Abstract

The Anti-Money Laundering (AML) program is designed to detect and prevent the flow of illicit funds, particularly those linked to terrorism financing. However, law enforcement efforts face significant challenges, including inadequate coordination in tracking digital transactions, technical limitations, and the complexity of proving criminal acts. These issues are especially pronounced in the Riau Islands Province, Indonesia, which has the highest potential for money laundering due to its strategic border location. Batam City, a key economic hub, ranks second after Jakarta regarding suspicious financial transactions. This study examines the effectiveness of the AML program in addressing money laundering in Batam City. Using an empirical approach, the research analyzes the coordination and implementation of AML initiatives at regional and provincial levels. Findings reveal critical gaps in enforcement strategies and highlight the need for improved interagency collaboration, advanced technical capabilities, and streamlined legal processes to combat money laundering effectively. The study concludes by proposing actionable solutions to reduce the prevalence of suspicious financial activities in Batam City. Key recommendations include strengthening regulatory frameworks, enhancing digital transaction monitoring, and fostering regional cooperation. This research contributes to the broader effort of fortifying Indonesia’s financial security and integrity

Abstract

Legal disruption has been reported to significantly change judicial practice. Therefore, this study aims to explore 2 problem topics, namely 1) how the era of legal and technological disruption affects the profession of judges in carrying out their duties as case deciders, and 2) how is the adaptability of judges in Indonesia in facing the era of legal disruption to ensure their role and function remain relevant. The study procedures were carried out using the normative-empirical legal method, where secondary data were obtained using literature studies. Subsequently, data were enriched with empirical data obtained through field studies. The results showed Artificial Intelligence (AI) and Big Data could be integrated into the judicial system as a transformative solution due to the limited number of judges in Indonesia. The integration was expected to improve the efficiency, consistency, and unity of law enforcement. The profession of judges was required to carry out a transformation that was not only technical but also philosophical. In addition, the Supreme Court Technical Education and Training Center was expected to create an ecosystem where technology could be used as an instrument to improve the quality of Indonesian judges decisions. This could be achieved through hybrid curriculum strategies, inclusive infrastructure, and adaptive regulations.

Abstract

Penelitian ini bertujuan untuk mengevaluasi sejauh mana program diversi berbasis keadilan restoratif di tingkat kejaksaan di Kota Batam mampu memenuhi tujuan utama yang diharapkan, yaitu pemulihan korban dan rehabilitasi anak. Melalui pendekatan kualitatif deskriptif yang berlandaskan asas hukum empiris, data penelitian diperoleh dari observasi, wawancara, dan studi literatur di Kejaksaan Negeri Batam. Kajian ini juga mengidentifikasi berbagai kendala dalam pelaksanaan prosedur diversi serta penerapan peraturan perundang-undangan terkait. Diharapkan, hasil penelitian ini dapat memberikan kontribusi nyata bagi penyempurnaan kebijakan hukum, sehingga efektivitas program diversi dalam sistem peradilan anak dapat lebih dioptimalkan.

Abstract

This study examines human rights protection in business practices in Indonesia, emphasizing the role of corporations in respecting, protecting, and redressing the rights of workers and communities. Although Indonesia has ratified international instruments such as the ICESCR and enacted sectoral laws such as Law No. 13 of 2003 concerning Manpower, Law No. 32 of 2009 concerning Environmental Protection, and the Job Creation Law, human rights violations remain rampant, including substandard wages, suppression of labor unions, violations of indigenous peoples' rights, and limited access to redress mechanisms. Using a normative-empirical approach, this study analyzes national laws and international standards through descriptive analysis. The findings indicate that wage and worker welfare policies serve as important indicators of respect for human rights, while corporate practices often prioritize economic efficiency over ethical obligations. This study underscores the urgent need to integrate the UN Guiding Principles on Business and Human Rights into Indonesia's legal framework.

Abstract

The right to get a decent place to live is the right of every person, including the sea people. Therefore, the local government builds houses and moves the sea people from living on boats and nomads to houses. The problem is that living in a house has changed their culture, which usually lives a nomadic life at sea. The purpose of this study is first to analyze the accuracy of the local government’s steps. Second, to analyze the right legal solution in providing decent housing for the sea people. The method in this study is empirical juridical. The type of data used is primary data, namely observations and interviews, and secondary data, namely laws and regulations. In addressing the formulation of the problem in this study, the legal and theoretical basis is the Progressive Legal Theory. The results of the study indicate that the steps taken by the local government in providing physical housing and legalizing the houses are good, but not right, because they have changed the culture of the sea people. A house is a manifestation of a group’s culture, so moving the sea people into houses not only changes their culture but also their lifestyle and work patterns. Therefore, the legal solution is to establish a halfway house with an empowerment program for the sea people, which can be regulated under the Lingga, Indonesia regional regulation. Then it is also necessary to form a law that specifically regulates indigenous peoples to accommodate the traditional rights of indigenous peoples.

Abstract

Pemenuhan hak bekerja bagi warga negara merupakan aspek penting dalam upaya mengentaskan kemiskinan. Penelitian ini membandingkan kebijakan serta pelaksanaan pemenuhan hak bekerja di Indonesia dan Malaysia untuk melihat seberapa efektif strategi yang digunakan dalam menurunkan angka kemiskinan. Metode yang digunakan adalah pendekatan kualitatif melalui studi perbandingan kebijakan ketenagakerjaan, regulasi, dan program sosial yang diterapkan di kedua negara. Hasil penelitian menunjukkan bahwa Malaysia memiliki sistem ketenagakerjaan yang lebih tertata, termasuk perlindungan sosial bagi pekerja, program pelatihan keterampilan, dan investasi sektor industri yang lebih terarah. Di sisi lain, Indonesia masih menghadapi tantangan berupa regulasi ketenagakerjaan yang rumit, tingginya tingkat pekerjaan informal, serta keterbatasan akses terhadap pelatihan kerja. Berdasarkan temuan tersebut, penelitian ini merekomendasikan perlunya peningkatan sinergi antara pemerintah, sektor swasta, dan lembaga pelatihan untuk memperkuat sistem ketenagakerjaan di Indonesia, sehingga akses terhadap pekerjaan yang layak dan berkelanjutan dapat ditingkatkan sebagai langkah strategis dalam mengentaskan kemiskinan.

Abstract

This research explores the role of Open Finance in strengthening Indonesia’s digital democracy, with a focus on transparency, digital consumer rights, and data oversight. While Open Finance has the potential to increase financial inclusion through the integration of alternative data for marginalized groups, such as MSMEs and rural communities, the practice of massive data sharing risks threatening democratic principles, such as data being vulnerable to mass surveillance, algorithmic discrimination, and weak regulatory accountability. A comparative analysis of the UK (CMA Order) and Australian (Consumer Data Rights) regulatory models highlight the importance of algorithmic transparency, granular consumer control over data, and public participation mechanisms in policymaking. In Indonesia, the suboptimal implementation of the Personal Data Protection Law (PDP Law), the digital literacy gap, and disparities in technological infrastructure are key challenges.
