Kabupaten Bengkalis lebih baik dan mencapai kesejahteraan masyarakat di Kabupaten Bengkalis.]

Abstract

The digital transformation of land administration in Indonesia, under the framework of Government Regulation Number 18 of 2021, marks a crucial step toward modernizing public services. However, a fundamental problem of legal certainty for land rights arises from its delegative model of authority, under which essential technical regulations are issued through the Regulation of Minister of ATR/KBPN Number 3 of 2023. This reliance on a ministerial-level regulation creates potential long-term juridical and operational vulnerabilities. This research aims to critically analyze the weaknesses of this delegative model and project strategic solutions, employing a normative legal research method with a functional comparative approach. The Province of Ontario, Canada, a global pioneer, was selected as the comparative jurisdiction. The analysis reveals that Indonesia’s delegative model is exacerbated by practical challenges, including technological infrastructure gaps, a deficit in public trust, and uneven digital literacy. Conversely, Ontario’s integrative legislative model—supported by a comprehensive ecosystem of regulations at the Act of Parliament level, a mature public-private partnership, and strict access governance—has been functionally proven to achieve superior levels of legal certainty and efficiency. It is concluded that to achieve complete legal certainty, Indonesia must elevate and consolidate its legal framework into a comprehensive Bill on Electronic Land Registration, which would serve as a solid foundation for building a holistic digital ecosystem of trust.

Abstract

The Anti-Money Laundering (AML) program is designed to detect and prevent the flow of illicit funds, particularly those linked to terrorism financing. However, law enforcement efforts face significant challenges, including inadequate coordination in tracking digital transactions, technical limitations, and the complexity of proving criminal acts. These issues are especially pronounced in the Riau Islands Province, Indonesia, which has the highest potential for money laundering due to its strategic border location. Batam City, a key economic hub, ranks second after Jakarta regarding suspicious financial transactions. This study examines the effectiveness of the AML program in addressing money laundering in Batam City. Using an empirical approach, the research analyzes the coordination and implementation of AML initiatives at regional and provincial levels. Findings reveal critical gaps in enforcement strategies and highlight the need for improved interagency collaboration, advanced technical capabilities, and streamlined legal processes to combat money laundering effectively. The study concludes by proposing actionable solutions to reduce the prevalence of suspicious financial activities in Batam City. Key recommendations include strengthening regulatory frameworks, enhancing digital transaction monitoring, and fostering regional cooperation. Abstract

Legal disruption has been reported to significantly change judicial practice. Therefore, this study aims to explore 2 problem topics, namely 1) how the era of legal and technological disruption affects the profession of judges in carrying out their duties as case deciders, and 2) how is the adaptability of judges in Indonesia in facing the era of legal disruption to ensure their role and function remain relevant. The study procedures were carried out using the normative-empirical legal method, where secondary data were obtained using literature studies. Subsequently, data were enriched with empirical data obtained through field studies. The results showed Artificial Intelligence (AI) and Big Data could be integrated into the judicial system as a transformative solution due to the limited number of judges in Indonesia. The integration was expected to improve the efficiency, consistency, and unity of law enforcement. The profession of judges was required to carry out a transformation that was not only technical but also philosophical. In addition, the Supreme Court Technical Education and Training Center was expected to create an ecosystem where technology could be used as an instrument to improve the quality of Indonesian judges decisions. This could be achieved through hybrid curriculum strategies, inclusive infrastructure, and adaptive regulations.
