Abstract

Penelitian ini bertujuan untuk mengevaluasi sejauh mana program diversi berbasis keadilan restoratif di tingkat kejaksaan di Kota Batam mampu memenuhi tujuan utama yang diharapkan, yaitu pemulihan korban dan rehabilitasi anak. Melalui pendekatan kualitatif deskriptif yang berlandaskan asas hukum empiris, data penelitian diperoleh dari observasi, wawancara, dan studi literatur di Kejaksaan Negeri Batam. Kajian ini juga mengidentifikasi berbagai kendala dalam pelaksanaan prosedur diversi serta penerapan peraturan perundang-undangan terkait. Diharapkan, hasil penelitian ini dapat memberikan kontribusi nyata bagi penyempurnaan kebijakan hukum, sehingga efektivitas program diversi dalam sistem peradilan anak dapat lebih dioptimalkan.

Abstract

The right to get a decent place to live is the right of every person, including the sea people. Therefore, the local government builds houses and moves the sea people from living on boats and nomads to houses. The problem is that living in a house has changed their culture, which usually lives a nomadic life at sea. The purpose of this study is first to analyze the accuracy of the local government’s steps. Second, to analyze the right legal solution in providing decent housing for the sea people. The method in this study is empirical juridical. The type of data used is primary data, namely observations and interviews, and secondary data, namely laws and regulations. In addressing the formulation of the problem in this study, the legal and theoretical basis is the Progressive Legal Theory. The results of the study indicate that the steps taken by the local government in providing physical housing and legalizing the houses are good, but not right, because they have changed the culture of the sea people. A house is a manifestation of a group’s culture, so moving the sea people into houses not only changes their culture but also their lifestyle and work patterns. Therefore, the legal solution is to establish a halfway house with an empowerment program for the sea people, which can be regulated under the Lingga, Indonesia regional regulation. Then it is also necessary to form a law that specifically regulates indigenous peoples to accommodate the traditional rights of indigenous peoples.

Abstract

Pemenuhan hak bekerja bagi warga negara merupakan aspek penting dalam upaya mengentaskan kemiskinan. Penelitian ini membandingkan kebijakan serta pelaksanaan pemenuhan hak bekerja di Indonesia dan Malaysia untuk melihat seberapa efektif strategi yang digunakan dalam menurunkan angka kemiskinan. Metode yang digunakan adalah pendekatan kualitatif melalui studi perbandingan kebijakan ketenagakerjaan, regulasi, dan program sosial yang diterapkan di kedua negara. Hasil penelitian menunjukkan bahwa Malaysia memiliki sistem ketenagakerjaan yang lebih tertata, termasuk perlindungan sosial bagi pekerja, program pelatihan keterampilan, dan investasi sektor industri yang lebih terarah. Di sisi lain, Indonesia masih menghadapi tantangan berupa regulasi ketenagakerjaan yang rumit, tingginya tingkat pekerjaan informal, serta keterbatasan akses terhadap pelatihan kerja. Berdasarkan temuan tersebut, penelitian ini merekomendasikan perlunya peningkatan sinergi antara pemerintah, sektor swasta, dan lembaga pelatihan untuk memperkuat sistem ketenagakerjaan di Indonesia, sehingga akses terhadap pekerjaan yang layak dan berkelanjutan dapat ditingkatkan sebagai langkah strategis dalam mengentaskan kemiskinan.

Abstract

This research explores the role of Open Finance in strengthening Indonesia’s digital democracy, with a focus on transparency, digital consumer rights, and data oversight. While Open Finance has the potential to increase financial inclusion through the integration of alternative data for marginalized groups, such as MSMEs and rural communities, the practice of massive data sharing risks threatening democratic principles, such as data being vulnerable to mass surveillance, algorithmic discrimination, and weak regulatory accountability. A comparative analysis of the UK (CMA Order) and Australian (Consumer Data Rights) regulatory models highlight the importance of algorithmic transparency, granular consumer control over data, and public participation mechanisms in policymaking. In Indonesia, the suboptimal implementation of the Personal Data Protection Law (PDP Law), the digital literacy gap, and disparities in technological infrastructure are key challenges.

Abstract

This study examines the human rights protection in Indonesia’s business sector amid the rapid expansion of contemporary economic activities. Using a normative juridical method supported by statutory, conceptual, and theoretical approaches, the research analyzes the legal dynamics of human rights issues in corporate practices and the dilemmas that arise in their regulation. The findings show that the discourse on business and human rights has gained increasing prominence at global and national levels, encouraging Indonesia to adopt Presidential Regulation Number 60 of 2023 concerning the National Strategy on Business and Human Rights. Although this regulation provides a policy framework for promoting responsible business conduct, it still presents substantive limitations, particularly the absence of a designated independent institution to monitor corporate compliance. This institutional gap reduces the effectiveness of implementation and weakens the state’s capacity to ensure adequate human rights protection in the business environment. Therefore, this study recommends revising Presidential Regulation Number 60 of 2023 and appointing the National Human Rights Commission (Komnas HAM) as the independent supervisory body, in accordance with the mandate of Article 1 of Law Number 39 of 1999. Strengthening regulatory clarity and institutional oversight is essential to improving human rights protection in Indonesia’s business sector.

Abstract

This study examines human rights protection in business practices in Indonesia, emphasizing the role of corporations in respecting, protecting, and redressing the rights of workers and communities. Although Indonesia has ratified international instruments such as the ICESCR and enacted sectoral laws such as Law No. 13 of 2003 concerning Manpower, Law No. 32 of 2009 concerning Environmental Protection, and the Job Creation Law, human rights violations remain rampant, including substandard wages, suppression of labor unions, violations of indigenous peoples' rights, and limited access to redress mechanisms. Using a normative-empirical approach, this study analyzes national laws and international standards through descriptive analysis. The findings indicate that wage and worker welfare policies serve as important indicators of respect for human rights, while corporate practices often prioritize economic efficiency over ethical obligations. This study underscores the urgent need to integrate the UN Guiding Principles on Business and Human Rights into Indonesia's legal framework.

Abstract

Introduction: Road users' legal awareness of the road itself is a key factor driving the urgency of creating safety and order on the roads. In Batam City, the Riau Islands Regional Police's (Polda Kepulauan riau) implementation of Electronic Traffic Law Enforcement (ETLE) is a means of enforcing traffic laws to increase public awareness and compliance with traffic laws through an electronic ticketing system based on Closed-Circuit Television (CCTV).Purposes of the Research: This research analyzes the implementation of ETLE in Batam City and its effectiveness in terms of increasing legal awareness of drivers, especially in Batam City, as well as various obstacles faced in the implementation of ETLE itself, both problems from the community and problems with law enforcement officers who organize ETLE.Methods of the Research: This research is an empirical legal study. The approaches used in this study are the statute approach and the sociological approach. The statute approach is used to examine the legal basis for implementing ETLE. Meanwhile, the sociological approach is used to understand how the law is applied in practice by the police. The data collection method for this research is through interviews with law enforcement officers, field observations, and analysis of secondary data from related sources.Results Main Findings of the Research: The final results of this research found that the implementation of ETLE implemented by the Riau Islands Regional Police (Polda Kepulauan Riau) in Batam City continues to face significant challenges and has not yet operated effectively. Although ETLE has recorded more than 1.526.013 traffic violations since its implementation, the extremely low rate of ticket resolution only approximately 13.232 offenders fulfilling their legal obligations. One of the main obstacles is inaccurate vehicle ownership data, particularly in cases where vehicles have changed ownership but the name transfer process has not been completed, resulting in violation confirmation letters failing to reach the actual offenders. Furthermore, the very limited number of static ETLE cameras restricts the scope of surveillance and causes many traffic violations to go unrecorded by the system.

Abstract

After the enactment of Act Number 11 of 2020 concerning Job Creation, we consider that a more comprehensive study is needed for businessman and academic to sharpen understanding related to the latest labor law regulations. So, we took the initiative to compile this article manuscript in the hope of contributing thought related to the substance to be discussed, namely changes in labour law in the Job Creation Law. The Discussion tha will be discussed in this article is the forms of changes in labor law and the substance of the changes contained in the Job Creation Law. This article aims to provide a comprehensive understanding related to the labor law after revision of Act Number 13 of 2003 concerning Employment in the Acr number 11 of 2020 concerning Job Creation. By using this type of normative research, it is hope that this research can provide a comparison of previous labour law (before revision) with the post revision. The result of the research in this article describes the various forms of changes in labor law in the form of table descriptions to facilitate understanding regarding the substance of these changes.

Abstract

This study aims to analyze the effectiveness of e-purchasing implementation in the government sector from the perspectives of transparency and fairness. The method used in this study is empirical approach with data collected through interviews, observation, documentation, and literature review. Data were analyzed qualitatively using a descriptive-analytical method based on Soerjono Soekanto’s theory of legal effectiveness. The research was conducted in Indonesian government agencies, involving Commitment-Making Officials (PPK) and Budget-Using Officials (KPA) as informants. The novelty of this research lies in the gap between the ideal (das sollen) and reality (das sein) in the implementation of e-purchasing, where, normatively, this system is designed to ensure transparency and accountability; however, in practice, deviations as well as structural and cultural barriers within the procurement bureaucracy are still observed. The results of the study show that although regulations governing the procurement of goods and services are sufficiently robust, the implementation of e-purchasing still faces various challenges, such as technical system barriers, resistance from procurement officials, infrastructure limitations, and a bureaucratic culture that does not yet fully support the principle of transparency. Additionally, indications of fictitious procurement practices were found, suggesting weak oversight and enforcement of the law. Conclusion of this study is that the effectiveness of e-purchasing implementation has not yet been fully achieved. Therefore, it is necessary to strengthen technical regulations, improve human resource capacity and infrastructure, foster a bureaucratic culture that is transparent and accountable, and implement stricter and more systematic oversight to ensure that e-purchasing truly becomes an instrument of procurement modernization oriented toward the public interest.

Abstract

Child trafficking has continued to happen in Southeast Asia despite the ratification of ACTIP for ASEAN members like Indonesia, Malaysia, and Vietnam. This prompts the need for an assessment of ACTIP enforceability, which is a research gap that has remained underexplored. The ACTIP benchmarking and the focus on Indonesia, Malaysia, and Vietnam serve as the core novelty of this study, with the objective of assessing ACTIP standards and their enforceability in the said ASEAN member states. Findings show that Indonesia has normative disharmony and lacks a clear basis for victim-identification mechanisms. Malaysia demonstrates stronger alignment but retains serious loopholes around marriage, adoption, parental consent, and limited immunity. Vietnam provides stronger victim-support mechanisms but suffers from conflicting age thresholds and problematic non-punishment protection. In response, this study devises practical recommendations for each jurisdiction, with Indonesia recommended to focus on harmonizing its trafficking and child-protection frameworks, Malaysia to remove said loopholes while expanding non-punishment protection, and Vietnam to prioritize aligning its Penal Code with ACTIP’s under-18 standard. This study contribute to the literature on ASEAN anti-trafficking law by showing that ACTIP compliance must be assessed not only through ratification, but also through the domestic legal mechanisms required to make its standards enforceable
